		<legis-type>A BILL</legis-type>
		<official-title>To establish limitations, for fiscal years 2013, 2014,
		  and 2015 on the total amount in awards or other discretionary monetary payments
		  which may be paid to any Federal employee.</official-title>

		<section id="HB959F32EAB91415DB277593F781AC82E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Common Sense in Compensation
			 Act</short-title></quote>.</text>
		</section><section id="H2DC25EE442BD4CA1A3879F566F4BF14F"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this Act—</text>
			<paragraph id="H82B5892DB1F0459FB1F1A2940EB454BC"><enum>(1)</enum><text>the term
			 <term>employee</term> means an employee (as defined by section 2105(a) of title
			 5, United States Code) holding a position in or under an Executive agency;</text>
			</paragraph><paragraph id="HCDAD1863B99D41169BFA18B49EBC8700"><enum>(2)</enum><text>the term
			 <term>Executive agency</term> has the meaning given such term by section 105 of
			 title 5, United States Code;</text>
			</paragraph><paragraph id="H58A71E83917B4E74ACCAAF4DE7267055"><enum>(3)</enum><text>the term
			 <term>discretionary monetary payment</term> means—</text>
				<subparagraph id="H241B6E3EE1A1499B8468F8F59AC3C99C"><enum>(A)</enum><text>any award or other
			 monetary payment under chapter 45, or section <external-xref legal-doc="usc" parsable-cite="usc/5/5753">5753</external-xref> or <external-xref legal-doc="usc" parsable-cite="usc/5/5754">5754,</external-xref> of title 5, United
			 States Code; and</text>
				</subparagraph><subparagraph id="H23EA5799546443FEB991BC4FDF7E4887"><enum>(B)</enum><text>any step-increase
			 under <external-xref legal-doc="usc" parsable-cite="usc/5/5336">section 5336</external-xref> of title 5, United States Code;</text>
				</subparagraph></paragraph><paragraph id="H507BDA841B8540ED9E7061283924E6FB"><enum>(4)</enum><text>the term
			 <term>covered compensation</term>, as used with respect to an employee in
			 connection with any period, means the sum of—</text>
				<subparagraph id="H4DBE99F3AC064330A03B7A5DCAE9B7E8"><enum>(A)</enum><text>the basic pay,
			 and</text>
				</subparagraph><subparagraph id="H7B99A880DAD74EEE8453E3A2C0A7A921"><enum>(B)</enum><text>any discretionary
			 monetary payments (excluding basic pay),</text>
				</subparagraph><continuation-text continuation-text-level="paragraph">payable to
			 such employee during such period; and</continuation-text></paragraph><paragraph id="H898CBE69EFF74E6791D3366497EAA4F5"><enum>(5)</enum><text>the term
			 <term>basic pay</term> means basic pay for service as an employee.</text>
			</paragraph></section><section id="H69271254EFDB49449196DE44813A5D20"><enum>3.</enum><header>Limitations</header><text display-inline="no-display-inline">Notwithstanding any other provision of law,
			 no discretionary monetary payment may be made to an employee—</text>
			<paragraph id="H9B50A528E7A644C8A3E16468319C5FA8"><enum>(1)</enum><text>during the period
			 beginning on the date of the enactment of this Act and ending as of the close
			 of fiscal year 2013; or</text>
			</paragraph><paragraph id="HD19ECBC4FD0E4BBFAB79FEF397CC9ED5"><enum>(2)</enum><text display-inline="yes-display-inline">during fiscal year 2014 or 2015, to the
			 extent that such payment would cause the total covered compensation of such
			 employee for such fiscal year to exceed 105 percent of the total amount of
			 basic pay payable to such individual (before the application of any
			 step-increase in such fiscal year under <external-xref legal-doc="usc" parsable-cite="usc/5/5336">section 5336</external-xref> of title 5, United States
			 Code) for such fiscal year.</text>
			</paragraph></section><section id="H27B7D7BF896C4B2FA30093F6144AAD36"><enum>4.</enum><header>Regulations</header><text display-inline="no-display-inline">The Office of Personnel Management may
			 prescribe regulations to carry out this Act.</text>
