		<section id="H277C6894C96C43CCA997EAB69FA407C1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Trash Reduction Act of
			 2013</short-title></quote>.</text>
		</section><section id="HA3250200FDB14C4D88975700C608C38C"><enum>2.</enum><header>Imposition of tax
			 on disposable carryout bags</header>
			<subsection id="HD9639F53066A4094A36A29515BAA9781"><enum>(a)</enum><header>General
			 rule</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/31">Chapter 31</external-xref> of the Internal Revenue Code of 1986 (relating to
			 retail excise taxes) is amended by inserting after subchapter C the following
			 new subchapter:</text>

				Carryout Bags</header>
						<toc container-level="subchapter-container" idref="H2E0F0D47402E43A69F08B1415F26DDAF" lowest-bolded-level="division-lowest-bolded" lowest-level="section" quoted-block="no-quoted-block" regeneration="yes-regeneration">
							<toc-entry idref="HC66096D508A14B239E58DA66BEB02160" level="section">Sec. 4056. Imposition of tax.</toc-entry>
						</toc>
						<section id="HC66096D508A14B239E58DA66BEB02160"><enum>4056.</enum><header>Imposition of
				tax</header>
							<subsection id="H6617EBE5E06A4C42BDC9FB42C5A53C99"><enum>(a)</enum><header>General
				rule</header><text>There is hereby imposed on any retail sale a tax on each
				disposable carryout bag.</text>
							</subsection><subsection id="H95AE66188B254A6F876864771BA57AA0"><enum>(b)</enum><header>Amount of
				tax</header><text>The amount of tax imposed by subsection (a) shall be $0.05
				per disposable carryout bag.</text>
							</subsection><subsection id="H33F9948174FF46A0883D64B4464A215C"><enum>(c)</enum><header>Liability for
				tax</header><text>The retailer shall be liable for the tax imposed by this
				section.</text>
							</subsection><subsection id="H2760E2D3288F459191740241AE9967B1"><enum>(d)</enum><header>Definitions</header><text>For
				purposes of this section—</text>
								<paragraph id="HE2582588372E4F1BBD1296A355C1D213"><enum>(1)</enum><header>Disposable
				carryout bag</header>
									<subparagraph id="H7BDB35DCF3DF42C2B43020FE6981DB7F"><enum>(A)</enum><header>In
				general</header><text>The term <term>disposable carryout bag</term> means a bag
				of any material, commonly plastic or kraft paper, which is provided to a
				consumer at the point of sale to carry or cover purchases, merchandise, or
				other items.</text>
									</subparagraph><subparagraph id="H2AAA2BD5668945DBAFA7A978C8AB1EFA"><enum>(B)</enum><header>Exceptions</header><text>Such
				term does not include—</text>
										<clause id="HC5C6D9A6E34449AFA876C054BFE14F2F"><enum>(i)</enum><text>any reusable
				bag,</text>
										</clause><clause id="H4933B5EB04224B14B5C8A7DEA80E76CA"><enum>(ii)</enum><text>any bag
				manufactured for use by a customer inside a store to package bulk items such as
				fruit, vegetables, nuts, grains, candy, or small hardware items, such as nails
				and bolts,</text>
										</clause><clause id="HA74F501A72E848DC9B86A286C0397DD8"><enum>(iii)</enum><text>any bag that
				contains or wraps frozen foods, prepared foods, or baked goods when not
				prepackaged,</text>
										</clause><clause id="HF2FE628E364D45CDB5A76A360B8E2630"><enum>(iv)</enum><text>any bag
				manufactured for use by a pharmacist to contain prescription drugs, and</text>
										</clause><clause id="H9AD5074CC55C4EDEBDA7768678AD20A0"><enum>(v)</enum><text>any bag
				manufactured to be sold at retail in packages containing multiple bags intended
				for use as garbage, pet waste, or yard waste bags.</text>
										</clause></subparagraph></paragraph><paragraph id="HFAE1382C0DEF4AA2A109A1A0393443D2"><enum>(2)</enum><header>Reusable
				bag</header><text>The term <term>reusable bag</term> means a bag that
				is—</text>
									<subparagraph id="H06CB8AEE2CE843A388E74B3A1FAA59C5"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="HECEB859BE7BF421790B5E1523A40FCE5"><enum>(i)</enum><text>made of cloth or other
				machine washable fabric, or</text>
										</clause><clause id="HA5CABBAAEFD24020B5F96974C01A1330" indent="up1"><enum>(ii)</enum><text>made of a durable plastic that is
				at least 2.25 millimeters thick, and</text>
										</clause></subparagraph><subparagraph id="H7ABC1398C4494CF0A2720DB41D0ECF13"><enum>(B)</enum><text>is specifically
				designed and manufactured for multiple use.</text>
									</subparagraph></paragraph></subsection><subsection id="HA77CAB248AA84A43A0E19836B13AB25A"><enum>(e)</enum><header>Special
				rules</header>
								<paragraph id="HF6791F9DC1F6425EAE872C4B288C7863"><enum>(1)</enum><header>Pass through of
				tax</header><text>The tax imposed by subsection (a) shall be passed through to
				the customer and shall be separately stated on the receipt of sale provided to
				the customer.</text>
								</paragraph><paragraph id="HC1E29A3C1D794E65A822F02A3F6A755A"><enum>(2)</enum><header>1st retail sale;
				use treated as sale</header><text>For purposes of this section, rules similar
				to the rules of subsections (a) and (b) of section 4002 shall
				apply.</text>
								</paragraph></subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HB95334D812BD4B898631496F44B1049B"><enum>(b)</enum><header>Carryout bag
			 recycling program</header><text>Subchapter B of chapter 65 of such Code is
			 amended by adding at the end the following new section:</text>
				<quoted-block id="H78320D050C02483DAE3A92DD01AD744C" style="OLC">
					<section id="HCFF7E54BCE974B9E918D1624452D58F0"><enum>6433.</enum><header>Qualified
				disposable carryout bag recycling program</header>
						<subsection id="HE7E8053DF5234FE3AEE70214F3E5E839"><enum>(a)</enum><header>Allowance of
				credit</header><text>If—</text>
							<paragraph id="H80F0FB7DDF2F4999A8583C905741BEF3"><enum>(1)</enum><text>tax has been
				imposed under section 4056 on any disposable carryout bag,</text>
							</paragraph><paragraph id="H97122C6BE308406AA934431DC64EBEBC"><enum>(2)</enum><text>a retailer
				provides such bag to a customer in a point of sale transaction,</text>
							</paragraph><paragraph id="H4AF64964239A4228AD11A9DE14C45EDF"><enum>(3)</enum><text>such retailer has
				in effect at the time of such transaction a qualified carryout bag recycling
				program, and</text>
							</paragraph><paragraph id="H57D6156F3AAD46FF8373A69246A1C477"><enum>(4)</enum><text>such retailer has
				kept and can produce records for purposes of this section and section 4056 that
				include the total number of disposable carryout bags purchased and the amounts
				passed through to the customer for such bags pursuant to section
				4056(e),</text>
							</paragraph><continuation-text continuation-text-level="subsection">the
				Secretary shall pay (without interest) to such retailer an amount equal to the
				applicable amount for each such bag used by the retailer in connection with a
				point of sale transaction.</continuation-text></subsection><subsection id="HA351BBC3F49240BAA3CF15D0DA4D9B9C"><enum>(b)</enum><header>Applicable
				amount</header><text>For purposes of subsection (a), the applicable amount is
				$0.01.</text>
						</subsection><subsection id="HD806346499784877BA25D13303DAE370"><enum>(c)</enum><header>Qualified
				disposable carryout bag recycling program</header><text>For purposes of this
				section—</text>
							<paragraph id="HF8D0867B84A34C289533609B1F861D25"><enum>(1)</enum><header>In
				general</header><text>The term <term>qualified carryout bag recycling
				program</term> means a recycling program under which the retailer—</text>
								<subparagraph id="H1BB5415A568845818108CE7F8B37908A"><enum>(A)</enum><text>to the extent the
				retailer provides disposable carryout bags (as defined in section 4056) to
				customers—</text>
									<clause id="H710037CADA454136B66C38D1A4463187"><enum>(i)</enum><text>passes through the
				tax imposed by section 4056 and tracks the total number of bags purchased and
				amount of tax passed through pursuant to section 6433(a),</text>
									</clause><clause id="H1B485EDB9DEE417A94045C648A4CFB3C"><enum>(ii)</enum><text>has printed or
				displayed on each such bag, in a manner clearly visible to a customer, the
				words <quote>PLEASE RETURN TO A PARTICIPATING STORE FOR
				RECYCLING</quote>,</text>
									</clause><clause id="H5AB47617E7824683B66C9F428D3EB49C"><enum>(iii)</enum><text display-inline="yes-display-inline">uses bags that are 100 percent
				recyclable,</text>
									</clause><clause id="HB6CC835DDF26473DB4293DB58BDE7783"><enum>(iv)</enum><text display-inline="yes-display-inline">uses bags that are made of high-density
				polyethylene film marked with the SPI resin identification code 2 or
				low-density polyethylene film marked with the SPI resin identification code 4,
				and</text>
									</clause><clause id="H18FE3376222845C3B5BD0BFC0DF60350"><enum>(v)</enum><text display-inline="yes-display-inline">uses bags that contain a minimum of 40
				percent post-consumer recycled content,</text>
									</clause></subparagraph><subparagraph id="H05ED8AA0C3304F109F4AE0C81B138B09"><enum>(B)</enum><text>places at each
				place of business at which retail operations are conducted one or more carryout
				bag collection bins which are visible, easily accessible to the customer, and
				clearly marked as being for the purpose of collecting and recycling disposable
				carryout bags,</text>
								</subparagraph><subparagraph id="HD66E08C36EAD4925AC6D2A2FE1671318"><enum>(C)</enum><text>recycles the
				disposable carryout bags collected pursuant to subparagraph (B),</text>
								</subparagraph><subparagraph id="H8C8951E85C014BC099E0A0FD362A4EDC"><enum>(D)</enum><text>maintains for not
				less than 3 years records (which shall be available to the Secretary)
				describing the collection, transport, and recycling of disposable carryout bags
				collected,</text>
								</subparagraph><subparagraph id="H351A6C9351304967B5CDCD5A36FD9DCB"><enum>(E)</enum><text>makes available to
				customers within the retail establishment reusable bags (as defined in section
				4056(c)(2)) which may be purchased and used in lieu of using a disposable
				carryout bag, and</text>
								</subparagraph><subparagraph id="H9AE23C3EA7104ED98DCBCFF13ABFD73C"><enum>(F)</enum><text>meets the
				definition of 4056(d)(3).</text>
								</subparagraph></paragraph><paragraph commented="no" id="H2F15F415F5D942289FC05491C24DF5A2"><enum>(2)</enum><header>Recycling
				program</header><text>The term <term>recycling program</term> means a program
				that processes used materials or waste materials into new products to prevent
				waste of potentially useful materials; reduce raw materials consumption; reduce
				energy usage; reduce air, water, or other pollution; or reduce the need for
				disposal.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H87F834CE5C4E4C2D823049D4F799F03D"><enum>(c)</enum><header>Establishment of
			 trust fund</header><text>Subchapter A of chapter 98 of such Code (relating to
			 trust fund code) is amended by adding at the end the following:</text>
				<quoted-block id="H3747B822B68D49E4BD094C8F7D29FA89" style="OLC">
					<section id="H3E6EE788429C46999C5BD03AEAF4D784"><enum>9512.</enum><header>Disposable
				carryout bag trust fund</header>
						<subsection id="HBB37B3576FB74C53B0462E8ECB639C05"><enum>(a)</enum><header>Creation of
				trust fund</header><text>There is established in the Treasury of the United
				States a trust fund to be known as the <quote>Disposable carryout bag Trust
				Fund</quote> (referred to in this section as the <quote>Trust Fund</quote>),
				consisting of such amounts as may be appropriated or credited to the Trust Fund
				as provided in this section or section 9602(b).</text>
						</subsection><subsection id="HB951FB9BBEA14F40B6D49DAA423D572C"><enum>(b)</enum><header>Transfers to
				trust fund</header><text>There is hereby appropriated to the Trust Fund an
				amount equivalent to the amounts received in the Treasury pursuant to section
				4056.</text>
						</subsection><subsection id="HC401F3C92F894CB7AA0C2210814BB2FC"><enum>(c)</enum><header>Expenditures
				from trust fund</header><text>Amounts in the Trust Fund shall be available, as
				provided by appropriation Acts, for making payments under section 6433.</text>
						</subsection><subsection id="H13EC7D3739474E0FB00DF8C9D266FC7F"><enum>(d)</enum><header>Transfer to land
				and water conservation fund</header>
							<paragraph id="H685BC3E44EB847859A583CCE6F589638"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall pay from time to time from the Trust
				Fund into the land and water conservation fund provided for in title I of the
				Land and Water Conservation Fund Act of 1965 amounts (as determined by the
				Secretary) equivalent to the aggregate of the transactions on which tax is
				imposed under section 4056 aggregate amounts determined on the basis of
				$0.04.</text>
							</paragraph><paragraph id="H3B364D7ED79148D88B9586B60F7133DC"><enum>(2)</enum><header>Special rule
				regarding amounts transferred</header><text>Amounts transferred to the land and
				water conservation fund under paragraph (1) shall not be taken into account for
				purposes of determining amounts to be appropriated or credited to the fund
				under section 2(c) of the Land and Water Conservation Fund Act of 1965 (16
				U.S.C.
				460l–5(c)).</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H1B04205D86674BB2B9D5CD9BEB20AA6B"><enum>(d)</enum><header>Study</header><text>Not
			 later than December 31, 2015, the Comptroller General of the United States
			 shall conduct a study on the effectiveness of the provisions of this Act at
			 reducing the use of disposable carryout bags and encouraging recycling of such
			 bags. The report shall—</text>
				<paragraph id="H104EB6D6A95F4356AD2976162EB9F8B2"><enum>(1)</enum><text>address measures
			 that the Comptroller General determines may increase the effectiveness of such
			 provisions, including the amount of tax imposed on each disposable carryout
			 bag, and</text>
				</paragraph><paragraph id="HE177095F6C5C4FF2A345DB5136989425"><enum>(2)</enum><text>any effects, both
			 positive and negative, on any United States businesses. The Comptroller General
			 shall submit a report of such study to the Committee on Ways and Means of the
			 House of Representatives and the Committee on Finance of the Senate.</text>
				</paragraph></subsection><subsection id="H62C597AEFDD544BEA45AE4AE3DF8049F"><enum>(e)</enum><header>Clerical
			 amendments</header>
				<paragraph id="H51E34C71AB08495CA63372645E72CD57"><enum>(1)</enum><text>The table of
			 subchapters for chapter 31 of such Code is amended by inserting after the item
			 relating to adding at the end thereof the following new item:</text>

						</toc>

				</paragraph><paragraph id="H73BEFEBC669D4B2297C43413E5AC0025"><enum>(2)</enum><text display-inline="yes-display-inline">The table of sections for subchapter B of
			 chapter 65 of such Code is amended by adding at the end the following new
			 item:</text>

			 date</header><text>The amendments made by this section shall take effect on
			 January 1, 2014.</text>
