R. 1742</legis-num><current-chamber display="yes">IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20131029">October 29, 2013</action-date><action-desc>Received; read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To exclude from consideration as income under the United States Housing Act of 1937 payments of pension made under <external-xref legal-doc="usc" parsable-cite="usc/38/1521">section 1521</external-xref> of title 38, United States Code, to veterans who are in need of regular aid and attendance, and for other purposes.</official-title></form><legis-body id="H3AB83328698340E5B1AF24BBECFF4107" style="OLC"><section id="HD028A1D4DF854AB7AF0228FFE8143036" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Vulnerable Veterans Housing Reform Act of 2013</short-title></quote>.</text></section><section id="H5B8E42AF4D99458994DC40AFE7D60CEB" section-type="subsequent-section"><enum>2.</enum><header>Exclusion from income</header><text display-inline="no-display-inline">Paragraph (4) of section 3(b) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437a">42 U.S.C. 1437a(b)(4)</external-xref>) is amended—</text><paragraph id="H71314B90116E43C28307E82CBF4ADBA5"><enum>(1)</enum><text>by striking <quote><short-title>and any amounts</short-title></quote> and inserting <quote>, any amounts</quote>;</text></paragraph><paragraph id="H370933F7CD634106BFC279676CA5F7EC"><enum>(2)</enum><text>by striking <quote>or any deferred</quote> and inserting <quote>, any deferred</quote>; and</text></paragraph><paragraph id="H9951E16FF1D4406CA26CD517B2A6D493"><enum>(3)</enum><text>by inserting after <quote>prospective monthly amounts</quote> the following: <quote>, and any expenses related to aid and attendance as detailed under <external-xref legal-doc="usc" parsable-cite="usc/38/1521">section 1521</external-xref> of title 38, United States Code</quote>.</text></paragraph></section><section display-inline="no-display-inline" id="H94373185D9B24DC986DDFD7D0A440334" section-type="subsequent-section"><enum>3.</enum><header>Utility allowances and data</header><text display-inline="no-display-inline">Section 8(o) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(o)</external-xref>) is amended—</text><paragraph id="H452BE0E8256149EF8585FF593D40F30D"><enum>(1)</enum><text>in paragraph (2), by adding at the end the following new subparagraph:</text><quoted-block display-inline="no-display-inline" id="H317B964A2A4243CD9321A23DC7FC8BD5" style="OLC"><subparagraph id="HE8B54D73BE444D579759B2D9D33B485D"><enum>(D)</enum><header>Utility allowance</header><clause id="H28C1C41AA5574CC19A6F4E1FE23CEA59"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">In determining the monthly assistance payment for a family under subparagraphs (A) and (B), the amount allowed for tenant-paid utilities shall not exceed the appropriate utility allowance for the family unit size as determined by the public housing agency regardless of the size of the dwelling unit leased by the family.</text></clause><clause id="H2A09AB9591E24F9CA2522E38C580B3B6"><enum>(ii)</enum><header>Exception for certain families</header><text>Notwithstanding subparagraph (A), upon request by a family that includes a person with disabilities, an elderly family, or a family that includes any person who is less than 18 years of age, the public housing agency shall approve a utility allowance that is higher than the applicable amount on the utility allowance schedule, except that in the case of a family that includes a person with disabilities, the agency shall approve such higher amount only if a higher utility allowance is needed as a reasonable accommodation to make the program accessible to and usable by the family member with a disability.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HFCB6D8C3576D4C24A6949C47C2CD6881"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="H59EBB1A74C1B4AAFAF39C8A455C58942" style="OLC"><paragraph id="H834D3F34592A4ED0A72CA749C216C12B"><enum>(21)</enum><header>Utility data</header><subparagraph id="HCA484CCBFAEC4FF7B2B21C7C670FA694"><enum>(A)</enum><header>Publication</header><text display-inline="yes-display-inline">The Secretary shall, to the extent that data can be collected cost effectively, regularly publish such data regarding utility consumption and costs in local areas as the Secretary determines will be useful for the establishment of allowances for tenant-paid utilities for families assisted under this subsection.</text></subparagraph><subparagraph id="H02EA25792D9D4454BAF946E049531ED2"><enum>(B)</enum><header>Use of data</header><text>The Secretary shall provide such data in a manner that—</text><clause id="HC676E5384F41482197BE4B9775C18182"><enum>(i)</enum><text>avoids unnecessary administrative burdens for public housing agencies and owners; and</text></clause><clause id="HB92731B379C84ADFA85210481907A1D3"><enum>(ii)</enum><text>protects families in various unit sizes and building types, and using various utilities, from high rent and utility cost burdens relative to income.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body><attestation><attestation-group><attestation-date chamber="House" date="20131028">Passed the House of Representatives October 28, 2013.</attestation-date><attestor display="yes">Karen L.
