			 limitations</header><text display-inline="no-display-inline">Section 5 of the
			 Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2014">7 U.S.C. 2014</external-xref>) is amended—</text>
			<paragraph id="H0B552C87AC0548DEBFE801D950B9FBAC"><enum>(1)</enum><text>by striking the
			 section designation and heading and all that follows through <quote>(a)
			 Participation</quote> and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="HFAFC895365BC4B9D8BCD7EE26C00D70C" style="OLC">
					<section id="HEF3E1776F4A54861A0EC41AA4B31DC32"><enum>5.</enum><header>Eligible
				households</header>
						<subsection id="HB3161285CE5F4030B3BC7EB7C5915A1C"><enum>(a)</enum><header>Requirements</header>
							<paragraph id="HBE75B1AFEBFD465C892519E44AD5F06D"><enum>(1)</enum><header>In
				general</header><text>Participation</text>
							</paragraph></subsection></section><after-quoted-block>;
				</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H7D5839145D304F35A42199EB0968EA14"><enum>(2)</enum><text>in subsection
			 (a)—</text>
				<subparagraph id="H6718939602C7475285F922B06B7A331B"><enum>(A)</enum><text>by striking the
			 second sentence and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="H62A85F95959F42F191117E2EF1994DA9" style="OLC">
						<paragraph id="HC7D637499A7943A9B3B3EF64137D1DEA"><enum>(2)</enum><header>Recipients of
				other Federal benefits</header><text>Except as provided in section 3(n)(4) and
				subsections (b), (d)(2), and (g) of section 6, a household shall be eligible to
				participate in the supplemental nutrition assistance program if each member of
				the household receives—</text>
							<subparagraph id="HBA450A65AF0F4E9FB8921506447D7980"><enum>(A)</enum><text>cash assistance in
				the form of ongoing basic needs benefit payments for financially needy families
				under the program of block grants to States for temporary assistance for needy
				families established under part A of title IV of the Social Security Act (42
				U.S.C. 601 et seq.);</text>
							</subparagraph><subparagraph id="HC3A7DEDC6126483B8E39D759120B7EB7"><enum>(B)</enum><text>cash assistance
				under the supplemental security income program established under title XVI of
				that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1381">42 U.S.C. 1381 et seq.</external-xref>); or</text>
							</subparagraph><subparagraph id="H35B86537D6B24640B17B76C2ED5EEA3D"><enum>(C)</enum><text>aid to the aged,
				blind, or disabled under title I, X, XIV, or XVI of that Act (42 U.S.C. 301 et
				seq.).</text>
							</subparagraph></paragraph><after-quoted-block>;
				</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="H9A797645257B4D91B8E21BBD860254A7"><enum>(B)</enum><text>in the third
			 sentence, by striking <quote>Except for sections 6, 16(e)(1), and section
			 3(n)(4), households</quote> and inserting the following:</text>

			 (j)—</text>
				<subparagraph id="H1D9EC795AAF1421D9076A732BC8365F9"><enum>(A)</enum><text>by inserting
			 <quote>cash assistance in the form of</quote> before <quote>supplemental
			 security income benefits</quote>; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H96070EC860EA42708C741C0A4DDB37A0"><enum>(B)</enum><text>by striking
			 <quote>or who receives benefits</quote> and inserting <quote>or who receives
			 cash assistance</quote>.</text>
				</subparagraph></paragraph></section><section id="H27220BB09E1A4124A6C9A684F5784BB6"><enum>2.</enum><header>Requirements for
			 re-enrollment</header><text display-inline="no-display-inline">Paragraph (4) of
			 section 5(a) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2014">7 U.S.C. 2014(a)</external-xref>) (as
			 designated by section 1(2)(C)) is amended—</text>
			<paragraph id="HCB6BC08D9F1E4FB89C7AA6F0037C9A7C"><enum>(1)</enum><text>by striking
			 <quote>Assistance</quote> and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="HC18EAFC4B40341B28D484E574404E481" style="OLC">
					<subparagraph id="H581427E4A1FE48C8BBBD1F30FE423898"><enum>(A)</enum><header>In
				general</header><text>Assistance</text>
					</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H8CCC5F828A044B2780DECB64FFCF86DF"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H050D789B19B04086BA116416F548B4D4" style="OLC">
					<subparagraph id="HFB7703826CB948CEB833729335C81FE7"><enum>(B)</enum><header>Reenrollment</header><text>Any
				eligible household that previously received benefits under the supplemental
				nutrition assistance program and applies for reenrollment in the program shall
				be required—</text>
						<clause id="H2357944CF9DA4BBF9AFEBBE5FD2E5445"><enum>(i)</enum><text>to
				complete in full a new application; and</text>
						</clause><clause id="HE97142E856F34AB0AC2D154DF9FA7056"><enum>(ii)</enum><text>to verify that
				the income and assets of the household are in compliance with the requirements
				of the
				program.</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HADD82741B57A46F99F6ED1BAF3C00012"><enum>3.</enum><header>Standard utility
			 allowances based on the receipt of energy assistance payments</header>
			<subsection id="H7EBA422AF10E43C8B1F0C955438EB2A2"><enum>(a)</enum><header>Standard utility
			 allowance</header><text>Section 5 of the Food and Nutrition Act of 2008 (7
			 U.S.C. 2014) is amended—</text>
				<paragraph id="HA01B1FC9B62E424583E94DA02BF09CD4"><enum>(1)</enum><text>in subsection
			 (e)(6)(C), by striking clause (iv); and</text>
				</paragraph><paragraph id="HF1A0D063CE62405A9F547049079CCC80"><enum>(2)</enum><text>in subsection (k),
			 by striking paragraph (4) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="H9387055231F8454FADA5EEB3CF71F2DD" style="OLC">
						<paragraph id="H5E034991E80A44919000F4D8B7AED8A6"><enum>(4)</enum><header>Third party
				energy assistance payments</header><text>For purposes of subsection (d)(1), a
				payment made under a State law (other than a law referred to in paragraph
				(2)(G)) to provide energy assistance to a household shall be considered money
				payable directly to the
				household.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HB3C7E4D0C71B4A9D8C7357C16B3CB766"><enum>(b)</enum><header>Conforming
			 amendments</header><text>Section 2605(f)(2) of the Low-Income Home Energy
			 Assistance Act of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/42/8624">42 U.S.C. 8624(f)(2)</external-xref>) is amended—</text>
				<paragraph id="HDB4B5FACAF3B491B984964B44E88070F"><enum>(1)</enum><text>by striking
			 <quote>and for purposes of determining any excess shelter expense deduction
			 under section 5(e) of the Food and Nutrition Act of 2008 (7 U.S.C.
			 2014(e))</quote>, and</text>
				</paragraph><paragraph id="HF4D9C77AB005469EB9193208DFCF8AEE"><enum>(2)</enum><text>in subparagraph
			 (A), by inserting before the semicolon the following: <quote>, except that such
			 payments or allowances shall not be deemed to be expended for purposes of
			 determining any excess shelter expense deduction under section 5(e)(6) of the
			 Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2014">7 U.S.C. 2014(e)(6)</external-xref>)</quote>.</text>
				</paragraph></subsection></section><section id="H9C2405EA4AE44889B1BAE5A025356935"><enum>4.</enum><header>Repeal of funding
			 for employment and training programs</header>
			<subsection id="H0E51A3450B3E46629394E38231B769D0"><enum>(a)</enum><header>In
			 general</header><text>Section 6(d)(4) of the Food and Nutrition Act of 2008 (7
			 U.S.C. 2015(d)(4)) is amended—</text>
				<paragraph id="HCBFCBF6A06AD4A99B6DB00A903E7FBC5"><enum>(1)</enum><text>by striking
			 <quote>(A) <header-in-text level="subparagraph" style="OLC">In
			 general</header-in-text>.—</quote>; and all that follows through <quote>the
			 following components</quote> in the matter preceding clause (i) in subparagraph
			 (B) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="HDBB98DC4089247EE9CF204ACDB3F1CAE" style="OLC">
						<subparagraph id="H7458FF49AF4D460B9FA553F71C76C451"><enum>(A)</enum><header>Definition of
				employment and training program</header><text>In this Act, the term
				<term>employment and training program</term> means a Federal, State, or private
				program not administered by the Secretary or funded through the Food and
				Nutrition Service that contains 1 or more of the following
				components</text>
						</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HF560F81299264C398E3E69110BC6F75B"><enum>(2)</enum><text>by striking clause
			 (viii) in subparagraph (A) (as designated in paragraph (1)) and inserting the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="H9F2EEE9FE46146F1B0826844A04830C6" style="OLC">
						<clause id="HA2024A8C04AE478599A3794F59F6FB2E"><enum>(viii)</enum><text>As approved by
				the State, other employment and training programs, educational programs,
				projects, and experiments, such as a supported work program, aimed at
				accomplishing the purpose of the employment and training
				program.</text>
						</clause><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HE523DE65E0DE43AF885BD6D16A64BA34"><enum>(3)</enum><text>in subparagraph
			 (E), by striking <quote>subparagraph (D)</quote> and inserting
			 <quote>subparagraph (C)</quote>;</text>
				</paragraph><paragraph id="H25E5BA02916649FBA33CCB2481761010"><enum>(4)</enum><text>by striking
			 subparagraphs (H) through (K); and</text>
				</paragraph><paragraph id="H0E631B0E34A64198950D626B0AF94AFB"><enum>(5)</enum><text>by redesignating
			 subparagraphs (C) through (G) and (L) and (M) as subparagraphs (B) through (F)
			 and (G) and (H), respectively.</text>
				</paragraph></subsection><subsection id="H920E3E23D90E4B2B9E84275FDDED486D"><enum>(b)</enum><header>Repeal of
			 funding</header><text>Section 16 of the Food and Nutrition Act of 2008 (7
			 U.S.C. 2025) is amended by striking subsection (h).</text>
			</subsection><subsection id="H4ED0CE7265AD4EE88A1A75297EA0A73E"><enum>(c)</enum><header>Conforming
			 amendments</header>
				<paragraph id="H8B12A68A852542A49EEDC3719E37515C"><enum>(1)</enum><text>Section 5(d) of
			 the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2014">7 U.S.C. 2014(d)</external-xref>) is amended—</text>
					<subparagraph id="HA9B6F71626224C6B837DDF3DCEA690ED"><enum>(A)</enum><text>by striking
			 paragraph (14); and</text>
					</subparagraph><subparagraph id="H964BF92A6C6E4CC2B1ED4E858778AD6B"><enum>(B)</enum><text>by redesignating
			 paragraphs (15) through (19) as paragraphs (14) through (18),
			 respectively.</text>
					</subparagraph></paragraph><paragraph id="H9DAF9F6D9EF54305BDFF827D320F6DDC"><enum>(2)</enum><text>Section
			 17(b)(1)(B)(iv)(III) of the Food and Nutrition Act of 2008 (7 U.S.C.
			 2026(b)(1)(B)(iv)(III)) is amended—</text>
					<subparagraph id="H04AB1FE514B443D4A1AE0D8C2729B020"><enum>(A)</enum><text>in item (dd), by
			 striking <quote>, (4)(F)(i), or (4)(K)</quote> and inserting <quote>or
			 (4)(E)</quote>; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE77A8BBA6DF147D28F5744C51165FE9D"><enum>(B)</enum><text>in item (hh), by
			 striking <quote>(g), (h)(2), or (h)(3) of section 16</quote> and inserting
			 <quote>or (f) of section 16</quote>.</text>
					</subparagraph></paragraph></subsection></section><section id="H15748E035B55444B8FB8DA031CB92490"><enum>5.</enum><header>Work
			 Requirement</header><text display-inline="no-display-inline">Section 6(o)(4)(A)
			 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2015">7 U.S.C. 2015(o)(4)(A)</external-xref>) is amended by
			 striking <quote>reside—</quote> and all that follows through the end of clause
			 (ii) and inserting <quote>reside has an unemployment rate of over 10
			 percent.</quote>.</text>
		</section><section id="HB67405CAD0A34072B714701959FA4417"><enum>6.</enum><header>Centralized
			 database for cross-compliance</header><text display-inline="no-display-inline">Section 11(o) of the Food and Nutrition Act
			 of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2020">7 U.S.C. 2020(o)</external-xref>) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="HA5718194E4E24CF8A12D901F394B50BC" style="OLC">
				<paragraph id="H5DA923E179D848018F5E044A93B4B4CF"><enum>(6)</enum><header>Centralized
				database for cross-compliance</header>
					<subparagraph id="H1118FAECF91D4A24ACBB74683DECD938"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Not later than 1 year
				after the date of enactment of this paragraph, the Secretary shall develop a
				centralized database to facilitate cooperation between the Secretary and State
				agencies so as to ensure that an individual does not enroll to receive benefits
				in more than 1 State.</text>
					</subparagraph><subparagraph id="HA0DCE3A966A14D239A37237AE10E86D7"><enum>(B)</enum><header>Use of existing
				databases</header><text display-inline="yes-display-inline">To the maximum
				extent practicable to reduce development and implementation costs, in
				developing the centralized database the Secretary shall use Federal databases
				in existence as of the date of enactment of this
				paragraph.</text>
					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HFB28EC14322E495AB16714CD801B44F3"><enum>7.</enum><header>Quality
			 control</header>
			<subsection id="H43AEAFEA75094F38812A06D411175014"><enum>(a)</enum><header>In
			 general</header><text>Section 16(c) of the Food and Nutrition Act of 2008 (7
			 U.S.C. 2025(c)) is amended—</text>
				<paragraph id="H1D27BEC3BD37452C9E072E82A982C89C"><enum>(1)</enum><text>in paragraph
			 (1)—</text>
					<subparagraph id="H983D0514DF0443F4864CF5FB8814DFDF"><enum>(A)</enum><text>in subparagraph
			 (D)(i)(II), by inserting <quote>except as provided in subparagraph (H),</quote>
			 before <quote>require</quote>; and</text>
					</subparagraph><subparagraph id="HAFF42608B4AE46ECB2E1490F90BE9268"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="HEE0A8E16FB2346B79F0CABC580D3B946" style="OLC">
							<subparagraph id="H7D0C424C766C4C9893BC7EAD67F95C34"><enum>(H)</enum><header>States in
				liability status for a third consecutive fiscal year</header>
								<clause id="HB3DEBEA79D8447408DC530FFACEF8493"><enum>(i)</enum><header>In
				general</header><text>If a liability amount has been established for a State
				agency under subparagraph (C) for 3 or more consecutive fiscal years, the
				Secretary shall require the State to pay the entire liability amount for those
				fiscal years.</text>
								</clause><clause id="HD556A0EF8B634D9486AB79F09182865A"><enum>(ii)</enum><header>Alternatives to
				full payment not available</header><text>Subparagraph (D) shall not apply to a
				State agency described in clause
				(i).</text>
								</clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HCDD988D8DF2D48C3937C7EFF588D3E81"><enum>(2)</enum><text>by redesignating
			 paragraph (9) as paragraph (10); and</text>
				</paragraph><paragraph id="HB812D91710D54FFEBBF390D9820596F8"><enum>(3)</enum><text>by inserting after
			 paragraph (8) the following:</text>
					<quoted-block display-inline="no-display-inline" id="H825C0A2787D741E99CA80CBFDB4571B3" style="OLC">
						<paragraph id="H9DCFC1B9EA6444D5A1313DC7E85A87EA"><enum>(9)</enum><header>Penalty for
				negative error rate</header>
							<subparagraph id="H620C73BED61A4ED8A6E2436E289EFF0D"><enum>(A)</enum><header>Definitions</header><text>In
				this paragraph:</text>
								<clause id="HD9538F1D7DF9452F84E8E06A68D5A215"><enum>(i)</enum><header>Affected State
				agency</header><text>The term <term>affected State agency</term> means a State
				agency that maintains, for 2 or more consecutive fiscal years, a negative error
				rate that is more than 50 percent higher than the national average negative
				error rate, as determined by the Secretary.</text>
								</clause><clause commented="no" id="H20108F0F51D64A9BA4051319D4A01A40"><enum>(ii)</enum><header>Average
				negative error rate</header><text>The term <term>average negative error
				rate</term> means the product obtained by multiplying—</text>
									<subclause commented="no" id="H1C03A7E09C944B37AA94233B67F0A22A"><enum>(I)</enum><text>the negative error
				rate of a State agency; and</text>
									</subclause><subclause commented="no" id="HFF8D2E62405645248D993BE5C8851003"><enum>(II)</enum><text>the proportion of
				the total negative caseload of that State agency for the fiscal year, as
				calculated under the quality control sample at the time of the notifications
				issued under subparagraph (C), as determined by the Secretary.</text>
									</subclause></clause><clause id="HB6A435633558411B914BF74332406290"><enum>(iii)</enum><header>Negative error
				rate</header>
									<subclause id="H79C34E027A6E415EA69E0CB66A4350B8"><enum>(I)</enum><header>In
				general</header><text>The term <term>negative error rate</term> means, for a
				State agency, the proportion that—</text>
										<item id="HBC48820CC5654F8E991FBE1368FE3379"><enum>(aa)</enum><text>the
				total number of actions erroneously taken by the State agency to deny
				applications or suspend or terminate benefits of a household participating in
				the supplemental nutrition assistance program established under this Act, as
				determined by the Secretary, in that fiscal year; bears to</text>
										</item><item id="H7B04AED4464443EF9F101F65D15F87C2"><enum>(bb)</enum><text>the
				total number of actions taken by the State agency to deny applications or
				suspend or terminate benefits of households participating in the supplemental
				nutrition assistance program established under this Act in that fiscal
				year.</text>
										</item></subclause><subclause id="H8DAFA2E9B0904CC48E2EB9F19D86C92B"><enum>(II)</enum><header>Exclusions</header><text>The
				term <term>negative error rate</term> does not include—</text>
										<item id="H3B2A624B78D045D3A8AC9FEFD98D2FD6"><enum>(aa)</enum><text>an
				error resulting from the application of regulations promulgated under this Act
				during the period—</text>
											<subitem id="HE1E91909A1054C4C8AEFF98EB13F42F6"><enum>(AA)</enum><text>beginning on the
				date of enactment of this clause; and</text>
											</subitem><subitem id="H239678685A284D43BC6A9CB56D81B9B7"><enum>(BB)</enum><text>ending on the
				date that is 121 days after the date on which the regulation is implemented;
				and</text>
											</subitem></item><item id="H3C7FFDC31F944071BF2CBAD9EFAEA689"><enum>(bb)</enum><text>an
				error resulting from—</text>
											<subitem id="H5CA78F62965E495D8D00034F4412FD89"><enum>(AA)</enum><text>the use by a
				State agency of correctly processed information concerning households or
				individuals received under a Federal program; or</text>
											</subitem><subitem id="HFD760A93E3D0460C94089F05A8189846"><enum>(BB)</enum><text>an action that is
				based on policy information that is approved or disseminated, in writing, by
				the Secretary or a designee of the Secretary.</text>
											</subitem></item></subclause></clause></subparagraph><subparagraph id="HA7FC8A8D28EB4B84A10D0045FD559FE0"><enum>(B)</enum><header>Penalty
				amount</header><text>For fiscal year 2012 and each subsequent fiscal year, the
				amount of the penalty for an affected State agency shall be equal to 5 percent
				of the amount otherwise payable under subsection (a).</text>
							</subparagraph><subparagraph id="HFDB1DD18DD294F7F9BD172B9DDB56157"><enum>(C)</enum><header>Information
				reporting by States</header>
								<clause id="HDC29551BD9674294A858E886AFF13595"><enum>(i)</enum><header>In
				general</header><text>For each fiscal year, each State agency shall
				expeditiously submit to the Secretary data concerning the operations of the
				State agency sufficient for the Secretary to establish the negative error rate
				and penalty amount of the State agency.</text>
								</clause><clause id="HD3C66A97BC404EC5A90C8520B1CD69E8"><enum>(ii)</enum><header>Relevant
				information</header><text>The Secretary may require a State agency to report
				any factors necessary to determine the negative error rate of the State
				agency.</text>
								</clause><clause id="HCCEFAD96CEF94E868CF58869A5A0CDAC"><enum>(iii)</enum><header>Information
				not reported</header><text>If a State agency fails to report information
				required by the Secretary, the Secretary may use any information, as the
				Secretary considers appropriate, to establish the negative error rate of the
				State agency for the applicable year.</text>
								</clause><clause commented="no" id="HAB08C89FCE3148CD989313D409999109"><enum>(iv)</enum><header>National
				average error rate</header><text>If a State agency fails to report information
				required by the Secretary, the Secretary may use the national average negative
				error rate to establish the negative error rate for the State agency.</text>
								</clause></subparagraph><subparagraph id="H8DEA3DA88FE8452A8FDFF6FB2A4ABD12"><enum>(D)</enum><header>Announcement of
				error rates</header>
								<clause id="H681FB45A09A147789303B81035ED8679"><enum>(i)</enum><header>Case
				review</header><text>Not later than May 31 of each fiscal year, the case review
				and all arbitration of State-Federal differences on negative error rates for
				the previous fiscal year shall be completed.</text>
								</clause><clause id="H141079988482409F8417FADAA9AF562F"><enum>(ii)</enum><header>Determination
				and announcement</header><text>Not later than June 30 of each fiscal year, the
				Secretary shall, for the previous fiscal year—</text>
									<subclause id="H8E625AA3E34E41B694B8B7A89A38B7B8"><enum>(I)</enum><text>determine—</text>
										<item id="HB8634C5E77244546AAB6436575110034"><enum>(aa)</enum><text>final negative
				error rates;</text>
										</item><item id="H4EB1C7CA6CE740FDA2C0503B049E6B4A"><enum>(bb)</enum><text>the
				national average negative error rate; and</text>
										</item><item id="HD40FED5055AF4E75A5FDBA76B97B1C67"><enum>(cc)</enum><text>penalty
				amounts;</text>
										</item></subclause><subclause id="H14ED55309EEC40658A812EA4AA2FC4DB"><enum>(II)</enum><text>notify affected
				State agencies of the penalty amounts;</text>
									</subclause><subclause id="H9CD1C43219B84DA9AEFD0FB7D2AE9E92"><enum>(III)</enum><text>provide a copy
				of the notification under subclause (II) to the chief executive officer and the
				legislature of the affected State; and</text>
									</subclause><subclause id="H161FAED6B2284510BFFC1CEA6FB1F8EE"><enum>(IV)</enum><text>establish a claim
				against the State agency for the monetary penalty amount assessed against the
				State agency.</text>
									</subclause></clause></subparagraph><subparagraph id="HEFBB57F654B94F888265ADBAC364AFEC"><enum>(E)</enum><header>Review</header>
								<clause id="HB6DAB636882F46DAB1A90998DF6809CF"><enum>(i)</enum><header>In
				general</header><text>For any fiscal year, if the Secretary imposes a penalty
				amount against a State agency under subparagraph (D)(ii), the following
				determinations of the Secretary shall be subject to administrative and judicial
				review:</text>
									<subclause id="HE308B1E3EAE140E48CA23E07E4CA7386"><enum>(I)</enum><text>The final negative
				error rate of the State agency.</text>
									</subclause><subclause id="H8CE1A49B6638416F807AF3F98B618042"><enum>(II)</enum><text>A determination
				of the Secretary that the negative error rate of the State agency exceeds 50
				percent of the national average negative error rate.</text>
									</subclause><subclause id="H3D2CE326B17740FAA8749D2EC717B578"><enum>(III)</enum><text>The monetary
				penalty amount assessed against the State agency.</text>
									</subclause></clause><clause id="H08D1BDD16F8F4E089223A5171EA050C7"><enum>(ii)</enum><header>Determination
				not reviewable</header><text>The national average negative error rate under
				this paragraph shall not be subject to administrative or judicial
				review.</text>
								</clause></subparagraph><subparagraph id="H7FF27B0F2485482EBAB810453C6662E4"><enum>(F)</enum><header>Payment of
				penalty amount</header>
								<clause id="H0B061850C06B4AB5AE293A52B5F6AFEE"><enum>(i)</enum><header>In
				general</header><text>On completion of administrative and judicial review under
				subparagraph (E), an affected State agency shall pay to the Secretary the
				penalty amount designated under subparagraph (D)(ii), subject to the findings
				of the administrative or judicial review, not later than September 30 of the
				fiscal year for which the claim has been issued to the State agency.</text>
								</clause><clause id="H5FA4B7DA72EC44D3BFEAB4714A4A78F6"><enum>(ii)</enum><header>Alternative
				method of collection</header>
									<subclause id="HB876FCD2C5584F4AAFE379E988EDFA0D"><enum>(I)</enum><header>In
				general</header><text>If a State agency fails to make a payment under clause
				(i) by September 30 of the fiscal year for which the claim has been issued to
				the State agency, the Secretary may reduce any amount due to the State agency
				under any other provision of this Act by the amount of the monetary penalty
				established under subparagraph (D)(ii).</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="HBDE844B2A2E24A41B2A465039749CF99"><enum>(II)</enum><header>Accrual of
				interest</header><text>Interest on the amount owed shall not accrue until after
				September 30 of the applicable fiscal
				year.</text>
									</subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

			 rates</header>
			<subsection id="H8240752D234F4A498682E84C30D5445F"><enum>(a)</enum><header>In

			 Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2025">7 U.S.C. 2025</external-xref>) is amended by striking

				the nutrition education and obesity prevention grant program under this

				2013, an amount equal to $5 per household in the State enrolled in the
				supplemental nutrition assistance program; and</text>
						</subparagraph><subparagraph id="H109DF93EF1024CDB854DE78D8E011EDB"><enum>(B)</enum><text>for fiscal year
				2014 and each subsequent fiscal year, the applicable amount during the
				preceding fiscal year, as adjusted to reflect any increases for the 12-month
				period ending the preceding June 30 in the Consumer Price Index for All Urban
				Consumers published by the Bureau of Labor Statistics of the Department of
				Labor, per household in the State enrolled in the supplemental nutrition
				assistance program.</text>
						</subparagraph></paragraph><paragraph id="HC7B5985C5C25471D8C27A3F9DE47F768"><enum>(2)</enum><header>Timing of
				determination</header><text>At the end of each fiscal year, the Secretary shall
				determine the total number of households in each State enrolled in the
				supplemental nutrition assistance program so as to determine appropriate
				funding levels for the coming fiscal
				year.</text>
