		<legis-type>A BILL</legis-type>
		<official-title>To ensure that homeowners who have mortgages insured by
		  the FHA, or owned or guaranteed by Fannie Mae or Freddie Mac, and whose homes
		  are located in major disaster areas are notified of any forbearance relief in
		  connection with such disaster that is offered or recommended by the FHA, the
		  Federal Housing Finance Agency, the Federal National Mortgage Association, or
		  the Federal Home Loan Mortgage Corporation, and for other
		  purposes.</official-title>

		<section id="HCEC4EB950F1043A582D5D65644550BB5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Disaster-Affected Homeowners
			 Notification Act of 2013</short-title></quote>.</text>
		</section><section id="H9BCA4B1B8DBC4DF0AC948FE2C5CB5626"><enum>2.</enum><header>Requirement to
			 notify affected homeowners of mortgage relief</header>
			<subsection id="HD2FEE1B71B9A4F959BC8E6A4B9300019"><enum>(a)</enum><header>Requirement</header><text display-inline="yes-display-inline">If, in connection with any major disaster
			 declared pursuant to section 401 of the Robert T. Stafford Disaster Relief and
			 Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>), the Secretary of Housing and Urban
			 Development, the Director of the Federal Housing Finance Agency, the Federal
			 National Mortgage Association, or the Federal Home Loan Mortgage Corporation
			 makes available forbearance relief with respect to any covered mortgage, or any
			 such agency head or enterprise issues any notice or guidelines to mortgagees or
			 servicers recommending or requiring such relief, the applicable agency head
			 shall—</text>
				<paragraph id="H4EFE466E9002451AA5F9B07BBD026EBA"><enum>(1)</enum><text display-inline="yes-display-inline">provide, to each mortgagor under a covered
			 mortgage, direct notification in accordance with subsection (b) of such relief
			 made available, required, or recommended; and</text>
				</paragraph><paragraph id="H3A39FAF9FA3C419B9F2B1726A79F65D8"><enum>(2)</enum><text display-inline="yes-display-inline">provide, for areas subject to such disaster
			 declaration, community-wide notification in accordance with the guidelines
			 issued under subsection (c) of such relief made available, required, or
			 recommended.</text>
				</paragraph></subsection><subsection id="H0D5093C8B7704BC1A63863110C94D901"><enum>(b)</enum><header>Direct
			 notification</header><text>Direct notification in accordance with this
			 subsection is notification to the mortgagor under a covered mortgage—</text>
				<paragraph id="H714D26138BCE4A75B742F7017A1FB9C3"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H2447701670E34575A5FE8DBBB074973E"><enum>(A)</enum><text>made by a telephone call
			 to the mortgagor or by mail to the residence subject to the mortgage;
			 and</text>
					</subparagraph><subparagraph id="H31E53CE83C2546BAA22D67E4754DF09E" indent="up1"><enum>(B)</enum><text>by such other method of direct contact
			 as may be provided in the guidelines issued pursuant to subsection (e);
			 and</text>
					</subparagraph></paragraph><paragraph id="H1F21467A6FCB477E9C247C0D36BBC9C0"><enum>(2)</enum><text>that clearly
			 informs the mortgagor—</text>
					<subparagraph display-inline="no-display-inline" id="HFBA870EF9C754F5FB66BEECC49684978"><enum>(A)</enum><text>that the mortgage
			 is a covered mortgage;</text>
					</subparagraph><subparagraph id="H7E2AA41FFDA94AF8ACE34B657228FF47"><enum>(B)</enum><text>of the forbearance
			 relief made available, required, or recommended;</text>
					</subparagraph><subparagraph id="HA946A0B9429645B4B1E77E439C6D5D02"><enum>(C)</enum><text>of any moratorium
			 on foreclosure with respect to covered mortgages; and</text>
					</subparagraph><subparagraph id="H9A8F7D4EC21A4AF382019AE830477D4E"><enum>(D)</enum><text>of how to obtain
			 more information regarding such relief.</text>
					</subparagraph></paragraph></subsection><subsection id="HD72BDB1A075D4C76AA2E445EC7BF1910"><enum>(c)</enum><header>Community-Wide
			 notification and awareness measures</header><text display-inline="yes-display-inline">The applicable agency heads shall, pursuant
			 to subsection (e), issue guidelines regarding measures designed to provide
			 notice and awareness of any forbearance relief made available, required, or
			 recommended in connection with a major disaster throughout the areas subject to
			 such disaster declaration. Such guidelines may include requirements regarding
			 the types of notification measures, such as town hall meetings, public service
			 announcements, public advertisements and the types of media used to convey such
			 advertisements, and flyers and other community notices.</text>
			</subsection><subsection id="HD799A78E58454FD5BC0C66AD2914EDB8"><enum>(d)</enum><header>Definitions</header><text>For
			 purposes of this section, the following definitions shall apply:</text>
				<paragraph id="HE23DCD66124B4D6FB079D6B60ED762CC"><enum>(1)</enum><header>Applicable
			 agency head</header><text>The term <quote>applicable agency head</quote>
			 means—</text>
					<subparagraph id="HEBF0DE8F848A40BCABBA55F437358D14"><enum>(A)</enum><text>the Secretary,
			 with respect to a covered mortgage described in paragraph (2)(B)(i); and</text>
					</subparagraph><subparagraph id="H4AC6FC401B2E49769941D2B99F1ECA31"><enum>(B)</enum><text display-inline="yes-display-inline">the Director, with respect to a covered
			 mortgage described in paragraph (2)(B)(ii).</text>
					</subparagraph></paragraph><paragraph id="HE2973BA410324962A0094837AC766EA6"><enum>(2)</enum><header>Covered
			 mortgage</header><text display-inline="yes-display-inline">The term
			 <quote>covered mortgage</quote> means, with respect to any major disaster
			 declared pursuant to section 401 of the Robert T. Stafford Disaster Relief and
			 Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>), a mortgage—</text>
					<subparagraph id="H4B5518BDDCD340719C2AAD89DC7A1319"><enum>(A)</enum><text>that is secured by
			 a one- to four-family dwelling that—</text>
						<clause id="HB06795F80ADC4F07A2D7768EFB9E44A0"><enum>(i)</enum><text>is
			 the principal residence of the mortgagor; and</text>
						</clause><clause id="H4CE8A5876C8A46A8A642C12D9256B722"><enum>(ii)</enum><text>is
			 located within an area for which such major disaster was declared; and</text>
						</clause></subparagraph><subparagraph id="H3028ED14E2794902AE4CC320B902E069"><enum>(B)</enum><text>that is—</text>
						<clause id="HF3E28AB896DB44AEADAB25AF3C9FF4FC"><enum>(i)</enum><text>insured under
			 title II of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1707">12 U.S.C. 1707 et seq.</external-xref>); or</text>
						</clause><clause id="H999E5054D9A440E6A056AEFCFC74ED99"><enum>(ii)</enum><text display-inline="yes-display-inline">owned or guaranteed by the Federal National
			 Mortgage Association or the Federal Home Loan Mortgage Corporation.</text>
						</clause><continuation-text continuation-text-level="subparagraph">Any
			 delinquency or default under a mortgage shall not affect the status of such
			 mortgage as a covered mortgage.</continuation-text></subparagraph></paragraph><paragraph id="H7FAA2C330BC746FAA7DF90616E964530"><enum>(3)</enum><header>Director</header><text>The
			 term <quote>Director</quote> means the Director of the Federal Housing Finance
			 Agency.</text>
				</paragraph><paragraph id="H462F433EC6884DA2A8222515D7980384"><enum>(4)</enum><header>Forbearance
			 relief</header><text display-inline="yes-display-inline">The term
			 <quote>forbearance relief</quote> means, with respect to a mortgage, any
			 suspension or reduction of payments due under the mortgage, in any form and to
			 any extent.</text>
				</paragraph><paragraph id="H3D747DFCB24549858667E947B0730F66"><enum>(5)</enum><header>Mortgagee</header><text>The
			 term <quote>mortgagee</quote> means, with respect to a covered mortgage, the
			 original lender under the mortgage and any affiliates, agents, subsidiaries,
			 successors, or assignees of such lender, any subsequent purchaser, trustee, or
			 transferee of the mortgage or credit instrument issued by such lender.</text>
				</paragraph><paragraph id="H77F112D01A7146FEAF6D69CA71AA97E9"><enum>(6)</enum><header>Secretary</header><text>The
			 term <quote>Secretary</quote> means the Secretary of Housing and Urban
			 Development.</text>
				</paragraph></subsection><subsection id="HA9494AB6BB9E47258B2B387C73A385E7"><enum>(e)</enum><header>Guidelines</header><text display-inline="yes-display-inline">Not later than the expiration of the 30-day
			 period beginning on the date of the enactment of this Act, the Secretary and
			 the Director shall jointly issue guidelines to carry out this section.</text>
			</subsection><subsection id="H1FE39F62E9EF455F97D7721605D2D063"><enum>(f)</enum><header>Applicability</header><text display-inline="yes-display-inline">This Act shall apply with respect to any
			 major disaster declared pursuant to section 401 of the Robert T. Stafford
			 Disaster Relief and Emergency Assistance Act in connection with Hurricane Sandy
			 and any major disaster declared thereafter.</text>
