			 term <term>Secretary</term> means the Secretary of Energy.</text>

			 codes</header>
				<section id="HDD3EBAC045E04C68BCE764169D9CD47E"><enum>101.</enum><header>Greater energy
			 efficiency in building codes</header>
					<subsection id="HDC68ADFB14564CF996638A6CB0FD9BAC"><enum>(a)</enum><header>Definitions</header><text>Section
			 303 of the Energy Conservation and Production Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6832">42 U.S.C. 6832</external-xref>) is
			 amended—</text>
						<paragraph id="HB1ED9F2821AC42AB952530945014C092"><enum>(1)</enum><text>by striking
			 paragraph (14) and inserting the following:</text>
							<quoted-block display-inline="no-display-inline" id="HB1F4D7AB8D154A829DE861EE63D1EDE0" style="OLC">
								<paragraph id="H062D0CB2A31E4BFBB517137D068CC0D5"><enum>(14)</enum><header>Model building
				energy code</header><text>The term <term>model building energy code</term>
				means a voluntary building energy code and standards developed and updated
				through a consensus process among interested persons, such as the IECC or the
				code used by—</text>
									<subparagraph id="HDFDE6B6A463A4BBE8597E5C65EFC1F7F"><enum>(A)</enum><text>the Council of
				American Building Officials;</text>
									</subparagraph><subparagraph id="H22EC8CD4BFFD4EAA988AC7E2F504B047"><enum>(B)</enum><text>the American
				Society of Heating, Refrigerating, and Air-Conditioning Engineers; or</text>
									</subparagraph><subparagraph id="H829B8E91524A4C3A86E50964ED5469EA"><enum>(C)</enum><text>other appropriate
				organizations.</text>
									</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</paragraph><paragraph id="H6D19E06EB98A422284C36D9D2117CC44"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
							<quoted-block display-inline="no-display-inline" id="H5AD233C9195C4491ACDB37809EB54307" style="OLC">
								<paragraph id="H9D6412F320BC4AA595A8FD672330F64E"><enum>(17)</enum><header>IECC</header><text>The
				term <term>IECC</term> means the International Energy Conservation Code.</text>
								</paragraph><paragraph id="H1C858215D26B4974BC2764BA84AAE496"><enum>(18)</enum><header>Indian
				tribe</header><text>The term <term>Indian tribe</term> has the meaning given
				the term in section 4 of the Native American Housing Assistance and
				Self-Determination Act of 1996 (25 U.S.C.
				4103).</text>
								</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H66DB5589ABE641FE948EB38DED57AE20"><enum>(b)</enum><header>State building
			 energy efficiency codes</header><text>Section 304 of the Energy Conservation
			 and Production Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6833">42 U.S.C. 6833</external-xref>) is amended to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="H853D29920DF54935B0A912F399FC8E2A" style="OLC">
							<section id="H44A26E1F12634BB29192BE0506C2BAB0"><enum>304.</enum><header>Updating State
				building energy efficiency codes</header>
								<subsection id="H2EA2F72116244284B0EC85FE6F06A301"><enum>(a)</enum><header>In
				general</header><text>The Secretary shall—</text>
									<paragraph id="H9BFF5C06CF6B4B3FA664231A552017FB"><enum>(1)</enum><text>encourage and
				support the adoption of building energy codes by States, Indian tribes, and, as
				appropriate, by local governments that meet or exceed the model building energy
				codes, or achieve equivalent or greater energy savings; and</text>
									</paragraph><paragraph id="H08B3F55A5F4A4BFAB6D71193D9D6A2FD"><enum>(2)</enum><text>support full
				compliance with the State and local codes.</text>
									</paragraph></subsection><subsection id="H0B023B33938D4F958551BAA5B75572A6"><enum>(b)</enum><header>State and Indian
				tribe certification of building energy code updates</header>
									<paragraph id="H290E079F4B874B2ABE3F3997A72A05B7"><enum>(1)</enum><header>Review and
				updating of codes by each State and Indian tribe</header>
										<subparagraph id="H4B427D476AC14027A47DB5266FE2F9EA"><enum>(A)</enum><header>In
				general</header><text>Not later than 2 years after the date on which a model
				building energy code is updated, each State or Indian tribe shall certify
				whether or not the State or Indian tribe, respectively, has reviewed and
				updated the energy provisions of the building code of the State or Indian
				tribe, respectively.</text>
										</subparagraph><subparagraph id="HE5C3787517F84988A6ADBD76C9C6EF1C"><enum>(B)</enum><header>Demonstration</header><text>The
				certification shall include a demonstration of whether or not the energy
				savings for the code provisions that are in effect throughout the State or
				Indian tribal territory meet or exceed—</text>
											<clause id="HE5A64AA393E44AC9B19E27A751D7A171"><enum>(i)</enum><text>the energy savings
				of the updated model building energy code; or</text>
											</clause><clause id="HB84FBBABD44B4F348472702B5F4E4F9B"><enum>(ii)</enum><text>the targets
				established under section 307(b)(2).</text>
											</clause></subparagraph><subparagraph id="H21DD4B7830B44D31AD0DBC2507C547C7"><enum>(C)</enum><header>No model
				building energy code update</header><text>If a model building energy code is
				not updated by a target date established under section 307(b)(2)(D), each State
				or Indian tribe shall, not later than 2 years after the specified date, certify
				whether or not the State or Indian tribe, respectively, has reviewed and
				updated the energy provisions of the building code of the State or Indian
				tribe, respectively, to meet or exceed the target in section 307(b)(2).</text>
										</subparagraph></paragraph><paragraph id="H422F7FF2779E49A996A65C4305E9B08D"><enum>(2)</enum><header>Validation by
				Secretary</header><text>Not later than 90 days after a State or Indian tribe
				certification under paragraph (1), the Secretary shall—</text>
										<subparagraph id="HF8BED377B9F74F318F77C5822EEEA116"><enum>(A)</enum><text>determine whether
				the code provisions of the State or Indian tribe, respectively, meet the
				criteria specified in paragraph (1); and</text>
										</subparagraph><subparagraph id="HB150897E093F4E3EBD692793B9E7EE52"><enum>(B)</enum><text>if the
				determination is positive, validate the certification.</text>
										</subparagraph></paragraph></subsection><subsection id="HFA0DE00BE9994250AFCFAADAE9E8E9D3"><enum>(c)</enum><header>Improvements in
				compliance with building energy codes</header>
									<paragraph id="H8F31566703F842B78D8F40D798A85009"><enum>(1)</enum><header>Requirement</header>
										<subparagraph id="HF28EFC854BEE4DFBB3100E5016F58DBD"><enum>(A)</enum><header>In
				general</header><text>Not later than 3 years after the date of a certification
				under subsection (b), each State and Indian tribe shall certify whether or not
				the State and Indian tribe, respectively, has—</text>
											<clause id="HC4D656130D6C4414A116E00EC87654C2"><enum>(i)</enum><text>achieved full
				compliance under paragraph (3) with the applicable certified State and Indian
				tribe building energy code or with the associated model building energy code;
				or</text>
											</clause><clause id="H0B3E3D2A24974C7F8A4FE51EC42ACC79"><enum>(ii)</enum><text>made significant
				progress under paragraph (4) toward achieving compliance with the applicable
				certified State and Indian tribe building energy code or with the associated
				model building energy code.</text>
											</clause></subparagraph><subparagraph id="HE9FC830E97F84EDCB26E1D7C147F52AA"><enum>(B)</enum><header>Repeat
				certifications</header><text>If the State or Indian tribe certifies progress
				toward achieving compliance, the State or Indian tribe shall repeat the
				certification until the State or Indian tribe certifies that the State or
				Indian tribe has achieved full compliance, respectively.</text>
										</subparagraph></paragraph><paragraph id="HAD40B4E7DC3A4385AF3D14EF035A91B9"><enum>(2)</enum><header>Measurement of
				compliance</header><text>A certification under paragraph (1) shall include
				documentation of the rate of compliance based on—</text>
										<subparagraph id="H4EA95043A0A048338948B47CFACBDFFF"><enum>(A)</enum><text>independent
				inspections of a random sample of the buildings covered by the code in the
				preceding year; or</text>
										</subparagraph><subparagraph id="H782C28784002451DA1769C91B6B8CCA6"><enum>(B)</enum><text>an alternative
				method that yields an accurate measure of compliance.</text>
										</subparagraph></paragraph><paragraph id="HAEBB04FD093E420D99EC9C2475D146CA"><enum>(3)</enum><header>Achievement of
				compliance</header><text>A State or Indian tribe shall be considered to achieve
				full compliance under paragraph (1) if—</text>
										<subparagraph id="H7A98421944A644D6A9CB307CC3CEFF1B"><enum>(A)</enum><text>at least 90
				percent of building space covered by the code in the preceding year
				substantially meets all the requirements of the applicable code specified in
				paragraph (1), or achieves equivalent or greater energy savings level;
				or</text>
										</subparagraph><subparagraph id="HFC0275E4F5A04FB688E10C8BA4DB47DE"><enum>(B)</enum><text>the estimated
				excess energy use of buildings that did not meet the applicable code specified
				in paragraph (1) in the preceding year, compared to a baseline of comparable
				buildings that meet this code, is not more than 5 percent of the estimated
				energy use of all buildings covered by this code during the preceding
				year.</text>
										</subparagraph></paragraph><paragraph id="HDCEBA612C48941B394D3B3F9D846927E"><enum>(4)</enum><header>Significant
				progress toward achievement of compliance</header><text>A State or Indian tribe
				shall be considered to have made significant progress toward achieving
				compliance for purposes of paragraph (1) if the State or Indian tribe—</text>
										<subparagraph id="H923861F5B6A34DC1A0A09804BB53336F"><enum>(A)</enum><text>has developed and
				is implementing a plan for achieving compliance during the 8-year period
				beginning on the date of enactment of this paragraph, including annual targets
				for compliance and active training and enforcement programs; and</text>
										</subparagraph><subparagraph id="HEB99FA81C86246B19ABE48E628FA03E8"><enum>(B)</enum><text>has met the most
				recent target under subparagraph (A).</text>
										</subparagraph></paragraph><paragraph id="HA3FDA12512694D419BE50A84401CCAD2"><enum>(5)</enum><header>Validation by
				Secretary</header><text>Not later than 90 days after a State or Indian tribe
				certification under paragraph (1), the Secretary shall—</text>
										<subparagraph id="HDBEEF39D23D04D0FBD6C4C79DFCC6145"><enum>(A)</enum><text>determine whether
				the State or Indian tribe has demonstrated meeting the criteria of this
				subsection, including accurate measurement of compliance; and</text>
										</subparagraph><subparagraph id="HEAD16D59FF9B489CB81C4FE6E7F57E6E"><enum>(B)</enum><text>if the
				determination is positive, validate the certification.</text>
										</subparagraph></paragraph></subsection><subsection id="H2BB8E8C60CA140D9A0519459D6339F66"><enum>(d)</enum><header>States or Indian
				tribes that do not achieve compliance</header>
									<paragraph id="HB42C8ADAD5404BAEA3D7B542F45D9197"><enum>(1)</enum><header>Reporting</header><text>A
				State or Indian tribe that has not made a certification required under
				subsection (b) or (c) by the applicable deadline shall submit to the Secretary
				a report on—</text>
										<subparagraph id="HABF7C1FB7E65422C90F8CCDE816518F3"><enum>(A)</enum><text>the status of the
				State or Indian tribe with respect to meeting the requirements and submitting
				the certification; and</text>
										</subparagraph><subparagraph id="HFC3A5AB65CBF4289A6ABCA1178DAD304"><enum>(B)</enum><text>a plan for meeting
				the requirements and submitting the certification.</text>
										</subparagraph></paragraph><paragraph id="H32C9498829CD42268DF11308BD2DBF6B"><enum>(2)</enum><header>Federal
				support</header><text>For any State or Indian tribe for which the Secretary has
				not validated a certification by a deadline under subsection (b) or (c), the
				lack of the certification may be a consideration for Federal support authorized
				under this section for code adoption and compliance activities.</text>
									</paragraph><paragraph id="HBC41E8DC298541F28B0967CA11F33E06"><enum>(3)</enum><header>Local
				government</header><text>In any State or Indian tribe for which the Secretary
				has not validated a certification under subsection (b) or (c), a local
				government may be eligible for Federal support by meeting the certification
				requirements of subsections (b) and (c).</text>
									</paragraph><paragraph id="H0B48B6C7D1C14D9E808FEC2041985D84"><enum>(4)</enum><header>Annual reports
				by Secretary</header>
										<subparagraph id="H8CE285F80F1E4431BC89A50345D49AED"><enum>(A)</enum><header>In
				general</header><text>The Secretary shall annually submit to Congress, and
				publish in the Federal Register, a report on—</text>
											<clause id="H15B33461E4B34E69B3393FF62B93D7A1"><enum>(i)</enum><text>the status of
				model building energy codes;</text>
											</clause><clause id="HD17A49C320FB4770BED1FBA17F23C0BF"><enum>(ii)</enum><text>the status of
				code adoption and compliance in the States and Indian tribes;</text>
											</clause><clause id="HCAE0FE22D5A348A18E9E184A26128C56"><enum>(iii)</enum><text>implementation
				of this section; and</text>
											</clause><clause id="HA71BE9F074184978970232B0A9337EE5"><enum>(iv)</enum><text>improvements in
				energy savings over time as result of the targets established under section
				307(b)(2).</text>
											</clause></subparagraph><subparagraph id="H34034A8F498B4799A57FA0F2CA2597F6"><enum>(B)</enum><header>Impacts</header><text>The
				report shall include estimates of impacts of past action under this section,
				and potential impacts of further action, on—</text>
											<clause id="HED20BBEAF6EC4FC1888F64B700320ABD"><enum>(i)</enum><text>upfront financial
				and construction costs, cost benefits and returns (using investment analysis),
				and lifetime energy use for buildings;</text>
											</clause><clause id="H47F4B848ECF045A4B6EFB1664D84D875"><enum>(ii)</enum><text>resulting energy
				costs to individuals and businesses; and</text>
											</clause><clause id="H7D2585D4AAD44FD58083CDF5650F5255"><enum>(iii)</enum><text>resulting
				overall annual building ownership and operating costs.</text>
											</clause></subparagraph></paragraph></subsection><subsection id="HB89B37E9A7F6455996BBD38B76D79181"><enum>(e)</enum><header>Technical
				assistance to States and Indian tribes</header><text>The Secretary shall
				provide technical assistance to States and Indian tribes to implement the goals
				and requirements of this section, including procedures and technical analysis
				for States and Indian tribes—</text>
									<paragraph id="HED073F8E188E43FF8BF60C921ED01B50"><enum>(1)</enum><text>to improve and
				implement State residential and commercial building energy codes;</text>
									</paragraph><paragraph id="HEAEA51DFD27845B9AC0AA20FB6220A65"><enum>(2)</enum><text>to demonstrate
				that the code provisions of the States and Indian tribes achieve equivalent or
				greater energy savings than the model building energy codes and targets;</text>
									</paragraph><paragraph id="H264F61A6246D48C98072379D87A89126"><enum>(3)</enum><text>to document the
				rate of compliance with a building energy code; and</text>
									</paragraph><paragraph id="H52E98F9A7D724E92AB949150C7D0CB39"><enum>(4)</enum><text>to otherwise
				promote the design and construction of energy efficient buildings.</text>
									</paragraph></subsection><subsection id="HD8EF153595BE40C58A6521DDA35F6343"><enum>(f)</enum><header>Availability of
				incentive funding</header>
									<paragraph id="HCB65A1164B2249549D514D870D8ECA91"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall provide incentive funding to States
				and Indian tribes—</text>
										<subparagraph id="H87A0E60A2E9D41BF803F3FD060EF054D"><enum>(A)</enum><text>to implement the
				requirements of this section;</text>
										</subparagraph><subparagraph id="H4F4A103A581E46D0AB57918FFE7DA880"><enum>(B)</enum><text>to improve and
				implement residential and commercial building energy codes, including
				increasing and verifying compliance with the codes and training of State,
				tribal, and local building code officials to implement and enforce the codes;
				and</text>
										</subparagraph><subparagraph id="H577B22A4D8074FBCB15262BB45129CC5"><enum>(C)</enum><text>to promote
				building energy efficiency through the use of the codes.</text>
										</subparagraph></paragraph><paragraph id="H51CEAC51B0A2465E9D3BD1642FF15DB9"><enum>(2)</enum><header>Additional
				funding</header><text>Additional funding shall be provided under this
				subsection for implementation of a plan to achieve and document full compliance
				with residential and commercial building energy codes under subsection
				(c)—</text>
										<subparagraph id="H8A66ECC72E864C19BB3343173F4D004B"><enum>(A)</enum><text>to a State or
				Indian tribe for which the Secretary has validated a certification under
				subsection (b) or (c); and</text>
										</subparagraph><subparagraph id="H9F2537FADA924B5297BFC4BCEF3F00A1"><enum>(B)</enum><text>in a State or
				Indian tribe that is not eligible under subparagraph (A), to a local government
				that is eligible under this section.</text>
										</subparagraph></paragraph><paragraph id="HF9991F70DE90484985B44D739B947F61"><enum>(3)</enum><header>Training</header><text>Of
				the amounts made available under this subsection, the State may use amounts
				required, but not to exceed $750,000 for a State, to train State and local
				building code officials to implement and enforce codes described in paragraph
				(2).</text>
									</paragraph><paragraph id="HDCC9DB9060DC414BAD6AD69C4A8DAB8A"><enum>(4)</enum><header>Local
				governments</header><text>States may share grants under this subsection with
				local governments that implement and enforce the codes.</text>
									</paragraph></subsection><subsection id="HB093399D8250402085FAADE5EDF2CE31"><enum>(g)</enum><header>Stretch codes
				and advanced standards</header>
									<paragraph id="HCE5AAEBDD1794AE094F72A0F6A853BFC"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall provide technical and financial
				support for the development of stretch codes and advanced standards for
				residential and commercial buildings for use as—</text>
										<subparagraph id="HA4C2315F82D148A3918FFCED9A045E24"><enum>(A)</enum><text>an option for
				adoption as a building energy code by local, tribal, or State governments;
				and</text>
										</subparagraph><subparagraph id="HE562903485DB44E284C830C3D331D63A"><enum>(B)</enum><text>guidelines for
				energy-efficient building design.</text>
										</subparagraph></paragraph><paragraph id="H3262696E112C4CF5AA4FF62BB669853F"><enum>(2)</enum><header>Targets</header><text>The
				stretch codes and advanced standards shall be designed—</text>
										<subparagraph id="H1C6B5521917B40B5A004EF9782D1260B"><enum>(A)</enum><text>to achieve
				substantial energy savings compared to the model building energy codes;
				and</text>
										</subparagraph><subparagraph id="HDEC0144C240C4533AAE3EE1CEED95B47"><enum>(B)</enum><text>to meet targets
				under section 307(b), if available, at least 3 to 6 years in advance of the
				target years.</text>
										</subparagraph></paragraph></subsection><subsection id="HD799B27B34764808B97826584FE3854E"><enum>(h)</enum><header>Studies</header><text>The
				Secretary, in consultation with building science experts from the National
				Laboratories and institutions of higher education, designers and builders of
				energy-efficient residential and commercial buildings, code officials, and
				other stakeholders, shall undertake a study of the feasibility, impact,
				economics, and merit of—</text>
									<paragraph id="H026AF30EF15C43BDB2C8567B810FA5A2"><enum>(1)</enum><text>code improvements
				that would require that buildings be designed, sited, and constructed in a
				manner that makes the buildings more adaptable in the future to become
				zero-net-energy after initial construction, as advances are achieved in
				energy-saving technologies;</text>
									</paragraph><paragraph id="H838C9B451B3D42BBA7A5AAFDC195B3F6"><enum>(2)</enum><text>code procedures to
				incorporate measured lifetimes, not just first-year energy use, in trade-offs
				and performance calculations; and</text>
									</paragraph><paragraph id="HDC548A83F70C49699536CCE2C5CD13C5"><enum>(3)</enum><text>legislative
				options for increasing energy savings from building energy codes, including
				additional incentives for effective State and local action, and verification of
				compliance with and enforcement of a code other than by a State or local
				government.</text>
									</paragraph></subsection><subsection id="HF72EFE9BD82949258C99E9558850108D"><enum>(i)</enum><header>Effect on other
				laws</header><text>Nothing in this section or section 307 supersedes or
				modifies the application of sections 321 through 346 of the Energy Policy and
				Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6291">42 U.S.C. 6291 et seq.</external-xref>).</text>
								</subsection><subsection id="HDA66B1DA2DB841819BC458CCD2CF3FA0"><enum>(j)</enum><header>Authorization of
				appropriations</header><text>There are authorized to be appropriated to carry
				out this section and section 307 $200,000,000, to remain available until
				expended.</text>
								</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="H2F49C1724F4C4C14B4C8B53F3C48605B"><enum>(c)</enum><header>Federal building
			 energy efficiency standards</header><text display-inline="yes-display-inline">Section 305 of the Energy Conservation and
			 Production Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6834">42 U.S.C. 6834</external-xref>) is amended by striking <quote>voluntary
			 building energy code</quote> each place it appears in subsections (a)(2)(B) and
			 (b) and inserting <quote>model building energy code</quote>.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="H38339692D5B5404EAD52097085492037"><enum>(d)</enum><header>Model building
			 energy codes</header><text>Section 307 of the Energy Conservation and
			 Production Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6836">42 U.S.C. 6836</external-xref>) is amended to read as follows:</text>

							<section id="H3B840ECEB3924B749A6B1AB3A1ACC2FC"><enum>307.</enum><header>Support for
				model building energy codes</header>
								<subsection id="HCE9E2BD9C032421C942501010DF15997"><enum>(a)</enum><header>In
				general</header><text>The Secretary shall support the updating of model
				building energy codes.</text>
								</subsection><subsection id="H21BCA368B7D445BBAC9A13504D39993F"><enum>(b)</enum><header>Targets</header>
									<paragraph id="HA13FCD55B76B412CB3BE4BA21179BE80"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall support the updating of the model
				building energy codes to enable the achievement of aggregate energy savings
				targets established under paragraph (2).</text>
									</paragraph><paragraph id="H22FC19B0956E4B57B2594FFF7C32C13C"><enum>(2)</enum><header>Targets</header>
										<subparagraph id="HF3408C2A519545E0858D7BEEB74335AA"><enum>(A)</enum><header>In
				general</header><text>The Secretary shall work with State, Indian tribes, local
				governments, nationally recognized code and standards developers, and other
				interested parties to support the updating of model building energy codes by
				establishing one or more aggregate energy savings targets to achieve the
				purposes of this section.</text>
										</subparagraph><subparagraph id="HC0426FB13DFC4F7DBC1B99C4F5D30B8F"><enum>(B)</enum><header>Separate
				targets</header><text>The Secretary may establish separate targets for
				commercial and residential buildings.</text>
										</subparagraph><subparagraph id="H235D381B9CF34755B39A3938A7A72757"><enum>(C)</enum><header>Baselines</header><text>The
				baseline for updating model building energy codes shall be the 2009 IECC for
				residential buildings and ASHRAE Standard 90.1–2010 for commercial
				buildings.</text>
										</subparagraph><subparagraph id="HF3539BE951A14675B97380496977DDDC"><enum>(D)</enum><header>Specific
				years</header>
											<clause id="HFE118A2C49A246F39405E3D19EE561FE"><enum>(i)</enum><header>In
				general</header><text>Targets for specific years shall be established and
				revised by the Secretary through rulemaking and coordinated with nationally
				recognized code and standards developers at a level that—</text>
												<subclause id="HADBE6E912D584724986488F990F99315"><enum>(I)</enum><text>is at the maximum
				level of energy efficiency that is technologically feasible and life-cycle cost
				effective, while accounting for the economic considerations under paragraph
				(4);</text>
												</subclause><subclause id="H252D1D91676448D78431E6956301D331"><enum>(II)</enum><text>is higher than
				the preceding target; and</text>
												</subclause><subclause id="H1A982DEF60BA4DB69AABE09347887C04"><enum>(III)</enum><text>promotes the
				achievement of commercial and residential high-performance buildings through
				high performance energy efficiency (within the meaning of section 401 of the
				Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17061">42 U.S.C. 17061</external-xref>)).</text>
												</subclause></clause><clause id="HF6B2A98251B04DD4BCB4B25BEB906A8D"><enum>(ii)</enum><header>Initial
				targets</header><text>Not later than 1 year after the date of enactment of this
				clause, the Secretary shall establish initial targets under this
				subparagraph.</text>
											</clause><clause id="HE4A0299054874183BB0FE80669637422"><enum>(iii)</enum><header>Different
				target years</header><text>Subject to clause (i), prior to the applicable year,
				the Secretary may set a later target year for any of the model building energy
				codes described in subparagraph (A) if the Secretary determines that a target
				cannot be met.</text>
											</clause><clause id="H8B9562E1AB6142A6A63751FFFF5824E2"><enum>(iv)</enum><header>Small
				business</header><text>When establishing targets under this paragraph through
				rulemaking, the Secretary shall ensure compliance with the Small Business
				Regulatory Enforcement Fairness Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/5/601">5 U.S.C. 601</external-xref> note; Public Law
				104–121).</text>
											</clause></subparagraph></paragraph><paragraph id="HF621DB21122548A6BE86EE2EEDE3F7A6"><enum>(3)</enum><header>Appliance
				standards and other factors affecting building energy use</header><text>In
				establishing building code targets under paragraph (2), the Secretary shall
				develop and adjust the targets in recognition of potential savings and costs
				relating to—</text>
										<subparagraph id="H83FE5F19A95546CE91CB774C61734E54"><enum>(A)</enum><text>efficiency gains
				made in appliances, lighting, windows, insulation, and building envelope
				sealing;</text>
										</subparagraph><subparagraph id="H6EE85D5EDE6244B489F02BB58C21860B"><enum>(B)</enum><text>advancement of
				distributed generation and on-site renewable power generation
				technologies;</text>
										</subparagraph><subparagraph id="HDABE60F0136E46938B571BF85CC2A43A"><enum>(C)</enum><text>equipment
				improvements for heating, cooling, and ventilation systems;</text>
										</subparagraph><subparagraph id="HC29C6A5E68A347FB83F39DB5D4DEE5BE"><enum>(D)</enum><text>building
				management systems and SmartGrid technologies to reduce energy use; and</text>
										</subparagraph><subparagraph id="HF14BF89936F84CA2ABB0F9FE0D354826"><enum>(E)</enum><text>other
				technologies, practices, and building systems that the Secretary considers
				appropriate regarding building plug load and other energy uses.</text>
										</subparagraph></paragraph><paragraph id="H68ADD505333C4D439651993100F03473"><enum>(4)</enum><header>Economic
				considerations</header><text>In establishing and revising building code targets
				under paragraph (2), the Secretary shall consider the economic feasibility of
				achieving the proposed targets established under this section and the potential
				costs and savings for consumers and building owners, including a return on
				investment analysis.</text>
									</paragraph></subsection><subsection id="H779E61EA5B334F9780970021BC5801EF"><enum>(c)</enum><header>Technical
				assistance to model building energy code-Setting and standard development
				organizations</header>
									<paragraph id="H8A891265A7514F62B4E9757AC7F32C30"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall, on a timely basis, provide technical
				assistance to model building energy code-setting and standard development
				organizations consistent with the goals of this section.</text>
									</paragraph><paragraph id="H42273AD9BA204CB191F338FC786E5556"><enum>(2)</enum><header>Assistance</header><text>The
				assistance shall include, as requested by the organizations, technical
				assistance in—</text>
										<subparagraph id="HF546809AFD3B4C2191C6131B287979F7"><enum>(A)</enum><text>evaluating code or
				standards proposals or revisions;</text>
										</subparagraph><subparagraph id="HE4D146C24D6043D290135206472C704D"><enum>(B)</enum><text>building energy
				analysis and design tools;</text>
										</subparagraph><subparagraph id="H0ABC5EB2C15545A9BFE9942568275EEA"><enum>(C)</enum><text>building
				demonstrations;</text>
										</subparagraph><subparagraph id="HA718DBC03A5840B9A3E7252F336A7F65"><enum>(D)</enum><text>developing
				definitions of energy use intensity and building types for use in model
				building energy codes to evaluate the efficiency impacts of the model building
				energy codes;</text>
										</subparagraph><subparagraph id="HF618F449694D42F591FF055378AA4DA7"><enum>(E)</enum><text>performance-based
				standards;</text>
										</subparagraph><subparagraph id="HA964D8428C5340B59E077E5CA4EFD863"><enum>(F)</enum><text>evaluating
				economic considerations under subsection (b)(4); and</text>
										</subparagraph><subparagraph id="H325B344BD6784813ABAA154D7E9A3893"><enum>(G)</enum><text>developing model
				building energy codes by Indian tribes in accordance with tribal law.</text>
										</subparagraph></paragraph><paragraph id="H72A77F6CA04F412BBCF7331D57581CFB"><enum>(3)</enum><header>Amendment
				proposals</header><text>The Secretary may submit timely model building energy
				code amendment proposals to the model building energy code-setting and standard
				development organizations, with supporting evidence, sufficient to enable the
				model building energy codes to meet the targets established under subsection
				(b)(2).</text>
									</paragraph><paragraph id="H0B01A98DD40F427BA6B68AB6489DA803"><enum>(4)</enum><header>Analysis
				methodology</header><text>The Secretary shall make publicly available the
				entire calculation methodology (including input assumptions and data) used by
				the Secretary to estimate the energy savings of code or standard proposals and
				revisions.</text>
									</paragraph></subsection><subsection id="H8272804B535B465DA1E617B0716E9BFD"><enum>(d)</enum><header>Determination</header>
									<paragraph id="HC378866B18B64A45909406C855C3DF1B"><enum>(1)</enum><header>Revision of
				model building energy codes</header><text>If the provisions of the IECC or
				ASHRAE Standard 90.1 regarding building energy use are revised, the Secretary
				shall make a preliminary determination not later than 90 days after the date of
				the revision, and a final determination not later than 15 months after the date
				of the revision, on whether or not the revision will—</text>
										<subparagraph id="H6D4821B0656340D785783C451025FD51"><enum>(A)</enum><text>improve energy
				efficiency in buildings compared to the existing model building energy code;
				and</text>
										</subparagraph><subparagraph id="H61A3BBCA144E48B1B9B1D1E3DC64E774"><enum>(B)</enum><text>meet the
				applicable targets under subsection (b)(2).</text>
										</subparagraph></paragraph><paragraph id="H87A134E51CCF49F9AB2CC2D43C69EDF4"><enum>(2)</enum><header>Codes or
				standards not meeting targets</header>
										<subparagraph id="H93A8FECC4A6C4030B060A200BA5AEC00"><enum>(A)</enum><header>In
				general</header><text>If the Secretary makes a preliminary determination under
				paragraph (1)(B) that a code or standard does not meet the targets established
				under subsection (b)(2), the Secretary may at the same time provide the model
				building energy code or standard developer with proposed changes that would
				result in a model building energy code that meets the targets and with
				supporting evidence, taking into consideration—</text>
											<clause id="H13A14C4B0DA44503B6DC7A71168D32F4"><enum>(i)</enum><text>whether the
				modified code is technically feasible and life-cycle cost effective;</text>
											</clause><clause id="HB88B27CD678344BABE0E973C308F8249"><enum>(ii)</enum><text>available
				appliances, technologies, materials, and construction practices; and</text>
											</clause><clause id="H0AA83F0373BD4CEF810F1B7E5ED2E7C3"><enum>(iii)</enum><text>the economic
				considerations under subsection (b)(4).</text>
											</clause></subparagraph><subparagraph id="HD45CB84519A144E58E49A71C12B1D821"><enum>(B)</enum><header>Incorporation of
				changes</header>
											<clause id="H7D11B43C59AA45419C151300B6816FD4"><enum>(i)</enum><header>In
				general</header><text>On receipt of the proposed changes, the model building
				energy code or standard developer shall have an additional 270 days to accept
				or reject the proposed changes of the Secretary to the model building energy
				code or standard for the Secretary to make a final determination.</text>
											</clause><clause id="H58FBAA9B6C02487BAA10581FEC8096D6"><enum>(ii)</enum><header>Final
				determination</header><text>A final determination under paragraph (1) shall be
				on the modified model building energy code or standard.</text>
											</clause></subparagraph></paragraph></subsection><subsection id="HD92C1A762261490E956DECE1DF54DE98"><enum>(e)</enum><header>Administration</header><text>In
				carrying out this section, the Secretary shall—</text>
									<paragraph id="HFAACBD54211643BB822C557BAC2319EC"><enum>(1)</enum><text>publish notice of
				targets and supporting analysis and determinations under this section in the
				Federal Register to provide an explanation of and the basis for such actions,
				including any supporting modeling, data, assumptions, protocols, and
				cost-benefit analysis, including return on investment; and</text>
									</paragraph><paragraph id="H388DD9DA4B79410F8CCF8A21528AD9C1"><enum>(2)</enum><text>provide an
				opportunity for public comment on targets and supporting analysis and
				determinations under this section.</text>
									</paragraph></subsection><subsection id="H42A330D1A2864B0D92F6DD658FD30E89"><enum>(f)</enum><header>Voluntary codes
				and standards</header><text>Notwithstanding any other provision of this
				section, any model building code or standard established under this section
				shall not be binding on a State, local government, or Indian tribe as a matter
				of Federal
				law.</text>
								</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection></section></subtitle><subtitle id="HD0C3E754063241D68DEB7713BF606A4D"><enum>B</enum><header>Worker training
			 and capacity building</header>
				<section id="H77196B5BF4FB41019DD6E3866E508A36"><enum>111.</enum><header>Building
			 training and assessment centers</header>
					<subsection id="HE1357962673F48C4A9072BA61F6E2FD0"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary shall
			 provide grants to institutions of higher education (as defined in section 101
			 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)) and Tribal Colleges or
			 Universities (as defined in section 316(b) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1059c">20 U.S.C. 1059c(b)</external-xref>)) to
			 establish building training and assessment centers—</text>
						<paragraph id="H9CC3B4C5A79E4F5DBAF5167868EBBEE3"><enum>(1)</enum><text>to identify
			 opportunities for optimizing energy efficiency and environmental performance in
			 buildings;</text>
						</paragraph><paragraph id="HD42344676C274CE8AAB2EBED3AF8D2F2"><enum>(2)</enum><text>to promote the
			 application of emerging concepts and technologies in commercial and
			 institutional buildings;</text>
						</paragraph><paragraph id="H0ACE6619BB554E4492C8D138D937B04B"><enum>(3)</enum><text>to train
			 engineers, architects, building scientists, building energy permitting and
			 enforcement officials, and building technicians in energy-efficient design and
			 operation;</text>
						</paragraph><paragraph id="HD24A593259FB4D25A20DE0A03CCE3067"><enum>(4)</enum><text>to assist
			 institutions of higher education and Tribal Colleges or Universities in
			 training building technicians;</text>
						</paragraph><paragraph id="HFBDB65EDD7D44FCE84EED1D93CE9EC93"><enum>(5)</enum><text>to promote
			 research and development for the use of alternative energy sources and
			 distributed generation to supply heat and power for buildings, particularly
			 energy-intensive buildings; and</text>
						</paragraph><paragraph id="HF89E9DC9F82B47EC8A93DE09C82DB607"><enum>(6)</enum><text>to coordinate with
			 and assist State-accredited technical training centers, community colleges,
			 Tribal Colleges or Universities, and local offices of the National Institute of
			 Food and Agriculture and ensure appropriate services are provided under this
			 section to each region of the United States.</text>
						</paragraph></subsection><subsection id="H744CDF85A64343138CF34279C620CF51"><enum>(b)</enum><header>Coordination and
			 nonduplication</header>
						<paragraph id="HC8DD0B14530349DDBFD589CB6C0E2357"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall coordinate the program with the
			 industrial research and assessment centers program and with other Federal
			 programs to avoid duplication of effort.</text>
						</paragraph><paragraph id="H3AC9F233C43F4C03BCE90F0624F02518"><enum>(2)</enum><header>Collocation</header><text>To
			 the maximum extent practicable, building, training, and assessment centers
			 established under this section shall be collocated with Industrial Assessment
			 Centers.</text>
						</paragraph></subsection></section></subtitle></title><title commented="no" id="HFA42811EDA554A678A39493FD5E85CEE"><enum>II</enum><header>Private
			 commercial building efficiency financing</header>
			<section id="HE2504FCB17134FDDB6AAB502B6F867E5"><enum>201.</enum><header>Private
			 commercial building efficiency financing</header>
				<subsection id="H14838773FA304A0F9ED556610D6B9E31"><enum>(a)</enum><header>In
			 general</header><text>The Secretary shall establish a program to be known as
			 the <quote>Commercial Building Energy Efficiency Financing Initiative</quote>
			 under which the Secretary shall provide grants to States (as defined in section
			 3 of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6202">42 U.S.C. 6202</external-xref>)) to establish or
			 expand programs to promote the financing of energy efficiency retrofit projects
			 for private sector and commercial buildings.</text>
				</subsection><subsection id="HD6023E58A746478791691DE302729603"><enum>(b)</enum><header>Applications</header><text>A
			 State may apply to the Secretary for a grant under this section to establish or
			 expand a program described in subsection (a), including—</text>
					<paragraph id="HA7DAB23BBECB42F39754B9C15F1C2EF8"><enum>(1)</enum><text>a
			 commercial Property Assessed Clean Energy (PACE) financing program;</text>
					</paragraph><paragraph id="HD8A4D9B7549A48F980D8B4A3A36B92ED"><enum>(2)</enum><text>a
			 credit enhancement structure that is designed to mitigate the effects of
			 default, including a loan guarantee program, loan loss reserve program,
			 collateral or subordinated capital program, or other program;</text>
					</paragraph><paragraph id="H8C20800937BB41F39EF652F60DB82656"><enum>(3)</enum><text>a
			 revolving loan fund;</text>
					</paragraph><paragraph id="H71B4CD3166764F7E861BAD9250A935D3"><enum>(4)</enum><text>a
			 program to promote the use of energy savings performance contracts or utility
			 energy service contracts, or both;</text>
					</paragraph><paragraph id="H99DF5F16E1564DBEB848F244567D93C2"><enum>(5)</enum><text>a
			 utility on-bill financing or repayment program;</text>
					</paragraph><paragraph id="H4E0A6A4B5D3C436E8F92BC2C7AB87EFC"><enum>(6)</enum><text>an interest
			 buy-down program;</text>
					</paragraph><paragraph id="HF3C14B6653FD484D9A15EF45246D1FDB"><enum>(7)</enum><text>a
			 secondary market financing program;</text>
					</paragraph><paragraph id="H870D8897FABA44FA8EB212A92AA91AE5"><enum>(8)</enum><text>a
			 leasing structure that recognizes energy costs and addresses
			 split-incentives;</text>
					</paragraph><paragraph id="H6E0E64DD5EE942F596F5C3E2A1F3E40A"><enum>(9)</enum><text>an educational
			 program involving commercial lenders, energy service companies, commercial
			 building owners, and other stakeholders established—</text>
						<subparagraph id="H5BB9B5B04A3641AA88CA021C1887302D"><enum>(A)</enum><text>to provide
			 information to the community regarding program and project options and
			 outcomes; and</text>
						</subparagraph><subparagraph id="H188BB70F86C8437D8B367E1FA35F6DC0"><enum>(B)</enum><text>to build consensus
			 on approaches to greater energy efficiency investments; and</text>
						</subparagraph></paragraph><paragraph id="HFBE53BC164674E12B8C7784A37CCFCCE"><enum>(10)</enum><text>any other
			 activity that will significantly increase the total investment in, and energy
			 savings from, building retrofit projects and programs.</text>
					</paragraph></subsection><subsection id="H181545282E054D27A4B83E321E4A77C8"><enum>(c)</enum><header>Administration</header>
					<paragraph id="HE0C954C024C8426991987D539D517F26"><enum>(1)</enum><header>In
			 general</header><text>A State receiving a grant under this section shall give a
			 higher priority to programs and projects that—</text>
						<subparagraph id="HA032EAD15E764999B5D434F06C4F5649"><enum>(A)</enum><text>leverage private
			 sources of funding; and</text>
						</subparagraph><subparagraph id="H6ADA26165B99468EAF8879D96C9D7C03"><enum>(B)</enum><text>aim explicitly to
			 expand the use of energy efficiency project financing using private sources of
			 funding, including philanthropic and other institutional investment.</text>
						</subparagraph></paragraph><paragraph id="HF3B838ED61A1464D85B71CFFCD308504"><enum>(2)</enum><header>Other
			 actions</header><text>A State receiving a grant under this section is
			 encouraged to consider establishing such other appropriate policies,
			 incentives, or actions that will advance the purposes of this section.</text>
					</paragraph></subsection><subsection id="H95D5CBF96FEE431485CAB01E02D962AA"><enum>(d)</enum><header>Evaluation of
			 programs</header><text>The Secretary shall evaluate applications from States
			 under this section on the basis of—</text>
					<paragraph id="H5CF8D7A8FB6040D9AD5CAEC42D1507AF"><enum>(1)</enum><text>the likelihood
			 that a proposed program or activity will—</text>
						<subparagraph id="H766D201501984DC2983867D0F4A1D2E3"><enum>(A)</enum><text>be established or
			 expanded;</text>
						</subparagraph><subparagraph id="H4BA08F3EE1D34E8A95781F154E93BA83"><enum>(B)</enum><text>increase the total
			 investment and energy savings of the retrofit projects to be supported;
			 and</text>
						</subparagraph><subparagraph id="H1B031172DA9B4C25B66689703761354F"><enum>(C)</enum><text>increase the total
			 investment and energy savings in a State or region in which investments and
			 energy savings have the greatest potential for growth as compared to other
			 States or regions; and</text>
						</subparagraph></paragraph><paragraph id="H4F68704DDFB5417C8440BB6CB7214840"><enum>(2)</enum><text>other factors that
			 will advance the purposes of this section, as determined by the
			 Secretary.</text>
					</paragraph></subsection><subsection id="H132A89826F544A3CA1A511A8F25D761A"><enum>(e)</enum><header>Reports</header>
					<paragraph id="H861F4588C49F4474BC3645413C544CFF"><enum>(1)</enum><header>In
			 general</header><text>Not later than 2 years after the date of the receipt of a
			 grant under this section, a State shall submit to the Secretary, the Committee
			 on Energy and Natural Resources of the Senate, and the Committee on Energy and
			 Commerce of the House of Representatives a report on the performance of
			 programs and activities carried out with the grant.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7BD6DFC3BA214E40ACA23D7F107EF1E9"><enum>(2)</enum><header>Data</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="H0CE00664B0F843A8BCFE42D071B17CEB"><enum>(A)</enum><header>In
			 general</header><text>A State receiving a grant under this section and the
			 Secretary shall cooperate to collect and share data resulting from programs and
			 activities carried out under this section.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8E1AB850A4A5458DA16DA4AB05B46FB1"><enum>(B)</enum><header>Department
			 databases</header><text>The Secretary shall incorporate data described in
			 subparagraph (A) into appropriate databases of the Department of Energy, with
			 provisions for the protection of confidential business data.</text>
						</subparagraph></paragraph></subsection><subsection id="H9DA4252B9FA146C9BB527E1BF6563B14"><enum>(f)</enum><header>Funding</header>
					<paragraph id="H02FC348BA1F54882B193A0772FF056BF"><enum>(1)</enum><header>Authorization of
			 appropriations</header><text>There is authorized to be appropriated to carry
			 out this section $250,000,000 for the period of fiscal years 2015 through 2020,
			 to remain available until expended.</text>
					</paragraph><paragraph id="HF30DFB8360904CDD912E43F016C04ABA"><enum>(2)</enum><header>Allocation</header><text>Of
			 the amount made available for a fiscal year under paragraph (1)—</text>
						<subparagraph id="HB4AF0063DA5043CC8F14BBB3E772D11E"><enum>(A)</enum><text>75 percent of the
			 amount shall be allocated on a formula-basis that is consistent with the
			 formula used to allocate funds for State energy conservation programs
			 established under part D of title III of the Energy Policy and Conservation Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/6321">42 U.S.C. 6321 et seq.</external-xref>), as determined by the Secretary; and</text>
						</subparagraph><subparagraph id="H8D18B039F0F64AC0B98A02C7FA2AA3BB"><enum>(B)</enum><text>25 percent of the
			 amount shall be distributed by the Secretary consistent with the evaluation
			 criteria established under subsection (d).</text>
						</subparagraph></paragraph><paragraph id="H7E4475DC1C204A648E737A0C525E58FF"><enum>(3)</enum><header>State energy
			 offices</header><text>Funds provided to a State under this section shall be
			 provided to the office within the State that is responsible for developing the
			 State energy plan for the State under part D of title III of the Energy Policy
			 and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6321">42 U.S.C. 6321 et seq.</external-xref>).</text>
					</paragraph></subsection></section></title><title id="H6A18F88CA1574CF791FDCFF121023E9C"><enum>III</enum><header>Industrial
			 efficiency and competitiveness</header>
			<subtitle id="HE7294DA1D1794C72BB907B0035D0E373"><enum>A</enum><header>Manufacturing
			 energy efficiency</header>
				<section id="HE4076C5AEC3B445FB1A7632FCE7B1031"><enum>301.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this subtitle are—</text>
					<paragraph id="H5BFAFF1ED2094C3395A16F775D1FE223"><enum>(1)</enum><text>to reform and
			 reorient the industrial efficiency programs of the Department of Energy;</text>
					</paragraph><paragraph id="HFC85FAC2D64349A7A2620F32CDD82C98"><enum>(2)</enum><text>to establish a
			 clear and consistent authority for industrial efficiency programs of the
			 Department;</text>
					</paragraph><paragraph id="H30BCDCA006744457BEDD34A230E904E0"><enum>(3)</enum><text>to accelerate the
			 deployment of technologies and practices that will increase industrial energy
			 efficiency and improve productivity;</text>
					</paragraph><paragraph id="H736B0CE4591546D9B4379AA74D6BACE2"><enum>(4)</enum><text>to accelerate the
			 development and demonstration of technologies that will assist the deployment
			 goals of the industrial efficiency programs of the Department and increase
			 manufacturing efficiency;</text>
					</paragraph><paragraph id="H75C86F4A520A41C59A589BC3D59F4E0F"><enum>(5)</enum><text>to stimulate
			 domestic economic growth and improve industrial productivity and
			 competitiveness; and</text>
					</paragraph><paragraph id="H9E1614EEF0254F36B1F74E5E08B037B6"><enum>(6)</enum><text>to strengthen
			 partnerships between Federal and State governmental agencies and the private
			 and academic sectors.</text>
					</paragraph></section><section id="H52CCC40BB94B480EBD03DCE653EF9FE1"><enum>302.</enum><header>Future of
			 Industry program</header>
					<subsection id="HDBE2A578C3814632A78D6BE29F63AF5D"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 452 of the
			 Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17111">42 U.S.C. 17111</external-xref>) is amended by
			 striking the section heading and inserting the following:

			 research and assessment centers</header>

			 general</header><text>Section 452(e) of the Energy Independence and Security
			 Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17111">42 U.S.C. 17111(e)</external-xref>) is amended—</text>

				the Building Technologies Program of the Department of Energy to provide
				building assessment services to manufacturers;</text>
											</clause><clause id="HB5417CBBF5B24531A37D7519313F84A2"><enum>(iii)</enum><text>increase
				partnerships with the National Laboratories of the Department of Energy to
				leverage the expertise and technologies of the National Laboratories for
				national industrial and manufacturing needs;</text>
											</clause><clause id="HDBE1DB8D18314C51857CF56B74C9B35A"><enum>(iv)</enum><text>increase
				partnerships with energy service providers and technology providers to leverage
				private sector expertise and accelerate deployment of new and existing
				technologies and processes for energy efficiency, power factor, and load
				management;</text>
											</clause><clause id="HA19A607EA3A54CC39A86C3E21E4BAAB7"><enum>(v)</enum><text>identify
				opportunities for reducing greenhouse gas emissions; and</text>
											</clause><clause id="H849B4E7F4DE24502AF0C9F43EFCCC361"><enum>(vi)</enum><text>promote
				sustainable manufacturing practices for small- and medium-sized
				manufacturers.</text>
											</clause></subparagraph></paragraph><paragraph id="HDA2F88ADA3C944A096D68F995B0A5904"><enum>(3)</enum><header>Outreach</header><text>The
				Secretary shall provide funding for—</text>
										<subparagraph id="H579F7F3435974FD1A53F19C9827D03FB"><enum>(A)</enum><text>outreach
				activities by the industrial research and assessment centers to inform small-
				and medium-sized manufacturers of the information, technologies, and services
				available; and</text>
										</subparagraph><subparagraph id="HED61A667FCBA456F8D54AC0C803BC890"><enum>(B)</enum><text>coordination
				activities by each industrial research and assessment center to leverage
				efforts with—</text>
											<clause id="H58EC5F32F7824E7C8EC10F89C89E415D"><enum>(i)</enum><text>Federal and State
				efforts;</text>
											</clause><clause id="HFF076ED896914A85904549632455CFF6"><enum>(ii)</enum><text>the efforts of
				utilities and energy service providers;</text>
											</clause><clause id="HD02A55775800402D882DEF174F177E61"><enum>(iii)</enum><text>the efforts of
				regional energy efficiency organizations; and</text>
											</clause><clause id="H5EBB1BC09BDD45088F9FF093346EC443"><enum>(iv)</enum><text>the efforts of
				other industrial research and assessment centers.</text>
											</clause></subparagraph></paragraph><paragraph id="H79437C7E02544462AB3930102EFDD80B"><enum>(4)</enum><header>Workforce
				training</header>
										<subparagraph id="H8F7C051B93404ACEB65908F6BAF62EF4"><enum>(A)</enum><header>In
				general</header><text>The Secretary shall pay the Federal share of associated
				internship programs under which students work with or for industries,
				manufacturers, and energy service providers to implement the recommendations of
				industrial research and assessment centers.</text>
										</subparagraph><subparagraph id="HD7B4067D325F409E810AF905050DC978"><enum>(B)</enum><header>Federal
				share</header><text>The Federal share of the cost of carrying out internship
				programs described in subparagraph (A) shall be 50 percent.</text>
										</subparagraph></paragraph><paragraph id="H7686D157138B42518C3FFB3B30125936"><enum>(5)</enum><header>Small business
				loans</header><text>The Administrator of the Small Business Administration
				shall, to the maximum extent practicable, expedite consideration of
				applications from eligible small business concerns for loans under the Small
				Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/631">15 U.S.C. 631 et seq.</external-xref>) to implement recommendations of industrial
				research and assessment centers established under paragraph (1).</text>
									</paragraph><paragraph id="HE8D1D977A3F544839AFBA44B87AD9150"><enum>(6)</enum><header>Advanced
				manufacturing steering committee</header><text>The Secretary shall establish an
				advisory steering committee to provide recommendations to the Secretary on
				planning and implementation of the Advanced Manufacturing Office of the
				Department of
				Energy.</text>
									</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
							</subparagraph></paragraph></subsection></section><section id="H5502607413624A7FA91A6EB56276FDD6"><enum>303.</enum><header>Sustainable
			 manufacturing initiative</header>
					<subsection id="H74FD1082B966418784199CC91A209383"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Part E of title III
			 of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6341">42 U.S.C. 6341</external-xref>) is amended by adding
			 at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H5116F78BFC01494583CAB7F4D6A379E4" style="OLC">
							<section id="H58DEA3B548EA4785B23E4E9563DD4772"><enum>376.</enum><header>Sustainable
				manufacturing initiative</header>
								<subsection id="H6182617C7B784FDBBD28C6F988CD9546"><enum>(a)</enum><header>In
				general</header><text>As part of the Office of Energy Efficiency and Renewable
				Energy, the Secretary, on the request of a manufacturer, shall conduct onsite
				technical assessments to identify opportunities for—</text>
									<paragraph id="HE1683D1E4BFB4A0693BE6EB2AB78E26F"><enum>(1)</enum><text>maximizing the
				energy efficiency of industrial processes and cross-cutting systems;</text>
									</paragraph><paragraph id="HD7F6FE669B32488288DAAE495F567AEA"><enum>(2)</enum><text>preventing
				pollution and minimizing waste;</text>
									</paragraph><paragraph id="HBDDCFF8E482B4066835598272FA14C28"><enum>(3)</enum><text>improving
				efficient use of water in manufacturing processes;</text>
									</paragraph><paragraph id="HA5B4FE880AEA40098FEB3929C258B18B"><enum>(4)</enum><text>conserving natural
				resources; and</text>
									</paragraph><paragraph id="H13618F472D344C12948848AD0D074890"><enum>(5)</enum><text>achieving such
				other goals as the Secretary determines to be appropriate.</text>
									</paragraph></subsection><subsection id="HE3093B86C2A5440FAEF727D20A770B44"><enum>(b)</enum><header>Coordination</header><text>The
				Secretary shall carry out the initiative in coordination with the private
				sector and appropriate agencies, including the National Institute of Standards
				and Technology, to accelerate adoption of new and existing technologies and
				processes that improve energy efficiency.</text>
								</subsection><subsection id="HBED48AE8087A4141AA592F8EA1999C86"><enum>(c)</enum><header>Research and
				development program for sustainable manufacturing and industrial technologies
				and processes</header><text>As part of the industrial efficiency programs of
				the Department of Energy, the Secretary shall carry out a joint
				industry-government partnership program to research, develop, and demonstrate
				new sustainable manufacturing and industrial technologies and processes that
				maximize the energy efficiency of industrial plants, reduce pollution, and
				conserve natural
				resources.</text>
								</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="H32C729B06334432F813F72CC5824DDE2"><enum>(b)</enum><header>Table of
			 contents</header><text>The table of contents of the Energy Policy and
			 Conservation Act (42 U.S.C. prec. 6201) is amended by adding at the end of the
			 items relating to part E of title III the following:</text>

					</subsection></section></subtitle><subtitle id="H6E838278246D406682C53520FC569776"><enum>B</enum><header>Supply
			 Star</header>
				<section commented="no" display-inline="no-display-inline" id="H7DDCAB45CD134D96BC0E2DC1C199E598" section-type="subsequent-section"><enum>311.</enum><header display-inline="yes-display-inline">Supply Star</header><text display-inline="no-display-inline">The Energy Policy and Conservation Act is
			 amended by inserting after section 324A (<external-xref legal-doc="usc" parsable-cite="usc/42/6294a">42 U.S.C. 6294a</external-xref>) the following:</text>

				of Energy a Supply Star program to identify and promote practices, recognize
				companies, and, as appropriate, recognize products that use highly efficient
				supply chains in a manner that conserves energy, water, and other
				resources.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="HB00E423E9B5B43BC8FE813DAF4623F34"><enum>(b)</enum><header display-inline="yes-display-inline">Coordination</header><text display-inline="yes-display-inline">In carrying out the program described in
				subsection (a), the Secretary shall—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="H240A4031CDEB495DA519FC3A042C9FEB"><enum>(1)</enum><text display-inline="yes-display-inline">consult with other appropriate agencies;
				and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6CFAE42995074C9D98138B18203C8490"><enum>(2)</enum><text display-inline="yes-display-inline">coordinate efforts with the Energy Star
				program established under section 324A.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H6F7E98EE644349D490779F43DBF8FCB9"><enum>(c)</enum><header display-inline="yes-display-inline">Duties</header><text display-inline="yes-display-inline">In carrying out the Supply Star program
				described in subsection (a), the Secretary shall—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="H394047B7C7D64B8BA774C31710078F5D"><enum>(1)</enum><text display-inline="yes-display-inline">promote practices, recognize companies,
				and, as appropriate, recognize products that comply with the Supply Star
				program as the preferred practices, companies, and products in the marketplace
				for maximizing supply chain efficiency;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H37DD27B842B44C208B395FCABA92F87D"><enum>(2)</enum><text display-inline="yes-display-inline">work to enhance industry and public
				awareness of the Supply Star program;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H50B9800E55794D119C40D162B4FFB71B"><enum>(3)</enum><text display-inline="yes-display-inline">collect and disseminate data on supply
				chain energy resource consumption;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9FF3BAC3854E479BB574C60564EF940B"><enum>(4)</enum><text display-inline="yes-display-inline">develop and disseminate metrics, processes,
				and analytical tools (including software) for evaluating supply chain energy
				resource use;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H188EA322BD654AD8ACD6B3AB086317C4"><enum>(5)</enum><text display-inline="yes-display-inline">develop guidance at the sector level for
				improving supply chain efficiency;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H76627CA5AA3A4480A74666DACD232466"><enum>(6)</enum><text display-inline="yes-display-inline">work with domestic and international
				organizations to harmonize approaches to analyzing supply chain efficiency,
				including the development of a consistent set of tools, templates, calculators,
				and databases; and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5FDE57AC96554BA096FED21566A3F1CB"><enum>(7)</enum><text display-inline="yes-display-inline">work with industry, including small
				businesses, to improve supply chain efficiency through activities that
				include—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="HE643571795634731B2381AE311E22E21"><enum>(A)</enum><text display-inline="yes-display-inline">developing and sharing best practices;
				and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H89093C93C7B74615B5B655811B1296DF"><enum>(B)</enum><text display-inline="yes-display-inline">providing opportunities to benchmark supply
				chain efficiency.</text>
									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H2BB4372C4F4C4BA39387CAEEB8038730"><enum>(d)</enum><header display-inline="yes-display-inline">Evaluation</header><text display-inline="yes-display-inline">In any evaluation of supply chain
				efficiency carried out by the Secretary with respect to a specific product, the
				Secretary shall consider energy consumption and resource use throughout the
				entire lifecycle of a product, including production, transport, packaging, use,
				and disposal.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="H52E00DE119C3432B88FE8AB2DC167ABD"><enum>(e)</enum><header display-inline="yes-display-inline">Grants and Incentives</header>
								<paragraph commented="no" display-inline="no-display-inline" id="H897958D669FA45EE9673FE6958F767E3"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary may award grants or other
				forms of incentives on a competitive basis to eligible entities, as determined
				by the Secretary, for the purposes of—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="HF3C8CEAC75B8486588655502E7D078E1"><enum>(A)</enum><text display-inline="yes-display-inline">studying supply chain energy resource
				efficiency; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3F2D09952FA6420BAA48E9541E2CFA1C"><enum>(B)</enum><text display-inline="yes-display-inline">demonstrating and achieving reductions in
				the energy resource consumption of commercial products through changes and
				improvements to the production supply and distribution chain of the
				products.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H519DEBEDAE8B442FACE0ED43A8304B12"><enum>(2)</enum><header display-inline="yes-display-inline">Use of information</header><text display-inline="yes-display-inline">Any information or data generated as a
				result of the grants or incentives described in paragraph (1) shall be used to
				inform the development of the Supply Star Program.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HB951F8AE4FB54D81B962DAB1F2F20A5C"><enum>(f)</enum><header display-inline="yes-display-inline">Training</header><text display-inline="yes-display-inline">The Secretary shall use funds to support
				professional training programs to develop and communicate methods, practices,
				and tools for improving supply chain efficiency.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="HDFF8DD84620F422390634476340F08BE"><enum>(g)</enum><header>Effect of impact
				on climate change</header><text>For purposes of this section, the impact on
				climate change shall not be a factor in determining supply chain
				efficiency.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="H009D957477D1417D9BEA61770BC0B778"><enum>(h)</enum><header>Effect of
				outsourcing of American jobs</header><text>For purposes of this section, the
				outsourcing of American jobs in the production of a product shall not count as
				a positive factor in determining supply chain efficiency.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="H7446BB206FD349ADA9EF17AD6E84CE07"><enum>(i)</enum><header display-inline="yes-display-inline">Authorization of
				Appropriations</header><text display-inline="yes-display-inline">There is
				authorized to be appropriated to carry out this section $10,000,000 for the
				period of fiscal years 2014 through
				2023.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</section></subtitle><subtitle id="H43D8A83BD6D5401F870BFCF3D7643445"><enum>C</enum><header>Electric motor
			 rebate program</header>
				<section id="HC6BF7F168939470293DE574467B18888"><enum>321.</enum><header>Energy saving
			 motor control rebate program</header>
					<subsection id="H335E6933EAF44F22A89F781BC5C8F81A"><enum>(a)</enum><header>Establishment</header><text>Not
			 later than January 1, 2014, the Secretary shall establish a program to provide
			 rebates for expenditures made by entities for the purchase and installation of
			 a new constant speed electric motor control that reduces motor energy use by
			 not less than 5 percent.</text>
					</subsection><subsection id="HC6AF300E48BC4E4DA9754D9324A5CFA2"><enum>(b)</enum><header>Requirements</header>
						<paragraph id="HCFC42CFE4F714F78A10D7314124E8D72"><enum>(1)</enum><header>Application</header><text>To
			 be eligible to receive a rebate under this section, an entity shall submit to
			 the Secretary an application in such form, at such time, and containing such
			 information as the Secretary may require, including—</text>
							<subparagraph id="HBF0262A6B3204DB09ECD983E47D1F28E"><enum>(A)</enum><text>demonstrated
			 evidence that the entity purchased a constant speed electric motor control that
			 reduces motor energy use by not less than 5 percent; and</text>
							</subparagraph><subparagraph id="H601C665510B94A47A4F3FCC53588BA5A"><enum>(B)</enum><text>the physical
			 nameplate of the installed motor of the entity to which the energy saving motor
			 control is attached.</text>
							</subparagraph></paragraph><paragraph id="HD9AE6702ED2B4921865FF6AD780E658B"><enum>(2)</enum><header>Authorized
			 amount of rebate</header><text>The Secretary may provide to an entity that
			 meets the requirements of paragraph (1) a rebate the amount of which shall be
			 equal to the product obtained by multiplying—</text>
							<subparagraph id="H3B5233F184144A07B1B00E03FC91821F"><enum>(A)</enum><text>the nameplate
			 horsepower of the electric motor to which the energy saving motor control is
			 attached; and</text>
							</subparagraph><subparagraph id="H4C003ABC3C34453EB5FCB60543876213"><enum>(B)</enum><text>$25.</text>
							</subparagraph></paragraph></subsection><subsection id="H94E94A31A779404CA7234D8D473AA09B"><enum>(c)</enum><header>Authorization of
			 Appropriations</header><text>There is authorized to be appropriated to carry
			 out this section $5,000,000 for each of fiscal years 2014 and 2015, to remain
			 available until expended.</text>
					</subsection></section></subtitle><subtitle id="H7618A8AC1F6B43DB822870730C9A4DA1"><enum>D</enum><header>Transformer rebate
			 program</header>
				<section id="H80AB3B9559D44097A1EFDD194284EBAF"><enum>331.</enum><header>Energy
			 efficient transformer rebate program</header>
					<subsection id="H7FE1E725C2554D9D84B80448FFDDC15E"><enum>(a)</enum><header>Definition of
			 qualified transformer</header><text>In this section, the term <term>qualified
			 transformer</term> means a transformer that meets or exceeds the National
			 Electrical Manufacturers Association (NEMA) Premium Efficiency designation,
			 calculated to 2 decimal points, as having 30 percent fewer losses than the NEMA
			 TP–1–2002 efficiency standard for a transformer of the same number of phases
			 and capacity, as measured in kilovolt-amperes.</text>
					</subsection><subsection id="HB49B94622BB7476F97046FCCEC2079E9"><enum>(b)</enum><header>Establishment</header><text>Not
			 later than January 1, 2014, the Secretary shall establish a program under which
			 rebates are provided for expenditures made by owners of industrial or
			 manufacturing facilities, commercial buildings, and multifamily residential
			 buildings for the purchase and installation of a new energy efficient
			 transformers.</text>
					</subsection><subsection id="H55102D48F76B472FBE8AD99A73B7FC0B"><enum>(c)</enum><header>Requirements</header>
						<paragraph id="H440EAFDF14BC4F608C0E7322B4DB75D4"><enum>(1)</enum><header>Application</header><text>To
			 be eligible to receive a rebate under this section, an owner shall submit to
			 the Secretary an application in such form, at such time, and containing such
			 information as the Secretary may require, including demonstrated evidence that
			 the owner purchased a qualified transformer.</text>
						</paragraph><paragraph id="HB42E1D5CE5124DA783EC57324F9B7728"><enum>(2)</enum><header>Authorized
			 amount of rebate</header><text>For qualified transformers, rebates, in dollars
			 per kilovolt-ampere (referred to in this paragraph as <quote>kVA</quote>) shall
			 be—</text>
							<subparagraph id="H59783B1897044DACB025D3AD0EF255E9"><enum>(A)</enum><text>for 3-phase
			 transformers—</text>
								<clause id="H92D9264503EE457382FC305D6FC6FF77"><enum>(i)</enum><text>with
			 a capacity of not greater than 10 kVA, 15;</text>
								</clause><clause id="H716FA5499E174C6C8C85D3F8DAF882EA"><enum>(ii)</enum><text>with a capacity
			 of not less than 10 kVA and not greater than 100 kVA, the difference between 15
			 and the quotient obtained by dividing—</text>
									<subclause id="H7D9B3418469E44EB973FC0DA15BB7D1C"><enum>(I)</enum><text>the difference
			 between—</text>
										<item id="H3E73F5058DA64B44BE96E5167248B992"><enum>(aa)</enum><text>the
			 capacity of the transformer in kVA; and</text>
										</item><item id="HF0916926C38745E1A6844C4DBC755FFB"><enum>(bb)</enum><text>10;
			 by</text>
										</item></subclause><subclause id="H0320238408FA4063949D0AB9B4A48FA0"><enum>(II)</enum><text>9; and</text>
									</subclause></clause><clause id="H29AEC44FF5524C0E91E34746793020DF"><enum>(iii)</enum><text>with a capacity
			 greater than or equal to 100 kVA, 5; and</text>
								</clause></subparagraph><subparagraph id="H7FB6C27D33C24D2CB706101ADC67C806"><enum>(B)</enum><text>for single-phase
			 transformers, 75 percent of the rebate for a 3-phase transformer of the same
			 capacity.</text>
							</subparagraph></paragraph></subsection><subsection id="H8A8572F6306E45DA9F5587D077C9ADA7"><enum>(d)</enum><header>Authorization of
			 appropriations</header><text>There is authorized to be appropriated to carry
			 out this section $5,000,000 for each of fiscal years 2014 and 2015, to remain
			 available until expended.</text>
					</subsection></section></subtitle></title><title id="H032908A845D7477B88B6B6C12C11A437"><enum>IV</enum><header>Federal agency
			 energy efficiency</header>
			<section id="H930EB573386E433C8C96545E76D6A839"><enum>401.</enum><header>Adoption of
			 information and communications technology power savings techniques by Federal
			 agencies</header>
				<subsection id="H35005983452A439C9D2E5D044930063B"><enum>(a)</enum><header>In
			 general</header><text>Not later than 360 days after the date of enactment of
			 this Act, the Secretary, in consultation with the Secretary of Defense, the
			 Secretary of Veterans Affairs, and the Administrator of General Services, shall
			 issue guidance for Federal agencies to employ advanced tools promoting energy
			 efficiency and energy savings through the use of information and communications
			 technologies, including computer hardware, energy efficiency software, and
			 power management tools.</text>
				</subsection><subsection id="H0C7BE34883A74046B21A1E4A4CE0981E"><enum>(b)</enum><header>Reports on plans
			 and savings</header><text>Not later than 180 days after the date of the
			 issuance of the guidance under subsection (a), each Federal agency shall submit
			 to the Secretary a report that describes—</text>
					<paragraph id="H71179E4FA8F2419CA0AA588C3F1EA2A5"><enum>(1)</enum><text>the plan of the
			 agency for implementing the guidance within the agency; and</text>
					</paragraph><paragraph id="H590E57CEA0D244C0ABA6FCF174EB129E"><enum>(2)</enum><text>estimated energy
			 and financial savings from employing the tools and processes described in
			 subsection (a).</text>
					</paragraph></subsection></section><section id="H6247435B6FE64496B4DD0BDC7D59D164"><enum>402.</enum><header>Availability of
			 funds for design updates</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/40/3307">Section 3307</external-xref> of title 40, United States
			 Code, is amended—</text>
				<paragraph id="HC96BD59A1AC1404DBFD699D8B003A8ED"><enum>(1)</enum><text>by redesignating
			 subsections (d) through (h) as subsections (e) through (i), respectively;
			 and</text>
				</paragraph><paragraph id="H0B16EAE370334ABFA07570C87507910D"><enum>(2)</enum><text>by inserting after
			 subsection (c) the following:</text>
					<quoted-block display-inline="no-display-inline" id="HADC835D0EAA8445493627533A524D7DB" style="OLC">
						<subsection id="H62A16831589B4D8095FCED1053369F0E"><enum>(d)</enum><header>Availability of
				funds for design updates</header>
							<paragraph id="H9CC417E3DCF246159DC9C0F484405495"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraph (2), for any project for which
				congressional approval is received under subsection (a) and for which the
				design has been substantially completed but construction has not begun, the
				Administrator of General Services may use appropriated funds to update the
				project design to meet applicable Federal building energy efficiency standards
				established under section 305 of the Energy Conservation and Production Act (42
				U.S.C. 6834) and other requirements established under section 3312.</text>
							</paragraph><paragraph id="H79F4CB96EEDB4EFBA096D0EA48618896"><enum>(2)</enum><header>Limitation</header><text>The
				use of funds under paragraph (1) shall not exceed 125 percent of the estimated
				energy or other cost savings associated with the updates as determined by a
				life cycle cost analysis under section 544 of the National Energy Conservation
				Policy Act (42 U.S.C.
				8254).</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="H882D551CBE57463CBFFBD9DCA7EA93ED"><enum>403.</enum><header>Natural gas and
			 electric vehicle infrastructure</header><text display-inline="no-display-inline">Section 804(4) of the National Energy
			 Conservation Policy Act (<external-xref legal-doc="usc" parsable-cite="usc/42/8287c">42 U.S.C. 8287c(4)</external-xref>) is amended—</text>
				<paragraph id="H6E92A8566EE341D0B196B7F0563EC93D"><enum>(1)</enum><text>in subparagraph
			 (A), by striking <quote>or</quote> after the semicolon;</text>
				</paragraph><paragraph id="H16ADC6135C924A5B8091788A0A5D44D1"><enum>(2)</enum><text>in subparagraph
			 (B), by striking the period at the end and inserting <quote>; or</quote>;
			 and</text>
				</paragraph><paragraph id="H8C5ED388DEA34691B7DA3CDC7949534E"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H945079644D854AC383D797479B697D43" style="OLC">
						<subparagraph id="H0D3847F1001346BAA0FA1C74F839ECD4"><enum>(C)</enum><text>a measure to
				support the use of natural gas vehicles and electric vehicles or the fueling or
				charging infrastructure necessary for natural gas vehicles and electric
				vehicles, including the use of utility energy service contracts to support
				those vehicles or
				infrastructure.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="HC5BB582303314524918696F75E00FB5B"><enum>404.</enum><header>Federal data
			 center consolidation</header><text display-inline="no-display-inline">Not later
			 than 180 days after the date of enactment of this Act, the Administrator for
			 the Office of E-Government and Information Technology within the Office of
			 Management and Budget shall develop and publish a goal for the total amount of
			 planned energy and cost savings and increased productivity by the Federal
			 Government through the consolidation of Federal data centers during the 5-year
			 period beginning on the date of enactment of this Act, which shall include a
			 breakdown on a year-by-year basis of the projected savings and productivity
			 gains.</text>
			</section></title><title id="HE4D280DE45E44C339542B17351DC3975"><enum>V</enum><header>Miscellaneous</header>
			<section id="H64EF3D9F3A8B42838C737406B86B7714"><enum>501.</enum><header>Budgetary
			 effects</header><text display-inline="no-display-inline">The budgetary effects
			 of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act
			 of 2010, shall be determined by reference to the latest statement titled
			 <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted
			 for printing in the Congressional Record by the Chairman of the Senate Budget
			 Committee, provided that such statement has been submitted prior to the vote on
			 passage.</text>
			</section><section id="HDE121FAD5D6C4CCA93C8435DA550F322"><enum>502.</enum><header>Advance
			 appropriations required</header><text display-inline="no-display-inline">The
			 authorization of amounts under this Act and the amendments made by this Act
			 shall be effective for any fiscal year only to the extent and in the amount
			 provided in advance in appropriations Acts.</text>
