		<official-title>To direct the Secretary of Defense to provide the service
		  records of veterans to the Secretary of Veterans Affairs in an efficient,
		  electronic format.</official-title>

		<section id="HC7A75F3595E54A2F9561335960FEA3CA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>VA Claims, Operations, and Records
			 Efficiency Act</short-title></quote>.</text>
		</section><section id="HC474332F604A4A49AC148E8F72018A97" section-type="subsequent-section"><enum>2.</enum><header>Provision of service
			 records</header>
			<subsection id="HEAA00B2936494270A70DEE9801A649F7"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">In accordance with
			 subsection (b), the Secretary of Defense, in consultation with the Secretary of
			 Veterans Affairs, shall make the covered records of each member of the Armed
			 Forces available to the Secretary of Veterans Affairs in an electronic
			 format.</text>
			</subsection><subsection id="HEC6526FE59E84E1691CD373195427FA6"><enum>(b)</enum><header>Timeline</header><text display-inline="yes-display-inline">The Secretary of Defense shall ensure that
			 the covered records of members are made available to the Secretary of Veterans
			 Affairs as follows:</text>
				<paragraph id="HA746E1061DDB479F879D11884A496BEB"><enum>(1)</enum><text display-inline="yes-display-inline">With respect to a member of the Armed
			 Forces who was discharged or released from the Armed Forces before the date of
			 the enactment of this Act, not later than 45 days after the date of such
			 discharge or release.</text>
				</paragraph><paragraph id="HF9A9C6F8FDF7432AB5C238B84DC2DD96"><enum>(2)</enum><text display-inline="yes-display-inline">With respect to a member of the Armed
			 Forces who is discharged or released from the Armed Forces on or after the date
			 of the enactment of this Act, not later than 21 days after the date of such
			 discharge or release.</text>
				</paragraph></subsection><subsection id="H9FAAE6DB58784AB487430F179EC06962"><enum>(c)</enum><header>Certification</header><text>For
			 each member of the Armed Forces whose covered records are made available under
			 subsection (a), the Secretary of Defense shall transmit to the Secretary of
			 Veterans Affairs a letter certifying that—</text>
				<paragraph id="H908E5B16132247F38454C9019CCF4580"><enum>(1)</enum><text>the Secretary of
			 Defense thoroughly reviewed the records of the member;</text>
				</paragraph><paragraph id="HC62CCCB7F2944B9A98ACD753C70EB428"><enum>(2)</enum><text>the information
			 provided in the covered records of such member is complete as of the date of
			 the letter;</text>
				</paragraph><paragraph id="H7BA2986D2AB54433B73F7D6AF58C9C36"><enum>(3)</enum><text>no other
			 information that should be included in such covered records exist as of such
			 date; and</text>
				</paragraph><paragraph id="HB337A9B83D264B40BEFC45C7D6779A5B"><enum>(4)</enum><text>if other
			 information is later discovered—</text>
					<subparagraph id="H6BF7EB4DE7284A229E8017C188D26362"><enum>(A)</enum><text>such other
			 information will be added to such covered records; and</text>
					</subparagraph><subparagraph id="HC9ED07DB21FF4EBBA0B5B9F33D175CEC"><enum>(B)</enum><text>the Secretary of
			 Defense will notify the Secretary of Veterans Affairs of such addition.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" id="H10AC8B0929764AA4B0B93D3BB8744836"><enum>(d)</enum><header>Sharing of
			 protected health information</header><text display-inline="yes-display-inline">For purposes of the regulations promulgated
			 under section 264(c) of the Health Insurance Portability and Accountability Act
			 of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/42/1320d-2">42 U.S.C. 1320d–2</external-xref> note), making medical records available to the
			 Secretary of Veterans Affairs under subsection (a) shall be treated as a
			 permitted disclosure.</text>
			</subsection><subsection id="H3DC1EF2A62B14113AC5CA356A037990E"><enum>(e)</enum><header>Covered records
			 defined</header><text>In this section, the term <term>covered records</term>
			 means, with respect to a member of the Armed Forces—</text>
				<paragraph id="HE6DEA05988D44C1DB20C40898C91A6B8"><enum>(1)</enum><text display-inline="yes-display-inline">service treatment records;</text>
				</paragraph><paragraph id="H9F5CDCBC38D744F89740990293A1F565"><enum>(2)</enum><text>accompanying
			 personal records;</text>
				</paragraph><paragraph id="H6762F1F5CB0B497C9F765A03EF186B75"><enum>(3)</enum><text>relevant unit
			 records; and</text>
				</paragraph><paragraph id="HDE306AC5705147929D7A4E7E3FB133C0"><enum>(4)</enum><text>medical records
			 created by reason of treatment or services received pursuant to chapter 55 of
			 title 10, United States Code.</text>
