<official-title>To exclude from consumer credit reports medical debt that has been in collection and has been fully paid or settled, and for other purposes.</official-title>

<section id="H4DE0C4ACFAFF4BBDA7D5E39BB9A48293" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Medical Debt Responsibility Act of 2013</short-title></quote>.</text> </section> 
<section id="H629AF2A8FFA24BEDA2FA765B2B48C37C"><enum>2.</enum><header>Findings and purpose</header> 
<subsection id="H161DDD6C5EF144E5A18C16ACFE0EC27B"><enum>(a)</enum><header>Findings</header><text>Congress finds that—</text> 
<paragraph id="H95E2862D5F6C40CCB07C24529E311387"><enum>(1)</enum><text>medical debt is unique, and Americans do not choose when accidents happen or when illness strikes;</text> </paragraph> 
<paragraph id="H6089B581586A4FDA9C6A3333FE67B4B3"><enum>(2)</enum><text>medical debt collection issues affect both insured and uninsured consumers;</text> </paragraph> 
<paragraph id="HA634B421E01B42D18A97ED80DA138A20"><enum>(3)</enum><text>according to credit evaluators, medical debt collections are more likely to be in dispute, inconsistently reported, and of questionable value in predicting future payment performance because it is atypical and nonpredictive;</text> </paragraph> 
<paragraph id="H29A06C1383384A589EC2B6390EFA24B3"><enum>(4)</enum><text>nevertheless, medical debt that has been completely paid off or settled can significantly damage the credit score of a consumer for years;</text> </paragraph> 
<paragraph id="HD40BF8FD80A44F82949EFCB505DC1E13"><enum>(5)</enum><text>as a result, consumers may be denied credit or pay higher interest rates when buying a home or obtaining a credit card;</text> </paragraph> 
<paragraph id="HD496A557576949488064B7CD518D6773"><enum>(6)</enum><text>healthcare providers are increasingly turning to outside collection agencies to help secure payment from patients, coming at the expense of the consumer, because medical debts are not typically reported unless they become assigned to collections;</text> </paragraph> 
<paragraph id="H7C6460AC71AF4E9699FA8619187ACE8D"><enum>(7)</enum><text>in fact, medical bills account for more than half of all non-credit related collection actions reported to consumer credit reporting agencies;</text> </paragraph> 
<paragraph id="H503188EB6AFD40089FC881DE32FC94D3"><enum>(8)</enum><text>the issue of medical debt affects millions of consumers;</text> </paragraph> 
<paragraph id="H3447AAF5D6F64010AB33AA907526D00C"><enum>(9)</enum><text>according to the Commonwealth Fund, medical bill problems or accrued medical debt affects roughly 73,000,000 working-age adults in America; and</text> </paragraph> 
<paragraph id="H338DA3E9D0F246C9987B2B2B7296E9DD"><enum>(10)</enum><text>in 2010, 30,000,000 working-age American adults were contacted by a collection agency for unpaid medical bills.</text> </paragraph></subsection> 
<subsection id="H66ADAFC35B18413E9D09569505CE12B2"><enum>(b)</enum><header>Purpose</header><text>It is the purpose of this Act to exclude from consumer credit reports medical debt that had been characterized as debt in collection for credit reporting purposes and has been fully paid or settled.</text> </subsection></section> 
<section id="HB4467106B2AE403DA849C4C99F4A4D46"><enum>3.</enum><header>Amendments to fair credit reporting Act</header> 
<subsection id="H2F38245A94114E4580C37369661C858D"><enum>(a)</enum><header>Medical debt defined</header><text>Section 603 of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681a">15 U.S.C. 1681a</external-xref>) is amended by adding at the end the following:</text>

<subsection id="HF03168CBA40C4B8C9C9EA2916750E0E4"><enum>(z)</enum><header>Medical debt</header><text>The term <term>medical debt</term> means a debt described in section 604(g)(1)(C).</text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="H1B0E65F18C5543D0853C5A8F01E5B220"><enum>(b)</enum><header>Exclusion for paid or settled medical debt</header><text>Section 605(a) of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681c">15 U.S.C. 1681c(a)</external-xref>) is amended by adding at the end the following:</text>

<paragraph id="H0544B721E85D4649ACA25E9BD37E99DF"><enum>(7)</enum><text>Any information related to a fully paid or settled medical debt that had been characterized as delinquent, charged off, or in collection which, from the date of payment or settlement, antedates the report by more than 45 days.</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section>
