Public Housing Disaster Preparedness Act of
2013
.
2.Disaster Response
and Relief PlanThe United
States Housing Act of 1937 (42 U.S.C. 1437 et seq.) is amended by adding at the
end the following new title:
<enum>V</enum><header>Disaster
Preparedness</header>
<section id="H2E85C508710B45EA9530EF6A13587110"><enum>501.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
<paragraph id="H0F1A06E880C64DA1B2E0E4AAE5B19554"><enum>(1)</enum><header>Covered public
housing agency</header><text>The term <term>covered public housing
agency</term> means a public housing agency that owns, operates, or assists no
less than 500 dwelling units in public housing projects.</text>
</paragraph><paragraph id="HD7771343995A4748AA7E093177FCE949"><enum>(2)</enum><header>Disaster</header><text display-inline="yes-display-inline">The term <term>disaster</term> has the same
meaning given the term <term>major disaster</term> in section 102(2) of the
Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C.
5122(2)) and includes any natural catastrophe (including any hurricane,
tornado, storm, high water, wind driven water, tidal wave, tsunami, earthquake,
volcanic eruption, landslide, mudslide, snowstorm, or drought), or, regardless
of cause, any fire, flood, or explosion, which in the determination of a
relevant State or local official causes damage of sufficient severity and
magnitude to warrant disaster assistance in alleviating the damage, loss,
hardship, or suffering caused thereby.</text>
</paragraph><paragraph id="HC1FA8D54B7B342C6A57553A6FFCC2D81"><enum>(3)</enum><header>Secretary</header><text>The
term <term>Secretary</term> means the Secretary of Housing and Urban
Development.</text>
</paragraph></section><section id="HD15159CA6FDF4444988F038CF74E0131"><enum>502.</enum><header>Requirement of
disaster response and relief plan</header>
<subsection id="H161DE6C86B834578A8A98FA9A1390FFF"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">The Secretary shall
require each covered public housing agency to develop a disaster response and
relief plan in accordance with the provisions of this title to provide—</text>
<paragraph id="HC70E70377F284CC7989060AA185CD50F"><enum>(1)</enum><text>guidance
for—</text>
<subparagraph id="HA52CBD5A96A64C52B33ECA77220D9F2A"><enum>(A)</enum><text>public housing
agencies and staff;</text>
</subparagraph><subparagraph id="H46D421AC8E9941ADA180D7855D5FBA48"><enum>(B)</enum><text display-inline="yes-display-inline">residents of dwelling units in public
housing;</text>
</subparagraph><subparagraph id="H68AC7BEC01AF42519F27ED70ABAB32C0"><enum>(C)</enum><text>relevant Federal,
State, and local agencies and officials; and</text>
</subparagraph><subparagraph id="H3E2559D0064745DBBFED4E432728B6C8"><enum>(D)</enum><text>community-based
organizations; and</text>
</subparagraph></paragraph><paragraph id="H9935D34806EB45AE811C0B2717A9A546"><enum>(2)</enum><text>comprehensive
information regarding pre-disaster, disaster impact, and post-disaster
policies, standards, procedures, and protocols.</text>
</paragraph></subsection><subsection id="H263B94F97B154594A9A9E68AB9482415"><enum>(b)</enum><header>Submission with
annual and 5-year plans</header><text display-inline="yes-display-inline">A
disaster response and relief plan developed under this title shall be included
in the annual and 5-year plans required to be submitted under section 5A of
this Act.</text>
</subsection><subsection id="HC6E6A3BC514C48218E33BD13B6717578"><enum>(c)</enum><header>HUD
approval</header>
<paragraph id="H05C3E35EFD4A4C6A89140301796015D9"><enum>(1)</enum><header>In
general</header><text>A disaster response and relief plan developed under this
title shall be submitted to the Secretary for approval before implementation of
such plan.</text>
</paragraph><paragraph id="H1ED81C8B50B74D9E8BE3184012520CD9"><enum>(2)</enum><header>Response</header><text>The
Secretary shall have 60 days to respond to each submission made pursuant to
paragraph (1).</text>
</paragraph></subsection><subsection id="HD1E85055A4444E65A934D00E947ED70D"><enum>(d)</enum><header>Feedback</header><text>A
covered public housing agency shall seek input from resident or tenant
associations and advocacy groups during the development of the disaster relief
plan described in subsection (a).</text>
</subsection><subsection id="H23B18718EF3643F595E6092E73E1B14C"><enum>(e)</enum><header>Rule of
construction</header><text display-inline="yes-display-inline">Nothing in this
title prohibits a covered public housing agency from developing and submitting
to the Secretary multiple plans tailored to address specific disasters.</text>
</subsection></section><section id="H561D7C13C28F49A38A9B4AE1A824EE62"><enum>503.</enum><header>Establishing
communication and support</header>
<subsection id="H41EFAB6919574DA5A7EBC592F2A3201F"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">A covered public
housing agency shall include in the disaster response and relief plan developed
under this title protocols for receiving, analyzing, and disseminating
information regarding disasters before, during, and after such disaster.</text>
</subsection><subsection id="HB252D91FE861415FBC569AB78836153F"><enum>(b)</enum><header>Coordination and
dissemination of information</header><text display-inline="yes-display-inline">A covered public housing agency
shall—</text>
<paragraph id="H6572AD31CEE74F79AEF39B26D5A30D68"><enum>(1)</enum><text>provide structure
and organization within such agency by establishing a clearly defined chain of
command with set responsibilities for each individual or group of individuals
involved; and</text>
</paragraph><paragraph id="HB48B6715714F4ED5A143669620124F6E"><enum>(2)</enum><text>identify 1 or more
individuals or groups of individuals at each agency and each building that is
owned, operated, or assisted by each agency that are responsible for—</text>
<subparagraph id="H632CEB6A66B343B3A3523DAFEF523113"><enum>(A)</enum><text>coordinating
disaster relief efforts; and</text>
</subparagraph><subparagraph id="H413443A9C853419F953FA4B7575D064B"><enum>(B)</enum><text display-inline="yes-display-inline">disseminating information regarding
emergency protocols under the disaster response and relief plan developed under
this title to each resident of a dwelling unit in public housing owned,
operated, or assisted by such agency and other stakeholder groups, including
community-based organizations that may provide assistance to such resident
following a disaster.</text>
</subparagraph></paragraph></subsection></section><section id="HF1C206EA92B5442188E4BA3F299A8C2E"><enum>504.</enum><header>Resident
preparedness</header>
<subsection id="H3F3163BFB6CF4D6EAB9C79555F9D9C09"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">A covered public
housing agency shall disseminate information about the emergency protocols
established under the disaster response and relief plan developed under this
title to each resident of a dwelling unit in public housing owned, operated, or
assisted by such agency—</text>
<paragraph id="H3D70A20EAB8F473689AC8BEB86E73E98"><enum>(1)</enum><text display-inline="yes-display-inline">prior to such resident moving into their
dwelling unit;</text>
</paragraph><paragraph id="HA67754D00D5B4E31AEE3C43C230BB0AF"><enum>(2)</enum><text>annually;
and</text>
</paragraph><paragraph id="H3576FFA9DC964A3C80F7AB93EE8209AA"><enum>(3)</enum><text>if possible, prior
to an impending disaster.</text>
</paragraph></subsection><subsection id="HE56F152D92914DFAB8267C08E2A21502"><enum>(b)</enum><header>Information</header><text>Such
information disseminated under subsection (a) shall include—</text>
<paragraph id="H5A2FBE23F59C4F73BA4FE7D43AFF64A8"><enum>(1)</enum><text>information on how
to prepare for a disaster;</text>
</paragraph><paragraph id="H75180EA824614225B38F9E65AD453D58"><enum>(2)</enum><text>if necessary,
mandatory evacuation protocols;</text>
</paragraph><paragraph id="H5F40B1C2C7414DEF8E758D11AC3AEBD2"><enum>(3)</enum><text>a list of covered
public housing agency and resident rights and responsibilities, as applicable
under Federal, State, and local law and regulations, and covered public housing
agency rules and emergency protocols before, during, and after a disaster as
they relate to—</text>
<subparagraph id="HEEE474229EC04A0AB5038C6AEBB71390"><enum>(A)</enum><text>disaster
preparedness;</text>
</subparagraph><subparagraph id="H4D5F49998D5C4A3D9D8A801F27D46297"><enum>(B)</enum><text>evacuations;</text>
</subparagraph><subparagraph id="H018D7645E0434394B219F63792A3189F"><enum>(C)</enum><text>disaster
relief;</text>
</subparagraph><subparagraph id="H896334FF29BF4A0082D4CC9BADB70EE8"><enum>(D)</enum><text>basic human needs
assistance;</text>
</subparagraph><subparagraph id="HBF9354D2C4714F4C8A642735631DF24D"><enum>(E)</enum><text>utility
restoration;</text>
</subparagraph><subparagraph id="HC058398613D64BAAA4AEABB3D1D7D3F2"><enum>(F)</enum><text>resident
relocation;</text>
</subparagraph><subparagraph id="H0B2BED0316F341888E4C648E3AF24838"><enum>(G)</enum><text>supportive
services;</text>
</subparagraph><subparagraph id="H2B7697EC3C96401DBD35DBA3E6B41B1C"><enum>(H)</enum><text>payment of rent
and eligible rent exemptions; and</text>
</subparagraph><subparagraph id="H4F5F3DAC6AE24B999488B921095DDB63"><enum>(I)</enum><text>assessing and
repairing physical damage to public housing buildings; and</text>
</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HF6C2576649F847D2AA203807AE2A859E"><enum>(4)</enum><text>any other items
that the Secretary may require through regulations prescribed pursuant to this
title.</text>
</paragraph></subsection><subsection id="HF8C94A0033C94A50923C6275FBD6E541"><enum>(c)</enum><header>Method of
dissemination</header><text>The information described under subsection
(b)—</text>
<paragraph id="H0C071BD69845487F804BEEA0142DB050"><enum>(1)</enum><text>shall be
disseminated by—</text>
<subparagraph id="HA3F2C9F9BAAF4B8B8E17D9A6CC6681E5"><enum>(A)</enum><text display-inline="yes-display-inline">giving notices and flyers to each resident
of a dwelling unit in public housing and posted in high-traffic areas;</text>
</subparagraph><subparagraph id="H867125D8E3574820BC95AC8C4E1C9895"><enum>(B)</enum><text display-inline="yes-display-inline">having an automated system to contact
residents;</text>
</subparagraph><subparagraph id="H0017DB77BCCF4A7DBC04523444B4D5E4"><enum>(C)</enum><text>posting on the
official Web site of the covered public housing agency with links to the
appropriate Web pages regarding the impending disaster; and</text>
</subparagraph><subparagraph id="HFBDF5622077C4DBA8891B44C92EE1AB7"><enum>(D)</enum><text display-inline="yes-display-inline">any other means the Secretary may require
through regulations prescribed pursuant to this title; and</text>
</subparagraph></paragraph><paragraph id="HC55FB8B34C9241FDA80023746298F7DE"><enum>(2)</enum><text>may be
disseminated by—</text>
<subparagraph id="H019EA887208243B596AFF2EA736638A9"><enum>(A)</enum><text>visiting
door-to-door to each dwelling unit and providing such information to each
resident;</text>
</subparagraph><subparagraph id="HD40417F3861A40A2909343A4BA6A5FC3"><enum>(B)</enum><text>phone trees;
and</text>
</subparagraph><subparagraph id="H68D860F61CB0480B970D13A8B46D59B6"><enum>(C)</enum><text>toll-free numbers
for residents to call.</text>
</subparagraph></paragraph></subsection><subsection id="HBBCA19ACDB6648F1B959158B663B22F6"><enum>(d)</enum><header>Accessibility of
information</header><text>The information described under this section shall be
accessible to individuals with limited English proficiency.</text>
</subsection><subsection id="HB3D73EE67D334141BE8227E8627279F8"><enum>(e)</enum><header>Inclusion of
residents</header><text display-inline="yes-display-inline">A covered public
housing agency is strongly encouraged to include residents of public housing
owned, operated, or assisted by such agency in the execution of the disaster
response and relief plan developed under this title.</text>
</subsection></section><section id="HD359ECA23AE34B1C8433D94EDE125096"><enum>505.</enum><header>Immediate
disaster response</header><text display-inline="no-display-inline">A disaster
response and relief plan developed under this title shall include detailed
information on how the authorities plan to allocate and station staff before,
during, and after a disaster. The plan should reflect reasonable emergency work
hours and ensure staff is on call and prepared for a disaster.</text>
</section><section id="HF860EFC7FCA94BE2B9303B46415568B8"><enum>506.</enum><header>Protecting
special needs of residents</header>
<subsection id="HC1673CAA002A4093AA56FCD393BCC420"><enum>(a)</enum><header>List</header><text display-inline="yes-display-inline">A covered public housing agency shall
maintain a list, updated annually, of the members of each family residing in a
dwelling unit in public housing owned, operated, or assisted by such agency,
and identify the following (as such information is provided by
residents):</text>
<paragraph id="HA442B6DB8BF04EB9B458F7BBC5D674F7"><enum>(1)</enum><text display-inline="yes-display-inline">The special needs of certain residents
because of a disability, physical or mobility impairment, or medical
condition.</text>
</paragraph><paragraph id="H5E3C2B095D904DD293BC3A464EDCE342"><enum>(2)</enum><text>The units in which
residents who are elderly reside.</text>
</paragraph><paragraph id="H569370DAE3B24126B67909A5D2EE14FF"><enum>(3)</enum><text>The units in which
residents who have limited English proficiency reside and the primary languages
of such residents.</text>
</paragraph></subsection><subsection id="H30A678BFB7134F9C9ABF28EF1E493D3D"><enum>(b)</enum><header>Dissemination of
list</header><text>The list described in subsection (a) shall be provided to
the individual or individuals identified under section 503(b) and other
relevant staff of the covered public housing agency.</text>
</subsection><subsection id="HB3F096DF62484CDDBB40CA28BE2F9121"><enum>(c)</enum><header>Special
populations</header>
<paragraph id="H7FD16DD6D54C45CD9310D91E3E64BDC7"><enum>(1)</enum><header>In
general</header><text display-inline="yes-display-inline">A covered public
housing agency shall analyze the challenges of providing disaster relief
assistance with respect to the health and medical needs to certain populations
of residents of a dwelling unit in public housing owned, operated, or assisted
by such agency and include such analysis in the disaster response and relief
plan developed under this title.</text>
</paragraph><paragraph id="HBF0989EC806C42539F69B36A5C011509"><enum>(2)</enum><header>Populations</header><text>The
populations analyzed under paragraph (1) include—</text>
<subparagraph id="HE1F466265037497BB86AA066756A9C2C"><enum>(A)</enum><text>residents of a
dwelling unit in public housing who—</text>
<clause id="H9988DCF884E54E61BF03BBC10E5312E4"><enum>(i)</enum><text>are
disabled;</text>
</clause><clause id="H50CC2C306D104174B25C57A9B9427B06"><enum>(ii)</enum><text>require
life-support equipment or have other severe medical conditions;</text>
</clause><clause id="H769C8891C1174E7EA4F57C8309097524"><enum>(iii)</enum><text>are elderly; or</text>
</clause><clause id="H9B521B38E8E143EE9EF195C027D1193F"><enum>(iv)</enum><text>have a physical
or mobility impairment; and</text>
</clause></subparagraph><subparagraph id="HFF8BC936267B40A88187F9839B06F737"><enum>(B)</enum><text>other populations
of residents identified by the Secretary through regulations prescribed
pursuant to this title.</text>
</subparagraph></paragraph></subsection></section><section id="H2DD28BFC17374548B147756367E757E1"><enum>507.</enum><header>Safe evacuation
of residents and staff</header>
<subsection id="H06A6DE71FC0D43C89D1F2A41AB6FE8CA"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">A covered public
housing agency shall include in the disaster response and relief plan developed
under this title information on evacuating residents of a dwelling unit in
public housing owned, operated, or assisted by, and staff of, such
agency.</text>
</subsection><subsection id="H36D5F7FBF11B4D7489536B5596786CD5"><enum>(b)</enum><header>Required
information</header><text>The information required under subsection (a) shall
include the following:</text>
<paragraph id="HAE623BD014784408A1CB569FF2A547AC"><enum>(1)</enum><text display-inline="yes-display-inline">Detailed protocols regarding evacuating
residents and staff of a covered public housing agency safely and orderly.</text>
</paragraph><paragraph id="H897E8CE8E0DA40868766635895F37AF8"><enum>(2)</enum><text>Transportation
options, in addition to public transportation which may be out of service or
delayed, for transporting residents and staff to safe locations.</text>
</paragraph><paragraph id="H283F09C644F243ECA9E5BD78AB71F914"><enum>(3)</enum><text>A list of
pre-approved public housing agency safe locations for residents and
staff.</text>
</paragraph><paragraph id="HEC8FA6D1DD934055B59AAC4199D91614"><enum>(4)</enum><text>A list of
pre-approved public housing agency fall-back locations for staff to monitor a
disaster safely and launch response efforts following the conclusion of such a
disaster.</text>
</paragraph><paragraph id="H537588A8A76540A0BA35CF2BEB5FB78F"><enum>(5)</enum><text>Options for oral
and written translation services for residents with limited English
proficiency.</text>
</paragraph><paragraph id="HBCED5BFA13E04C68B7C05DAEBD8B69E5"><enum>(6)</enum><text>Any other
information the Secretary may require through regulations prescribed pursuant
to this title.</text>
</paragraph></subsection></section><section id="H93AAF7AC3D89413AB62FC674609CAFA5"><enum>508.</enum><header>Supporting
short- and long-term relocation of residents</header>
<subsection id="H1EA382C9A2074CDDA95BAB264424FE9E"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">A covered public
housing agency shall include in the disaster response and relief plan developed
under this title protocols for relocating residents in the event that the unit
in which such resident resides becomes uninhabitable.</text>
</subsection><subsection id="HE882F827C1774A08B4B7B15FCFC23B24"><enum>(b)</enum><header>Required
information</header><text>The protocols described in subsection (a) shall
include short-term, long-term, and permanent relocation possibilities.</text>
</subsection></section><section id="HD10E2FDF0A424B40B9A0A36BE9A14927"><enum>509.</enum><header>Providing
relief to other victims</header><text display-inline="no-display-inline">A
covered public housing agency shall include in the disaster response and relief
plan developed under this title protocols for temporarily renting vacant units
of public housing to local victims of a disaster who are not residents of
public housing.</text>
</section><section id="H0B050DA2E8874C9BA8A400DC80CA0AD7"><enum>510.</enum><header>Protecting
tenants from eviction</header>
<subsection id="H67C18379F03A432D98AE60548E22EC87"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">No covered public
housing agency shall begin, continue, or complete an eviction of a resident of
a dwelling unit in public housing owned, operated, or assisted by such agency
during the moratorium period defined in subsection (c).</text>
</subsection><subsection id="H4DEF18BDFEB94265BEC7567B453F8695"><enum>(b)</enum><header>Exception</header><text>Subsection
(a) shall not apply if an eviction of a resident is for—</text>
<paragraph id="H9A5FA686314F4105A7355F91DD2E38D9"><enum>(1)</enum><text>a drug-related or
violent criminal activity;</text>
</paragraph><paragraph id="H1A7B52FAC9FD491D9B3BB3087C5F4582"><enum>(2)</enum><text>a felony charge;
or</text>
</paragraph><paragraph id="HBBA85DE6002349AD9D2A71E82ECDE331"><enum>(3)</enum><text display-inline="yes-display-inline">a sex crime or any violation of Federal or
State law related to such resident’s status as a sex offender.</text>
</paragraph></subsection><subsection id="H923636E8028F41FAB740385780E39A4E"><enum>(c)</enum><header>Moratorium
period</header><text display-inline="yes-display-inline">The term
<term>moratorium period</term> means the time period beginning on the date that
a disaster is declared by applicable Federal, State, or local officials and
ending on the date that the Secretary determines that a covered public housing
agency’s disaster relief efforts have concluded.</text>
</subsection></section><section id="HBBCDA456E75443198410FE62D03D170C"><enum>511.</enum><header>Rental payment
fairness</header><text display-inline="no-display-inline">A covered public
housing agency shall prorate, for each month, the rental amount, and, if
applicable, the tenant-paid utility amount of a dwelling unit assisted under
this Act for each family residing in a dwelling unit in public housing owned,
assisted, or operated by such agency in accordance with the rent abatement
policies under the agency’s rules, the property lease executed between the
resident and the agency, or any relevant Federal, State, or local laws or
regulations.</text>
</section><section id="HE2BE53FA7CFF4554AFBD16F3ADD04E82"><enum>512.</enum><header>Ensuring
residents receive basic human needs and assistance</header>
<subsection id="HD9DA3B6470CC423393FDBFD330B3F0DF"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">Not later than 24
hours after the conclusion of a disaster, in such manner as the Secretary may
require, a covered public housing agency shall provide to each resident of a
dwelling unit in public housing owned, operated, or assisted by such agency the
following:</text>
<paragraph id="H31D2698F7AE5433997ECFADC1AD6B57F"><enum>(1)</enum><text>Contact
information for Federal, State, local agencies, or other local organizations
that can provide supportive services and disaster relief support and
assistance, including—</text>
<subparagraph id="HBFFA92A6C5044716903D11E665112B4B"><enum>(A)</enum><text>potable
water;</text>
</subparagraph><subparagraph id="H2D18F8F892F444308B144D232EC6DB15"><enum>(B)</enum><text>food;</text>
</subparagraph><subparagraph id="H36AFB68D09184551863FFB92E16E4926"><enum>(C)</enum><text>shelter;</text>
</subparagraph><subparagraph id="HC7781B3885A84AF688A063C24623FC45"><enum>(D)</enum><text>first aid;
and</text>
</subparagraph><subparagraph id="HF3EFA40F5B414C4C9BC8A5A07174DB1B"><enum>(E)</enum><text display-inline="yes-display-inline">any other support and assistance that the
Secretary may identify through regulations prescribed pursuant to this title.</text>
</subparagraph></paragraph><paragraph id="H5DD200F1F1E2425BBF997EEB996540FA"><enum>(2)</enum><text display-inline="yes-display-inline">Specific information about household and
individual assistance available from—</text>
<subparagraph id="HA9FE8F1E2EFE45D98C3707A05BB3F777"><enum>(A)</enum><text>the Federal
Emergency Management Agency;</text>
</subparagraph><subparagraph id="HD946EDE8CA3B462A80A213B5FA07CD41"><enum>(B)</enum><text>any other Federal,
State, and local emergency relief agencies; and</text>
</subparagraph><subparagraph id="H6499E8717F024A6E8BDF2B0476CA6569"><enum>(C)</enum><text>local
organizations and public housing agency partners.</text>
</subparagraph></paragraph><paragraph id="HBBB4AA4F16724B4282EF701FB4177FC7"><enum>(3)</enum><text>Information
regarding the personal property damage claims process of a covered public
housing agency, including—</text>
<subparagraph id="H5071ED713C8C48FE942B33D7D57163A1"><enum>(A)</enum><text>how to file a
claim;</text>
</subparagraph><subparagraph id="H8F3B41AE2FAF4A619FF93C56E203432D"><enum>(B)</enum><text>eligibility
guidelines for filing a claim;</text>
</subparagraph><subparagraph id="HA977719330CA4D838E37D108B526B40B"><enum>(C)</enum><text>coverage of the
policy; and</text>
</subparagraph><subparagraph id="HC6406E8DD85941B4B57B7A64B550E125"><enum>(D)</enum><text display-inline="yes-display-inline">the time period to file and process
claims.</text>
</subparagraph></paragraph></subsection><subsection id="HC18A5A20C3A94F1CB6F0FB62DF31429B"><enum>(b)</enum><header>Creating
partnerships</header>
<paragraph id="HB6A771D950DC48DD989D5EA9FCBA8BB1"><enum>(1)</enum><header>In
general</header><text display-inline="yes-display-inline">A covered public
housing agency shall create partnerships to provide basic human needs,
additional supportive services, and security before, during, and after the
conclusion of a disaster for each resident of a dwelling unit in public housing
owned, assisted, or operated by such agency.</text>
</paragraph><paragraph id="H5A0780C002684A30B9BD28378F58812F"><enum>(2)</enum><header>Potential
partners</header><text display-inline="yes-display-inline">A covered public
housing agency may establish partnerships with—</text>
<subparagraph id="H18E934964347490D84835DC2CB518780"><enum>(A)</enum><text>the Federal
Emergency Management Agency;</text>
</subparagraph><subparagraph id="H8A1C4B4AE6B944BFB8A01F06FBDD21E9"><enum>(B)</enum><text>State and local
governments;</text>
</subparagraph><subparagraph id="H2CA66EDDE02A4ABAA2D32BABAD0183C9"><enum>(C)</enum><text>local law
enforcement;</text>
</subparagraph><subparagraph id="H8D516166C5EE4AF6B5BD3D95BB21FD35"><enum>(D)</enum><text>community-based
organizations;</text>
</subparagraph><subparagraph id="H296177F7EBDE4449AFD0C28F264A7E62"><enum>(E)</enum><text display-inline="yes-display-inline">resident or tenant associations;</text>
</subparagraph><subparagraph id="H5639237A4B9641949B80BB5456849ED1"><enum>(F)</enum><text>health care
professionals;</text>
</subparagraph><subparagraph id="H6E1EA06925464E5B89B3F5B8D179C114"><enum>(G)</enum><text>other individuals
or organizations that provide volunteer services; or</text>
</subparagraph><subparagraph id="HD374B643CFEF43CEBFEBB5E3A6CBF987"><enum>(H)</enum><text>any other entity
that the Secretary may include through regulations prescribed pursuant to this
title.</text>
</subparagraph></paragraph></subsection><subsection id="H09A4B567C3DD43F3B698A3D988271AEB"><enum>(c)</enum><header>Rule of
construction</header><text display-inline="yes-display-inline">Nothing in this
section shall be construed as to prohibit or restrict any entity from providing
disaster relief to any resident of a dwelling unit in public housing.</text>
</subsection></section><section id="HE3B8729ED3114D578E1F4BD606AC74BD"><enum>513.</enum><header>Protection and
restoration of public housing buildings</header>
<subsection id="HC6233A67A3DE4E44A00856509E2B1F75"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">The disaster response
and relief plan developed under this title shall include protocols for
inspecting, evaluating, and repairing damage to physical assets of a covered
public housing agency.</text>
</subsection><subsection id="HAEB34D9B67AA47B2BE69D0CAC8F74381"><enum>(b)</enum><header>Protocols for
protection and restoration of public housing</header><text>Such protocols shall
include the following:</text>
<paragraph id="H03DAF003926E47D682BF5C7BF2B11D44"><enum>(1)</enum><text>Maintaining a list
of licensed contractors to assess damage to physical assets and provide
short-term repair and restoration efforts.</text>
</paragraph><paragraph id="H03D08EACD66145A5B06B80C5F407BA1E"><enum>(2)</enum><text display-inline="yes-display-inline">If possible, executing supportive services
contracts in advance of disasters to obtain faster response times.</text>
</paragraph><paragraph id="HDEE44988B3D64A4A9787F7E989CCD243"><enum>(3)</enum><text>Deploying
contractors immediately following the conclusion of a disaster to assess and
repair immediate priorities, including—</text>
<subparagraph id="HF4900483596F4870B7D6C1B8702A22C9"><enum>(A)</enum><text>restoring
electric, gas, water, VAC., sewage, and elevator service as soon as
possible;</text>
</subparagraph><subparagraph id="HF1CE7DEE327546B7BFB5CC87CBEBFC72"><enum>(B)</enum><text>remediating
exigent health and safety hazards, such as mold and mildew removal and pest
control; and</text>
</subparagraph><subparagraph id="HAF709979462D4E8792C3F799B9CCB321"><enum>(C)</enum><text display-inline="yes-display-inline">other items as described by the Secretary
through regulations prescribed pursuant to this title.</text>
</subparagraph></paragraph><paragraph id="H5FD7C53F45B14DF59F70DD2D23055356"><enum>(4)</enum><text>Not later than 14
days after the conclusion of a disaster, conducting follow-up inspections to
determine short- and long-term repair and restoration priorities.</text>
</paragraph><paragraph id="HEB779CAA1FCC431FB972983DBC56D498"><enum>(5)</enum><text display-inline="yes-display-inline">Establishing short-term priorities for the
repair and restoration of public housing projects, including—</text>
<subparagraph display-inline="no-display-inline" id="HE90092ABB3F44D7BA718425C677766FA"><enum>(A)</enum><text>air quality
testing to address disaster related health and safety hazards;</text>
</subparagraph><subparagraph id="H9938AEB6CD3F4A58A87F83ACCE567D36"><enum>(B)</enum><text>continuing to
maintain building systems and utilities; and</text>
</subparagraph><subparagraph id="HF93774FE116C42399F2B05789CCBCD3C"><enum>(C)</enum><text>other items as
described by the Secretary through regulations prescribed pursuant to this
title.</text>
</subparagraph></paragraph><paragraph id="H802046DEB22F4953AA51E71658511EC7"><enum>(6)</enum><text>Establishing
long-term priorities for the repair and restoration of public housing projects,
including—</text>
<subparagraph id="HA8B227E77F3C48A5BB380D58AFF9F86A"><enum>(A)</enum><text>developing a
revised physical capital needs assessment to determine necessary repairs and
rehabilitation of a public housing project;</text>
</subparagraph><subparagraph id="H40C9AD1298554967B34F94B7CE05F3C8"><enum>(B)</enum><text>rehabilitating
building structures;</text>
</subparagraph><subparagraph id="H82E3139421584A5988E2CD6C9F9086D6"><enum>(C)</enum><text display-inline="yes-display-inline">repairing and rehabilitating superficial
damages to building structures and dwelling units;</text>
</subparagraph><subparagraph id="HFC06F2D3357741F59B50ED68BAEB1E3A"><enum>(D)</enum><text>mitigating the
impact of a disaster that may occur in the future by upgrading or replacing
building systems or strengthening the structure of the building; and</text>
</subparagraph><subparagraph id="HE2DDFA36314F4AF6959E0069A2F19446"><enum>(E)</enum><text>other items as
described by the Secretary through regulations prescribed pursuant to this
title.</text>
</subparagraph></paragraph></subsection></section><section id="H5215B846DC9940AC8E3BC9525EF21DF4"><enum>514.</enum><header>Emergency
supplies and equipment</header>
<subsection id="H7DAD92F74CF3447F9450BCC29C076BAD"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">The disaster response
and relief plan developed under this title shall include a detailed list
describing the condition and location of emergency supplies and equipment,
including—</text>
<paragraph id="HE6E0D734CB8A45BD945D66322155CC06"><enum>(1)</enum><text display-inline="yes-display-inline">electrical generators and the types of
public housing building systems they are compatible with;</text>
</paragraph><paragraph id="H55A46BE33EC34387AC8AD5F9C2E2AB68"><enum>(2)</enum><text>mobile boilers and
the types of public housing building systems they are compatible with;</text>
</paragraph><paragraph id="H180E2D1E4CC74C3F9299A2686E0E247F"><enum>(3)</enum><text>heaters and
fans;</text>
</paragraph><paragraph id="H940A73AB87F2498A93BCF4E095DBD78E"><enum>(4)</enum><text>water
pumps;</text>
</paragraph><paragraph id="H55C17B88C6E44B15AE1D97A2A8311D91"><enum>(5)</enum><text display-inline="yes-display-inline">phones, radios, cameras, and televisions
(and power sources, if necessary, for these items);</text>
</paragraph><paragraph id="H2B3FC3AAE2AE49D99B00A84E7161A45C"><enum>(6)</enum><text>potable water,
food, and emergency supply kits;</text>
</paragraph><paragraph id="H4D330401C4CC4B219F89346358616EF0"><enum>(7)</enum><text>property
vehicles;</text>
</paragraph><paragraph id="HAA35E3B758E3423E8466B0FD3132E133"><enum>(8)</enum><text display-inline="yes-display-inline">backed-up critical computer files (such as
contact information for residents and staff, rent and income calculations, and
other information);</text>
</paragraph><paragraph id="H3605C703FD4F4AD4BD60CE54E9B74BB8"><enum>(9)</enum><text>first aid kits;
and</text>
</paragraph><paragraph id="HB33EA8666547404181DA1C997F109C69"><enum>(10)</enum><text display-inline="yes-display-inline">any other supplies and equipment that the
Secretary may describe through regulations prescribed pursuant to this
title.</text>
</paragraph></subsection><subsection id="HA7B7682548934A51980381E5E55083CD"><enum>(b)</enum><header>Annual
review</header><text>A covered public housing agency shall check annually to
ensure that the supplies and equipment described in subsection (a), or through
regulations prescribed pursuant to such subsection, are in working order. Such
agency shall immediately replace or repair such supplies and equipment that are
not in working order and update the list described in subsection (a).</text>
</subsection><subsection id="H86656C587DDB4C2094EF9B70D3FF29AD"><enum>(c)</enum><header>Contracts</header><text>A
public housing agency shall enter into standby contracts for critical
equipment, such as pumps, boilers, and generators, in order to expedite the
restoration of necessary utilities.</text>
</subsection></section><section id="H9FF3AACEA5A14FD9BEF3839397D6DF9F"><enum>515.</enum><header>Sources of
assistance</header><text display-inline="no-display-inline">The disaster
response and relief plan developed under this title shall include—</text>
<paragraph id="H0F40DD0FADA3419EB4DC1471F0C06690"><enum>(1)</enum><text>information
regarding Federal, State, and local grant and loan programs and other resources
related to disaster relief available to a covered public housing agency;</text>
</paragraph><paragraph id="H2064055654D84C299C729E498C44902B"><enum>(2)</enum><text>how to apply for
such resources; and</text>
</paragraph><paragraph id="HB8F1ACF26FF54FD396BAA7B3DE23DE56"><enum>(3)</enum><text>information
regarding the insurance policy of the covered public housing agency and how to
file a claim.</text>
</paragraph></section><section id="H8FFB72816DE84346B10E764EF0333EDE"><enum>516.</enum><header>Proper
implementation of plan</header><text display-inline="no-display-inline">The
disaster response and relief plan developed under this title shall include, and
a covered public housing agency shall have available on-site at each public
housing project, a step-by-step checklist to implement such plan to be utilized
by relevant staff of the agency. Such checklist shall emphasize disaster relief
on the property level.</text>
</section><section id="HB8202EEB1E00497E9C980341046CAEF6"><enum>517.</enum><header>Emergency
disaster training</header>
<subsection id="H383C77DEE3954D6A81ECE8D14225547F"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">The disaster response
and relief plan developed under this title shall include training requirements
such as—</text>
<paragraph id="H156DB6FB72F34C62AD9E26C749A33CF5"><enum>(1)</enum><text display-inline="yes-display-inline">hosting annual workshops to train employees
of public housing agencies on the disaster response and relief plans of such
agencies and the proper implementation of such plans;</text>
</paragraph><paragraph id="HF9CB2BBC11014B3CA236D57AF06304EA"><enum>(2)</enum><text display-inline="yes-display-inline">offering no less than 3 events, such as
workshops, seminars (held-in person or over the Internet), or conference calls,
to provide information to residents on—</text>
<subparagraph id="H8C7BC9E5B1DE4279BB3B1ACDBE79D3EC"><enum>(A)</enum><text>what to do during
a disaster;</text>
</subparagraph><subparagraph id="H61EAA316F3E4450EA423D1E87AB7853D"><enum>(B)</enum><text>covered public
housing agency and resident rights and responsibilities during a disaster; and</text>
</subparagraph><subparagraph id="H0CD6F85347AE489994DB9488EDD3462D"><enum>(C)</enum><text display-inline="yes-display-inline">basic first aid and CPR training; and</text>
</subparagraph></paragraph><paragraph id="HD993860AE7324060B463D5F3F31983ED"><enum>(3)</enum><text>conducting annual
evacuation and emergency drills for disasters at public housing
projects.</text>
</paragraph></subsection><subsection id="H96B6A39F321C47438F1731999B29C482"><enum>(b)</enum><header>Staff
training</header><text display-inline="yes-display-inline">A covered public
housing agency shall provide leadership, basic first aid, and CPR training to
staff of such agency to prepare such staff to coordinate and assist residents
of dwelling units in public housing owned, assisted, or operated by such agency
and other individuals in carrying out the pre-disaster, disaster impact, and
post-disaster polices and procedures developed pursuant to this title.</text>
</subsection><subsection id="H7FA890B666D64E418448CDEEF6453D78"><enum>(c)</enum><header>Resident
training</header><text display-inline="yes-display-inline">A covered public
housing agency may provide leadership, basic first aid, and CPR training to
residents of dwelling units in public housing owned, assisted, or operated by
such agency, in addition to training required to be provided to staff of such
agency under subsection (b), to prepare such residents to coordinate and assist
other residents in carrying out the pre-disaster, disaster impact, and
post-disaster polices and procedures developed pursuant to this title.</text>
</subsection></section><section id="HA7F2277D2CE14B51A8F88869575A18C6"><enum>518.</enum><header>Improving
disaster relief oversight</header><text display-inline="no-display-inline">Following a disaster in which a covered
public housing agency implemented its disaster response and relief plan
developed under this title, the Inspector General of the Department of Housing
and Urban Development shall evaluate such plan and, if necessary, make
recommendations for improving such plan not later than 180 days after the
conclusion of such disaster.</text>
</section>.
3.Amendments to
Housing Act
(a)Section 5A(a)(1)
of the United States Housing Act of 1937 (42 U.S.C. 1437c–1(a)(1)) is
amended—
(1)by adding at the
end the following new subparagraph:
(C)if applicable, a disaster response and
relief plan developed in accordance with title V.
;
(2)in subparagraph
(A), by striking and
; and
(3)in subparagraph
(B), by striking the period and inserting ; and
.
(b)Section 5A(d) of
the United States Housing Act of 1937 (42 U.S.C. 1437c–1(d)) is amended—
(1)by redesignating
paragraph (19) as paragraph (20); and
(2)by inserting after
paragraph (18) the following:
(19)Disaster
response and relief planIf,
applicable, a plan developed by the public housing agency in accordance with
title V that provides comprehensive information regarding pre-disaster,
disaster impact, and post-disaster policies, standards, procedures, and
protocols.
.
4.Authorization of
appropriations
(a)There are authorized
to be appropriated such sums as may be necessary to the Secretary to carry out
this Act.
(b)Any
sums appropriated under the authorization contained in this section shall
remain available, without fiscal year limitation, until expended.
5.A covered public housing
agency (as such term is defined in the amendments made under section 2 of this
Act) shall submit the initial disaster plan developed in accordance with the
amendments made under section 2 of this Act on the date that occurs on the
later of—
(1)270 days after the
date of the enactment of this Act; or
(2)the date that the
annual plan under section 5A(b) of the United States Housing Act of 1937 (42
U.S.C. 1437c–1(b)) is required to be submitted to the Secretary of Housing and
Urban Development.
