		<legis-type>A BILL</legis-type>
		<official-title>To amend the Help America Vote Act of 2002 to permit an
		  individual who is subject to a requirement to present identification as a
		  condition of voting in an election for Federal office to meet such requirement
		  by presenting a sworn written statement attesting to the individual’s
		  identification, and for other purposes.</official-title>

		<section id="H9BD4AABB886841D59A665376BB3A0EC9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>America Votes Act of
			 2013</short-title></quote>.</text>
		</section><section id="HCBFB46EAB29D4697909C629B789660E6"><enum>2.</enum><header>Permitting use of
			 sworn written statement to meet identification requirements for voting</header>
			<subsection id="HF285C6D02FA841CD9097D2035FA4CF31"><enum>(a)</enum><header>Permitting use
			 of statement</header><text display-inline="yes-display-inline">Title III of the
			 Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15481">42 U.S.C. 15481 et seq.</external-xref>) is amended by inserting
			 after section 303 the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H594FAABE71B8440294C588443DE18B42" style="OLC">
					<section id="HADA5D1522141455DBC39F62F12813F50"><enum>303A.</enum><header>Permitting use
				of sworn written statement to meet identification requirements</header>
						<subsection id="H9F9FEE4A145246F8843BD3B2DB4C875E"><enum>(a)</enum><header>Use of
				statement</header>
							<paragraph id="HD76208DC154E44F7A442C5D5EE6A3219"><enum>(1)</enum><header>In
				general</header><text>Except as provided in subsection (c), if a State has in
				effect a requirement that an individual present identification as a condition
				of receiving and casting a ballot in an election for Federal office, the State
				shall permit the individual to meet the requirement—</text>
								<subparagraph id="H3DF5297CE6D0445EB909CEB3C21E191C"><enum>(A)</enum><text>in the case of an
				individual who desires to vote in person, by presenting the appropriate State
				or local election official with a sworn written statement, signed by the
				individual under penalty of perjury, attesting to the individual’s
				identification and attesting that the individual is registered to vote in the
				election; or</text>
								</subparagraph><subparagraph id="H29A91B43089A4A9F80D9AFFEEEFDEF52"><enum>(B)</enum><text>in the case of an
				individual who desires to vote by mail, by submitting with the ballot the
				statement described in subparagraph (A).</text>
								</subparagraph></paragraph><paragraph id="H5943F89E494D4B3E87EC5E825D165203"><enum>(2)</enum><header>Providing
				pre-printed copy of statement</header><text>A State which is subject to
				paragraph (1) shall—</text>
								<subparagraph id="H2E01096208884EC384BF63AA0114808A"><enum>(A)</enum><text>prepare a
				pre-printed version of the statement described in paragraph (1)(A) which
				includes a blank space for an individual to provide a name and
				signature;</text>
								</subparagraph><subparagraph id="HDC0CEFB1CD6E40599C49A62B9723B72E"><enum>(B)</enum><text>make copies of the
				pre-printed version available at polling places for election officials to
				distribute to individuals who desire to vote in person; and</text>
								</subparagraph><subparagraph id="H817E0FF0E7CC4C57A4AF31BC602D14A7"><enum>(C)</enum><text>include a copy of
				the pre-printed version with each blank absentee or other ballot transmitted to
				an individual who desires to vote by mail.</text>
								</subparagraph></paragraph></subsection><subsection id="H3F4FB9E24AD24ABCA98E816168FFD142"><enum>(b)</enum><header>Requiring use of
				regular ballot</header><text>A State may not require an individual who presents
				or submits a sworn written statement in accordance with subsection (a)(1) to
				cast a provisional ballot in the election under section 302.</text>
						</subsection><subsection id="H1357F35DF80342AFB5A74B2DF7D311DA"><enum>(c)</enum><header>Exception for
				first-Time voters registering by mail</header><text>Subsections (a) and (b) do
				not apply with respect to any individual described in paragraph (1) of section
				303(b) who is required to meet the requirements of paragraph (2) of such
				section.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H3F00C813B1B248FFB7BFD0437F0F7DF4"><enum>(b)</enum><header>Conforming
			 amendment relating to enforcement</header><text>Section 401 of such Act (42
			 U.S.C. 15511) is amended by striking <quote>and 303</quote> and inserting
			 <quote>303, and 303A</quote>.</text>
			</subsection><subsection id="H748B590D91864540920186CB49450EA5"><enum>(c)</enum><header>Clerical
			 amendment</header><text>The table of contents of such Act is amended by
			 inserting after the item relating to section 303 the following new item:</text>

					<toc regeneration="no-regeneration">
						<toc-entry level="section">Sec. 303A. Permitting use of sworn written
				statement to meet identification

					</toc>
					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="HBE2206B551804C8D90E11A9A1EBF5651"><enum>3.</enum><header>Requiring States
			 to include information on use of sworn written statement in voting information
			 material posted at polling places</header><text display-inline="no-display-inline">Section 302(b)(2) of the Help America Vote
			 Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15482">42 U.S.C. 15482(b)(2)</external-xref>) is amended—</text>
			<paragraph id="HD13AE9D46F42404191DE6B4676F4A8ED"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of subparagraph (E);</text>
			</paragraph><paragraph id="H7FDAE71BFD2241488B46F24A31826AD4"><enum>(2)</enum><text>by striking the
			 period at the end of subparagraph (F) and inserting <quote>; and</quote>;
			 and</text>
			</paragraph><paragraph id="H1D46C2F5402346DB80D2B27B3D62A231"><enum>(3)</enum><text>by adding at the
			 end the following new subparagraph:</text>
				<quoted-block display-inline="no-display-inline" id="H68ADCF3CB23147ACB064D77B0B5A1DB0" style="OLC">
					<subparagraph id="H57DD82FBDEFF40349654F6907B60798D"><enum>(G)</enum><text display-inline="yes-display-inline">in the case of a State that has in effect a
				requirement that an individual present identification as a condition of
				receiving and casting a ballot in an election for Federal office, information
				on how an individual may meet such requirement by presenting a sworn written
				statement in accordance with section
				303A.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HC99A900CC26B4771A3E876D8F6778BDC"><enum>4.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">The amendments made by
			 this Act shall apply with respect to elections occurring on or after the date
			 of the enactment of this Act.</text>
