		<official-title>To amend the Healthy Forests Restoration Act of 2003 to
		  promote timely emergency rehabilitation and restoration of Federal forest land

		  salvage operations due to catastrophic events, and for other

		<section id="H74AFFAD7EC4A4790BA94B1FA95D33DD9" section-type="section-one"><enum>1.</enum><header>Emergency forest
			 rehabilitation and restoration</header><text display-inline="no-display-inline">Title VI of the Healthy Forests Restoration
			 Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6591">16 U.S.C. 6591</external-xref>) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="HE26560C1409A4C4AABA7AF364296DB51" style="OLC">
				<section id="HC0E00FFE6BC3496DA2A8A73EF4BB89FB"><enum>602.</enum><header>Emergency
				forest rehabilitation and restoration</header>
					<subsection id="H617EB547070B48B4830E30A56221A69D"><enum>(a)</enum><header>Definition</header><text>In
				this section:</text>
						<paragraph id="H1EF68CE4FDBE499CB026F2F445C89F22"><enum>(1)</enum><header>Catastrophic
				event</header>
							<subparagraph id="H8088D775242A4682A388BF29FC01A65E"><enum>(A)</enum><header>In
				general</header><text>The term <term>catastrophic event</term> means any
				natural disaster or any fire, flood, or explosion, regardless of cause, that
				the Secretary determines has caused or has the potential to cause damage of
				significant severity and magnitude to Federal land.</text>
							</subparagraph><subparagraph id="H87697C2DC1624B0ABC511C72618384CA"><enum>(B)</enum><header>Natural
				disaster</header><text>For purposes of subparagraph (A), a natural disaster, as
				determined by the Secretary, may include a hurricane, tornado, windstorm, snow
				or ice storm, rain storm, high water, wind-driven water, tidal wave,
				earthquake, volcanic eruption, landslide, mudslide, drought, or insect or
				disease outbreak.</text>
							</subparagraph></paragraph><paragraph id="HE72F5940BCE6447E94BE80D0DCF647CB"><enum>(2)</enum><header>Secretary</header><text>The
				term <term>Secretary</term> has the meaning given the term in section
				101.</text>
						</paragraph></subsection><subsection id="HCA8609B5C1C14C33B299F4D26BDD5309"><enum>(b)</enum><header>Mechanical
				forest treatment</header>
						<paragraph id="HB73D97E30354422091064EE5151467F1"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall implement such procedures as are
				necessary to ensure that not less than 600,000 acres of Federal land each
				fiscal year are treated with mechanical treatments intended to produce
				merchantable wood.</text>
						</paragraph><paragraph id="H3E5B688A0FD442A485C976F75F346694"><enum>(2)</enum><header>Funding</header><text>The
				Secretary shall use to carry out paragraph (1)—</text>
							<subparagraph id="HAE566EA0B60C403AA9D27A591F5EDA78"><enum>(A)</enum><text>funds described in
				subsection (f)(3); and</text>
							</subparagraph><subparagraph id="H6D39EC5A47704125A17779C3E9BDBE2A"><enum>(B)</enum><text>any other funds
				made available for the purposes described in paragraph (1).</text>
							</subparagraph></paragraph></subsection><subsection id="H358C6E8120EC43458E1502A2184E25DC"><enum>(c)</enum><header>Emergency
				circumstances</header>
						<paragraph id="HEA22F028B41B421CB9B633A347192922"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall—</text>
							<subparagraph id="HC10EBAE1A31243FEAEB1CA9830BEEAE8"><enum>(A)</enum><text>declare that
				emergency circumstances exist for all Federal land subject to the effects of a
				catastrophic event, including on Federal land outside urban interface areas;
				and</text>
							</subparagraph><subparagraph id="HD592FEF6F22E419C831A69EDE2A69BE3"><enum>(B)</enum><text>as soon as
				practicable, take all actions necessary for the rehabilitation or restoration
				of the Federal land, with highest priority given to Federal land impacted by
				large-scale beetle infestations.</text>
							</subparagraph></paragraph><paragraph id="HF4B0B25B711444BA9661739BA5357CC3"><enum>(2)</enum><header>Emergency
				alternative arrangements</header><text>In accordance with section 220.4 of
				title 36, Code of Federal Regulations and <external-xref legal-doc="usc" parsable-cite="usc/40/1506">section 1506.11</external-xref> of title 40, Code of
				Federal Regulations (or successor regulations), for any Federal land for which
				the Secretary declares the existence of emergency circumstances under paragraph
				(1), the Secretary may use emergency alternative arrangements to comply with
				the <act-name parsable-cite="NEPA69">National Environmental Policy Act of
				1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>).</text>
						</paragraph><paragraph id="H68F36E9D7D66472AA80F81F8B3E4A2F5"><enum>(3)</enum><header>Limitation on
				administrative appeals</header><text>Notwithstanding any other provision of
				law, no administrative appeal shall be allowed for any action classified as an
				emergency alternative arrangement under paragraph (2) or a categorical
				exclusion under the <act-name parsable-cite="NEPA69">National Environmental
				Policy Act of 1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) due to emergency
				circumstances declared under paragraph (1).</text>
						</paragraph></subsection><subsection id="HF655C93D58804CEAB18B05A9F5E9D501"><enum>(d)</enum><header>Catastrophic
				events</header>
						<paragraph id="HDF0EE3A0CEAC4DD5B4E04E8B3ADFF63A"><enum>(1)</enum><header>In
				general</header><text>As soon as practicable during but not later than 30 days
				after the conclusion of a catastrophic event, the Secretary shall initiate
				timely salvage activities on the Federal land affected by the catastrophic
				event so as to prevent significant deterioration of timber values, development
				of significant fire hazard, or other forest mortality that would prevent the
				Federal land from regenerating to forest within 5 years.</text>
						</paragraph><paragraph id="HB37E54AA777640979E90E2180A7AA7A6"><enum>(2)</enum><header>Funding</header><text>The
				Secretary shall use to carry out paragraph (1)—</text>
							<subparagraph id="HF4A28F7C089F4AE2B6AE534A920DC560"><enum>(A)</enum><text>funds described in
				subsection (f)(3); and</text>
							</subparagraph><subparagraph id="H20A387F3C41D4AFA85A9AE81C6190292"><enum>(B)</enum><text>any other funds
				made available for the purposes described in paragraph (1).</text>
							</subparagraph></paragraph></subsection><subsection id="H3F801CF14C6D44B98D679AB5D580F67D"><enum>(e)</enum><header>Exclusion of
				certain federal land</header><text>This section shall not apply to—</text>
						<paragraph id="HCA3BBC82FC8B4C5894E563B2B8232E1A"><enum>(1)</enum><text>a component of the
				National Wilderness Preservation System;</text>
						</paragraph><paragraph id="H25FD99930F134F988177271F6E93C038"><enum>(2)</enum><text>Federal land on
				which the removal of vegetation is prohibited or restricted by Act of Congress,
				Presidential proclamation, or the applicable land management plan; or</text>
						</paragraph><paragraph id="H8D17105FFD64497EAD62EA0EAB5E242C"><enum>(3)</enum><text>a wilderness study
				area.</text>
						</paragraph></subsection><subsection id="HB254040104744FF68AA5C3290403D07A"><enum>(f)</enum><header>Limitation on
				acquisition</header>
						<paragraph id="HB8CB5E3BF35341948BC62AA25F9550C7"><enum>(1)</enum><header>In
				general</header><text>Notwithstanding any other provision of law, except as
				provided in paragraph (2), beginning on the date of enactment of this section
				and during each of the subsequent 5 full fiscal years, none of the funds made
				available to the Secretary under any law may be used—</text>
							<subparagraph id="H4A0BB888F5DB4548A5AA4D500C3FF8DB"><enum>(A)</enum><text>to survey land for
				future acquisition as Federal land; or</text>
							</subparagraph><subparagraph id="HEE796F8E232D4A90AD17EEBD3FCB1313"><enum>(B)</enum><text>to enter into
				discussions with non-Federal landowners to identify land for acquisition as
				Federal land.</text>
							</subparagraph></paragraph><paragraph id="H8139D700DB2E4557B62675B9414D23A2"><enum>(2)</enum><header>Exception</header><text>Paragraph
				(1) does not apply to the use of funds—</text>
							<subparagraph id="H3967F92169874275B6DBBAB40D67CECC"><enum>(A)</enum><text>to complete land
				transactions underway on the date of enactment of this section;</text>
							</subparagraph><subparagraph id="HBFE46B9E16F64CD2B0D435103D0694B4"><enum>(B)</enum><text>to exchange
				Federal land for non-Federal land; or</text>
							</subparagraph><subparagraph id="H20A39EB76E1D402E829BA469618FA7CD"><enum>(C)</enum><text>to accept
				donations of non-Federal land as Federal land.</text>
							</subparagraph></paragraph><paragraph id="HAC18E83003E944739A27696CF484984A"><enum>(3)</enum><header>Use of
				funds</header><text>The Secretary shall use funds that would otherwise have
				been used for purchase of non-Federal land by the Forest Service to carry
				out—</text>
							<subparagraph id="H488FCCB8B2AA44B18A3D287F991F5502"><enum>(A)</enum><text>mechanical forest
				treatments described in subsection (b); and</text>
							</subparagraph><subparagraph id="HE2135F5AA41F4B9DAA2C8D10350C1BCB"><enum>(B)</enum><text>salvage activities
				described in subsection
				(d).</text>
							</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
