2.Congress finds the following:
(1)Geospatial data is
necessary and essential to—
(A)the management of
natural resources;
(B)economic
development;
(C)the management,
adjudication, and prevention of future disruptions in the home mortgage
system;
(D)the development
and implementation of a smart energy grid;
(E)the deployment of
universal domestic broadband service;
(F)the management of
Federal real property assets;
(G)emergency
preparedness and response;
(H)homeland
security;
(I)the delivery of
efficient health care and other services provided, financed, or regulated by
the Federal Government; and
(J)the maintenance,
rehabilitation, and enhancement of public works, transportation, and other
infrastructure of the United States.
(2)The geospatial
technology field is a high growth, high demand, and economically vital sector
of the economy of the United States.
(3)The United States
is the leader in the global geospatial technology field. The thousands of
geospatial firms in the United States, which include many small businesses, are
among the most capable and qualified geospatial firms in the international
market.
(4)Geospatial
technologies can enhance the operations of Government in planning and analysis,
asset management, situation awareness, workforce empowerment, citizen
engagement, transparency, education, and other services.
(5)The full use and
exploitation of geospatial technologies can foster economic growth, contribute
to environmental stewardship, and enable scientific and technological
excellence.
(6)Studies have
indicated that Federal agencies are not effectively using geospatial
technologies and can improve the management of information resources and other
applications.
(7)Efforts to reduce
redundancies in geospatial investments have not been fully successful. Federal
agencies are still independently acquiring and maintaining potentially
duplicative and costly data sets and systems and until these problems are
resolved, duplicative geospatial investments are likely to persist.
3.The purposes of this Act shall be to—
(1)ensure that a
centralized and comprehensive database of geospatial data for the United States
is available for use by the Federal Government to—
(A)improve the
quality of services provided by the Federal Government; and
(B)reduce the costs
to the Federal Government of providing such services;
(2)coordinate Federal
agencies, State and local governments, and private entities to—
(A)maximize the use
of private geospatial firms for the performance of Federal geospatial
activities; and
(B)eliminate
redundancy in the Federal performance of geospatial activities;
(3)foster the
establishment and growth of private geospatial firms in the United States;
and
(4)facilitate the
development of new geospatial technology in the United States.
4.In this Act:
(1)The term
Administrator means the Administrator of the National Geospatial
Technology Administration.
(2)The term
geospatial activity means—
(A)the collection of
geospatial data, including collection from terrestrial, ground-based, airborne,
or spaceborne platforms;
(B)the organization
of geospatial data, including organization in a survey (including a GPS or
field survey), map, chart, plan, report, or description;
(C)the storage,
dissemination, and retrieval of geospatial data;
(D)the interpretation
and use of geospatial data;
(E)the development of
products or technology to facilitate the activities described in subparagraphs
(A) through (D); and
(F)activities (other
than exclusively business-related activities) for the enhancement of geospatial
data and its use.
(3)The term
geospatial data means data—
(A)relating to
natural and human-made physical features and phenomena on or below the surface
of the Earth or in the space above the Earth, which may include data on the
size, shape, and location of such features, and data on the legal boundaries
relating to such features; and
(B)developed by
professionals, including surveyors, photogrammetrists, hydrographers,
geodesists, and cartographers.
(4)The term
licensed geospatial data means—
(A)commercial
off-the-shelf (COTS) data produced by a commercial provider that exists prior
to any purchase or procurement by the Government and is made available to the
market via an agreement of license with specific terms including rights and
restrictions;
(B)the cost of such
data is available from the provider’s published price list;
(C)delivery of such
data is provided at the point of sale;
(D)the specifications
for such data are prescribed by the provider and not subject to change at the
Government’s request; and
(E)a transaction in
which the Government does not become involved with defining any portion of the
geospatial data product specifications, requirements, uses, or design, which
shall be considered a professional service subject to section 303 of this
Act.
(5)The term
private geospatial firm means a private individual, firm,
partnership, corporation, association, or other legal entity organized and
permitted by law to engage in geospatial activities, that engages in such
activities—
(A)as a regular
course of trade or business; and
(B)with the principal
objective of livelihood and profit.
(6)The term
real property means land and—
(A)crops, forests,
and other resources attached to or contained in the land;
(B)buildings or other
structures on the land; and
(C)improvements to
the land, including fixtures permanently attached to the land or to structures
on the land.
(7)The term
State means each of the several States, the District of Columbia,
the Commonwealth of Puerto Rico, the United States Virgin Islands, Guam,
American Samoa, the Commonwealth of the Northern Mariana Islands, and any other
territory or possession of the United States.
5.Nothing in this Act
shall be construed to confer a private right of action on any person nor shall
affect any valid existing private property rights.
<enum>I</enum><header>NATIONAL
GEOSPATIAL TECHNOLOGY ADMINISTRATION</header>
<section id="HFA5F75850D2F46299A018936EA2123FE"><enum>101.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
<paragraph id="H13B4C7E722CF49E8ACD6FC4A171AFCB1"><enum>(1)</enum><text>The term
<term>cadastral information</term> means information on real property that
includes information on—</text>
<subparagraph id="H6B0F15EB932F49E8BA1DC8BB10DA4831"><enum>(A)</enum><text>the location,
boundaries, and size of the property; and</text>
</subparagraph><subparagraph id="HB814C9EC771B4543B68AD87EF498E145"><enum>(B)</enum><text>the use, value,
ownership (including any interest, benefit, right, or privilege in the
property), and assets of the property.</text>
</subparagraph></paragraph><paragraph id="H5421471CE24A49C2994A8A94D2774F58"><enum>(2)</enum><text>The term
<term>cadastral parcel</term> means a single area of land or, more
particularly, a volume of space, under homogeneous real property rights, unique
ownership, subdivision, or description, and address.</text>
</paragraph><paragraph id="H04AE84CABFA241D38AE9DFE39DF9FE8B"><enum>(3)</enum><text>The term
<term>geodetic control information</term> means information on the coordinate
positions of geographic data established using a common reference
system.</text>
</paragraph><paragraph id="H1A43B591386641E1B36B671662F9D26D"><enum>(4)</enum><text>The term
<term>orthoimagery</term> means georeferenced image maps prepared from an
aerial photograph or remotely sensed data from which displacements of images
caused by sensor orientation and terrain relief have been removed.</text>
</paragraph><paragraph id="H626EA2D55AAD44DB8B44B0A21092DF83"><enum>(5)</enum><text>The term
<term>elevation and bathymetry</term> means high-quality topographic data and
other three-dimensional representations of the Nation’s natural and constructed
features, including the depths of bodies of water.</text>
</paragraph></section><section id="H4F2E0EF0109F493B91EC7647A6FC44C3"><enum>102.</enum><header>National
Geospatial Technology Administration</header>
<subsection id="H4E65159122F244349BEED207DCAE0750"><enum>(a)</enum><header>Establishment</header><text>To
carry out the purposes of this Act, there is established within the Department
of the Interior the National Geospatial Technology Administration.</text>
</subsection><subsection id="HD6651B7441C0405ABB5F022B9076411E"><enum>(b)</enum><header>Administrator</header>
<paragraph id="HFB8A370EC6D84E86A17784EED272D76C"><enum>(1)</enum><header>In
general</header><text>The National Geospatial Technology Administration shall
be headed by an Administrator, who shall report directly to the Secretary of
the Interior.</text>
</paragraph><paragraph id="H31812E5CD3814B7A9E0C1B22B9AD929E"><enum>(2)</enum><header>Appointment</header><text>The
Administrator shall be appointed by the President, by and with the advice and
consent of the Senate.</text>
</paragraph></subsection></section><section id="H127DF6354655425D9C90AF0DA8451AA8"><enum>103.</enum><header>Establishment
and maintenance of National Geospatial Database</header>
<subsection id="H82554EF7E19740D29FCD7C4732FD25A7"><enum>(a)</enum><header>Establishment</header><text>The
Administrator shall establish and maintain a comprehensive database of
geospatial data for all lands owned or managed by the United States (including
public lands), all Indian trust parcels, and, to the extent possible, all
non-Federal lands in each State. The database shall be known as the
<quote>National Geospatial Database</quote>.</text>
</subsection><subsection id="HC3E589AF2818451ABB5FAC3085FF90E1"><enum>(b)</enum><header>Contents of
database</header><text>The National Geospatial Database shall include, for all
lands described in subsection (a), the following geospatial data (as
applicable):</text>
<paragraph id="H0FD35D92B44A4C4D8D436B8478FD9803"><enum>(1)</enum><text>Cadastral
information, organized on large scale maps—</text>
<subparagraph id="H56B8D43A0C8C4AFDA9CDD0A41E4F391D"><enum>(A)</enum><text>using a geodetic
network as a reference frame;</text>
</subparagraph><subparagraph id="H417449681FD3405D9892386390C67B59"><enum>(B)</enum><text>with a cadastral
boundary overlay delineating all cadastral parcels; and</text>
</subparagraph><subparagraph id="H01F7CE75023147B08CDE19C741847014"><enum>(C)</enum><text>with a system for
indexing and identifying each cadastral parcel.</text>
</subparagraph></paragraph><paragraph id="H49987A19AADD4876953AA0EB9BEB9CB0"><enum>(2)</enum><text>Geodetic control
information.</text>
</paragraph><paragraph id="HC94A84C76A624F54A0939E35162E50FC"><enum>(3)</enum><text>Orthoimagery.</text>
</paragraph><paragraph id="HCA0E01B88E8F4FC083973D2EAB30B7E3"><enum>(4)</enum><text>Elevation and
bathymetry.</text>
</paragraph><paragraph id="H8AFF3B630BD64E7CB371555BF19BADC4"><enum>(5)</enum><text>Information on
transportation networks.</text>
</paragraph><paragraph id="H56627EB6BC824453AAB8EC002B7802E8"><enum>(6)</enum><text>Hydrography.</text>
</paragraph><paragraph id="H6AC81DC0D4A24F3FB625CD0EA46186C5"><enum>(7)</enum><text>Information on
underground infrastructure, including the location, type, size, composition,
and use of underground structures including tunnels and pipelines, including
through reference to—</text>
<subparagraph id="H1C3CE399F5AE40F8B32EA095E2CB8908"><enum>(A)</enum><text>aerial
photogrammetric maps;</text>
</subparagraph><subparagraph id="H86C85FBD00B84BC9A53AD0A0369200C6"><enum>(B)</enum><text>GPS and field
surveys;</text>
</subparagraph><subparagraph id="H599E713542CF4B91BFBF98B283C4793A"><enum>(C)</enum><text>as-built
drawings;</text>
</subparagraph><subparagraph id="HE6EFBDBE46B04941A486F6B60D7F5EEF"><enum>(D)</enum><text>service connection
cards; and</text>
</subparagraph><subparagraph id="H507DFA6A83224B51A23F0F9391F94981"><enum>(E)</enum><text>historical maps
and documents.</text>
</subparagraph></paragraph><paragraph id="HB267741A6B1344AC8798E95CF1906026"><enum>(8)</enum><text>Information on the
geographic areas of governmental and administrative units.</text>
</paragraph><paragraph id="HBD69DDED45104285BE7E1C38E0C16A35"><enum>(9)</enum><text>In the case of
Federal property, any recommendation the Administrator has made about the
property under section 104(b).</text>
</paragraph><paragraph id="H73A88AA0B09C4B188A9994EC1E721C7B"><enum>(10)</enum><text>Other geospatial
data determined by the Administrator, in consultation with the National
Geospatial Policy Commission, to be useful in carrying out national priorities
including—</text>
<subparagraph id="HB9D795B4C93E4450A2720E00AF96B029"><enum>(A)</enum><text>economic
development;</text>
</subparagraph><subparagraph id="HFADDF6DA34A54C2686FC379557C9AE53"><enum>(B)</enum><text>the management,
adjudication, and prevention of future disruptions in the home mortgage
system;</text>
</subparagraph><subparagraph id="H87558B489DE2406BBD9896DAA5495001"><enum>(C)</enum><text>the development
and implementation of a smart energy grid;</text>
</subparagraph><subparagraph id="H04EB3764238D405B8EA58DA5E7EA68D5"><enum>(D)</enum><text>the deployment of
universal domestic broadband service;</text>
</subparagraph><subparagraph id="HEAABC641E050432280EA9B482699658E"><enum>(E)</enum><text>the management of
Federal real property assets;</text>
</subparagraph><subparagraph id="H3978252C8F4C46BA9446805D2B586527"><enum>(F)</enum><text>emergency
preparedness and response;</text>
</subparagraph><subparagraph id="H498280FBCCEA40F88D24351FAAAFD614"><enum>(G)</enum><text>homeland
security;</text>
</subparagraph><subparagraph id="H623AD7AB223B4E3982F1FDB319E7E618"><enum>(H)</enum><text>the delivery of
efficient health care and other services provided, financed, or regulated by
the Federal Government; and</text>
</subparagraph><subparagraph id="H71D10AFCCF564979BB864ABE159F5DA9"><enum>(I)</enum><text>the maintenance,
rehabilitation, and enhancement of the public works, transportation, and other
infrastructure of the United States.</text>
</subparagraph></paragraph></subsection><subsection commented="no" id="HC5F559A9382A428B87EC6E1B7A02BAC1"><enum>(c)</enum><header>Return on
Investment</header><text>The Administrator, in consultation with the National
Geospatial Policy Commission, shall provide a return on investment analysis and
economic benefit assessment of the National Geospatial Database.</text>
</subsection><subsection id="H4A5D6A7295D348B8BFE9915CD1B6363E"><enum>(d)</enum><header>Public
availability</header>
<paragraph id="H049312FC7925488C99ADAEE1EFF08486"><enum>(1)</enum><header>In
general</header><text>Except as provided by paragraph (2), the National
Geospatial Database shall be available to the public.</text>
</paragraph><paragraph id="HC75A21A8FD2C42B8AAEC2940A6B79AF1"><enum>(2)</enum><header>Exception for
national security</header><text>The Administrator shall withhold from public
disclosure any information the disclosure of which reasonably could be expected
to cause damage to the national security of the United States.</text>
</paragraph></subsection><subsection id="H60FE893B838141D698084BB76B2AF4E4"><enum>(e)</enum><header>Funding
strategy</header><text>The Administrator shall develop and implement a strategy
to fund the establishment and maintenance of the National Geospatial Database
through means that may include—</text>
<paragraph id="HAA8D6196520A42318A0BEE550B970F23"><enum>(1)</enum><text>the use of
appropriated funds;</text>
</paragraph><paragraph id="H04C2FA76DA4740C08299340FF365F008"><enum>(2)</enum><text>the establishment
of user fees for the National Geospatial Database;</text>
</paragraph><paragraph id="H7BC5F015C0404F338EB31813BEBB4974"><enum>(3)</enum><text>the establishment
of a revolving fund with respect to the user fees;</text>
</paragraph><paragraph id="H60C2DB1F4D89408CA415150168D436D6"><enum>(4)</enum><text>interagency and
intergovernmental partnerships; and</text>
</paragraph><paragraph id="HBCE5059096A34B62AC2C933691E43A81"><enum>(5)</enum><text>public-private
partnerships.</text>
</paragraph></subsection></section><section id="H9528DF12AB094DBA9BF62B450E3E1976"><enum>104.</enum><header>Reorganization
of geospatial and land management activities</header>
<subsection id="H272870422810450CB4ED02C74E4D5E91"><enum>(a)</enum><header>Implementation
of national geospatial data plan</header><text>The Administrator shall carry
out the recommendations of the National Geospatial Data Plan developed by the
National Geospatial Policy Commission under section 202(c).</text>
</subsection><subsection id="H23000C561A78473C91029275854ADC47"><enum>(b)</enum><header>Data with
respect to management of federal property</header><text>The Administrator shall
provide data to heads of other Federal agencies for the determination as to
whether any property owned or managed by the United States may be better
managed through ownership by a non-Federal entity, including a State or local
government, a tribal government, a nonprofit organization, or a private
entity.</text>
</subsection></section><section id="H736B690A61314E2AAB999CC028712D46"><enum>105.</enum><header>Promulgation of
standards for Federal geospatial data</header>
<subsection id="HAC94C73E59D94B9EAA6884853B2AB9CF"><enum>(a)</enum><header>Promulgation</header><text>The
Administrator, in consultation with the Administrator of the Office of
Electronic Government, shall promulgate standards to ensure the
interoperability of geospatial data collected by or with the support of the
Federal Government. Such standards shall be consistent with—</text>
<paragraph id="H76FCA1C9949C4979B8392A09D7D9CAF3"><enum>(1)</enum><text>standards
applicable to geospatial data in the Federal Real Property Profile established
under section 4(c) of Executive Order No. 13327 of February 4, 2004; and</text>
</paragraph><paragraph id="H57FB47C0444A4BC393F6A11BDCF08148"><enum>(2)</enum><text>protocols for the
collection of geospatial data developed under section 216 of the E-Government
Act of 2002 (<external-xref legal-doc="public-law" parsable-cite="pl/107/347">Public Law 107–347</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/44/3501">44 U.S.C. 3501</external-xref> note).</text>
</paragraph></subsection><subsection id="HF52540D4FBBC4EACA12D12AB20E84699"><enum>(b)</enum><header>Conformance with
standards</header>
<paragraph id="HB7DE87FE06C446FD9A79F948BBA148DD"><enum>(1)</enum><header>Requirement for
federal conformance</header><text>The head of each agency of the Federal
Government shall coordinate with the Administrator to ensure that all
geospatial data collected by or with the support of the agency conforms with
the standards promulgated under subsection (a), including geospatial data
collected under the following authorities:</text>
<subparagraph id="HDA4B2FE777EF417B9A96F5A4A5533C00"><enum>(A)</enum><text>Office of
Management and Budget Circular A–16.</text>
</subparagraph><subparagraph id="H16A44869BFAE474285651FF95B6F18B8"><enum>(B)</enum><text>Executive Order
No. 12906 of April 11, 1994.</text>
</subparagraph><subparagraph id="HC59A3A05B4174A76BE080797C0E55707"><enum>(C)</enum><text>The Real Estate
Settlement Procedures Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/12/2601">12 U.S.C. 2601 et seq.</external-xref>).</text>
</subparagraph><subparagraph id="H0A4DFDE03BE94337AA20903466415F4A"><enum>(D)</enum><text>The Home Mortgage
Disclosure Act of 1975 (<external-xref legal-doc="usc" parsable-cite="usc/12/2801">12 U.S.C. 2801 et seq.</external-xref>).</text>
</subparagraph></paragraph><paragraph id="HDFEE3FF9D571403AAA26FC6FADAE968F"><enum>(2)</enum><header>Encouragement of
non-federal conformance</header><text>The Administrator shall encourage
conformance of all other geospatial data collected for lands in the United
States with the standards promulgated under paragraph (1).</text>
</paragraph></subsection></section><section id="H91906C356F69445E955BCE7834543F24"><enum>106.</enum><header>Protection of
geospatial data</header><text display-inline="no-display-inline">The
Administrator shall promulgate regulations and carry out activities to prevent
any inmate in a Federal Prison Industries program under chapter 307 of title
18, United States Code, or a work program operated by a prison or jail of a
State or subdivision thereof from having access to any geospatial data
regarding the location of—</text>
<paragraph id="HE3C293F224BC4D37A3E8F25BED2C9F19"><enum>(1)</enum><text>surface and
subsurface infrastructure providing communications or water or electrical power
distribution or transmission;</text>
</paragraph><paragraph id="H4CBD2FE9C2624A46B4A652114BFEE0B9"><enum>(2)</enum><text>pipelines for the
distribution or transmission of natural gas, bulk petroleum products, or other
commodities;</text>
</paragraph><paragraph id="HE93B68098C6340148F17132D98E6E99F"><enum>(3)</enum><text>other utilities;
or</text>
</paragraph><paragraph id="HB190015FC550400C8CFDCF10C1C7A571"><enum>(4)</enum><text>any personal or
financial information about any individual private citizen, including
information relating to such person’s real property however described.</text>
</paragraph></section><section id="H3E24DD8841BC4714AB3D15DAE17F0E3C"><enum>107.</enum><header>Assumption of
geospatial functions of other Federal agencies</header>
<subsection id="HDCD4014C17A341289D34AFF567E079DB"><enum>(a)</enum><header>Functions of
department of the interior</header><text>All geospatial functions vested by law
in the Department of the Interior are hereby transferred to the Administrator,
including the following:</text>
<paragraph id="H77B6C4B049564C499B69E465649E49B8"><enum>(1)</enum><text>The
responsibilities for the survey of public lands and related functions vested by
<external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/32/1">chapter 1</external-xref> of title 32 of the Revised Statutes of the United States (43 U.S.C.
52–59).</text>
</paragraph><paragraph id="H68A10D24CB1C4D7489A44B2964568F7F"><enum>(2)</enum><text display-inline="yes-display-inline">All geospatial functions of the Geography
Division of the United States Geological Survey, including functions vested by
the Act of June 4, 1897 (<external-xref legal-doc="usc" parsable-cite="usc/43/31">43 U.S.C. 31</external-xref>).</text>
</paragraph><paragraph id="H5BE09216A2854F38A1C26F719E3185FD"><enum>(3)</enum><text>The
responsibilities, vested by the revised Office of Management and Budget
Circular A–16, dated August, 19, 2006, for stewardship by the Bureau of Land
Management of cadastral and Federal land ownership spatial data themes.</text>
</paragraph></subsection><subsection id="H0549AE90937F463CAC84FB56500A3A00"><enum>(b)</enum><header>Functions of
department of agriculture</header><text>All geospatial functions vested by law
in the Department of Agriculture with respect to the National Forest System are
hereby transferred to the Administrator, including the authority to survey and
map lands in and around the National Forest System lands vested by authorities,
including the following:</text>
<paragraph id="HD0B1F5999F31458D93B347DADC95FE7D"><enum>(1)</enum><text>Public Law 85–569
(<external-xref legal-doc="usc" parsable-cite="usc/7/1012a">7 U.S.C. 1012a</external-xref>).</text>
</paragraph><paragraph id="HD02EC20DDBFC4D8691DA15665E5C9FE0"><enum>(2)</enum><text>Public Law 97–465
(<external-xref legal-doc="usc" parsable-cite="usc/16/521d">16 U.S.C. 521d et seq.</external-xref>).</text>
</paragraph></subsection><subsection id="HCB2D7BFE42FA48E8BDE15254648EC3F6"><enum>(c)</enum><header>Functions of
national oceanic and atmospheric administration</header><text>All geospatial
functions vested by law in the National Oceanic and Atmospheric Administration
are hereby transferred to the Administrator, including all functions of the
National Geodetic Survey and other geospatial functions vested by authorities,
including the following:</text>

</subsection></section><section id="HC1CDC39F10B24A7D8310C4FC2D9CF0E9"><enum>108.</enum><header>Acquisition of
geospatial data from public sources</header>
<subsection id="H8AB31643982C44D888DF31D857EEDD4F"><enum>(a)</enum><header>Federal
agencies</header><text>At the request of the Administrator, the head of each
Federal agency shall make available to the Administrator for inclusion in the
National Geospatial Database geospatial data collected by the agency subject to
privacy protections, including—</text>
<paragraph id="H4E70EAF68EF44650A8A10779ADED7BA6"><enum>(1)</enum><text>all geospatial
data collected under the Real Estate Settlement Procedures Act of 1974 (12
U.S.C. 2601 et seq.);</text>
</paragraph><paragraph id="H9120A0F2C5AB4638ACF8D1B49B44EE9B"><enum>(2)</enum><text>all geospatial
data collected under the Home Mortgage Disclosure Act of 1975 (12 U.S.C. 2801
et seq.); and</text>
</paragraph><paragraph id="H0C9B299A031B4839A5D2CADF23D14784"><enum>(3)</enum><text>notwithstanding
sections <external-xref legal-doc="usc" parsable-cite="usc/13/9">9</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/13/214">214</external-xref> of title 13, United States Code, and to the extent
consistent with individual privacy protections, all data on building addresses
and geographical coordinates collected by the Director of the Bureau of the
Census.</text>
</paragraph></subsection><subsection id="HBC740EE55A744B27A9EC6CF96299A8E9"><enum>(b)</enum><header>Non-Federal
entities</header>
<paragraph id="H444E027F71C54ECDA07F41AFB0A16AAC"><enum>(1)</enum><header>Cost-sharing
agreements</header><text>The Administrator may enter into cost-sharing
agreements with, and provide other financial incentives to, State and local
governments and private entities and individuals to collect and share with the
Administrator geospatial data for inclusion in the National Geospatial
Database.</text>
</paragraph><paragraph id="H000F2173A2BA49C8BB7B298C97655F5B"><enum>(2)</enum><header>Limitations on
amount</header><text>The Federal share of any cost-sharing agreement under
paragraph (1) shall not exceed 50 percent of the total cost to the State of
collecting and sharing the data.</text>
</paragraph></subsection></section><section id="H088471D4AFA74C89B1ADE9633412B0A8"><enum>109.</enum><header>Acquisition of
geospatial data from commercial sources</header>
<subsection id="H1FBC6B1E652E424EA89F3C271DF1D0C9"><enum>(a)</enum><header>Commercial
sources</header><text>The Administrator shall, to the maximum extent
practicable, enter into contracts to obtain geospatial data and geospatial
activities from commercial sources.</text>
</subsection><subsection id="HBD04F7D289F0477E821B7FC6F5966AC5"><enum>(b)</enum><header>Licensed
data</header>
<paragraph id="HFDC4D1E4666B44CB8832CBB59CB3E8EE"><enum>(1)</enum><header>In
general</header><text>In carrying out this Act, the Administrator may acquire
licensed geospatial data from commercial sources.</text>
</paragraph><paragraph id="H1423E70BAE6640CCA18C3AE43C5ECE5C"><enum>(2)</enum><header>Considerations</header><text>In
determining whether to acquire licensed geospatial data from commercial
sources, the Administrator shall take into account—</text>
<subparagraph id="HFFD9ED74BC274234B633410AACBEE9DF"><enum>(A)</enum><text>existing
law;</text>
</subparagraph><subparagraph id="H5A59189E536D4C32A107A45C84138F20"><enum>(B)</enum><text>the quality of the
data relative to the intended use;</text>
</subparagraph><subparagraph id="H8578B0870C4D4B749C9F1905E96F1E11"><enum>(C)</enum><text>the preferences of
the intended (as opposed to incidental) beneficiaries of the data; and</text>
</subparagraph><subparagraph id="H46A6C56FA9934EDD895410B4BF2EC28C"><enum>(D)</enum><text>any restrictions
on redistribution of the licensed data, and their effect on—</text>
<clause id="H3950FC75042E493985995E4B275F666A"><enum>(i)</enum><text>the
ability of each agency using the data to carry out a mandate of the agency;
and</text>
</clause><clause id="H0459E1EAA637404F8350AFE5FD9705F8"><enum>(ii)</enum><text>the
benefit of the geospatial data to its intended users.</text>
</clause></subparagraph></paragraph></subsection></section><enum>II</enum><header>NATIONAL
GEOSPATIAL POLICY COMMISSION</header>
<section id="H41025F00D41B4611AF54BFE1655FCFCA"><enum>201.</enum><header>Establishment;
primary duties</header><text display-inline="no-display-inline">There is hereby
established a commission, to be known as the <quote>National Geospatial Policy
Commission</quote> (referred to hereinafter as the <quote>Commission</quote>).
The Commission shall—</text>
<paragraph id="HE583591554BA4C46911A2FECE4841B77"><enum>(1)</enum><text>develop and
periodically amend a comprehensive plan, to be known as the <quote>National
Geospatial Data Plan</quote>;</text>
</paragraph><paragraph id="HEB7AAD3B878C484EA814562FF199DD08"><enum>(2)</enum><text>coordinate Federal
agencies, State and local governments, and private entities to eliminate
redundancy in the performance of geospatial activities;</text>
</paragraph><paragraph id="HD721A4B6F52E40D399358E20AF756965"><enum>(3)</enum><text>convert geospatial
activities to performance by private geospatial firms when possible; and</text>
</paragraph><paragraph id="H0FA883AE126545BDBE1ADE92E9784A4E"><enum>(4)</enum><text>reduce the costs
to the Federal Government of geospatial activities not eliminated or converted
to performance by private geospatial firms.</text>
</paragraph></section><section id="H32DF196F27AC4B4AB4856E5007F9902E"><enum>202.</enum><header>Requirements
for National Geospatial Data plan</header>
<subsection id="HD1AECB6DE8F14C87B01D3C82961C3493"><enum>(a)</enum><header>Identification
of all geospatial activities performed by or for the federal
government</header><text>The Commission shall identify in the National
Geospatial Data Plan each geospatial activity performed by or for the Federal
Government, and—</text>
<paragraph id="H63E230BD81764E13AF8E981B6BB906EB"><enum>(1)</enum><text>the nature and
purpose of the activity;</text>
</paragraph><paragraph id="H6491C12D83D64A12843ECD1F04DCB670"><enum>(2)</enum><text>the authority
under which the activity is performed; and</text>
</paragraph><paragraph id="HA8B65AA6BFBB40278470B3C3F135F7C4"><enum>(3)</enum><text>the amount
expended by the Federal Government in fiscal year 2009 for the activity.</text>
</paragraph></subsection><subsection id="HD854A41AD0214B93A61B86B6DAEFCC2C"><enum>(b)</enum><header>Identification
of redundant, inefficient, and unnecessary geospatial
activities</header><text>The Commission shall identify in the National
Geospatial Data Plan each geospatial activity under subsection (a)—</text>
<paragraph id="H65D7A0DB7A5D46F684E6BB073BDFD2D5"><enum>(1)</enum><text>the performance of
which is unnecessary; and</text>
</paragraph><paragraph id="HC0800AA5BCD149F4AA08C33413FB562F"><enum>(2)</enum><text>that may be
converted to performance by a private geospatial firm.</text>
</paragraph></subsection><subsection id="H8766B55C652C486AAB9E7E116977C992"><enum>(c)</enum><header>Identification
of best means of acquiring geospatial data</header><text>The Commission shall
develop and include in the National Geospatial Data Plan recommendations
(including, as applicable, recommendations for changes in existing law)
for—</text>
<paragraph id="HCF1EA167A1994E9B9B82ADE3ECC1F23C"><enum>(1)</enum><text>elimination of
geospatial activities identified under subsection (b)(1);</text>
</paragraph><paragraph id="H6F1696FF2E544928BBFB9466C985BA93"><enum>(2)</enum><text>conversion of
geospatial activities identified under subsection (b)(2) to performance by a
private geospatial firm;</text>
</paragraph><paragraph id="HFF8EA79BA5D542B4B70823D017FA8CB0"><enum>(3)</enum><text>conversion of
performance of geospatial activities identified under subsection (b)(3)(A) to
performance by a State or local government; and</text>
</paragraph><paragraph id="H94113E71BE514235874B3B49759A4497"><enum>(4)</enum><text>consolidation of
geospatial activities identified under subsection (b)(3)(B).</text>
</paragraph></subsection><subsection id="H54615DE347154F5D8A89B865188F8514"><enum>(d)</enum><header>Estimate of cost
savings from adopting recommendations</header><text>The Commission shall
include in the National Geospatial Data Plan an estimate of the savings to the
United States that would result from adopting the recommendations in subsection
(c).</text>
</subsection><subsection id="HD95DDA61A45143FC973FD91CE58F1397"><enum>(e)</enum><header>Deadline for
development of national geospatial data plan</header><text>Not later than 1
year after funds are made available for this purpose, the Commission shall
complete the National Geospatial Data Plan in accordance with this
section.</text>
</subsection></section><section id="HA12F55E97CBD4227924F464CA11FFE9E"><enum>203.</enum><header>Membership</header>
<subsection id="HEED05DB8595B4A74B7A52C34B724B418"><enum>(a)</enum><header>Number and
appointment</header><text>The Commission shall be composed of the following
members:</text>
<paragraph id="H7BE23A1308EF46D7836AB93DD15B368E"><enum>(1)</enum><text>The Administrator
of the National Geospatial Technology Administration or designee.</text>
</paragraph><paragraph id="H47D2B08F57014381B7DD5B654CA7F110"><enum>(2)</enum><text>The Director of
the Office of Management and Budget or designee.</text>
</paragraph><paragraph id="H385A4A779B794B23967C63F41D65EFA7"><enum>(3)</enum><text>The Director of
the Office of Science and Technology Policy or designee.</text>
</paragraph><paragraph id="H1AEB321CD75F402AB8A16D6863309F90"><enum>(4)</enum><text>The Director of
the National Economic Council or designee.</text>
</paragraph><paragraph id="HABC68474EFB947B0BC38CEB6F3711A4C"><enum>(5)</enum><text>The Director of
the National Geospatial Intelligence Agency or designee.</text>
</paragraph><paragraph id="H604B4884D9F3486E8331289A05CB955C"><enum>(6)</enum><text>The Chairman of
the Committee on Homeland Security and Governmental Affairs of the Senate or
designee.</text>
</paragraph><paragraph id="H30071279FFF642108C9129B8B797BB96"><enum>(7)</enum><text>The Chairman of
the Committee on Oversight and Government Reform of the House of
Representatives or designee.</text>
</paragraph><paragraph id="HB8A2752E62604F80AC3DBCC13FF910CB"><enum>(8)</enum><text>Eleven citizens
with experience in geospatial activities appointed by the President,
including—</text>
<subparagraph id="HE08D5488A4C84AF9A596AA23C3C71CED"><enum>(A)</enum><text>two employed in
State government;</text>
</subparagraph><subparagraph id="HD2AB0295A1C54BE48444FCE134796997"><enum>(B)</enum><text>two employed in
regional or local government;</text>
</subparagraph><subparagraph id="HDB62C6246AFF4F079AD818B34B789321"><enum>(C)</enum><text>one employed in
tribal government;</text>
</subparagraph><subparagraph id="HA19D32BB590E47FB8CB22697E9E4402E"><enum>(D)</enum><text>one employed by a
nonprofit organization;</text>
</subparagraph><subparagraph id="H2C18E1E1A09949018D72B32F879BA9A5"><enum>(E)</enum><text>one employed by a
university; and</text>
</subparagraph><subparagraph id="H1BB692BCBE4349DFA66DC3AF14C41D1C"><enum>(F)</enum><text>four employed by a
private geospatial firm, at least one of whom shall be a licensed
surveyor.</text>
</subparagraph></paragraph></subsection><subsection id="HC7C4EDC6427F4B5893EF58C5D3ABB3D3"><enum>(b)</enum><header>Terms</header>
<paragraph id="H00A62F240FE244A9BA8CA72180276C3B"><enum>(1)</enum><header>Federal
officials</header><text>Each member appointed under subparagraphs (1) through
(7) of subsection (a) shall be appointed for the life of the Commission.</text>
</paragraph><paragraph id="H0F0179826629459D94AA558131A248F7"><enum>(2)</enum><header>Members
appointed by the president</header><text>Each member appointed under subsection
(a)(8) shall be appointed for a term of six years.</text>
</paragraph></subsection><subsection id="HE7EAF817F6414F558B4DA27C04C572EC"><enum>(c)</enum><header>Vacancies</header><text>Any
member appointed to fill a vacancy occurring before the expiration of the term
for which the member’s predecessor was appointed shall be appointed only for
the remainder of that term.</text>
</subsection><subsection id="H89652024CF1A4AB2833E1F3087B63A07"><enum>(d)</enum><header>Pay and
expenses</header><text>Each member appointed under subsection (a)(8) shall be
entitled to $100 a day when performing duties vested in the Commission and
reimbursement for necessary expenses incurred in performing those
duties.</text>
</subsection><subsection id="HC3CD3FF1D45D4A8082FBCD14ACA4995F"><enum>(e)</enum><header>Chair and
officers</header><text>The President shall designate the Chair of the
Commission from among the non-Federal members. The Commission may elect from
among its members other officers as it considers desirable.</text>
</subsection><subsection id="HDF48B43C4BC1488F80998F70D256319B"><enum>(f)</enum><header>Personnel</header><text>The
Commission may employ a Director, an executive officer, and other technical and
administrative personnel as it considers necessary. Without regard to section
3709 of the Revised Statues (<external-xref legal-doc="usc" parsable-cite="usc/41/5">41 U.S.C. 5</external-xref>) and section 3109, chapters 33 and 51,
and subchapter III of chapter 53, of title 5, the Commission may employ, by
contract or otherwise, the temporary or intermittent (not more than one year)
services of city planners, architects, engineers, appraisers, and other experts
or organizations of experts, as may be necessary to carry out its functions.
The Commission shall fix the rate of compensation so as not to exceed the rate
usual for similar services.</text>
</subsection><subsection commented="no" id="H2BED4157F4284C868F93644DF3655306"><enum>(g)</enum><header>Exemption</header><text>The
provisions of the Federal Advisory Committee Act (5 U.S.C. Appendix 2) shall
not apply to the Commission.</text>
</subsection></section><section commented="no" id="H489D3CC3E3714C1E84123134466D9550"><enum>204.</enum><header>Terminations</header>
<subsection commented="no" id="H530186E324074A588F916799DF5E8D42"><enum>(a)</enum><text>Upon the
establishment of the Commission, the Federal Geographic Data Committee shall be
terminated and all functions, duties, authorities, and responsibilities
outlined in Office of Management Budget Circular A–16 shall be vested in the
Commission and the Administrator.</text>
</subsection><subsection commented="no" id="H76D196C6CE5B4B5696D5D9836F214430"><enum>(b)</enum><text>Upon the
establishment of the National Geospatial Data Plan, Executive Orders 12906 and
13286 shall be repealed and all functions, duties, authorities, and
responsibilities therein shall be vested in the Commission and the
Administrator.</text>
</subsection><subsection commented="no" id="H8B94153853024EFD86465DB9883490CA"><enum>(c)</enum><text>Upon the
establishment of the Commission, the National Geospatial Advisory Committee
shall be terminated.</text>
</subsection></section><enum>III</enum><header>CONTRACTOR
PERFORMANCE OF FEDERAL GEOSPATIAL ACTIVITIES</header>
<section id="H980D195053254D08A34F83789AD0E47E"><enum>301.</enum><header>Policy</header><text display-inline="no-display-inline">It is the policy of the United States,
consistent with the United States Commercial Remote Sensing Policy, to—</text>
<paragraph id="H25E12679578B4A9BBAB6FBDB816D57B2"><enum>(1)</enum><text>rely to the
maximum practical extent on the private sector in the United States for the
acquisition of commercially available geospatial data and geospatial
activities; and</text>
</paragraph><paragraph id="H29B400CF865143E9B91F6E7823052E76"><enum>(2)</enum><text>develop a
long-term, sustainable relationship with the private geospatial
community.</text>
</paragraph></section><section id="H7BE5120761A44C02ABCAF4DE1F3ADDB2"><enum>302.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title, the term <term>agency
head</term> means the Secretary, the Administrator, or head of a department,
agency, or bureau of the Federal Government.</text>
</section><section id="HAC699401C1EC4C14AF71E7F182E590B1"><enum>303.</enum><header>Conversion to
contractor performance</header>
<subsection id="H58E8D398781841DF84E77A0FA2A41B2E"><enum>(a)</enum><header>Conversion of
activities identified by commission</header><text>Each agency head shall
convert, to the maximum extent possible, to performance by private geospatial
firms, all activities identified by the National Geospatial Policy Commission
for conversion under section 202(b)(2) that are performed by or for the
agency.</text>
</subsection><subsection id="H104450C357174C72A783CFF796FCEC25"><enum>(b)</enum><header>Solicitation of
offers for contractor performance of eligible activities</header>
<paragraph id="HE517BCFBE9434B2A8205FA577C165F2D"><enum>(1)</enum><header>Notice</header><text>Each
agency head shall issue a notice soliciting offers for the performance of each
activity described in subsection (a). The notice shall include a description of
qualifications and experience determined by the agency head to be necessary for
performance of the activity, and such other criteria as the agency head
determines to be appropriate.</text>
</paragraph><paragraph id="H168232313BA64ECC8875FC3BD3B7C290"><enum>(2)</enum><header>Submission of
offers</header><text>To be considered for performance of an activity, a private
geospatial firm shall submit to the agency head an offer that addresses the
criteria described in paragraph (1), including a statement of qualifications
and performance data.</text>
</paragraph><paragraph id="H8002C09B36B244C391C1D6A766108168"><enum>(3)</enum><header>Selection</header>
<subparagraph id="H5845E6C0C20343C68A9A5E77206EBAE0"><enum>(A)</enum><header>First
stage</header><text>Of the private geospatial firms that submit offers under
paragraph (2), the agency head shall select the three (or more) private
geospatial firms determined by the agency head to be most qualified for
performance of the activity, based on the private geospatial firms’ offers and
such other information related to the qualifications and experience of the
private geospatial firms as the agency head determines to be
appropriate.</text>
</subparagraph><subparagraph id="H5EEDEA18BF40488FADC690F6B7373F28"><enum>(B)</enum><header>Second
stage</header><text>The agency head shall discuss with each private geospatial
firm selected under subparagraph (A) different technologies and professional
approaches to furnishing the required services. Based on the discussion, the
agency head shall rank each such private geospatial firm in order of most to
least qualified.</text>
</subparagraph><subparagraph id="H649499BA32C14D0B8C334D1A2379A391"><enum>(C)</enum><header>Third
stage</header><text>The agency head shall negotiate with each private
geospatial firm determined to be the most qualified to perform the activity
required by the agency, for a contract for performance of the activity.</text>
</subparagraph><subparagraph id="H50FA93DB28D9493886238A45A4F4732B"><enum>(D)</enum><header>Final
selection</header><text>The agency head shall enter into a contract with each
private geospatial firm that, in negotiations under subparagraph (C), agrees to
a price determined by the agency head to be fair and reasonable, based on the
value of the services to be rendered and the scope, complexity, and specialized
nature of the activity.</text>
</subparagraph><subparagraph id="H695D4C9610664A909ABEE377A038E122"><enum>(E)</enum><header>Selection of
additional firms</header><text>If the agency head cannot enter into a contract
with a private geospatial firm under subparagraph (D), the agency head shall
determine the next most qualified private geospatial firms for performance of
the activity in accordance with subparagraph (A) and enter into discussions and
negotiations with such private geospatial firms under subparagraphs (B) and
(C), respectively.</text>
</subparagraph></paragraph><paragraph id="H866BC6459B7C4F178360E267978A3225"><enum>(4)</enum><header>Exception</header><text>The
process set forth in this section shall not apply to licensed geospatial
data.</text>
</paragraph></subsection></section><section id="H20B801E562144AE1BBDCF76BD3112D92"><enum>304.</enum><header>Requirement for
performance in United States</header>
<subsection id="HE705ED118BBB4DE69E77B4ECAA925950"><enum>(a)</enum><header>Federal
contracts</header><text>All Federal contracts for performance of a geospatial
activity shall include—</text>
<paragraph id="HE6D7923648BD48CC810CAEAB0CAA2294"><enum>(1)</enum><text>a
condition that the geospatial activity be performed in the United States;
and</text>
</paragraph><paragraph id="H29C5A4F8127C41CE926B5F94220337B0"><enum>(2)</enum><text>a
written certification that the funds will not be used for geospatial activities
performed outside the United States.</text>
</paragraph></subsection><subsection id="H17E75458002541C082023C892BF611BB"><enum>(b)</enum><header>Exceptions</header><text>The
requirements of this section shall not apply with respect to a geospatial
activity—</text>
<paragraph id="H655CF101FEAD417FB32A3658AA550678"><enum>(1)</enum><text>that was converted
to performance by a private geospatial firm under section 303 and was
previously performed outside the United States by the Federal
Government;</text>
</paragraph><paragraph id="HAF351BAC3CC14676BCC05B2E021F274F"><enum>(2)</enum><text>required by law
(including a treaty or trade agreement) to be performed outside the United
States;</text>
</paragraph><paragraph id="HC41C336CE3E940669C3D202C8B36F5CD"><enum>(3)</enum><text>required by
geographical necessity to be performed outside the United States;</text>
</paragraph><paragraph id="H2470D0C7E3A140BCB14A6FB25B5DCE3F"><enum>(4)</enum><text>determined by the
Administrator after a competitive procurement process under section 303(b) to
be unavailable in the United States;</text>
</paragraph><paragraph id="H028DB538BF0E4E1B9CC4EE9327A8F80B"><enum>(5)</enum><text>for which the
President has issued a determination in writing that performance outside of the
United States is necessary for national security; or</text>
</paragraph><paragraph id="HFDE2269E46E044609AE12E4B45DA4B72"><enum>(6)</enum><text>for the
acquisition of commercial off-the-shelf licensed geospatial data
products.</text>
</paragraph></subsection></section><enum>IV</enum><header>ENCOURAGING
PRIVATE ENTERPRISE</header>
<section id="H730C98C0E3DE471B9D1507A5401B3B9C"><enum>401.</enum><header>Findings;
purposes</header>
<subsection id="H1A7CEC90F1804423B54BD381CBFB2C00"><enum>(a)</enum><header>Findings</header><text>Congress
finds that the competitive enterprise system, characterized by individual
freedom and initiative, is the primary source of the economic strength of the
United States, and the Federal Government should not perform geospatial
functions better suited for performance by the private sector.</text>
</subsection><subsection id="H56ED02E02A2840AA895D10AC670D489E"><enum>(b)</enum><header>Purposes</header><text>The
purpose of this title is to promote the establishment and growth of private
geospatial firms in the United States by—</text>
<paragraph id="H394A7B38F9B04B568C3ED357ACE00FF9"><enum>(1)</enum><text>encouraging the
use by the Federal Government of geospatial data, products, technology, and
services to accomplish national priorities;</text>
</paragraph><paragraph id="H64FB87BE0C5D4F54897B3E8FB2F6AB61"><enum>(2)</enum><text>encouraging the
acquisition of geospatial data, products, technology, and services from private
geospatial firms;</text>
</paragraph><paragraph id="H574AD100F95440B78F0AF8F90B6E96A4"><enum>(3)</enum><text>encouraging the
development, and ensuring the continued employment, of a workforce that will
meet future employment demands in the geospatial field; and</text>
</paragraph><paragraph id="H82190C128B4A4089BD27DDA2BE48C908"><enum>(4)</enum><text>fostering an
environment in which all private geospatial firms may compete effectively and
grow to their full potential.</text>
</paragraph></subsection></section><section id="HE334982B78174A4A94107BEA6D2D4B0F"><enum>402.</enum><header>Strategy for
encouraging Federal use of private geospatial firms</header>
<subsection id="HA54EE300C9E14514A3C1945C7073DAFF"><enum>(a)</enum><header>Development of
strategy</header><text>Not later than one year after the date of the enactment
of this Act, the Administrator shall cooperate with private geospatial firms,
and any associations composed exclusively of such firms, to develop a
comprehensive strategy to encourage and enhance the use of private geospatial
firms by Federal agencies and other entities that receive Federal funds,
including State and local governmental agencies, universities, nonprofit
organizations, and foreign governments.</text>
</subsection><subsection id="H1EA5AE00C948471DAB6AA54E2BE31F66"><enum>(b)</enum><header>Information
gathering</header><text>In developing the strategy described in subsection (a),
the Administrator shall—</text>
<paragraph id="H0CED23F2939744DAAF3A6CB94E3D9E2C"><enum>(1)</enum><text>examine the
current role of private geospatial firms, including small businesses, in the
economy of the United States;</text>
</paragraph><paragraph id="H2D76654A16D94B2AB4B05F681DA06E76"><enum>(2)</enum><text>States expending
Federal funds;</text>
</paragraph><paragraph id="H29DD49610808481CA326ED05E175F9E8"><enum>(3)</enum><text>assess the
contribution such firms may make in the future to the growth of the economy of
the United States;</text>
</paragraph><paragraph id="H397B86D7A63A43EFAB34449F060365DD"><enum>(4)</enum><text>evaluate the
efforts of each Federal agency to use private geospatial firms, including the
procurement strategies, policies, and methodologies of each Federal agency;
and</text>
</paragraph><paragraph id="HC769BB32198C4D0EBC91A3A03C3528F1"><enum>(5)</enum><text>assemble
statistical information on the use of private geospatial firms by Federal
agencies.</text>
</paragraph></subsection><subsection id="H8E1F99AD9EE5432AB6A4DDF4188FBF88"><enum>(c)</enum><header>Enhancement of
federal agency use of private geospatial firms</header>
<paragraph id="H67BEBB1217664AEDBA0A3B74BF5EAF89"><enum>(1)</enum><text>The Administrator
shall develop and communicate to each Federal agency recommendations to
encourage and enhance the use by the Federal agency of private geospatial
firms.</text>
</paragraph><paragraph id="HDD1C27FACAC046AEA31D3C75D60768DF"><enum>(2)</enum><text>The Administrator
shall establish training programs and facilitate knowledge sharing among
Federal agencies on the use of geospatial data, products, technology, and
services and the process for procurement of such activities from the private
sector.</text>
</paragraph><paragraph id="H475897C3462C45A59E1BCCD6471AD810"><enum>(3)</enum><text>The Administrator
shall cooperate with public and private agencies, businesses, and other
organizations to disseminate information about the use and application of
geospatial data, products, technology, and services, the capabilities of
private geospatial firms, and the ways in which private geospatial firms may
benefit Federal agencies.</text>
</paragraph></subsection><subsection id="H5EA2BD5F17CF4ED68759463B33361A78"><enum>(d)</enum><header>Advocacy and
assistance for private geospatial firms affected by federal policies and
activities</header>
<paragraph id="H8D10D80C5E2848759E7EE2F663C65587"><enum>(1)</enum><text>The Administrator
shall receive, and, as appropriate, address or otherwise act upon complaints,
criticisms, and suggestions from private geospatial firms regarding the
policies and activities of Federal agencies.</text>
</paragraph><paragraph id="H1C67A21225894D09A0FC4F72D03E751F"><enum>(2)</enum><text>If the policies
and activities of a Federal agency affect or may affect private geospatial
firms, the Administrator shall represent the views and interests of the private
geospatial firms to the Federal agency.</text>
</paragraph><paragraph id="HFA0416CB92F343899E083B93FD1DF590"><enum>(3)</enum><text>The Administrator
shall make counseling available to private geospatial firms on how to resolve
questions and problems concerning the relationship of such firms to the Federal
Government.</text>
</paragraph></subsection><subsection id="H82A5E4EBA61D49888886CC6DDFA93E07"><enum>(e)</enum><header>Development of
standard clauses, contracts, and form licenses</header><text>The Administrator
shall, in consultation with trade associations and public interest groups,
develop and promote standard clauses and contracts for use by the Federal
Government in the acquisition of geospatial data and licenses for the
acquisition of licensed geospatial data products.</text>
</subsection><subsection id="H425E6919EEF742EFA4FAB74A6284216E"><enum>(f)</enum><header>Standards for
assessment of progress</header><text>To evaluate and increase the effectiveness
of the strategy, the Administrator shall develop standards (including metrics,
benchmarks, and measures of performance) by which to assess—</text>
<paragraph id="HB6A76D178B2B42E9A03DFB6DBC975D33"><enum>(1)</enum><text>the state of
geospatial activities in the United States; and</text>
</paragraph><paragraph id="H6A5D38DF1C724835927FCA341C6D4487"><enum>(2)</enum><text>progress in the
development of private geospatial enterprise in the United States.</text>
</paragraph></subsection></section><enum>V</enum><header>GEOSPATIAL
RESEARCH AND DEVELOPMENT</header>
<section id="H817F6F175AB6412695B01130933BA339"><enum>501.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this title are to encourage
innovation and entrepreneurship in the geospatial field by—</text>
<paragraph id="H295743A2E55D4C508CF07C9AD1785055"><enum>(1)</enum><text>promoting the
advancement of geospatial products and technologies, and value-added services
related to such products and technologies; and</text>
</paragraph><paragraph id="H394C298927AA4FA1BF791993E60276AB"><enum>(2)</enum><text>providing an
avenue through which new and untested geospatial products and services may be
brought to the marketplace.</text>
</paragraph></section><section id="H9BBE8E71751D488D817F34A86157AF4F"><enum>502.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
<paragraph id="H86DAFFE495634AC49CC6DCB770C12CE3"><enum>(1)</enum><text>The term
<term>Geospatial Research Plan</term> means the plan developed under section
503(a).</text>
</paragraph><paragraph id="H0DE4794C85ED4D778A10783AB7F71481"><enum>(2)</enum><text>The term
<term>research and development</term>—</text>
<subparagraph id="H26F37F4D4C1B4DBC948022B049D11D9E"><enum>(A)</enum><text>means—</text>
<clause id="HF49F57A5B80641F8B8EFF45715C10BF5"><enum>(i)</enum><text>a
systematic study directed specifically toward applying new knowledge to meet a
recognized need;</text>
</clause><clause id="HD44FE8133EF347AA91F2DA4D9054F104"><enum>(ii)</enum><text>a
systematic application of knowledge toward the production of useful materials,
devices, and systems or methods, including design, development, and improvement
of prototypes and new processes to meet specific requirements; or</text>
</clause><clause id="HA74B8DEFF6E24ED19029212F6ABE5D31"><enum>(iii)</enum><text>development of
data, products, technology, or services not currently available in the
marketplace and that cannot otherwise be procured commercially through ordinary
business channels; and</text>
</clause></subparagraph><subparagraph id="HD740AE159B7641458364ABC31B697098"><enum>(B)</enum><text>may
include—</text>
<clause id="H49A46711C00447FCB9E554E581F607AD"><enum>(i)</enum><text>research in the
physical and natural sciences;</text>
</clause><clause id="H9B36941017D342729879573B57765B35"><enum>(ii)</enum><text>applied
research;</text>
</clause><clause id="HC6C44609998B4DBAB31962055BCC7D71"><enum>(iii)</enum><text>technology
development; and</text>
</clause><clause id="H7B155FC8AC8B4219850EEDA4CE63705E"><enum>(iv)</enum><text>social science
research.</text>
</clause></subparagraph></paragraph></section><section id="HBD40A8FF649E40DDA62285D2CC1E36F4"><enum>503.</enum><header>Geospatial
research plan</header>
<subsection id="H5F6A83BEFF7441FEA5A2299EDA856268"><enum>(a)</enum><header>Development</header><text>Not
later than one year after the date of the enactment of this Act, the
Administrator shall develop a plan, to be known as the <quote>Geospatial
Research Plan</quote>, to provide a coordinated and integrated approach to the
investment of the United States in geospatial research and development
activities in the 5-year period beginning on the date of the issuance of the
Plan.</text>
</subsection><subsection id="H30D8DD9E3E2646B59A660BB571E09FB8"><enum>(b)</enum><header>Requirements</header><text>In
the Geospatial Research Plan, the Administrator shall collaborate with a wide
range of interested persons to identify and recommend investments in geospatial
research and development activities that will—</text>
<paragraph id="H75B308C7EB3048B29211E7FB4B703594"><enum>(1)</enum><text>facilitate the
establishment the National Geospatial Database;</text>
</paragraph><paragraph id="H902F5F6DA84B4A7D8D89DC01E5582AAF"><enum>(2)</enum><text>facilitate the
maintenance of a current and accurate National Geospatial Database;</text>
</paragraph><paragraph id="HF1AB6186109440A6966849108C8101A7"><enum>(3)</enum><text>enhance the
ability to store and archive geospatial data;</text>
</paragraph><paragraph id="HB7F5C0C46E0A424D8DBFA50468105C26"><enum>(4)</enum><text>increase public
access to and dissemination of stored and archived geospatial data;</text>
</paragraph><paragraph id="HEAED319B91A9464D85E93E580BB35815"><enum>(5)</enum><text>improve sensor and
other data collection technologies;</text>
</paragraph><paragraph id="HDBBF017181E1491FA6431A2D29002A92"><enum>(6)</enum><text>improve the
ability to acquire, visualize, analyze, and apply geospatial data;</text>
</paragraph><paragraph id="HB6E6F9C2B86746A886DCAA4497591197"><enum>(7)</enum><text>improve the
durability and extend the life of geospatial infrastructure;</text>
</paragraph><paragraph id="HA516DBC5974B42BFA966312C7B402D59"><enum>(8)</enum><text>address geospatial
requirements necessary to meet national needs, Government programs, and
emerging public policy issues, including but not limited to—</text>
<subparagraph id="HEE403D8CD24D42ADA85BA9338F82ABEB"><enum>(A)</enum><text>protecting and
enhancing the environment;</text>
</subparagraph><subparagraph id="HB79E3A92D9D94F18A64301031C5426AE"><enum>(B)</enum><text>building and
maintaining the physical infrastructure of the United States;</text>
</subparagraph><subparagraph id="HA36BC22812A44747AF80B08A5A3F818E"><enum>(C)</enum><text>managing land and
real property assets and resources related thereto;</text>
</subparagraph><subparagraph id="H6B1940EB2CDD4B17B543D170EE571E62"><enum>(D)</enum><text>providing for the
national defense and homeland security;</text>
</subparagraph><subparagraph id="H724AE89ADFB84737ACB6A3FB4B1B097F"><enum>(E)</enum><text>managing housing
and financial services systems;</text>
</subparagraph><subparagraph id="H6C7B9F0FAA934130ACDFED994CEB37BD"><enum>(F)</enum><text>producing and
utilizing energy in a safe and efficient manner;</text>
</subparagraph><subparagraph id="HBF09B6873529450A9E79BC8F1A094878"><enum>(G)</enum><text>preparing for,
responding to, and recovering from natural and anthropogenic
emergencies;</text>
</subparagraph><subparagraph id="H077BBAFC40EC4D19B87C57EFAD067660"><enum>(H)</enum><text>conducting the
census;</text>
</subparagraph><subparagraph id="H3CC1EB6DDEED4DBCA5685B150369F4B1"><enum>(I)</enum><text>administering the
system of justice; and</text>
</subparagraph><subparagraph id="HEEA6B206BAF94A33B2322B4D44F7C146"><enum>(J)</enum><text>providing for new
forms of communication; and</text>
</subparagraph></paragraph><paragraph id="H1703554115494AB980D936979F929035"><enum>(9)</enum><text>meet any other
research and development needs of the Federal Government and geospatial data
producers and users.</text>
</paragraph></subsection><subsection id="HA388D4D8121C4EDDAC28243AF09D5D15"><enum>(c)</enum><header>Estimated
funding levels and benefit</header><text>In the Geospatial Research Plan, the
Administrator shall describe, for each activity identified under subsection
(b)—</text>
<paragraph id="H929F95DCCF5D4E53B58790333149CCFB"><enum>(1)</enum><text>the anticipated
annual funding levels for the activity for the period described in subsection
(a); and</text>
</paragraph><paragraph id="HD25F23E0600447208308502C90E98082"><enum>(2)</enum><text>the benefit the
Administrator expects to gain from the activity by the end of the period
described in subsection (a).</text>
</paragraph></subsection><subsection id="H6E00FDC527444E3DAF1E477E48C8EDA7"><enum>(d)</enum><header>Considerations</header><text>The
Administrator shall ensure that the Geospatial Research Plan—</text>
<paragraph id="H0161F8D24DA84E1B8F5661229DEAACE7"><enum>(1)</enum><text>includes and
integrates the research and development activities of the National Geospatial
Technology Administration;</text>
</paragraph><paragraph id="H18AC2F1186CE4C9F8653239F0B51DD1F"><enum>(2)</enum><text>defines the
respective roles and responsibilities of Federal, State, local, regional,
tribal, private sector, academic, and nonprofit institutions in geospatial
research and development activities; and</text>
</paragraph><paragraph id="HC94DCE60A9BC4F2BA75AC07FE4301DB6"><enum>(3)</enum><text>takes into account
the activities of other Federal, State, private sector, and nonprofit
institutions, and avoids unnecessary duplication with such activities.</text>
</paragraph></subsection></section><section id="HE24DAE90C1584FA78DE34806B0185200"><enum>504.</enum><header>Policy
directives for research and development</header>
<subsection id="H8F4ED8B230984968B1DF04D7FF31D9FD"><enum>(a)</enum><header>Development of
policy directives</header><text>Not later than 180 days after the date of the
enactment of this Act, the Administrator shall develop policy directives for
implementation by the Federal Government of geospatial research and development
activities through innovative partnerships, cooperative research and
development agreements, and other means.</text>
</subsection><subsection id="HEA246F082FF04D41B9440120A6B01836"><enum>(b)</enum><header>Contents of
policy directives</header><text>The policy directives developed under
subsection (a) shall provide for—</text>
<paragraph id="H490B95BA58704444B9322C3B107528E4"><enum>(1)</enum><text>simplified,
standardized, and timely solicitations;</text>
</paragraph><paragraph id="HC920649F752C4CA181D0F9A15CC63812"><enum>(2)</enum><text>a
simplified, standardized funding process that provides for—</text>
<subparagraph id="H61D3F4963197461199A9CA8DB5D273E7"><enum>(A)</enum><text>the timely receipt
and review of proposals;</text>
</subparagraph><subparagraph id="H97C9030F490A4C838EA68D3C39FAE44C"><enum>(B)</enum><text>outside peer
review of proposals, if appropriate;</text>
</subparagraph><subparagraph id="HF707612BAADA49528EF0DD4CC608041D"><enum>(C)</enum><text>protection of
proprietary information provided in proposals;</text>
</subparagraph><subparagraph id="HD46CF2E02B134DF8A587D4599C9AD454"><enum>(D)</enum><text>selection of
awardees;</text>
</subparagraph><subparagraph id="H603E2660C9F24A2FAA827E80D7579342"><enum>(E)</enum><text>retention of data
rights generated in the performance of the contract by a business
concern;</text>
</subparagraph><subparagraph id="H57787ADAC04C4A679D0A9AC04016B880"><enum>(F)</enum><text>recognition of the
right to intellectual property rights by the private sector partner;</text>
</subparagraph><subparagraph id="H5B7E44FF32094B99BFCA193A785252C2"><enum>(G)</enum><text>cost sharing;
and</text>
</subparagraph><subparagraph id="HC54AAB6820FF4EA9A14334F22CFAF4A8"><enum>(H)</enum><text>cost principles
and payment schedules;</text>
</subparagraph></paragraph><paragraph id="HF8269E14655B4C359205E61386F46F8C"><enum>(3)</enum><text>ensuring that
research and development activities of Government, universities, and nonprofit
institutions do not duplicate or compete with those of the private sector;
and</text>
</paragraph><paragraph id="H6FC40ACC27CB45A2A43CD0976FC18BDE"><enum>(4)</enum><text>the prompt
commercialization of the results of geospatial research and development
activities.</text>
</paragraph></subsection><subsection id="H7933CB58F85E4A4B9280318EC2EAC1B0"><enum>(c)</enum><header>Recommendations
for legislation</header><text>The Administrator shall propose to Congress any
recommendations for legislation to authorize innovative partnerships not
authorized under existing law.</text>
</subsection></section><section id="H6D001C8D202241C88D9461B8F4290ABF"><enum>505.</enum><header>Annual
report</header><text display-inline="no-display-inline">The Administrator shall
submit to appropriate committees of Congress an annual report, in conjunction
with the President’s annual budget request as set forth in section 1105 of
title 31, United States Code, describing the amount spent in the last completed
fiscal year on geospatial research and development and the amount proposed in
the current budget for geospatial research and development.</text>
</section><section id="H6CB718B893124CF28D22EE0074833DDA"><enum>506.</enum><header>National
defense and security exemption</header><text display-inline="no-display-inline">This title shall not apply to research and
development activities that would adversely affect the national defense and
security of the United States.</text>
</section>
