<legis-type>A BILL</legis-type> 
<official-title>To amend the Diplomatic Security Act to require certain notifications to Congress of Accountability Review Boards of the Department of State, avoid conflicts of interest of the members of such Boards, require actions with respect to reports from such Boards, and for other purposes.</official-title>

<section id="H42103B56F2F24FE0832F31CC1C3D8DD6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Accountability Review Board Reform Act of 2013</short-title></quote>.</text></section> 
<section id="HEC2A97C9EEF8486AAB0072A7F0432C96"><enum>2.</enum><header>Findings; Sense of Congress</header> 
<subsection id="HE6BEBBF78E6B4366B600BBA6154B3C52"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text> 
<paragraph id="H032D6EC3827845CFB240991AB8A4796B"><enum>(1)</enum><text>The United States has a crucial stake in supporting the presence abroad of United States Government personnel representing United States interests.</text></paragraph> 
<paragraph id="HC332681ABEDD4F4AAD4D0A2266F01648"><enum>(2)</enum><text>United States Government personnel and missions abroad are confronted by serious security risks, including the threat of terrorism, which will continue for the foreseeable future.</text></paragraph> 
<paragraph id="HE8994590D658420CBD06A8393F29B29B"><enum>(3)</enum><text>The Accountability Review Board process was established in 1986 by Congress to conduct a thorough assessment of security-related incidents at or related to a United States Government mission abroad.</text></paragraph> 
<paragraph id="H8C1AAED7E03647ABA161709D2CE15F47"><enum>(4)</enum><text>Each assessment by a Board is expected to promote strengthened security measures, and to provide for the accountability of United States Government personnel with security-related responsibilities.</text></paragraph> 
<paragraph id="H8A877443726043F98E6776F5927873DD"><enum>(5)</enum><text>The terrorist attack in Benghazi, Libya, on September 11, 2012, that took the lives of four United States Government personnel has brought unprecedented attention to the work of such Boards.</text></paragraph></subsection> 
<subsection id="HE6DCF9255EE9402299305D4A79B7BA08"><enum>(b)</enum><header>Sense of Congress</header><text>It is the sense of Congress that the effectiveness of Accountability Review Boards would be improved by reconstituting such Boards to increase their independence from the Department of State.</text></subsection></section> 
<section id="HD4FAD50D01C94536807A6482FD53CBCB"><enum>3.</enum><header>Notification to Congress about certain information relating to accountability review boards of the Department of State</header><text display-inline="no-display-inline">Subsection (c) of section 301 of the Omnibus Diplomatic Security and Antiterrorism Act (<external-xref legal-doc="usc" parsable-cite="usc/22/4831">22 U.S.C. 4831</external-xref>) is amended—</text> 
<paragraph id="H930CE8990D9240C0BE208FA551507585"><enum>(1)</enum><text>in the matter preceding paragraph (1), by inserting <quote>, the Chairman of the Committee on Foreign Affairs of the House of Representatives,</quote> after <quote>the Committee on Foreign Relations of the Senate</quote>; and </text></paragraph> 
<paragraph id="H701698999E004129856A3A7CE5AA2B52"><enum>(2)</enum><text>in paragraph (2), by striking <quote>and</quote> at the end;</text></paragraph> 
<paragraph id="HA9EA0B9ED1EC4989A5871D034DE9DDC6"><enum>(3)</enum><text>by redesignating paragraph (3) as paragraph (5); and</text></paragraph> 
<paragraph id="H56D430A6153C4CA687677844A66897C3"><enum>(4)</enum><text>by inserting after paragraph (2) the following new paragraphs:</text> 
<quoted-block style="OLC" id="H07B6354965CB4548BB463614F68FCDAF" display-inline="no-display-inline"> 
<paragraph id="H9DC09EA1A0D4492F9FD204C00B6FD903" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">of any individual who is employed at a grade of not lower than the level of FS-3 or GS-14 who is hired, assigned, or detailed to assist the Board to carry out its duties;</text></paragraph> 
<paragraph id="HF112A166B53B401AA8800F887CE43820"><enum>(4)</enum><text>of any political appointee who is hired, assigned, or detailed to assist the Board to carry out its duties; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H15992D3AA33941609FB9046B059CF029"><enum>4.</enum><header>Accountability review boards</header> 
<subsection id="HCF6859E484B74CBDAF9E2C914D020670" commented="no"><enum>(a)</enum><header>Membership</header><text>Subsection (a) of section 302 of the Omnibus Diplomatic Security and Antiterrorism Act (<external-xref legal-doc="usc" parsable-cite="usc/22/4832">22 U.S.C. 4832</external-xref>) is amended—</text> 
<paragraph id="H9CF042C4888D4327AF2D796A0DD4A7B1" commented="no"><enum>(1)</enum><text>by striking the first sentence and inserting the following new sentence: <quote>A Board shall consist of five members, two appointed by the Secretary of State, two appointed by the Chairperson of the Council of Inspectors General on Integrity and Efficiency (the CIGIE Chairperson), and one appointed by the Director of National Intelligence.</quote>; and</text></paragraph> 
<paragraph id="H74BDB2DDB580429B8903B0E4E3FD4D03" commented="no"><enum>(2)</enum><text>by striking the final two sentences and inserting the following new sentences: <quote>Members of a Board who are not Federal officers or employees shall each be paid at a rate not to exceed the maximum rate of basic pay payable for level IV of the Executive Schedule under <external-xref legal-doc="usc" parsable-cite="usc/5/5317">section 5317</external-xref> of title 5, United States Code, for each day (including travel time) during which such members are engaged in the actual performance of duties vested in such Board. Members of the Board who are Federal officers or employees shall receive no additional pay by reason of such membership. Only in exceptional circumstances may a member of a Board be a current Federal officer or employee.</quote>. </text></paragraph></subsection> 
<subsection id="H4AD7D03B76F84B238434F841F5FFAEF8"><enum>(b)</enum><header>Staff</header><text>Paragraph (2) of subsection (b) of section 302 of the Omnibus Diplomatic Security and Antiterrorism Act is amended to read as follows:</text>

<paragraph id="HEF2D1C8A1B9C495598785595193FEE63"><enum>(2)</enum><header>Staff</header> 
<subparagraph id="HE169A186F44E41FA856CE031FCA4C3BB"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">A Board may hire staff to assist the Board, and may have any Federal Government employee assigned or detailed to such Board, with or without reimbursement, to assist such Board. Any such assignee or detailee shall retain without interruption the rights, status, and privileges of his or her regular employment.</text></subparagraph> 
<subparagraph id="HF5DDC2142AE24F8A9ACE054B82552084"><enum>(B)</enum><header>Special rule</header><text>Any individual who is hired, assigned, or detailed to assist a Board under subparagraph (A) shall be subject to the rule relating to the avoidance of conflicts of interest under subsection (a) in the same manner and to the same extent as a Member of such a Board is subject to such avoidance under such subsection.</text></subparagraph> 
<subparagraph id="HAE81614773B74A5689DDDBAF9F8226CC"><enum>(C)</enum><header>Office of the Inspector General</header><text>To the maximum extent practicable, individuals assisting the Board shall be employees of the Office of the Inspector General of the Department of State.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HCECDEAE76F2A424B852453AD556BA10C"><enum>(c)</enum><header>Conflicts of interest</header><text>Section 302 of the Omnibus Diplomatic Security and Antiterrorism Act is amended by adding at the end the following new subsections:</text>

<subsection id="H2DAE9A0B624144FDB316C1D257910BE9" commented="no"><enum>(c)</enum><header>Avoidance of conflicts of interest</header> 
<paragraph id="H313323EBD07D4BBABFC56EEC8F7B3367" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of State, the CIGIE Chairperson, and the Director of National Intelligence may not appoint any individual as a member of a Board if the Secretary, the CIGIE Chairperson, or the Director, as the case may be, determines that such individual has a conflict of interest concerning a person whose performance such Board reasonably could be expected to review.</text></paragraph> 
<paragraph id="H650BB4E6A12C433193EFEF6471789069" commented="no"><enum>(2)</enum><header>Declining appointment</header><text>An individual shall decline appointment to membership on a Board if such individual has actual knowledge of a conflict of interest concerning a person whose performance such Board could reasonably be expected to review.</text></paragraph> 
<paragraph id="H68DF635B9EF6468FB979DD6C36B5BF5C" commented="no"><enum>(3)</enum><header>Recusal from particular activities</header><text>A member of a Board shall recuse him or herself from any Board activity, interview, deposition, or recommendation concerning a person with whom such member has a conflict of interest. Such member shall promptly notify the other members of such Board of any such recusal, but need not state the basis therefor.</text></paragraph></subsection> 
<subsection id="H4D0F0908B71B42BAAE7C9F41FD589E18" commented="no"><enum>(d)</enum><header>Conflict of interest defined</header><text display-inline="yes-display-inline">In this section, the term <quote>conflict of interest</quote> means one of the following relationships, whether current or former, that would cause a reasonable person with knowledge of the relevant facts to question the impartiality of the parties to such relationship toward each other:</text> 
<paragraph id="H35F38C51E04140B5966524A92AB086E0"><enum>(1)</enum><text>A business, contractual, or other financial relationship that involves other than a routine consumer transaction.</text></paragraph> 
<paragraph id="H1ED38C6A76DA42C79E7EFE5F3CEC26A6"><enum>(2)</enum><text>A familial, member of household, or other close personal relationship, including a social relationship of a romantic or intimate nature.</text></paragraph> 
<paragraph id="H8088CBD591644DBC8A9CD81427BBD83F"><enum>(3)</enum><text>A direct managerial or supervisory workplace relationship.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H58D4F440331849FAB5E4C874FA672F74"><enum>5.</enum><header>Evidence</header><text display-inline="no-display-inline">Subsection (a) of section 303 of the Omnibus Diplomatic Security and Antiterrorism Act (<external-xref legal-doc="usc" parsable-cite="usc/22/4833">22 U.S.C. 4833</external-xref>) is amended by adding at the end the following new paragraph:</text> 
<quoted-block style="OLC" id="HFDD30427DFF14EF1BC2AFDD10EC4B304" display-inline="no-display-inline"> 
<paragraph id="H9EE0CCADEE964F05A684A388B202B226"><enum>(4)</enum><header>Determination of relevancy</header><text display-inline="yes-display-inline">The Board may accept any evidence determined by a member of the Board to be relevant and material to an investigation or inquiry of the Board. The Federal Rules of Evidence are not applicable to the Board.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HFC727419366240D1B822754F285FCEE9"><enum>6.</enum><header>Board actions</header> 
<subsection id="HB7FC499304ED4F75A500D9491FA5ECFE"><enum>(a)</enum><header>Program recommendations</header><text display-inline="yes-display-inline">Subsection (b) of section 304 of the Omnibus Diplomatic Security and Antiterrorism Act (<external-xref legal-doc="usc" parsable-cite="usc/22/4834">22 U.S.C. 4834</external-xref>) is amended to read as follows:</text> 
<quoted-block style="OLC" id="HC877B9545A214F02A5259E3FDF4800AB" display-inline="no-display-inline"> 
<subsection id="HA7A5A8F439B34C20962E771CEEB389B6"><enum>(b)</enum><header>Program recommendations</header> 
<paragraph id="H8DDC3E80F5284B64874E8CCC53A70671"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), not later than 90 days after a Board is convened in a case, such Board shall submit to the Secretary of State and Congress its findings (which may be classified to the extent determined necessary by the Board), together with recommendations as appropriate to improve the security and efficiency of any program or operation which such Board has reviewed.</text></paragraph> 
<paragraph id="H80B52B9AFE864CFFB66D8E09789AAC8A"><enum>(2)</enum><header>Extension</header><text>The 90 day period referred to in paragraph (1) may be extended for up to 60 days if the Chairperson of the Board referred to in such paragraph determines that such additional time is necessary to complete a thorough review of the program or operation at issue.</text></paragraph> 
<paragraph id="H3829948FA87E4272AF9156DCD5E4F15C"><enum>(3)</enum><header>Dissenting views</header><text display-inline="yes-display-inline">If a member dissents from any of the findings or recommendations of the Board, such member may submit dissenting views to accompany the submission of the Board’s findings and recommendations under paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H485E195D6B984CCEB7DBABEA8D567340"><enum>(b)</enum><header>Reports</header><text>Paragraph (1) of subsection (d) of section 304 of the Omnibus Diplomatic Security and Antiterrorism Act is amended to read as follows:</text> 
<quoted-block style="OLC" id="H52BA75186CFD4D818818AAC2E706F793" display-inline="no-display-inline"> 
<paragraph id="HC34AD0D78D104E89B738FFB20D64A9CB"><enum>(1)</enum><header>Program recommendations</header><text display-inline="yes-display-inline">Not later than 90 days after the submission to the Secretary of State of the findings and recommendations from any Board in accordance with subsection (b), the Secretary shall submit to Congress a corresponding report on the action taken with respect to each such recommendation.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H37A19F1A34364B16841C828F1A317E24"><enum>7.</enum><header>Regulations</header><text display-inline="no-display-inline">The Secretary of State shall promulgate or update regulations, as the case may be, to carry out the amendments made by this Act.</text></section> 
<section id="H0FD6DAC8683F40719526D112C3076DFA"><enum>8.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall apply with respect to any case of an Accountability Review Board that is convened under section 301 of the Omnibus Diplomatic Security and Antiterrorism Act (<external-xref legal-doc="usc" parsable-cite="usc/22/4831">22 U.S.C. 4831</external-xref>) on or after the date of the enactment of this Act.</text></section>
