		<official-title>To amend title 10, United States Code, to eliminate the
		  different treatment under the Survivor Benefit Plan accorded members of the
		  reserve components who die from an injury or illness incurred or aggravated in
		  the line of duty during inactive-duty training compared to members of the Armed
		  Forces who die in the line of duty while on active duty.</official-title>

		<section id="HE9FDB87F7A054DDB82A6CCB5244867F2" section-type="section-one"><enum>1.</enum><header>Equal benefits under Survivor
			 Benefit Plan for reserve component members who die in the line of duty during
			 inactive-duty training</header>
			<subsection id="H869C69734A5D4037B95076D6B3C8F284"><enum>(a)</enum><header>Treatment of
			 inactive-Duty training in same manner as active duty</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/10/1451">Section 1451(c)(1)(A)</external-xref> of title 10, United
			 States Code, is amended—</text>
				<paragraph id="H0E6B8543D3F14800B482BC6D42DFC320"><enum>(1)</enum><text display-inline="yes-display-inline">in clause (i)—</text>
					<subparagraph id="H3C57F97412CA49BCA6B86084F11520EA"><enum>(A)</enum><text>by inserting
			 <quote>or 1448(f)</quote> after <quote>section 1448(d)</quote>; and</text>
					</subparagraph><subparagraph id="H88B37F00C7D545C7BD072E7986F22CFA"><enum>(B)</enum><text>by inserting
			 <quote>or (iii)</quote> after <quote>clause (ii)</quote>; and</text>
					</subparagraph></paragraph><paragraph id="HAA12EF5E145D44CC8AC485354FF60FB9"><enum>(2)</enum><text display-inline="yes-display-inline">in clause (iii), by striking <quote>section
			 1448(f) of this title</quote> and inserting <quote>section 1448(f)(1)(A) of
			 this title by reason of the death of a member or former member not in line of
			 duty</quote>.</text>
				</paragraph></subsection><subsection id="HAB2D2F5CEA084317B9F71FD142FA00E2"><enum>(b)</enum><header>Consistent
			 treatment of dependent children and deemed elections</header><text>Section
			 1448(f) of such title is amended—</text>
				<paragraph id="H3C7E427F78A04E95958D55A1AC6700F1"><enum>(1)</enum><text>by striking
			 paragraph (2) and inserting the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H2CFC406E6D2E44E7829D06B37C6B957D" style="OLC">
						<paragraph id="H78AD1DF421294B58B74199A86E2AA363"><enum>(2)</enum><header>Dependent
				children</header>
							<subparagraph id="HB5E467A110554BE1A743A37068F92F1E"><enum>(A)</enum><header>Annuity when no
				eligible surviving spouse</header><text display-inline="yes-display-inline">In
				the case of a member described in paragraph (1), the Secretary concerned shall
				pay an annuity under this subchapter to the member’s dependent children under
				section 1450(a)(2) of this title as applicable.</text>
							</subparagraph><subparagraph id="HF38A0D63A487410ABE1CCA5034C0D589"><enum>(B)</enum><header>Optional annuity
				when there is an eligible surviving spouse</header><text>The Secretary may pay
				an annuity under this subchapter to the member’s dependent children under
				section 1450(a)(3) of this title, if applicable, instead of paying an annuity
				to the surviving spouse under paragraph (1), if the Secretary concerned, in
				consultation with the surviving spouse, determines it appropriate to provide an
				annuity for the dependent children under this paragraph instead of an annuity
				for the surviving spouse under paragraph
				(1).</text>
							</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H22D48D62921048ACB4A9FF4700FDB141"><enum>(2)</enum><text>by adding at the
			 end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="HD82C6B21C4244C03AD3EEBF18E14E238" style="OLC">
						<paragraph id="H5CE22D33EBE2429CB8D77B0C82818DA3"><enum>(5)</enum><header>Deemed election
				to provide an annuity for dependent</header><text display-inline="yes-display-inline">Paragraph (6) of subsection (d) shall apply
				in the case of a member described in paragraph (1) who dies after November 23,
				2003, when no other annuity is payable on behalf of the member under this
				subchapter.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H95A45052B71F4E7390E115A4A5C713D3"><enum>(c)</enum><header>Availability of
			 special survivor indemnity allowance</header><text>Section 1450(m)(1)(B) of
			 such title is amended by inserting <quote>or (f)</quote> after
			 <quote>subsection (d)</quote>.</text>
			</subsection><subsection id="H571CD69F86CB41D896CD9F233FE4772C"><enum>(d)</enum><header>Effective date;
			 application of amendments</header>
				<paragraph id="H8D93ACFB48E34114BFA7BAA989394A7A"><enum>(1)</enum><header>Retroactive
			 application</header><text display-inline="yes-display-inline">Except as
			 provided in the amendment made by subsection (b)(2), the amendments made by
			 this section shall take effect as of September 10, 2001, and shall apply with
			 respect to deaths of members of the Armed Forces occurring after that
			 date.</text>
				</paragraph><paragraph id="HD2A1BB1D86794FC4A31902B4BFAC4BD4"><enum>(2)</enum><header>Payment
			 adjustment and lump-sum payments</header><text>The Secretary of Defense
			 shall—</text>
					<subparagraph id="HDD3B24AEE3B44E9BA68C5A490D9D4A8A"><enum>(A)</enum><text>require payments
			 under the Survivor Benefit Plan for months beginning after the date of the
			 enactment of this section to be adjusted to reflect the amendments made by this
			 section; and</text>
					</subparagraph><subparagraph id="HE396C77F1F15472BAD1FFE80943F53E9"><enum>(B)</enum><text display-inline="yes-display-inline">provide a lump-sum payment to cover the
			 period between the death of the member concerned (or October 1, 2008, if later
			 than that date in the case of the special survivor indemnity allowance) and the
			 date the adjustment takes effect under subparagraph (A).</text>
					</subparagraph></paragraph></subsection></section></legis-body>
