		<section id="H2C526BF4B5B446E193F69FFA038F19ED" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>National High Performance Passenger
			 Rail Transportation-Oriented Development Act of
			 2013</short-title></quote>.</text>
		</section><section id="H873AEA30269C4683BFBF17AB634AD462"><enum>2.</enum><header>Transportation-oriented
			 development initiative</header>
			<subsection id="H29C653028408451B8E9026BF413828C6"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary of Transportation (in this
			 Act referred to as the <quote>Secretary</quote>) shall establish an initiative
			 to promote intercity and urban passenger rail operations and
			 transportation-oriented development by creating incentives for communities to
			 encourage dedicated revenue sources for urban and regional rail corridor
			 development.</text>
			</subsection><subsection id="H886E925DE348473BA7180862A83C5145"><enum>(b)</enum><header>Implementation</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
			 enactment of this Act, the Secretary shall obtain the services of qualified
			 independent private sector entity with experience in transportation-oriented
			 development to serve as a liaison between the Federal Government, State and
			 local authorities, private sector participants, and appropriate other
			 stakeholders in the initiative. Such entity shall—</text>
				<paragraph id="H79F61704DB80457C9E85CB4DE55C253A"><enum>(1)</enum><text>serve as a
			 development planning advisor, by advancing and recommending methodologies to
			 use in the overall implementation of the initiative;</text>
				</paragraph><paragraph id="H1C06C8635D934ADD8B9A301C24C4D1CE"><enum>(2)</enum><text>provide
			 recommendations as requested by the Secretary, which shall include
			 recommendations on—</text>
					<subparagraph id="H163947357DBD4CDEAEC2CFDCF5973F61"><enum>(A)</enum><text>liaison between
			 the Federal Government, and State, local, or regional applicants for incentives
			 under the initiative;</text>
					</subparagraph><subparagraph id="H502CE7CA20574629A327186335FA995C"><enum>(B)</enum><text>mechanisms for
			 coordination among all stakeholders, including State, local, and regional
			 authorities;</text>
					</subparagraph><subparagraph id="H98AA6F66CB1F4BFDA7D2E149874BEA06"><enum>(C)</enum><text>types of projects
			 that should receive incentives under the initiative; and</text>
					</subparagraph><subparagraph id="HBFF7659C18584855A60E5CEFC6BD81C0"><enum>(D)</enum><text>mechanisms for
			 providing technical assistance and types of technical assistance that should be
			 provided; and</text>
					</subparagraph></paragraph><paragraph id="H13FD98B44C49424CA28AB10DC9477479"><enum>(3)</enum><text>conduct a
			 preliminary transportation-oriented development survey on the Northeast
			 Corridor or other local station areas or regional corridors.</text>
				</paragraph></subsection><subsection id="H27345E6CAD214C53BC312F79AD04C8F7"><enum>(c)</enum><header>Coordination</header><text>The
			 Secretary shall harmonize planning requirements and direct coordination and
			 administration of the initiative between the Federal Railroad Administration
			 and the Federal Transit Administration.</text>
			</subsection></section><section id="H583F4A5B390F46F3A62BDF4D220B4715"><enum>3.</enum><header>Federal
			 incentives</header>
			<subsection id="H789DC874A02C4E31962B9553B91C6CF2"><enum>(a)</enum><header>Qualified
			 projects</header>
				<paragraph id="HD8E8AF2313E546CE9C3CA9F5FC2C53B5"><enum>(1)</enum><header>Criteria</header><text>The
			 Secretary shall establish criteria for the designation of projects qualified
			 for Federal incentives pursuant to this section and the amendments made by this
			 section.</text>
				</paragraph><paragraph id="HF78C1161CAF048ACA626BDD7897EAFF0"><enum>(2)</enum><header>Types of
			 projects that may qualify</header><text display-inline="yes-display-inline">Projects that may qualify for Federal
			 incentives pursuant to this section and the amendments made by this section are
			 commercial development or other projects that—</text>
					<subparagraph id="H695B4FC474D34D329D2427AC06E3C204"><enum>(A)</enum><text>contribute to the
			 generation of revenue by the capture of increasing value from development
			 around station areas, through the establishment of special assessment
			 districts, increasing the tax base, promoting job growth, promoting cost
			 effectiveness, facilitating intermodal connectivity, combining congestion
			 relief with station development, stimulating economic development, or any other
			 appropriate means;</text>
					</subparagraph><subparagraph id="H28F27E40F7564B63AC64A7C6D6AAFABF"><enum>(B)</enum><text>are likely to make
			 long-term contributions to rail corridor development funds or similar
			 mechanisms that help finance intercity and urban passenger rail infrastructure
			 or operating expenses; and</text>
					</subparagraph><subparagraph id="H4F951A8D3352485D86A6AD78F6B3CBEC"><enum>(C)</enum><text>provide for a
			 quantifiable revenue stream to the relevant station or rail operation.</text>
					</subparagraph></paragraph><paragraph id="HF1CA789FD51E4E44945F236BF7A11921"><enum>(3)</enum><header>Applicant
			 coordinating authority</header><text display-inline="yes-display-inline">An
			 applicant for Federal incentives pursuant to this section and the amendments
			 made by this section shall be a State, local, or regional authority. Such
			 authority shall provide for coordination among stakeholders, local governments,
			 and private developers in the defined region, and shall be the lead party in
			 the application.</text>
				</paragraph><paragraph id="H726C1A5D8F284ABAB318D46CF365FA3C"><enum>(4)</enum><header>Projects
			 authorized</header><text display-inline="yes-display-inline">Except as provided
			 in subsection (b), projects are not authorized to receive Federal incentives
			 pursuant to this section and the amendments made by this section until the date
			 that is 1 year after the report required under subsection (c) is transmitted to
			 Congress.</text>
				</paragraph></subsection><subsection id="H6567A2AC082C4A8D96BDAC42EC8CB3A5"><enum>(b)</enum><header>Pilot
			 projects</header><text display-inline="yes-display-inline">The Secretary may
			 designate up to 4 pilot projects as qualified for Federal incentives pursuant
			 to this section and the amendments made by this section before the date
			 specified in subsection (a)(4).</text>
			</subsection><subsection id="HD024644E7FCE442A879197ABD36BE639"><enum>(c)</enum><header>Report to
			 Congress</header><text display-inline="yes-display-inline">Not later than 1
			 year after the date of enactment of this Act, the Secretary, after consultation
			 with each State, local, or regional authority coordinating a pilot project
			 under subsection (b), shall transmit to Congress a report assessing the success
			 or failure of each such pilot project and making any appropriate
			 recommendations for modifications to the initiative under this Act.</text>
			</subsection><subsection id="H6B77C1DCC22B468C9549BB460B4AB3F3"><enum>(d)</enum><header>Railroad
			 rehabilitation improvement financing</header><text>Section 502 of the Railroad
			 Revitalization and Regulatory Reform Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/45/822">45 U.S.C. 822</external-xref>) is
			 amended—</text>
				<paragraph id="HCB278D24391746D89DDD1BDF1631839A"><enum>(1)</enum><text>in subsection
			 (a)—</text>
					<subparagraph id="H42D34FA0D66D41E08245EA72086210A5"><enum>(A)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (5);</text>
					</subparagraph><subparagraph id="H9462FBA484FE4691BC1C871BEC21B7A1"><enum>(B)</enum><text>by striking the
			 period at the end of paragraph (6) and inserting <quote>; and</quote>;
			 and</text>
					</subparagraph><subparagraph id="H8C4D703FE6BF4EC1B29179A0AE1D7EB7"><enum>(C)</enum><text>by adding at the
			 end the following new paragraph:</text>
						<quoted-block id="HF10C986F13224AEDB37D9C42085584B5" style="OLC">
							<paragraph id="H99FF19DDF53B46148B9068DCCB4975B8"><enum>(7)</enum><text display-inline="yes-display-inline">persons conducting a qualified project (as
				defined by the Secretary under section 3 of the National High Performance
				Passenger Rail Transportation-Oriented Development Act of
				2013).</text>
							</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HA16FCDCA4B104B949BC89A43EFEAE58F"><enum>(2)</enum><text>in subsection
			 (b)(1)—</text>
					<subparagraph id="H3F1ABCBC7C02445C91DEA8BED06B38DA"><enum>(A)</enum><text>by striking
			 <quote>or</quote> at the end of subparagraph (B);</text>
					</subparagraph><subparagraph id="H43D3A54EA032492384E7DEF4AD3DE2E1"><enum>(B)</enum><text>by striking the
			 period at the end of subparagraph (C) and inserting <quote>; or</quote>;
			 and</text>
					</subparagraph><subparagraph id="H72A93663839041F6BE86B9DAA36BAD20"><enum>(C)</enum><text>by adding at the
			 end the following new subparagraph:</text>
						<quoted-block id="HC5D29D48618C4A4E98071642AB5450AB" style="OLC">
							<subparagraph id="HFC4129F84C7A48028219A95DFF035D36"><enum>(D)</enum><text>conduct a
				qualified project (as defined by the Secretary under section 3 of the National
				High Performance Passenger Rail Transportation-Oriented Development Act of
				2013).</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="HAC7C512B2D354222ABBCACC17FF85128"><enum>(e)</enum><header>Transportation
			 infrastructure finance</header><text><external-xref legal-doc="usc" parsable-cite="usc/23/601">Section 601(a)(12)</external-xref> of title 23, United
			 States Code, is amended—</text>
				<paragraph id="H4239500595B949B794719A5F6BD8416F"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of subparagraph (C);</text>
				</paragraph><paragraph id="HE8CE794D5DA94F1CB2A91698C2CC867F"><enum>(2)</enum><text>by striking the
			 period at the end of subparagraph (D) and inserting <quote>; and</quote>;
			 and</text>
				</paragraph><paragraph id="H65C512632D214219939EAE75467628A4"><enum>(3)</enum><text>by adding at the
			 end the following new subparagraph:</text>
					<quoted-block id="HBF1E3836BEE34B0ABDC03C513B96B522" style="OLC">
						<subparagraph id="HC052313488614A43B32C7F5BCF64606C"><enum>(E)</enum><text>a qualified
				project (as defined by the Secretary under section 3 of the National High
				Performance Passenger Rail Transportation-Oriented Development Act of
				2013).</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HF37B6BB0AB764D549A6E573814FE7F66"><enum>(f)</enum><header>Application
			 priority</header><text>In general, Federal applications to the Federal Railroad
			 Administration and Federal Transit Administration for railroad projects that
			 participate in the transportation-oriented development initiative under this
			 Act shall receive a priority for funding in the application decision
			 process.</text>
			</subsection><subsection id="HFB594A4215BD4DA2A099F19720674F55"><enum>(g)</enum><header>Revenue neutral
			 program cost</header><text display-inline="yes-display-inline">The Secretary
			 shall establish and apply to recipients of Federal incentives pursuant to this
			 section and the amendments made by this section a fee in an amount sufficient
			 to cover the administrative costs of carrying out this Act, including section
			 2(b).</text>
			</subsection></section><section id="HFA4397D6BB014D0E92E5D1FCF6BE2E6D"><enum>4.</enum><header>Technical
			 assistance</header>
			<subsection id="H3AAC01C94238492C8979D8CE30FAED58"><enum>(a)</enum><header>National
			 technical assistance</header><text display-inline="yes-display-inline">The
			 Secretary shall provide technical assistance to applicants and potential
			 applicants for Federal incentives pursuant to this Act and the amendments made
			 by this Act with respect to—</text>
				<paragraph id="H3B9A968F53E14DC688278D5DBA64631C"><enum>(1)</enum><text>identification of
			 transportation-oriented development opportunities;</text>
				</paragraph><paragraph id="HCFD53B5D21A049A5A369965EB73535CD"><enum>(2)</enum><text>establishment of
			 special assessment districts in regions;</text>
				</paragraph><paragraph id="H6DC91BBB7BF84CE89981A68773CE9D7B"><enum>(3)</enum><text>establishment of
			 rail corridor development funds; and</text>
				</paragraph><paragraph id="H56479FDB69594D3BB363E927C4E70911"><enum>(4)</enum><text>expediting
			 Federal, State, and local regulatory approvals.</text>
				</paragraph></subsection><subsection id="HB62E5A1B405B4F4FA6B3DCD4747B896F"><enum>(b)</enum><header>States,
			 localities, and regions outside the northeast corridor</header><text display-inline="yes-display-inline">The Secretary shall provide technical
			 assistance to the States, localities, and regions outside the Northeast
			 Corridor as identified by the Secretary, including—</text>
				<paragraph id="H6026D0EA49944C3484D5F206891724BE"><enum>(1)</enum><text>technical
			 assistance on the establishment of regional authorities appropriate to carrying
			 out the purposes of this Act at the regional level; and</text>
				</paragraph><paragraph id="H999EE458B09546F385D00AD4E07D6E10"><enum>(2)</enum><text display-inline="yes-display-inline">technical assistance at the request of a
			 State, local, or regional entity to identify stations and potential stations
			 within a region and conduct a preliminary survey of property available and
			 potentially available, to maximize development and commercial revenue
			 generation to financially support the development of a high performance
			 intercity or urban rail passenger corridor.</text>
				</paragraph></subsection><subsection id="H52E2F4B2C33945238EFE253447D1DF72"><enum>(c)</enum><header>Northeast
			 corridor</header><text display-inline="yes-display-inline">The Secretary shall
			 provide technical assistance to the States and local or regional entities along
			 the Northeast Corridor, including—</text>
				<paragraph id="HC193328E809644048D73F69FC2037E4F"><enum>(1)</enum><text display-inline="yes-display-inline">technical assistance on the establishment,
			 by the Northeast Corridor Infrastructure and Operations Advisory Commission
			 established under <external-xref legal-doc="usc" parsable-cite="usc/49/24905">section 24905</external-xref> of title 49, United States Code, of a Northeast
			 Corridor Transportation-Oriented Development Working Group, which shall—</text>
					<subparagraph id="HA8C8937B1C8040F1A8282775F0823BFA"><enum>(A)</enum><text>include outside
			 members with expertise in transportation-oriented development;</text>
					</subparagraph><subparagraph id="H2200E453B26E4148BC4558898A07E30A"><enum>(B)</enum><text display-inline="yes-display-inline">be supported by the independent private
			 sector entity retained by the Secretary under section 2(b);</text>
					</subparagraph><subparagraph id="HFEA92330AEFC42AB97679810085BE938"><enum>(C)</enum><text display-inline="yes-display-inline">be chaired by a designee appointed by the
			 Secretary who is an expert with private sector transportation oriented
			 development experience; and</text>
					</subparagraph><subparagraph id="H562BBC41066144DD9BD85D2DC456B9B6"><enum>(D)</enum><text>advise the
			 Secretary and the Northeast Corridor Infrastructure and Operations Advisory
			 Commission on the ways and means for carrying out the purposes of this Act at
			 the regional level; and</text>
					</subparagraph></paragraph><paragraph id="H7A76F15A3070455D8D67C2600B919040"><enum>(2)</enum><text display-inline="yes-display-inline">not more than 1 year after the date of
			 enactment of this Act, technical assistance to identify Northeast Corridor
			 stations and potential stations and conduct a preliminary survey of property
			 available and potentially available, to maximize development and commercial
			 revenue generation to financially support the creation of a true high-speed
			 rail corridor in the Northeast Corridor.</text>
				</paragraph></subsection></section></legis-body>
