		<section id="H23223D62EA4F48BDA1629E73038B53E2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <short-title><quote>Fostering Rights through Economic
			 Engagement in Vietnam Act</quote></short-title> or
			 <short-title><quote>FREE Vietnam Act</quote></short-title>
			 .</text>
		</section><section id="H1A6CE1E0E49D406D9E1E7930D9FDA467" section-type="subsequent-section"><enum>2.</enum><header>Prohibition on
			 designation of Vietnam under title V of the Trade Act of 1974</header>
			<subsection id="HE75E96EDCB7D4A8AA0E8E6C984B2F9EB"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 502(b) of the
			 Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2462">19 U.S.C. 2462(b)</external-xref>) is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H9867D75833E440A4A49ACE3E64581030" style="OLC">
					<paragraph id="H33A4014525D643E0958BBB20D9C9B817"><enum>(3)</enum><header>Vietnam</header>
						<subparagraph id="H8A239355096A4745A19C700B08EE7D19"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">In addition to the
				countries listed in paragraph (1), Vietnam may not be designated as a
				beneficiary developing country for purposes of this title unless the President
				submits to Congress a certification described in subparagraph (B).</text>
						</subparagraph><subparagraph id="HBAE6801018D841AF9B5A04AB7BCF5BD7"><enum>(B)</enum><header>Certification</header><text>A
				certification referred to in subparagraph (A) is a certification that contains
				a determination of the President that—</text>
							<clause id="HC3865E1161044A02A83328098668DAE2"><enum>(i)</enum><text display-inline="yes-display-inline">Vietnam is not on the special watch list
				under section 110(b)(3)(A) of the Trafficking Victims Protection Act of 2000
				(<external-xref legal-doc="usc" parsable-cite="usc/22/7107">22 U.S.C. 7107(b)(3)(A)</external-xref>);</text>
							</clause><clause id="H4DA34D488A2D470D9C3F590D51A87DE1"><enum>(ii)</enum><text display-inline="yes-display-inline">the Government of Vietnam does not engage
				in pervasive violations of internationally recognized human rights, including
				freedom of speech and freedom of religion; and</text>
							</clause><clause id="H560771F7841E4128A07083A18CD510AA"><enum>(iii)</enum><text>Vietnam
				otherwise meets the requirements of this title.</text>
							</clause></subparagraph><subparagraph id="H70C132FC12E5407BBB09F4972CA35CC5"><enum>(C)</enum><header>Waiver</header><text>The
				President may waive the application of subparagraph (A) if the President
				determines and certifies to Congress that it is in the national interest of the
				United States to do
				so.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H813ED0EA2151479DB5E3F9AAA3B5B3FA"><enum>(b)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 this section applies to goods entered, or withdrawn from warehouse for
			 consumption, on or after the 15th day after the date of enactment of this
			 Act.</text>
