		  certain energy-related rules that are estimated to cost more than $1 billion
		  and will cause significant adverse effects to the
		  economy.<pagebreak></pagebreak></official-title>

		<section id="H1794792D642F46DFBC9ABC9C3BB03A85" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Energy Consumers Relief Act of
			 2013</short-title></quote>.</text>
		</section><section id="H17670080D76A4901AB3E948DD2F687DE"><enum>2.</enum><header>Prohibition against
			 finalizing certain energy-related rules that will cause significant adverse
			 effects to the economy</header><text display-inline="no-display-inline">Notwithstanding any other provision of law,
			 the Administrator of the Environmental Protection Agency may not promulgate as
			 final an energy-related rule that is estimated to cost more than $1 billion if
			 the Secretary of Energy determines under section 3(3) that the rule will cause
			 significant adverse effects to the economy.</text>
		</section><section id="H97622D40632641719CA6D182080C0FFC"><enum>3.</enum><header>Reports and
			 determinations prior to promulgating as final certain energy-related
			 rules</header><text display-inline="no-display-inline">Before promulgating as
			 final any energy-related rule that is estimated to cost more than $1
			 billion:</text>
			<paragraph id="H662B872FD3EB4813AD2D83941E733BC8"><enum>(1)</enum><header>Report to
			 Congress</header><text display-inline="yes-display-inline">The Administrator of
			 the Environmental Protection Agency shall submit to Congress a report (and
			 transmit a copy to the Secretary of Energy) containing—</text>
				<subparagraph id="HDC64775EBCFE4DE19244D4058855060C"><enum>(A)</enum><text>a copy of the
			 rule;</text>
				</subparagraph><subparagraph id="H196106A179E242A18891039FA71C5459"><enum>(B)</enum><text>a concise general
			 statement relating to the rule;</text>
				</subparagraph><subparagraph id="HD2A1A9F6F5A44CD58001CFA963F61572"><enum>(C)</enum><text>an estimate of the total
			 costs of the rule, including the direct costs and indirect costs of the
			 rule;</text>
				</subparagraph><subparagraph display-inline="no-display-inline" id="H7564A165850E42A09496F79904E5EF16"><enum>(D)</enum><text display-inline="yes-display-inline">an estimate of the total benefits of the
			 rule, an estimate of when such benefits are expected to be realized, and a
			 description of the modeling, the assumptions, and the limitations due to
			 uncertainty, speculation, or lack of information associated with the estimates
			 under this subparagraph;</text>
				</subparagraph><subparagraph id="HD06F29E414974116AC1E29F42E05B0A5"><enum>(E)</enum><text>an estimate of the
			 increases in energy prices, including potential increases in gasoline or
			 electricity prices for consumers, that may result from implementation or
			 enforcement of the rule; and</text>
				</subparagraph><subparagraph id="HB78BCC89F0FB4A80980229AD9646C832"><enum>(F)</enum><text>a detailed description of
			 the employment effects, including potential job losses and shifts in
			 employment, that may result from implementation or enforcement of the
			 rule.</text>
				</subparagraph></paragraph><paragraph id="H862FD10B099144D89FD45CD8365D3F5D"><enum>(2)</enum><header>Initial determination
			 on increases and impacts</header><text>The Secretary of Energy, in consultation
			 with the Federal Energy Regulatory Commission and the Administrator of the
			 Energy Information Administration, shall prepare an independent analysis to
			 determine whether the rule will cause—</text>
				<subparagraph id="H27CDC3D0A3AF45C4A3C2B065EF4266B5"><enum>(A)</enum><text>any increase in energy
			 prices for consumers, including low-income households, small businesses, and
			 manufacturers;</text>
				</subparagraph><subparagraph id="H862EF9F965EE4E1FA2C352592E1D0395"><enum>(B)</enum><text>any impact on fuel
			 diversity of the Nation’s electricity generation portfolio or on national,
			 regional, or local electric reliability;</text>
				</subparagraph><subparagraph display-inline="no-display-inline" id="HDD2C3F664B924C8DACE7DB087074279D"><enum>(C)</enum><text display-inline="yes-display-inline">any adverse effect on energy supply,
			 distribution, or use due to the economic or technical infeasibility of
			 implementing the rule; or</text>
				</subparagraph><subparagraph id="H512B38874CB245F0A481D431976B66C6"><enum>(D)</enum><text display-inline="yes-display-inline">any other adverse effect on energy supply,
			 distribution, or use (including a shortfall in supply and increased use of
			 foreign supplies).</text>
				</subparagraph></paragraph><paragraph id="H239410045F7D48898F83DEB039C30811"><enum>(3)</enum><header>Subsequent
			 determination on adverse effects to the economy</header><text display-inline="yes-display-inline">If the Secretary of Energy determines,
			 under paragraph (2), that the rule will cause an increase, impact, or effect
			 described in such paragraph, then the Secretary, in consultation with the
			 Administrator of the Environmental Protection Agency, the Secretary of
			 Commerce, the Secretary of Labor, and the Administrator of the Small Business
			 Administration, shall—</text>
				<subparagraph id="H24D9DAACECCC4C2F834BD796227F7DC7"><enum>(A)</enum><text display-inline="yes-display-inline">determine whether the rule will cause
			 significant adverse effects to the economy, taking into consideration—</text>
					<clause id="HDBDAB6FA924C4FCD9A1A8ADDDBEF977E"><enum>(i)</enum><text display-inline="yes-display-inline">the costs and benefits of the rule and
			 limitations in calculating such costs and benefits due to uncertainty,
			 speculation, or lack of information; and</text>
					</clause><clause id="H5DFE05261AAD457FA7B3815E73E4A8B9"><enum>(ii)</enum><text>the positive and
			 negative impacts of the rule on economic indicators, including those related to
			 gross domestic product, unemployment, wages, consumer prices, and business and
			 manufacturing activity; and</text>
					</clause></subparagraph><subparagraph id="H8437AF735A1848E1939546FAE9B590F3"><enum>(B)</enum><text>publish the results of
			 such determination in the Federal Register.</text>
				</subparagraph></paragraph></section><section id="H7B00B5E8436246D49F4EEB9BFCFE18F6"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph commented="no" id="H9C0E12A205424093B66FFA4C55DD8709"><enum>(1)</enum><text>The terms <term>direct
			 costs</term> and <term>indirect costs</term> have the meanings given such terms
			 in chapter 8 of the Environmental Protection Agency’s <quote>Guidelines for
			 Preparing Economic Analyses</quote> dated December 17, 2010.</text>
			</paragraph><paragraph id="HA9D875D4C26645D7A3F40C8062370BC3"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>energy-related rule that is
			 estimated to cost more than $1 billion</term> means a rule of the Environmental
			 Protection Agency that—</text>
				<subparagraph id="H82072312C4EF49519F81E3C491C279E4"><enum>(A)</enum><text display-inline="yes-display-inline">regulates any aspect of the production,
			 supply, distribution, or use of energy or provides for such regulation by
			 States or other governmental entities; and</text>
				</subparagraph><subparagraph id="H2E01F1DF16A74985B60F7B3934B7EBCF"><enum>(B)</enum><text display-inline="yes-display-inline">is estimated by the Administrator of the
			 Environmental Protection Agency or the Director of the Office of Management and
			 Budget to impose direct costs and indirect costs, in the aggregate, of more
			 than $1,000,000,000.</text>
				</subparagraph></paragraph><paragraph id="HF053752090AB4125B8A8166639D2D39E"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>rule</term> has the meaning
			 given to such term in <external-xref legal-doc="usc" parsable-cite="usc/5/551">section 551</external-xref> of title 5, United States Code.</text>
