		  the Department of Homeland Security, which shall be headed by the Assistant
		  Commissioner for Agriculture Inspection, and for other
		  purposes.</official-title>

		<section id="HFCCD169AB9534428AC4D4980BF4B7ECF" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Safeguarding American Commerce and
			 Agriculture Act of 2013</short-title></quote>.</text>
		</section><section id="HC72A4055FE41402EADEA539C823253E3"><enum>2.</enum><header>Establishment of
			 the office of agricultural inspection</header><text display-inline="no-display-inline">Title IV of the Homeland Security Act of
			 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/201">6 U.S.C. 201 et seq.</external-xref>) is amended by inserting after section 421 the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="HC3E056C8012A4BEB9CED7DCA14F9B3FD" style="OLC">
				<section id="H050870584EC54AABAC01AB156DE1231B"><enum>421a.</enum><header>Office of
				agricultural inspection</header>
					<subsection id="HAA57D76C55B6483EB40A7A94BE5B5160"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established within U.S. Customs
				and Border Protection an Office of Agriculture Inspection, which shall be
				headed by an Assistant Commissioner.</text>
					</subsection><subsection id="H9391A2B4BF2B4B309BE9705DA4F280F2"><enum>(b)</enum><header>Agriculture
				specialist career track</header><text display-inline="yes-display-inline">The
				Secretary—</text>
						<paragraph id="HEB19C528CBCD42CE8A1E347C897BA33C"><enum>(1)</enum><text>shall identify
				appropriate career paths for customs and border protection agriculture
				specialists, including the education, training, experience, and assignments
				necessary for career progression within U.S. Customs and Border
				Protection;</text>
						</paragraph><paragraph id="H86B058087EAE48A1A14077B62610D2B8"><enum>(2)</enum><text>shall publish
				information on the career paths identified under paragraph (1); and</text>
						</paragraph><paragraph id="H0F0857E530B2439A9BB0C5D19BC746E5"><enum>(3)</enum><text>may establish
				criteria by which appropriately qualified customs and border protection
				technicians may be promoted to customs and border protection agriculture
				specialists.</text>
						</paragraph></subsection><subsection id="H1487AA268BEF45EE9C50606DD51C10E5"><enum>(c)</enum><header>Education,
				training, and experience</header><text>The Secretary shall provide customs and
				border protection agriculture specialists the opportunity to acquire the
				education, training, and experience necessary to qualify for promotion within
				U.S. Customs and Border Protection.</text>
					</subsection><subsection id="H742CB487E9C54285818F33435A783B3E"><enum>(d)</enum><header>Agriculture
				specialist recruitment and retention</header><text display-inline="yes-display-inline">Not later than 270 days after the date of
				the enactment of this section, the Secretary shall develop a plan to more
				effectively recruit and retain qualified customs and border protection
				agriculture specialists. The plan shall include—</text>
						<paragraph id="HFD6E959AEFFE4DCDB74FDA6AC3441E78"><enum>(1)</enum><text display-inline="yes-display-inline">numerical goals for recruitment and
				retention; and</text>
						</paragraph><paragraph id="HE1117AE5540D4308AFEB560E9FC0D160"><enum>(2)</enum><text display-inline="yes-display-inline">the use of recruitment incentives, as
				appropriate and permissible under existing laws and regulations.</text>
						</paragraph></subsection><subsection id="IDc5ce62e80e944b7088c0e7a42c38daf4"><enum>(e)</enum><header>Equipment
				support</header><text display-inline="yes-display-inline">Not later than 270
				days after the date of the enactment of this section, the Secretary
				shall—</text>
						<paragraph id="IDfaae282af59b40d5b0102b4ede45c2a5"><enum>(1)</enum><text>determine the
				minimum equipment and other resources that are necessary at U.S. Customs and
				Border Protection agriculture inspection stations and facilities to enable
				customs and border protection agriculture specialists to fully and effectively
				carry out their mission;</text>
						</paragraph><paragraph id="IDdbfe2596660b487c98744887c73feca6"><enum>(2)</enum><text>complete an
				inventory of the equipment and other resources available at each U.S. Customs
				and Border Protection agriculture inspection station and facility;</text>
						</paragraph><paragraph id="IDe35c4b97f6f44e52a87d7dc2b417b7ba"><enum>(3)</enum><text>identify the
				necessary equipment and other resources that are not currently available at
				agriculture inspection stations and facilities; and</text>
						</paragraph><paragraph id="ID703f155f97d449ef99bd87b3038fe90d"><enum>(4)</enum><text>develop a plan to
				address any resource deficiencies identified under paragraph (3).</text>
						</paragraph></subsection><subsection id="H15F400AA05874FBEA98014F61031377D"><enum>(f)</enum><header>Interagency
				rotation program</header><text display-inline="yes-display-inline">The
				Secretary of Homeland Security and the Secretary of Agriculture are authorized
				to enter into an agreement that—</text>
						<paragraph id="HB7170D3CDFDF4B3FBBA20FCC9658D45D"><enum>(1)</enum><text display-inline="yes-display-inline">establishes an interagency rotation
				program; and</text>
						</paragraph><paragraph id="H827E2E36EF564890A8AA3087606ACE65"><enum>(2)</enum><text display-inline="yes-display-inline">provides for personnel of the Animal and
				Plant Health Inspection Service of the Department of Agriculture to take
				rotational assignments within U.S. Customs and Border Protection and vice versa
				for the purposes of strengthening working relationships between agencies and
				promoting interagency experience.</text>
						</paragraph></subsection><subsection id="HC613D7C624374F0BAE21731A52959123"><enum>(g)</enum><header>Report</header><text>Not
				later than 270 days after the date of the enactment of this section, the
				Secretary of Homeland Security shall submit a report to the
				<committee-name committee-id="SSGA00">Committee on Homeland Security and
				Governmental Affairs of the Senate</committee-name> and the
				<committee-name committee-id="">Committee on Homeland Security of the House of
				Representatives</committee-name> that describes—</text>
						<paragraph id="H5A89697F32034D1B8028D185BE0267CE"><enum>(1)</enum><text>the status of the
				implementation of the action plans developed by the Animal and Plant Health
				Inspection Service-U.S. Customs and Border Protection Joint Task Force on
				Improved Agriculture Inspection;</text>
						</paragraph><paragraph id="HFF26EF65E8594F10A8B2A5AE3FBEA675"><enum>(2)</enum><text>the findings of
				the Secretary under paragraphs (1), (2), and (3) of subsection (e);</text>
						</paragraph><paragraph id="HBB939F3C726944C6B09DE27C0AF82FD7"><enum>(3)</enum><text>the plan described
				in paragraph (e)(4);</text>
						</paragraph><paragraph id="H57A3289812DB4954A6E63959A0E85907"><enum>(4)</enum><text>the implementation
				of the remaining requirements under such subsection (e); and</text>
						</paragraph><paragraph id="H666788AA4AB1403899C791EBB863E7A8"><enum>(5)</enum><text>any additional
				legal authority that the Secretary determines to be necessary to effectively
				carry out the agriculture inspection mission of the Department of Homeland
				Security.</text>
						</paragraph></subsection><subsection id="H99CEA045428E4FC38FD3FD9EF89FC54E"><enum>(h)</enum><header>Administration</header><text display-inline="yes-display-inline">The Secretary shall carry out this section
				acting through the Commissioner of U.S. Customs and Border Protection in
				consultation with the Assistant Commissioner for Agricultural Inspection.</text>
