		  Mountain Aerial Gunnery Range, California, and for other

		<section id="HBC81E54FE07246B8A78163D6D2396106" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Chocolate Mountain Aerial Gunnery
			 Range Transfer Act of 2013</short-title></quote>.</text>
		</section><section id="H202D3392CDD5482CB0FD8B9E3A16B56C"><enum>2.</enum><header>Transfer of
			 administrative jurisdiction, Chocolate Mountain Aerial Gunnery Range,
			 California</header>
			<subsection id="HFA8AD7F4DE1D426CBF31871EE3151EFF"><enum>(a)</enum><header>Transfer
			 required</header><text display-inline="yes-display-inline">The Secretary of the
			 Interior shall transfer to the administrative jurisdiction of the Secretary of
			 the Navy the surface estate in certain public land administered by the Bureau
			 of Land Management in Imperial and Riverside Counties, California, consisting
			 of approximately 226,711 acres, as generally depicted on the map titled
			 <quote>Chocolate Mountain Aerial Gunnery Range Proposed–Withdrawal</quote>
			 dated 1987 (revised July 1993), and identified as WESTDIV Drawing No. C–102370,
			 which was prepared by the Naval Facilities Engineering Command of the
			 Department of the Navy and is on file with the California State Office of the
			 Bureau of Land Management.</text>
			</subsection><subsection id="H17C87B98B95F4ADE80963F80B0325990"><enum>(b)</enum><header>Valid existing
			 rights</header><text display-inline="yes-display-inline">The transfer of
			 administrative jurisdiction under subsection (a) shall be subject to any valid
			 existing rights, including any property, easements, or improvements held by the
			 Bureau of Reclamation and appurtenant to the Coachella Canal. The Secretary of
			 the Navy shall provide for reasonable access by the Bureau of Reclamation for
			 inspection and maintenance purposes not inconsistent with military
			 training.</text>
			</subsection><subsection id="H5358DCEEE0A84C1F9704E533F406113F"><enum>(c)</enum><header>Time for
			 conveyance</header><text display-inline="yes-display-inline">The transfer of
			 administrative jurisdiction under subsection (a) shall occur pursuant to a
			 schedule agreed to by the Secretary of the Interior and the Secretary of the
			 Navy, but in no case later than the date of the completion of the boundary
			 realignment required by section 4.</text>
			</subsection><subsection id="H702D7992330E4EA6A1DB3823167DC3CB"><enum>(d)</enum><header>Map and legal
			 description</header>
				<paragraph id="H45D91D2F155541568F5D2298B931CF23"><enum>(1)</enum><header>Preparation and
			 publication</header><text display-inline="yes-display-inline">The Secretary of
			 the Interior shall publish in the Federal Register a legal description of the
			 public land to be transferred under subsection (a).</text>
				</paragraph><paragraph id="H93CA1B95AFAF46B68EA88A21E0B1AB99"><enum>(2)</enum><header>Submission to
			 congress</header><text display-inline="yes-display-inline">The Secretary of the
			 Interior shall file with the Committee on Energy and Natural Resources of the
			 Senate and the Committee on Natural Resources of the House of
			 Representatives—</text>
					<subparagraph id="H6AF6BA113498413E996087D36337965E"><enum>(A)</enum><text>a copy of the
			 legal description prepared under paragraph (1); and</text>
					</subparagraph><subparagraph id="H7C4B284F69CE4BC1BBA3568C4CDE93A9"><enum>(B)</enum><text>a map depicting
			 the legal description of the transferred public land.</text>
					</subparagraph></paragraph><paragraph id="H8C4FF87153814B92B3DE258C38B52F24"><enum>(3)</enum><header>Availability for
			 public inspection</header><text display-inline="yes-display-inline">Copies of
			 the legal description and map filed under paragraph (2) shall be available for
			 public inspection in the appropriate offices of—</text>
					<subparagraph id="H5C52483D7B1C413295C5FB8EAE12FAC1"><enum>(A)</enum><text>the Bureau of Land
			 Management;</text>
					</subparagraph><subparagraph id="HC6D34BF70F4D4479AB7C23D113A5306D"><enum>(B)</enum><text display-inline="yes-display-inline">the Office of the Commanding Officer,
			 Marine Corps Air Station Yuma, Arizona;</text>
					</subparagraph><subparagraph id="HBB60BBA051884F9688FE62F67C0C8BC0"><enum>(C)</enum><text>the Office of the
			 Commander, Navy Region Southwest; and</text>
					</subparagraph><subparagraph id="HCE3555D57F564FFD92DB2803CC5E1E3B"><enum>(D)</enum><text>the Office of the
			 Secretary of the Navy.</text>
					</subparagraph></paragraph><paragraph id="H7BBDBAE8E2B04EC39CE2C9C22B2073DA"><enum>(4)</enum><header>Force of
			 law</header><text display-inline="yes-display-inline">The legal description and
			 map filed under paragraph (2) shall have the same force and effect as if
			 included in this Act, except that the Secretary of the Interior may correct
			 clerical and typographical errors in the legal description or map.</text>
				</paragraph><paragraph id="HF937F245DE2D4F54A5053D7DE54D9D8F"><enum>(5)</enum><header>Reimbursement of
			 costs</header><text display-inline="yes-display-inline">The transfer required
			 by subsection (a) shall be made without reimbursement, except that the
			 Secretary of the Navy shall reimburse the Secretary of the Interior for any
			 costs incurred by the Secretary of the Interior to prepare the legal
			 description and map under this subsection.</text>
				</paragraph></subsection></section><section id="H37D43944707044DDA9055030023A5F1A"><enum>3.</enum><header>Management and
			 use of transferred land</header>
			<subsection id="HBAB67FC307914927934A1FFAC05E8B45"><enum>(a)</enum><header>Use of
			 transferred land</header><text display-inline="yes-display-inline">Upon the
			 receipt of the land under section 2, the Secretary of the Navy shall administer
			 the land as the Chocolate Mountain Aerial Gunnery Range, California, and
			 continue to authorize use of the land for military purposes.</text>
			</subsection><subsection id="H0608F79761004FC695D7EF05CFD74BED"><enum>(b)</enum><header>Protection of
			 desert tortoise</header><text display-inline="yes-display-inline">Nothing in
			 the transfer required by section 2 shall affect the prior designation of
			 certain lands within the Chocolate Mountain Aerial Gunnery Range as critical
			 habitat for the desert tortoise (Gopherus Agassizii).</text>
			</subsection><subsection id="HDFDDADDAA3A847668DFA3202428A58E3"><enum>(c)</enum><header>Withdrawal of
			 Mineral Estate</header><text>Subject to valid existing rights, the mineral
			 estate of the land to be transferred under section 2 are withdrawn from all
			 forms of appropriation under the public land laws, including the mining laws
			 and the mineral and geothermal leasing laws.</text>
			</subsection><subsection id="HAE569BF7DEF841C4B8BD6C852AB8EA20"><enum>(d)</enum><header>Integrated
			 natural resources management plan</header><text display-inline="yes-display-inline">Not later than one year after the transfer
			 of the land under section 2, the Secretary of the Navy, in cooperation with the
			 Secretary of the Interior, shall prepare an integrated natural resources
			 management plan pursuant to the Sikes Act (<external-xref legal-doc="usc" parsable-cite="usc/16/670a">16 U.S.C. 670a et seq.</external-xref>) for the
			 transferred land and for land that, as of the date of the enactment of this
			 Act, is under the jurisdiction of the Secretary of the Navy underlying the
			 Chocolate Mountain Aerial Gunnery Range.</text>
			</subsection></section><section id="H96E10BEE4F454B259038733ECA6E3E74"><enum>4.</enum><header>Realignment of
			 range boundary and related transfer of title</header>
			<subsection id="H253DC69BE58443B49FE2EB26A74A0B5A"><enum>(a)</enum><header>Realignment;
			 purpose</header><text display-inline="yes-display-inline">The Secretary of the
			 Interior and the Secretary of the Navy shall realign the boundary of the
			 Chocolate Mountain Aerial Gunnery Range, as in effect on the date of the
			 enactment of this Act, to improve public safety and management of the Range,
			 consistent with the following:</text>
				<paragraph id="H9149EAFA6D2142B4B9319F59F06794B5"><enum>(1)</enum><text>The northwestern
			 boundary of the Chocolate Mountain Aerial Gunnery Range shall be realigned to
			 the edge of the Bradshaw Trail so that the Trail is entirely on public land
			 under the jurisdiction of the Department of the Interior.</text>
				</paragraph><paragraph id="H3F62BB8113B2402D97222EA2B7620F58"><enum>(2)</enum><text>The centerline of
			 the Bradshaw Trail shall be delineated by the Secretary of the Interior in
			 consultation with the Secretary of the Navy, beginning at its western terminus
			 at Township 8 South, Range 12 East, Section 6 eastward to Township 8 South,
			 Range 17 East, Section 32 where it leaves the Chocolate Mountain Aerial Gunnery
			 Range.</text>
				</paragraph></subsection><subsection id="H2C282621AA2A41D1BEEFF8072E75DC8D"><enum>(b)</enum><header>Transfers
			 related to realignment</header><text display-inline="yes-display-inline">The
			 Secretary of the Interior and the Secretary of the Navy shall make such
			 transfers of administrative jurisdiction as may be necessary to reflect the
			 results of the boundary realignment carried out pursuant to subsection
			 (a).</text>
			</subsection><subsection id="H21F0EBDE83C34CFCB3CF28654B794CC8"><enum>(c)</enum><header>Applicability of
			 national environmental policy act of 1969</header><text>The National
			 Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) shall not apply to
			 any transfer of land made under subsection (b) or any decontamination actions
			 undertaken in connection with such a transfer.</text>
			</subsection><subsection id="H717B9D12AADD4F678822D3CC5C9152B0"><enum>(d)</enum><header>Decontamination</header><text display-inline="yes-display-inline">The Secretary of the Navy shall maintain,
			 to the extent funds are available for such purpose and consistent with
			 applicable Federal and State law, a program of decontamination of any
			 contamination caused by defense-related uses on land transferred under
			 subsection (b). The Secretary of Defense shall include a description of such
			 decontamination activities in the annual report required by section 2711 of
			 title 10, United States Code.</text>
			</subsection><subsection id="HE99124DFB73C4B34B93B63A1F48F89CB"><enum>(e)</enum><header>Timeline</header><text>The
			 delineation of the Bradshaw Trail under subsection (a) and any transfer of land
			 under subsection (b) shall occur pursuant to a schedule agreed to by the
			 Secretary of the Interior and the Secretary of the Navy, but in no case later
			 than two years after the date of the enactment of this Act.</text>
			</subsection></section><section id="HD297B2E1C6CC4D46B831FDA0AD70EB44"><enum>5.</enum><header>Effect of
			 termination of military use</header>
			<subsection id="H8FA7F2CC339544AA88BCAF7E441BF336"><enum>(a)</enum><header>Notice and
			 effect</header><text display-inline="yes-display-inline">Upon a determination
			 by the Secretary of the Navy that there is no longer a military need for all or
			 portions of the land transferred under section 2, the Secretary of the Navy
			 shall notify the Secretary of the Interior of such determination. Subject to
			 subsections (b), (c), and (d), the Secretary of the Navy shall transfer the
			 land subject to such a notice back to the administrative jurisdiction of the
			 Secretary of the Interior.</text>
			</subsection><subsection id="HD10C0273694E4908A45455DADB2B5D87"><enum>(b)</enum><header>Contamination</header><text>Before
			 transmitting a notice under subsection (a), the Secretary of the Navy shall
			 prepare a written determination concerning whether and to what extent the land
			 to be transferred are contaminated with explosive, toxic, or other hazardous
			 materials. A copy of the determination shall be transmitted with the notice.
			 Copies of the notice and the determination shall be published in the Federal
			 Register.</text>
			</subsection><subsection id="H8A1C235726C649C5821D358FD8B4424B"><enum>(c)</enum><header>Decontamination</header><text display-inline="yes-display-inline">The Secretary of the Navy shall
			 decontaminate any contaminated land that is the subject of a notice under
			 subsection (a) if—</text>
				<paragraph id="H71B4280FF9B3430D819DA968BE58F1B9"><enum>(1)</enum><text>the Secretary of
			 the Interior, in consultation with the Secretary of the Navy, determines
			 that—</text>
					<subparagraph id="H57DFD93F894F4ADCBE72DAD1A75B4EDA"><enum>(A)</enum><text>decontamination is
			 practicable and economically feasible (taking into consideration the potential
			 future use and value of the land); and</text>
					</subparagraph><subparagraph id="H39527308D6BF44B699CAF45877CDBC17"><enum>(B)</enum><text>upon
			 decontamination, the land could be opened to operation of some or all of the
			 public land laws, including the mining laws; and</text>
					</subparagraph></paragraph><paragraph id="HED423C14DB2D453A83A1A77410F3CD9F"><enum>(2)</enum><text>funds are
			 appropriated for such decontamination.</text>
				</paragraph></subsection><subsection id="HBF71CFBFB6944B55BAB29908E1A21812"><enum>(d)</enum><header>Alternative</header><text display-inline="yes-display-inline">The Secretary of the Interior is not
			 required to accept land proposed for transfer under subsection (a) if the
			 Secretary of the Interior is unable to make the determinations under subsection
			 (c)(1) or if Congress does not appropriate a sufficient amount of funds for the
			 decontamination of the land.</text>
			</subsection></section><section id="H09472025603842278324ACFF42F5ABA1"><enum>6.</enum><header>Temporary
			 extension of existing withdrawal period</header><text display-inline="no-display-inline">Subsection (a) of section 806 of the
			 California Military Lands Withdrawal and Overflights Act of 1994 (title VIII of
			 <external-xref legal-doc="public-law" parsable-cite="pl/103/433">Public Law 103–433</external-xref>; 108 Stat. 4505) is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="H2FC06EF4153946ED9CBFEAEFA519E756" style="OLC">
				<subsection id="H2B374EAFC00B425EBC60D9C71035FC4F"><enum>(a)</enum><header>Duration</header><text display-inline="yes-display-inline">The withdrawal and reservation established
				by subsection (a) of section 803 shall terminate on October 31, 2014. The
				withdrawal and reservation established by subsection (b) of such section shall
				not terminate until the date on which the land transfer required by section 2
				of the <short-title>Chocolate Mountain Aerial Gunnery
				Range Transfer Act of 2013</short-title> is
				executed.</text>
