		<official-title>To amend title XVIII of the Social Security Act to
		  increase diagnosis of Alzheimer’s disease and related dementias, leading to
		  better care and outcomes for Americans living with Alzheimer’s disease and
		  related dementias.</official-title>

		<section id="H41ABE69A01154CA0BBAE8F53FCB8C70B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Health Outcomes, Planning, and
			 Education for Alzheimer’s Act</short-title></quote>.</text>
		</section><section id="HF8FA4B6002F64B39AED4675F5C179BE4"><enum>2.</enum><header>Findings and
			 purpose</header>
			<subsection id="H12CC43B23F8142569E41966FA665CD28"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress makes the following
			 findings:</text>
				<paragraph id="H26FA8132453344D087E41B0A90659092"><enum>(1)</enum><text display-inline="yes-display-inline">As many as half of the estimated 5.2
			 million Americans with Alzheimer’s disease have never received a
			 diagnosis.</text>
				</paragraph><paragraph id="H85283A0A8DCF4DF2B1E780AFC34C015E"><enum>(2)</enum><text>An early and
			 documented diagnosis and access to care planning services leads to better
			 outcomes for individuals with Alzheimer’s disease and other dementias and their
			 caregivers.</text>
				</paragraph><paragraph id="H656BCC0F699A4C4B8B7874B7C13C09F4"><enum>(3)</enum><text display-inline="yes-display-inline">Combining the existing Medicare benefits of
			 a diagnostic evaluation and care planning into a single package of services
			 would help ensure that individuals receive an appropriate diagnosis as well as
			 critical information about the disease and available care options, which leads
			 to better outcomes.</text>
				</paragraph><paragraph id="H9680ADD3DCB940B280322A8AF161BD89"><enum>(4)</enum><text display-inline="yes-display-inline">An accurate diagnosis allows for better
			 management of other known chronic conditions and more efficient utilization of
			 medical resources, including reducing complications and the number of costly
			 emergency room visits and hospitalizations.</text>
				</paragraph><paragraph id="H540625F509B6429FA4636DDF3CED646B"><enum>(5)</enum><text>A
			 formal diagnosis allows individuals and their caregivers to have access to
			 available medical and non-medical treatments, build a care team, participate in
			 support services, and enroll in clinical trials.</text>
				</paragraph><paragraph id="HB3308D74AA734E3EAEAECE1B08383819"><enum>(6)</enum><text display-inline="yes-display-inline">Undertaking the diagnostic process
			 potentially allows cognitive impairment to be reversed, as the cognitive
			 impairment of nine percent of individuals experiencing dementia-like symptoms
			 is due to a potentially reversible cause, such as depression or vitamin
			 deficiency.</text>
				</paragraph></subsection><subsection id="H01135297340C448B9366EE170F6058AA"><enum>(b)</enum><header>Purpose</header><text>The
			 purpose of this Act is to increase diagnosis of Alzheimer's disease and related
			 dementias, leading to better care and outcomes for Americans living with
			 Alzheimer's disease and related dementias.</text>
			</subsection></section><section display-inline="no-display-inline" id="H38FEE1FCC44046879A490DFED299056A" section-type="subsequent-section"><enum>3.</enum><header>Medicare coverage of
			 comprehensive Alzheimer’s disease diagnosis and services</header>
			<subsection id="H3A24B8220C9548828370086C1141BB0F"><enum>(a)</enum><header>In
			 general</header><text>Section 1861 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x</external-xref>)
			 is amended—</text>
				<paragraph id="H496E146AA6274FA6B11E48339192B3E5"><enum>(1)</enum><text>in subsection
			 (s)(2)—</text>
					<subparagraph id="H1A9A499122DB41F79FECAC6C84D5AC3B"><enum>(A)</enum><text>by striking
			 <quote>and</quote> at the end of subparagraph (EE);</text>
					</subparagraph><subparagraph id="H98582C581EB44E668DB49630B9272A00"><enum>(B)</enum><text>by adding
			 <quote>and</quote> at the end of subparagraph (FF); and</text>
					</subparagraph><subparagraph id="H8B4A3150BD04428182218F4C4D530090"><enum>(C)</enum><text>by adding at the
			 end the following new subparagraph:</text>
						<quoted-block display-inline="no-display-inline" id="HEFCD5E7A654C4D41923FDF50DE289E08" style="OLC">
							<subparagraph id="H955D4A5057E34834B560BDC51563028F" indent="up1"><enum>(GG)</enum><text display-inline="yes-display-inline">comprehensive Alzheimer’s disease diagnosis
				and services (as defined in subsection
				(iii));</text>
							</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H1AA4FF69034645B8938948C3A66E9245"><enum>(2)</enum><text>by adding at the
			 end the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="HF409BB43EB79493DAF6A669E920947FD" other-style="archaic" style="other">
						<subsection id="HFB35D921EA57458A995A94F2D09201DC"><enum>(iii)</enum><header>Comprehensive Alzheimer’s disease diagnosis and
		  services</header><paragraph commented="no" display-inline="yes-display-inline" id="H0396ACD5BC9841FF9096D2AFEC3838EE"><enum>(1)</enum><text>The term
				<term>comprehensive Alzheimer’s disease diagnosis and services</term> means the
				services described in paragraph (2) furnished to an individual—</text>
								<subparagraph id="HA17C66E4DE72418F9718435E54F70D25" indent="up1"><enum>(A)</enum><text>who does not already have a diagnosis
				of Alzheimer’s disease; and</text>
								</subparagraph><subparagraph id="H6AB9C1E0166C4A288849B3085037D0D6" indent="up1"><enum>(B)</enum><text>for whom a physician or a practitioner
				described in clause (i), (iv), or (v) of section 1842(b)(18)(C), in a medical
				setting such as a physician's office, a hospital, a skilled nursing facility, a
				community health center, or another similar medical setting—</text>
									<clause id="HF38A2E03FF374BF8900578284EAB2C74"><enum>(i)</enum><text>has detected the individual may
				have a cognitive impairment or dementia; and</text>
									</clause><clause id="HEA39193F5C3D4F11837624E510AE3041"><enum>(ii)</enum><text>pursuant to such detection, has
				determined a diagnostic evaluation for Alzheimer’s disease is needed.</text>
									</clause></subparagraph></paragraph><paragraph id="H7A51CBDE7B424AC893297B83401AC2FE" indent="up1"><enum>(2)</enum><text>The services described in this
				paragraph are the following:</text>
								<subparagraph id="HCD16869F93F943E3A1404FBF9D26A433"><enum>(A)</enum><text>A diagnostic evaluation, including
				referral to a specialist if recommended.</text>
								</subparagraph><subparagraph id="HB7D14D405381455F9CC00BD1E2720061"><enum>(B)</enum><text display-inline="yes-display-inline">If
				the individual is diagnosed with Alzheimer's disease under the diagnostic
				evaluation under subparagraph (A), care planning services (with the individual,
				with the personal representative of the individual, or with one or more family
				caregivers of the individual with or without the presence of the individual),
				including assistance understanding the diagnosis as well as the medical and
				non-medical options for ongoing treatment, services, and supports, and
				information about how to obtain such treatments, services, and supports. Such
				care planning services for individuals diagnosed with Alzheimer’s disease
				should take into consideration and address other co-morbid chronic
				conditions.</text>
								</subparagraph><subparagraph id="H0C8AE5E7DC28452488EC247664D5201E"><enum>(C)</enum><text>Medical record documentation, with
				respect to an individual, of the diagnostic evaluation under subparagraph (A),
				the diagnosis, and any care planning services under subparagraph (B).</text>
								</subparagraph></paragraph><paragraph id="H7C903EC9C2D245BD8E5B2F98C40A6697" indent="up1"><enum>(3)</enum><text>In this subsection—</text>
								<subparagraph id="H9FDE4D5BCCA74000AE2F119FCC40238E"><enum>(A)</enum><text>the term <term>Alzheimer's
				disease</term> means Alzheimer's disease and related dementias; and</text>
								</subparagraph><subparagraph id="H959DC59B7E6B4EB48DCA2AF26E401776"><enum>(B)</enum><text display-inline="yes-display-inline">the term <term>personal
				representative</term> means, with respect to an individual, a person legally
				authorized to make health care decisions on such individual’s
				behalf.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H568C0832CBAF477DA659BF0FCDE12D88"><enum>(b)</enum><header>Payment</header><text display-inline="yes-display-inline">Section 1833(a)(1) of the Social Security
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l(a)(1)</external-xref>) is amended by striking <quote>and</quote> before
			 <quote>(Z)</quote> and inserting before the semicolon at the end the following:
			 <quote>, and (AA) with respect to comprehensive Alzheimer’s disease diagnosis
			 and services (as defined in section 1861(iii)), the amount paid shall be an
			 amount equal to 80 percent of the amount determined under a fee schedule
			 designated by the Secretary</quote>.</text>
			</subsection><subsection id="H238E94FCEBCD4CE3BC2211DE0D4C3461"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to services
			 furnished on or after January 1 of the year following the year which includes
			 the date of the enactment of this Act.</text>
