		<official-title>To improve the implementation and oversight for the
		  program under section 3 of the Housing and Urban Development Act of 1968 for
		  training and hiring requirements for public housing, Indian housing assistance,
		  and housing and community development programs.</official-title>

		<section id="HDACFA17D45C2413D8446ACAFDE5EA49D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Raising Employment in Affordable
			 Communities and Homes Act of 2013</short-title></quote> or the
			 <quote><short-title>REACH Act of
			 2013</short-title></quote> .</text>
		</section><section id="HF4AC310F7B8F49D19FA9BCF28D65DC11"><enum>2.</enum><header>Section 3 action
			 plans</header><text display-inline="no-display-inline">Section 3 of the Housing
			 and Urban Development Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/12/1701u">12 U.S.C. 1701u</external-xref>) is amended—</text>
			<paragraph id="H62FB42AB1BF44381AB959F321AC40F55"><enum>(1)</enum><text>by redesignating
			 subsections (e), (f), and (g) as subsections (f), (g), and (h), respectively;
			 and</text>
			</paragraph><paragraph id="H52402B2004C148D69A0433E39DFD7A83"><enum>(2)</enum><text>by inserting after
			 subsection (d) the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HEA3E6F56BF2E42F6835B6F2BB24F11C0" style="OLC">
					<subsection id="H19B26D2C578E4FD8A305FF274D35E753"><enum>(e)</enum><header>Action
				plans</header>
						<paragraph id="H38B421F1820842A9B3D0070B8D1437E7"><enum>(1)</enum><header>Public housing
				and Indian housing assistance</header>
							<subparagraph id="H4486A093BC474B18977FEB99B3047AB3"><enum>(A)</enum><header>Public housing
				agencies</header>
								<clause id="H61DC5A934A834C14B832FB3F7618133E"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">Except as provided in
				clause (ii), a public housing agency may not be provided any development
				assistance pursuant to section 5 of the United States Housing Act of 1937 (42
				U.S.C. 1437c), or assistance from the Operating Fund or Capital Fund under
				section 9 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437g">42 U.S.C. 1437g</external-xref>), for any
				fiscal year unless the agency prepares an action plan under this subsection
				that describes activities to be carried out in accordance subsections (c) and
				(d) of this section during such fiscal year.</text>
								</clause><clause id="H888F1F4A10C740BA94EAD5AD479A6901"><enum>(ii)</enum><header>Inapplicability
				to qualified public housing agencies</header><text display-inline="yes-display-inline">Clause (i) shall not apply to any qualified
				public housing agency, as such term is defined in section 5A(b)(3)(C) of the
				United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437c-1">42 U.S.C. 1437c–1(b)(3)(C)</external-xref>).</text>
								</clause></subparagraph><subparagraph id="HAAC64E3C943E4655AAC96EB8FA21E17D"><enum>(B)</enum><header>Indian
				tribes</header>
								<clause id="HCF821AE262A346DAA4593E8FF0B0C9B8"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">Except as provided in
				clause (ii), an Indian tribe or tribally designated housing entity (as such
				terms are defined in section 4 of the Native American Housing Assistance and
				Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4103">25 U.S.C. 4103</external-xref>)) may not be provided any grant
				amounts under such Act for any program year unless the tribe or entity prepares
				an action plan under this subsection that describes activities to be carried
				out in accordance subsections (c) and (d) of this section during such fiscal
				year.</text>
								</clause><clause id="H18A70144226E423BA1FBCCEC26C3079D"><enum>(ii)</enum><header>Inapplicability</header><text display-inline="yes-display-inline">Clause (i) shall not apply to any recipient
				of grant amounts under the Native American Housing Assistance and
				Self-Determination Act of 1996 for which the sum of—</text>
									<subclause id="H0B180DC7A8EB4CD19036F310C7B9BBE6"><enum>(I)</enum><text>the number of
				affordable housing dwelling units administered by such recipient and assisted
				with such grant amounts, and</text>
									</subclause><subclause id="H82086B4047D740A89234FB713B8B1C69"><enum>(II)</enum><text>the number of
				households provided tenant-based rental assistance with such grant amounts by
				such recipient,</text>
									</subclause><continuation-text continuation-text-level="clause">is 550 or
				fewer.</continuation-text></clause></subparagraph><subparagraph id="H044A0FAE12344454AED60785657405A3"><enum>(C)</enum><header>Incorporation in
				annual plan</header><text>Such an action plan for a year shall be
				incorporated—</text>
								<clause id="H0D2D3EC3DAC342978610BCA50CA2D77D"><enum>(i)</enum><text>in
				the case of a public housing agency, in the annual plan under section 5A of
				such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1437c-1">42 U.S.C. 1437c–1</external-xref>) for the agency for such fiscal year; and</text>
								</clause><clause id="H2BCDFEC50AD14432A4527FC1AE6A6A40"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of an Indian tribe or tribally
				designated housing entity, the Indian housing plan under section 102 of the
				Native American Housing Assistance and Self-Determination Act of 1996 (25
				U.S.C. 4112) for the tribe for the program year.</text>
								</clause></subparagraph><subparagraph id="HE7A2E5E862B640CCAECD56F653953281"><enum>(D)</enum><header>Retroactive
				funding</header><text display-inline="yes-display-inline">Funds may be provided
				to any public housing agency, and to any Indian tribe or tribally designated
				housing entity, retroactively upon the development and inclusion of an action
				plan under this subsection in an agency’s annual plan, or the tribe’s or
				tribally designated housing entity’s Indian housing plan, respectively.</text>
							</subparagraph></paragraph><paragraph id="HD38E9C4441E24DE39A664103F1CA71E4"><enum>(2)</enum><header>Other
				programs</header><text>The Secretary shall require that each application for
				housing and community development assistance in an amount exceeding $200,000
				shall include an action plan under this subsection that describes activities to
				be carried out in accordance subsections (c) and (d) of this section.</text>
						</paragraph><paragraph id="H20D8583B74004E3480FB486CDAFF80FA"><enum>(3)</enum><header>Content</header><text display-inline="yes-display-inline">An action plan under this subsection for a
				public housing agency, for an Indian tribe or tribally designated housing
				entity, or for a recipient of housing and community development assistance,
				shall specify the agency’s, tribe’s or entity’s, or recipient’s—</text>
							<subparagraph id="H698ADA67EA474175B95800E2EA37A53B"><enum>(A)</enum><text>intended outreach
				efforts under this section within the community;</text>
							</subparagraph><subparagraph id="H49AC4C50C44F42C5857C630BA7200BE3"><enum>(B)</enum><text>planned training
				programs;</text>
							</subparagraph><subparagraph id="HAC5529C4A1EC4AD4955FD62A24778690"><enum>(C)</enum><text>relevant
				employment opportunities under this section; and</text>
							</subparagraph><subparagraph id="H5FB0877D532D49FC99C25CB26B06BC65"><enum>(D)</enum><text>timeline for
				planned implementation under this section.</text>
							</subparagraph></paragraph><paragraph id="H8D3C0160B3B64FD893322933772F95B5"><enum>(4)</enum><header>Oversight</header><text>The
				Secretary shall take such actions as may be necessary to review the
				implementation of annual action plans under this subsection.</text>
						</paragraph><paragraph display-inline="no-display-inline" id="H81FAD55730CD4806B4C4540ECCB5150B"><enum>(5)</enum><header>Penalties</header><text>The
				Secretary may establish and impose penalties for public housing agencies,
				Indian tribes and tribally designated housing entities, recipients of housing
				and community development assistance that do not comply with their action plans
				to the satisfaction of the Secretary. Such penalties may include—</text>
							<subparagraph id="HCD9D2E2D46F946AF8189E9F669CC05E1"><enum>(A)</enum><text display-inline="yes-display-inline">in the case of a public housing agency, or
				tribe or tribally designated housing entity, withholding of assistance from the
				Department until compliance is achieved; and</text>
							</subparagraph><subparagraph id="H318F0FC839104CE29D7717B0FDB3C0E2"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of recipients of housing and
				community development assistance—</text>
								<clause id="H6A97B2289DFB4F47A595D3CCCCA075A4"><enum>(i)</enum><text>enforcement
				actions through the Departmental Enforcement Center of the Department of
				Housing and Urban Development;</text>
								</clause><clause id="H76A1CDD34F214C2293AFE402B6C5EF22"><enum>(ii)</enum><text>withholding
				future assistance payments;</text>
								</clause><clause id="H43294A81007E45E5B31E3C8D87B03453"><enum>(iii)</enum><text>a flag in the
				Active Partners Performance System; and</text>
								</clause><clause id="HA356E05B9B074F408989EDCBF4E1C0F9"><enum>(iv)</enum><text>rejection of any
				further applications for assistance from the Department until compliance is
				achieved.</text>
								</clause></subparagraph></paragraph><paragraph id="H0D87CF46E4774553BBE6FB2012231101"><enum>(6)</enum><header>Authorization of
				appropriation</header><text>There are authorized to be appropriated such sums
				as may be necessary to carry out this
				subsection.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H0715CB002EF94B4EBE85740B3D08B5A3"><enum>3.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">The amendment under
			 section 2 shall take effect upon the expiration of the 90-day period beginning
			 on the date of the enactment of this Act.</text>
