		<legis-type>A BILL</legis-type>
		<official-title>To amend title 38, United States Code, to deem certain
		  service in the organized military forces of the Government of the Commonwealth
		  of the Philippines and the Philippine Scouts to have been active service for
		  purposes of benefits under programs administered by the Secretary of Veterans
		  Affairs.</official-title>

		<section display-inline="no-display-inline" id="H818CA46A2859423B94F47C22604AFD3F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Filipino Veterans Fairness Act of
			 2013</short-title></quote>.</text>
		</section><section id="H83E6C6463E6B4A0CB2F53BA6D1713F47"><enum>2.</enum><header>Certain service
			 in the organized military forces of the Philippines and the Philippine Scouts
			 deemed to be active service</header>
			<subsection id="HD2360D4449084E0490A3E6BAD6B9235A"><enum>(a)</enum><header>In
			 General</header><text><external-xref legal-doc="usc" parsable-cite="usc/38/107">Section 107</external-xref> of title 38, United States Code, is
			 amended—</text>
				<paragraph id="H479E8A85A828412CA094F38C26B4C9A4"><enum>(1)</enum><text>in subsection
			 (a)—</text>
					<subparagraph id="HCE4EB0E2BFCB4100B8E88ECEAE669E75"><enum>(A)</enum><text>by striking
			 <quote>not</quote> after <quote>Army of the United States, shall</quote>;
			 and</text>
					</subparagraph><subparagraph id="H80CC91F31E50475EB4B8CB905E73804D"><enum>(B)</enum><text>by striking
			 <quote>, except benefits under—</quote> and all that follows in that subsection
			 and inserting a period;</text>
					</subparagraph></paragraph><paragraph id="H1AC4A44A0B164C228786545474EAFAAC"><enum>(2)</enum><text>in subsection
			 (b)—</text>
					<subparagraph id="H15B78D5804574301844C269A4F8EB489"><enum>(A)</enum><text>by striking
			 <quote>not</quote> after <quote>Armed Forces Voluntary Recruitment Act of 1945
			 shall</quote>; and</text>
					</subparagraph><subparagraph id="H2E51231BAF884B54B0FA6B6003BBFC11"><enum>(B)</enum><text>by striking
			 <quote>except—</quote> and all that follows in that subsection and inserting a
			 period;</text>
					</subparagraph></paragraph><paragraph id="HE83413E655F5487F9A26F4B33C2C57C4"><enum>(3)</enum><text>by amending
			 subsection (c) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H237DDD420D9B46F3A9CA634ABB2796C2" style="USC">
						<subsection id="H709421B9A8704A398A311080BB1065A0"><enum>(c)</enum><header>Determination of
				eligibility</header><paragraph commented="no" display-inline="yes-display-inline" id="H1151C6E4539B4343840E74FB768E10E0"><enum>(1)</enum><text>In determining the
				eligibility of the service of an individual under this section, the Secretary
				shall take into account any alternative documentation regarding such service,
				including documentation other than the Missouri List, that the Secretary
				determines relevant.</text>
							</paragraph><paragraph id="H4841B66BED944162B2B5EFCBFDEFD7D6" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Not later than March 1 of each year, the
				Secretary shall submit to the Committees on Veterans’ Affairs of the Senate and
				House of Representatives a report that includes—</text>
								<subparagraph id="H992B363DE34A4667B2A47EA6C9F185BE"><enum>(A)</enum><text>the number of individuals applying for
				benefits pursuant to this section during the previous year; and</text>
								</subparagraph><subparagraph id="HD17F24A390664DE3B0CDFF8C6963B147"><enum>(B)</enum><text>the number of such individuals that
				the Secretary approved for benefits.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HE27815510A5C47DB8B88784FB085122C"><enum>(4)</enum><text>by amending
			 subsection (d) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H8ED04B4D47724D7E99CB4EDE2AD94A3B" style="USC">
						<subsection id="H057B1396CF844140A59023BF0DBD334C"><enum>(d)</enum><header>Relation to
				Filipino Veterans Equity Compensation Fund</header><text display-inline="yes-display-inline">Section 1002(h) of the American Recovery
				and Reinvestment Act of 2009 (title X of division A of <external-xref legal-doc="public-law" parsable-cite="pl/111/5">Public Law 111–5</external-xref>; 123
				Stat. 200; <external-xref legal-doc="usc" parsable-cite="usc/38/107">38 U.S.C. 107</external-xref> note) shall not apply to an individual described in
				subsection (a) or (b) of this
				section.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H6190D0DF334D44AAA8A8ECD47CB1E5A0"><enum>(b)</enum><header>Conforming
			 Amendments</header><paragraph commented="no" display-inline="yes-display-inline" id="H6D8F7342BDFE4C8E9473F5B4114330D1"><enum>(1)</enum><text>The heading of such
			 section is amended to read as follows:</text>

						<section id="HB958B3044F124B1BB95ADD79DC9F0F37"><enum>107.</enum><header>Certain service
				deemed to be active service: service in organized military forces of the

						</section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H1820FC3020B44B5B92E69D86EFE24CCA" indent="up1"><enum>(2)</enum><text>The item relating to such section in
			 the table of sections at the beginning of chapter 1 of such title is amended to
			 read as follows:</text>

				</paragraph></subsection></section><section id="HBC9FA7BC0FFF45348DB242C83C5583DE"><enum>3.</enum><header>Effective
			 date</header>
			<subsection id="HC1869BAC7C08481F89E6E04959EB47CB"><enum>(a)</enum><header>In
			 general</header><text>The amendments made by this Act shall take effect on the
			 date that is 90 days after the date of the enactment of this Act.</text>
			</subsection><subsection id="H00BD808F06824399BD392999B117DBF1"><enum>(b)</enum><header>Applicability</header><text>No
			 benefits shall accrue to any person for any period before the effective date of
			 this Act by reason of the amendments made by this Act.</text>
