		<section id="H10D8A287D43249528E0D2C626BE78091" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited at the
			 <quote><short-title>Reducing Regulatory Obstacles to Wind
			 Energy Production Act</short-title></quote>.</text>
		</section><section id="H77F87580EA3C4F9FBF101F6DB782185A"><enum>2.</enum><header>Onshore
			 meteorological site testing and monitoring project</header>
			<subsection id="H2DD2827C84F34F4B85FA9607F9B99E63"><enum>(a)</enum><header>Definition of
			 meteorological site testing and monitoring project</header><text>In this
			 section, the term <term>meteorological site testing and monitoring
			 project</term> means a project carried out on land administered by the Bureau
			 of Land Management or the Forest Service to test or monitor weather (including
			 wind and solar energy) using towers or other devices, that—</text>
				<paragraph id="HCAB9D29935E846A5B3793324E8B3821E"><enum>(1)</enum><text>causes—</text>
					<subparagraph id="HFAB69E9D81404FE6A838ABEFE8D58BDA"><enum>(A)</enum><text>less than 1 acre
			 of soil or vegetation disruption at the location of each meteorological tower
			 or other device; and</text>
					</subparagraph><subparagraph id="H3B72803D60DD43D8AA0BC39C2C72F3FA"><enum>(B)</enum><text>not more than 5
			 acres of soil or disruption within the proposed right-of-way for the
			 project;</text>
					</subparagraph></paragraph><paragraph id="H13A13E5D88A0418090C9CF59C1987966"><enum>(2)</enum><text>is
			 installed—</text>
					<subparagraph id="HF5020792A4CE4E30AA1E81440F739E9D"><enum>(A)</enum><text>to the maximum
			 extent practicable, using existing access roads;</text>
					</subparagraph><subparagraph id="H2D61997FFF6B4F73AC166EDDF997FE9C"><enum>(B)</enum><text>in a manner that
			 does not require off-road motorized access other than 1 installation activity
			 and 1 decommissioning activity along an identified off-road route approved by
			 the Director of the Bureau of Land Management or Chief of the Forest
			 Service;</text>
					</subparagraph><subparagraph id="H32F465ACA95D45F496B52D9B245DE6F6"><enum>(C)</enum><text>without
			 construction of new roads other than upgrading of existing minor drainage
			 crossings for safety purposes; and</text>
					</subparagraph><subparagraph id="H5E164AE4A5D94D618375D26CC261EC34"><enum>(D)</enum><text>without the use of
			 digging or drilling equipment vehicles other than rubber-tired vehicles with
			 gross weight ratings under 8,500 pounds;</text>
					</subparagraph></paragraph><paragraph id="H7979D05D151648979436D7D52722A110"><enum>(3)</enum><text>is decommissioned
			 not more than 5 years after the date of commencement of the project,
			 including—</text>
					<subparagraph id="HE4EE0BD3C69C4D88AF4A4A38853457F8"><enum>(A)</enum><text>removal of any
			 towers, devices, or other surface infrastructure from the site; and</text>
					</subparagraph><subparagraph id="HC4F34DE911F34281BA615EB9D5EFEF53"><enum>(B)</enum><text>restoration of the
			 site to approximately the condition that existed at the time the project began;
			 and</text>
					</subparagraph></paragraph><paragraph id="H3B65C250362C4C95A317BF90420FCFFC"><enum>(4)</enum><text>provides
			 meteorological information obtained by the permitted project to the Bureau of
			 Land Management and the Forest Service.</text>
				</paragraph></subsection><subsection id="H9A606329B8894DCB929A069BA19FCF97"><enum>(b)</enum><header>NEPA
			 exclusion</header><text display-inline="yes-display-inline">Section 102(2)(C)
			 of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332(2)(C)</external-xref>) shall
			 not apply with respect to a meteorological site testing and monitoring
			 project.</text>
			</subsection><subsection id="HA353A8E842054B1D9FAE78888A5792A8"><enum>(c)</enum><header>Permit timeline
			 and conditions</header>
				<paragraph id="HC94EF183A3264B7A885095B82E41119C"><enum>(1)</enum><header>In
			 general</header><text>The Director of the Bureau of Land Management or Chief of
			 the Forest Service, as applicable, shall decide whether to issue a permit for a
			 project that is a meteorological site testing and monitoring project within 30
			 days after receiving an application for the permit.</text>
				</paragraph><paragraph id="H572E8C0688084EAA9530459CB3419676"><enum>(2)</enum><header>Public comment
			 and consultation</header><text>During the period referred to in paragraph (1),
			 the Director of the Bureau of Land Management or the Chief of the Forest
			 Service, as applicable, shall—</text>
					<subparagraph id="H3CCE4CA6390047F991EDC1856C7950D5"><enum>(A)</enum><text>provide an
			 opportunity for submission of comments by the public; and</text>
					</subparagraph><subparagraph id="H941944DACBD6412C99E900CA5FD20B75"><enum>(B)</enum><text>consult with the
			 heads of other Federal, State, and local agencies that would be affected by the
			 issuance of the permit.</text>
					</subparagraph></paragraph><paragraph id="H1A338B8B413E4BCC828C2B2037BF68E7"><enum>(3)</enum><header>Denial of
			 Application</header><text>If the application is denied, the Director or Chief,
			 respectively, shall provide the applicant—</text>
					<subparagraph id="H822C4E5741344A67A3F87023B291A326"><enum>(A)</enum><text>in writing, clear
			 and comprehensive reasons why the application was not approved and detailed
			 information concerning any deficiencies, and</text>
					</subparagraph><subparagraph id="H2228FC20E4324EA4977EC28A1FB81BBB"><enum>(B)</enum><text>an opportunity to
			 remedy any deficiencies.</text>
					</subparagraph></paragraph></subsection><subsection id="HE1838914E4164A46856AF0834D538201"><enum>(d)</enum><header>Protection of
			 information</header><text>The information provided to the Bureau of Land
			 Management and the Forest Service pursuant to subsection (a)(4) shall be
			 treated by such agency as proprietary information and protected against
			 disclosure.</text>
