		<legis-type>A BILL</legis-type>
		<official-title>To amend title 10, United States Code, to provide notice
		  to members of the Armed Forces, beginning with recruit basic training and the
		  initial training of officer candidates, regarding the availability of mental
		  health services, to help eliminate perceived stigma associated with seeking and
		  receiving mental health services, and to clarify the extent to which
		  information regarding a member seeking and receiving mental health services may
		  be disclosed.</official-title>

		<section id="H82F9279F2D8C408CA07D02B7F4BFD394" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Military Mental Health Empowerment
			 Act</short-title></quote>.</text>
		</section><section id="H191507D3C7034BA7AC4CCF5B792DEBB5"><enum>2.</enum><header>Provision of
			 information to members of the Armed Forces on availability of mental health
			 services and related privacy rights</header>
			<subsection id="HB58F4F568E4F43C7BD83486B7A45E030"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Chapter 55 of title
			 10, United States Code, is amended by inserting after section 1090a the
			 following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H23CD1E3E6D8741B0ACE4B25D66D99ED5" style="USC">
					<section id="H6595050A8E1E4D5581555117D5D62D22"><enum>1090b.</enum><header>Notice to
				members of the armed forces of the availability of mental health services and
				privacy rights related to receipt of such services</header>
						<subsection id="H9C97CC09ED5D48CEA6638599FF7BD7D1"><enum>(a)</enum><header>Provision of
				information required</header><text display-inline="yes-display-inline">The
				Secretaries of the military departments shall ensure that the information
				described in subsection (b) is provided—</text>
							<paragraph id="HB1B938E7834244CB973235778FD341AF"><enum>(1)</enum><text>to each officer
				candidate during initial training;</text>
							</paragraph><paragraph id="HAB475C7A364A428FA805639F4FFCBDCF"><enum>(2)</enum><text>to each recruit
				during basic training; and</text>
							</paragraph><paragraph id="HE236B70C3E5346BF8AADD68FCC093579"><enum>(3)</enum><text>to other members
				of the armed forces at such times as the Secretary of Defense considers
				appropriate.</text>
							</paragraph></subsection><subsection id="H130E236F4A9241C98851D900C35B7838"><enum>(b)</enum><header>Required
				information</header><text>The information required to be provided under
				subsection (a) shall include at a minimum the following:</text>
							<paragraph id="HE23C0227DB72443A9F93240F97BDBA74"><enum>(1)</enum><text>Information
				regarding the availability of mental health services under this chapter.</text>
							</paragraph><paragraph id="H6DAFB2882B5446E4ACF8C349EC9A2D7C"><enum>(2)</enum><text display-inline="yes-display-inline">Information on the applicability of
				Department of Defense Directive 6025.18 and other regulations regarding privacy
				prescribed pursuant to the Health Insurance Portability and Accountability Act
				of 1996 (<external-xref legal-doc="public-law" parsable-cite="pl/104/191">Public Law 104–191</external-xref>) to records regarding a member seeking and
				receiving mental health services, including the extent to which—</text>
								<subparagraph id="H39E23EF324144340B1413B4AC256C537"><enum>(A)</enum><text display-inline="yes-display-inline">any such records can be shared with
				promotion boards, commanding officers, and other members of the armed
				forces;</text>
								</subparagraph><subparagraph id="H5D897DAA62CE454FB939A6A93AA0D58B"><enum>(B)</enum><text display-inline="yes-display-inline">any adverse actions can be taken against
				the member for seeking and receiving mental health services; and</text>
								</subparagraph><subparagraph id="HEADE6F8898114198B99B8B94753C998B"><enum>(C)</enum><text>a diagnosis of a
				mental health condition can result in negative personnel action.</text>
								</subparagraph></paragraph></subsection><subsection id="H77AE1171DF98421FB939690CF474FF0D"><enum>(c)</enum><header>Reduction of
				perceived stigma</header><text display-inline="yes-display-inline">As provided
				in section 1090a(b)(1) of this title, in providing information under subsection
				(a), the Secretary of a military department shall seek to eliminate perceived
				stigma associated with seeking and receiving mental health services and to
				promote the use of mental health services on a basis comparable to the use of
				other medical and health
				services.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H8C8C59B68EA24B0D834B5E46FB862E04"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of such chapter
			 is amended by inserting after the item relating to section 1090a the following
			 new item:</text>

						<toc-entry level="section">1090b. Notice to members of the armed
				forces of the availability of mental health services and privacy rights related
				to receipt of such

					</toc>
					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H2C4A59EBDE5D49E187C494F3DFF75AB5"><enum>(c)</enum><header>Provision of
			 information to current members</header><text display-inline="yes-display-inline">As soon as practicable after the date of
			 the enactment of this Act, the Secretary of Defense shall ensure that all
			 members of the Armed Forces, including members of the reserve components,
			 serving in the Armed Forces as of that date are provided the information
			 required to be provided to new recruits and officer candidates pursuant to
			 <external-xref legal-doc="usc" parsable-cite="usc/10/1090b">section 1090b</external-xref> of title 10, United States Code, as added by subsection
			 (a).</text>
