or</text></paragraph><paragraph id="HAF2A308ABC5948C08B6556B06450136E"><enum>(3)</enum><text>a certified, third-party appraiser pursuant to a contract with the Indian tribe.</text></paragraph></subsection><subsection id="HFE2D6F4475AF4C5C86AC3F3FCA4CDD5B"><enum>(b)</enum><header>Time Limit on Secretarial Review and Action</header><text>Not later than 30 days after the date on which the Secretary receives an appraisal conducted by or for an Indian tribe pursuant to paragraphs (2) or (3) of subsection (a), the Secretary shall—</text><paragraph id="H65F3FED0FD36425999F43220AE345FF7"><enum>(1)</enum><text>review the appraisal; and</text></paragraph><paragraph id="HB7A4180A7A364653AED300926D2805F2"><enum>(2)</enum><text>provide to the Indian tribe a written notice of approval or disapproval of the appraisal.</text></paragraph></subsection><subsection id="H60D68F8CC68247AE900FCC78258E31BA"><enum>(c)</enum><header>Failure of Secretary To Approve or Disapprove</header><text>If, after 60 days, the Secretary has failed to approve or disapprove any appraisal received, the appraisal shall be deemed approved.</text></subsection><subsection id="H97778C12FAE84FC5839B18E351790315"><enum>(d)</enum><header>Option to Indian Tribes To Waive Appraisal</header><paragraph id="H9E7680CE4CE44B8D84AEA780C91288C7"><enum>(1)</enum><text>An Indian tribe wishing to waive the requirements of subsection (a), may do so after it has satisfied the requirements of subsections (2) and (3) below.</text></paragraph><paragraph id="H61F2962840624F65BE346239E32044AD"><enum>(2)</enum><text>An Indian tribe wishing to forego the necessity of a waiver pursuant to this section must provide to the Secretary a written resolution, statement, or other unambiguous indication of tribal intent, duly approved by the governing body of the Indian tribe.</text></paragraph><paragraph id="H6091E162A6854704B85E5FE0E0CBF452"><enum>(3)</enum><text>The unambiguous indication of intent provided by the Indian tribe to the Secretary under paragraph (2) must include an express waiver by the Indian tribe of any claims for damages it might have against the United States as a result of the lack of an appraisal undertaken.</text></paragraph></subsection><subsection id="H4D111DD672F64B69AA254B9F9BCCF65B"><enum>(e)</enum><header>Definition</header><text>For purposes of this subsection, the term <term>appraisal</term> includes appraisals and other estimates of value.</text></subsection><subsection id="HFE79FA0F341441C291FE9EE7AFFC6FDD"><enum>(f)</enum><header>Regulations</header><text>The Secretary shall develop regulations for implementing this section, including standards the Secretary shall use for approving or disapproving an appraisal.</text></subsection></section><after-quoted-block>. </after-quoted-block></quoted-block></subsection><subsection id="H67231AF7447C4324B46B9107B1555315"><enum>(b)</enum><header>Conforming amendment</header><text>The table of contents of the Energy Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/42/13201">42 U.S.C. 13201</external-xref> note) is amended by adding at the end of the items relating to title XXVI the following:</text><quoted-block changed="added" committee-id="HII00" display-inline="no-display-inline" id="H570C1E4A47854DFC9692889945D53C7E" reported-display-style="italic" style="OLC"><toc changed="added" committee-id="HII00" regeneration="no-regeneration" reported-display-style="italic"><toc-entry level="section">Sec. 2607. Appraisal reforms.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H9D4E0A706DCE4590A6E64D4F70C4CBFF"><enum>4.</enum><header>Standardization</header><text display-inline="no-display-inline">As soon as practicable after the date of the enactment of this Act, the Secretary of the Interior shall implement procedures to ensure that each agency within the Department of the Interior that is involved in the review, approval, and oversight of oil and gas activities on Indian lands shall use a uniform system of reference numbers and tracking systems for oil and gas wells.</text></section><section display-inline="no-display-inline" id="HDD53F5AA78BF4DA58B444F7642A24272"><enum>5.</enum><header>Environmental reviews of major Federal actions on Indian lands</header><text display-inline="no-display-inline">Section 102 of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332</external-xref>) is amended by inserting <quote>(a) <header-in-text level="subsection" style="OLC">In general.—</header-in-text></quote> before the first sentence, and by adding at the end the following:</text><quoted-block changed="added" committee-id="HII00" id="HF86CE775DB074ECC9CA210C4C44EB2E1" reported-display-style="italic" style="OLC"><subsection id="H996283B39A95468CAB0DABF85B7E5F98"><enum>(b)</enum><header>Review of major Federal actions on Indian lands</header><paragraph id="H0285B2CDECE04F19A27446C484593BD5"><enum>(1)</enum><header>In general</header><text>For any major Federal action on Indian lands of an Indian tribe requiring the preparation of a statement under subsection (a)(2)(C), the statement shall only be available for review and comment by the members of the Indian tribe and by any other individual residing within the affected area.</text></paragraph><paragraph id="HF29397A9B1694398B944B7B7FD5D66D4"><enum>(2)</enum><header>Regulations</header><text>The Chairman of the Council on Environmental Quality shall develop regulations to implement this section, including descriptions of affected areas for specific major Federal actions, in consultation with Indian tribes.</text></paragraph><paragraph id="H4CC0A68F261642DB8481E43217C2C617"><enum>(3)</enum><header>Definitions</header><text>In this subsection, each of the terms <term>Indian land</term> and <term>Indian tribe</term> has the meaning given that term in section 2601 of the Energy Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/25/3501">25 U.S.C. 3501</external-xref>).</text></paragraph><paragraph id="HFD5E562665A741FB9617CBE0BD5CB084"><enum>(4)</enum><header>Clarification of authority</header><text display-inline="yes-display-inline">Nothing in the Native American Energy Act, except section 7 of that Act, shall give the Secretary any additional authority over energy projects on Alaska Native Claims Settlement Act lands.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HBB5577DF005A49A29E940D03C6E57E68"><enum>6.</enum><header>BLM oil and gas fees</header><text display-inline="no-display-inline">The Secretary of the Interior, acting through the Bureau of Land Management, shall not collect any fee for any of the following:</text><paragraph id="HE81533FB1A0A40DF89040F09FF023ABF"><enum>(1)</enum><text>For an application for a permit to drill on Indian land.</text></paragraph><paragraph id="H67415D59E5BF445DAEF6C1EAB068BB9E"><enum>(2)</enum><text>To conduct any oil or gas inspection activity on Indian land.</text></paragraph><paragraph id="H85B46EA31492486F8B38F45AF685F269"><enum>(3)</enum><text>On any oil or gas lease for nonproducing acreage on Indian land.</text></paragraph></section><section commented="no" id="H916BB503AEC945B19B26D2B53CDC97DB"><enum>7.</enum><header>Bonding requirements and nonpayment of attorneys’ fees to promote Indian energy projects</header><subsection commented="no" id="H5D9BD9A573C444E8BB41F12DC545A651"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline">A plaintiff who obtains a preliminary injunction or administrative stay in an energy related action, but does not ultimately prevail on the merits of the energy related action, shall be liable for damages sustained by a defendant who—</text><paragraph commented="no" id="HCE9A263A0C334A80BF1A531453DF0F35"><enum>(1)</enum><text>opposed the preliminary injunction or administrative stay; and</text></paragraph><paragraph commented="no" id="HBD0BB83ABD804D0AA1C63C8CE4459420"><enum>(2)</enum><text>was harmed by the preliminary injunction or administrative stay.</text></paragraph></subsection><subsection commented="no" id="H5E1C24B641EC439284351AA968B5B05D"><enum>(b)</enum><header>Bond</header><text>Unless otherwise specifically exempted by Federal law, a court may not issue a preliminary injunction and an agency may not grant an administrative stay in an energy related action until the plaintiff posts with the court or the agency a surety bond or cash equivalent—</text><paragraph commented="no" id="H66AA44146FEC45A8A355F97E62407579"><enum>(1)</enum><text display-inline="yes-display-inline">in an amount the court or agency decides is 30 percent of that amount that the court or agency considers is sufficient to compensate each defendant opposing the preliminary injunction or administrative stay for damages, including but not limited to preliminary development costs, additional development costs, and reasonable attorney fees, that each defendant may sustain as a result of the preliminary injunction or administrative stay;</text></paragraph><paragraph commented="no" id="H166D8B5A905E4E4A8611CDADECE79BDC"><enum>(2)</enum><text>written by a surety licensed to do business in the State in which the Indian Land or other land where the activities are undertaken is situated; and</text></paragraph><paragraph commented="no" id="H9B2F42FAA75C49DE872C4191CCD9A650"><enum>(3)</enum><text>payable to each defendant opposing the preliminary injunction or administrative stay, in the event that the plaintiff does not prevail on the merits of the energy related action, <italic>Provided</italic>, that, if there is more than one plaintiff, the court or agency shall establish the amount of the bond required by this subsection for each plaintiff in a fair and equitable manner.</text></paragraph></subsection><subsection commented="no" id="HE0A0984BB3CA43A7920DD71CCF87DA67"><enum>(c)</enum><header>Limitation on certain payments</header><text>Notwithstanding <external-xref legal-doc="usc" parsable-cite="usc/31/1304">section 1304</external-xref> of title 31, United States Code, no award may be made under <external-xref legal-doc="usc" parsable-cite="usc/5/504">section 504</external-xref> of title 5, United States Code, or under <external-xref legal-doc="usc" parsable-cite="usc/28/2412">section 2412</external-xref> of title 28, United States Code, and no amounts may be obligated or expended from the Claims and Judgment Fund of the United States Treasury to pay any fees or other expenses under such sections to any plaintiff related to an energy related action.</text></subsection><subsection commented="no" id="H1F9541B5A2D14827967279F1CA91197D"><enum>(d)</enum><header>Definitions</header><text>For the purposes of this section, the following definitions apply:</text><paragraph commented="no" id="H1286CD0B0CE04DA4B2DAABC1E986CECD"><enum>(1)</enum><header>Administrative stay</header><text>The term <term>Administrative Stay</term> means a stay or other temporary remedy issued by a Federal agency, including the Department of the Interior, the Department of Agriculture, the Department of Energy, the Department of Commerce, and the Environmental Protection Agency.</text></paragraph><paragraph commented="no" id="HE85FE0A66B224BD6BF673C5ED4C4C43D"><enum>(2)</enum><header>Indian land</header><text>The term <term>Indian Land</term> has the same meaning given such term in section 203(c)(3) of the Energy Policy Act of 2005 (<external-xref legal-doc="public-law" parsable-cite="pl/109/58">Public Law 109–58</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/25/3501">25 U.S.C. 3501</external-xref>), including lands owned by Native Corporations under the Alaska Native Claims Settlement Act (<external-xref legal-doc="public-law" parsable-cite="pl/92/203">Public Law 92–203</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/43/1601">43 U.S.C. 1601</external-xref>).</text></paragraph><paragraph commented="no" id="H5E24CB8EFB9B453092C6BED2F51D8EF5"><enum>(3)</enum><header>Energy related action</header><text>The term <term>energy related action</term> means a cause of action that—</text><subparagraph commented="no" id="H4F083472326A4E73B799518F01CD9DA6"><enum>(A)</enum><text>is filed on or after the effective date of this Act; and</text></subparagraph><subparagraph commented="no" id="H7C627326094B4139B7F2F0ACE0DC1991"><enum>(B)</enum><text>seeks judicial review of a final agency action (as defined in <external-xref legal-doc="usc" parsable-cite="usc/5/702">section 702</external-xref> of title 5, United States Code), to issue a permit, license, or other form of agency permission allowing:</text><clause commented="no" id="H038FB3306CBC48268BF64E85097697DD"><enum>(i)</enum><text display-inline="yes-display-inline">any person or entity to conduct activities on Indian Land, which activities involve the exploration, development, production or transportation of oil, gas, coal, shale gas, oil shale, geothermal resources, wind or solar resources, underground coal gasification, biomass, or the generation of electricity, or</text></clause><clause commented="no" id="H88DE09512CAE4F4EB00D9EB206A33DA1"><enum>(ii)</enum><text display-inline="yes-display-inline">any Indian Tribe, or any organization of two or more entities, at least one of which is an Indian tribe, to conduct activities involving the exploration, development, production or transportation of oil, gas, coal, shale gas, oil shale, geothermal resources, wind or solar resources, underground coal gasification, biomass, or the generation of electricity, regardless of where such activities are undertaken.</text></clause></subparagraph></paragraph><paragraph commented="no" id="H9A7DA72733E7465FA31CF7E551399FCA"><enum>(4)</enum><header>Ultimately prevail on the merits</header><text>The phrase <quote>Ultimately prevail on the merits</quote> means, in a final enforceable judgment on the merits, the court rules in the plaintiff’s favor on at least one cause of action which is an underlying rationale for the preliminary injunction, and does not include circumstances where the final agency action is modified or amended by the issuing agency unless such modification or amendment is required pursuant to a final enforceable judgment of the court or a court-ordered consent decree.</text></paragraph><paragraph id="H460F95DF5F614452AE021B3CCAC49C1A"><enum>(5)</enum><header>Indian tribe</header><text display-inline="yes-display-inline">The term <quote>Indian tribe</quote> means any Indian tribe, band, nation, or other organized group or community, including any Alaska Native village or regional or village corporation as defined in or established pursuant to the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1601">43 U.S.C. 1601 et seq.</external-xref>), which is recognized as eligible for the special programs and services provided by the United States to Indians because of their status as Indians.</text></paragraph></subsection></section><section id="H6700B8AED9FB4BA9B80A1AC8BBD4B94D"><enum>8.</enum><header>Tribal biomass demonstration project</header><text display-inline="no-display-inline">The Tribal Forest Protection Act of 2004 is amended by inserting after section 2 (<external-xref legal-doc="usc" parsable-cite="usc/25/3115a">25 U.S.C. 3115a</external-xref>) the following:</text><quoted-block changed="added" committee-id="HII00" display-inline="no-display-inline" id="HEDE30CA9F09D4B8D89148D77F13AE9D8" reported-display-style="italic" style="OLC"><section id="H8DB9E977F77649E5947F325A197C91BE"><enum>3.</enum><header>Tribal biomass demonstration project</header><subsection id="H4905594A2B064058B21B9AD2E54D8C67"><enum>(a)</enum><header>In general</header><text>For each of fiscal years 2014 through 2018, the Secretary shall enter into stewardship contracts or other agreements, other than agreements that are exclusively direct service contracts, with Indian tribes to carry out demonstration projects to promote biomass energy production (including biofuel, heat, and electricity generation) on Indian forest land and in nearby communities by providing reliable supplies of woody biomass from Federal land.</text></subsection><subsection id="H7ED8F109E693436AA88D339D9183373B"><enum>(b)</enum><header>Definitions</header><text>The definitions in section 2 shall apply to this section.</text></subsection><subsection id="HF68FDCDE494B4F3A92139AA5252E06A1"><enum>(c)</enum><header>Demonstration projects</header><text>In each fiscal year for which projects are authorized, the Secretary shall enter into contracts or other agreements described in subsection (a) to carry out at least 4 new demonstration projects that meet the eligibility criteria described in subsection (d).</text></subsection><subsection id="H51CB1FAF080E428E8E5B9068B46CF081"><enum>(d)</enum><header>Eligibility criteria</header><text>To be eligible to enter into a contract or other agreement under this subsection, an Indian tribe shall submit to the Secretary an application—</text><paragraph id="H26B714A2DA414D7A928A518CD9E2D580"><enum>(1)</enum><text>containing such information as the Secretary may require; and</text></paragraph><paragraph id="H4532FFD4958F43C1BCC0719F41276DC5"><enum>(2)</enum><text>that includes a description of—</text><subparagraph id="HF73B45A7A21E4F16BA320F6507A61051"><enum>(A)</enum><text>the Indian forest land or rangeland under the jurisdiction of the Indian tribe; and</text></subparagraph><subparagraph id="H7DD19130395F48159EBCFB1BAA848F3E"><enum>(B)</enum><text>the demonstration project proposed to be carried out by the Indian tribe.</text></subparagraph></paragraph></subsection><subsection id="H86C27654D6214D659E03529082C283A9"><enum>(e)</enum><header>Selection</header><text>In evaluating the applications submitted under subsection (c), the Secretary—</text><paragraph id="HBA35F5F072D04C1EBE783A34A454DF0D"><enum>(1)</enum><text>shall take into consideration the factors set forth in paragraphs (1) and (2) of section 2(e) of <external-xref legal-doc="public-law" parsable-cite="pl/108/278">Public Law 108–278</external-xref>; and whether a proposed demonstration project would—</text><subparagraph id="H89A0BC1B95014C0987A1E2714311C0B6"><enum>(A)</enum><text>increase the availability or reliability of local or regional energy;</text></subparagraph><subparagraph id="HBF9633D0D89B4D17BE1C5D3765B61B06"><enum>(B)</enum><text>enhance the economic development of the Indian tribe;</text></subparagraph><subparagraph id="HF57581433C8A4C9E84FDB867D8088CF5"><enum>(C)</enum><text>improve the connection of electric power transmission facilities serving the Indian tribe with other electric transmission facilities;</text></subparagraph><subparagraph id="H4274474D349046E494AB55E8BB907970"><enum>(D)</enum><text>improve the forest health or watersheds of Federal land or Indian forest land or rangeland; or</text></subparagraph><subparagraph id="H853FC08461A146838A3706437E0FB44F"><enum>(E)</enum><text>otherwise promote the use of woody biomass; and</text></subparagraph></paragraph><paragraph id="H9FF841701DAF4DB19AB328EA17DE1E24"><enum>(2)</enum><text>shall exclude from consideration any merchantable logs that have been identified by the Secretary for commercial sale.</text></paragraph></subsection><subsection id="HA77B0B6A00E24309B26CDCF98B5681AF"><enum>(f)</enum><header>Implementation</header><text>The Secretary shall—</text><paragraph id="H437A3AA8D337457DA2D0926F8A617CBB"><enum>(1)</enum><text>ensure that the criteria described in subsection (c) are publicly available by not later than 120 days after the date of enactment of this section; and</text></paragraph><paragraph id="HB9CFC41245BF42C2A2C23CCD5D6F1553"><enum>(2)</enum><text>to the maximum extent practicable, consult with Indian tribes and appropriate intertribal organizations likely to be affected in developing the application and otherwise carrying out this section.</text></paragraph></subsection><subsection id="H809B006607EE431DAE34796E0D534CFE"><enum>(g)</enum><header>Report</header><text>Not later than September 20, 2015, the Secretary shall submit to Congress a report that describes, with respect to the reporting period—</text><paragraph id="H5A5E6E1465384CB58E00287E753CA42A"><enum>(1)</enum><text>each individual tribal application received under this section; and</text></paragraph><paragraph id="HA651C610F3D6404AB32E7CF3761611A5"><enum>(2)</enum><text>each contract and agreement entered into pursuant to this section.</text></paragraph></subsection><subsection id="H29716007FB1A4250BF7E0918A1134AB2"><enum>(h)</enum><header>Incorporation of management plans</header><text>In carrying out a contract or agreement under this section, on receipt of a request from an Indian tribe, the Secretary shall incorporate into the contract or agreement, to the extent practicable, management plans (including forest management and integrated resource management plans) in effect on the Indian forest land or rangeland of the respective Indian tribe.</text></subsection><subsection id="H55EDBA02E7F945918E7C9C99D615FB2C"><enum>(i)</enum><header>Term</header><text>A stewardship contract or other agreement entered into under this section—</text><paragraph id="HAA51B2544097401890AF7BFDB899D208"><enum>(1)</enum><text>shall be for a term of not more than 20 years; and</text></paragraph><paragraph id="HDE3CCE55FA5F4B9F822096345B04304D"><enum>(2)</enum><text>may be renewed in accordance with this section for not more than an additional 10 years.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H478C74E9E87A42748F065DD35266C447"><enum>9.</enum><header>Tribal resource management plans</header><text display-inline="no-display-inline">Unless otherwise explicitly exempted by Federal law enacted after the date of the enactment of this Act, any activity conducted or resources harvested or produced pursuant to a tribal resource management plan or an integrated resource management plan approved by the Secretary of the Interior under the National Indian Forest Resources Management Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3101">25 U.S.C. 3101 et seq.</external-xref>) or the American Indian Agricultural Resource Management Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3701">25 U.S.C. 3701 et seq.</external-xref>), shall be considered a sustainable management practice for purposes of any Federal standard, benefit, or requirement that requires a demonstration of such sustainability.</text></section><section commented="no" id="HDDCB92A6292E494D8AAE4E5D357C416F"><enum>10.</enum><header>Leases of restricted lands for the Navajo Nation</header><text display-inline="no-display-inline">Subsection (e)(1) of the first section of the Act of August 9, 1955 (<external-xref legal-doc="usc" parsable-cite="usc/25/415">25 U.S.C. 415(e)(1)</external-xref>; commonly referred to as the <quote>Long-Term Leasing Act</quote>), is amended—</text><paragraph commented="no" id="H0E5ED21BDF314F99A5BF08A63E60AFBE"><enum>(1)</enum><text>by striking <quote>, except a lease for</quote> and inserting <quote>, including leases for</quote>;</text></paragraph><paragraph commented="no" id="HD2A00291DFC1461FACDC19A9D1C4AB6A"><enum>(2)</enum><text>in subparagraph (A), by striking <quote>25</quote> the first place it appears and all that follows and inserting <quote>99 years;</quote>;</text></paragraph><paragraph commented="no" id="HE0C620735A2844A7BEDCFEB855E851ED"><enum>(3)</enum><text>in subparagraph (B), by striking the period and inserting <quote>; and</quote>; and</text></paragraph><paragraph commented="no" id="HB916685E799C496A88D2E8F291E8AE7A"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block changed="added" committee-id="HII00" display-inline="no-display-inline" id="HE7E9E59826CD4474ACBD8DDBFDA68A80" reported-display-style="italic" style="OLC"><subparagraph commented="no" id="HE82353645B14482283E37C661AB1069D" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">in the case of a lease for the exploration, development, or extraction of mineral resources, including geothermal resources, 25 years, except that any such lease may include an option to renew for one additional term not to exceed 25 years.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HAF7874A6C4324A418752EA9CA0896393"><enum>11.</enum><header>Nonapplicability of certain rules</header><text display-inline="no-display-inline">No rule promulgated by the Department of the Interior regarding hydraulic fracturing used in the development or production of oil or gas resources shall have any effect on any land held in trust or restricted status for the benefit of Indians except with the express consent of the beneficiary on whose behalf such land is held in trust or restricted status.</text></section></legis-body><endorsement display="yes"><action-date>November 12, 2013</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc></endorsement></bill>
