			</subsection></section><section id="H28D31A9A1B714B5784A11174ABA8D0DF"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to provide
			 Federal financial assistance to the States, in the form of a single grant, to
			 allow the States maximum flexibility in providing, and financing the provision
			 of, supplemental food and nutrition assistance.</text>
		</section><section id="HC144A57CBEE2492FAEA8531DEEBD2911"><enum>3.</enum><header>Grants to
			 States</header>
			<subsection id="HD52D6DE331E14C52AA918A66AD9F2A8F"><enum>(a)</enum><header>Allotments</header><text display-inline="yes-display-inline">Subject to the requirements of this Act,
			 each State that meets the requirements of
			 <internal-xref idref="H2389616855554D599A39309289663471" legis-path="3.(d)">subsection (d)</internal-xref> is entitled to receive from
			 the Secretary of the Treasury a grant for each quarter of each of fiscal years
			 2014 through 2023 in an amount equal to 25 percent of the amount that bears the
			 same relation to the funds appropriated by
			 <internal-xref idref="H567DDF7BFA9F48F0BCF9941DF76A0E67" legis-path="3.(b)">subsection (b)</internal-xref> for a fiscal year as the
			 number of individuals who reside within the State and are members of families
			 with incomes below the poverty line for the most recent fiscal year for which
			 satisfactory data are available, bears to the total number of such individuals
			 who reside in all States for such fiscal year.</text>
			</subsection><subsection id="H567DDF7BFA9F48F0BCF9941DF76A0E67"><enum>(b)</enum><header>Appropriation</header><text display-inline="yes-display-inline">Out of any money in the Treasury of the
			 United States not otherwise appropriated, there are appropriated for each of
			 fiscal years 2014 through 2023, $37,642,040,000.</text>
			</subsection><subsection id="H2482DA4C19FE484A8154BC3917136B50"><enum>(c)</enum><header>Requirements
			 relating to intergovernmental financing</header><text>The Secretary of the
			 Treasury shall make the transfer of funds under grants under subsection (a)
			 directly to each State in accordance with the requirements of section 6503 of
			 title 31, United States Code.</text>
			</subsection><subsection id="H2389616855554D599A39309289663471"><enum>(d)</enum><header>State
			 requirements</header><text display-inline="yes-display-inline">In order to
			 receive a grant under
			 <internal-xref idref="HD52D6DE331E14C52AA918A66AD9F2A8F" legis-path="3.(a)">subsection (a)</internal-xref>, the Governor of a State
			 shall certify to the Secretary of the Treasury—</text>
				<paragraph id="HD6186DB156AF448EA73317D92AD347C2"><enum>(1)</enum><text display-inline="yes-display-inline">that the supplemental food and nutrition
			 assistance that will be provided by the State using such grant will include
			 limitations on the eligible uses of benefits that are at least as restrictive
			 as the limitations in place for the supplemental nutrition assistance program
			 established under the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>) as
			 of May 31, 2012; and</text>
				</paragraph><paragraph id="H4EF7CBC5ED8343C69C6B5EE834FEFFF0"><enum>(2)</enum><text>that the State
			 will use a portion of the grant to establish a work activation program
			 described in
			 <internal-xref idref="HFA5AFD943E8448518376D3E0EE02ABD2" legis-path="3.(e)">subsection (e)</internal-xref> for able-bodied individuals
			 receiving supplemental food and nutrition assistance;</text>
				</paragraph></subsection><subsection id="HFA5AFD943E8448518376D3E0EE02ABD2"><enum>(e)</enum><header>Work activation
			 program</header>
				<paragraph id="H02BDCFDEDBED4E9BA8C29558F9FBEA41"><enum>(1)</enum><header>Program
			 requirements</header><text>The work activation program established by a State
			 under
			 <internal-xref idref="H4EF7CBC5ED8343C69C6B5EE834FEFFF0" legis-path="3.(d)(2)">subsection (d)(2)</internal-xref> shall met the following
			 requirements:</text>
					<subparagraph commented="no" id="H41369E0B22B5490797760235EB4F2E43"><enum>(A)</enum><text display-inline="yes-display-inline">The average number of able-bodied
			 individuals receiving supplemental food and nutrition assistance that shall
			 participate in the program in the State for each month of a fiscal year shall
			 be based on the State’s relative proportion of able-bodied individuals
			 receiving supplemental food and nutrition assistance for the most recent month
			 of the most recent fiscal year for which satisfactory data is available,
			 compared to the total number of such individuals in all States for such month,
			 except that, each month, not less than a total of 1,500,000 individuals shall
			 participate in 1 or more such work activation programs.</text>
					</subparagraph><subparagraph id="H6562B25949D5439EAA2E9B848A425957"><enum>(B)</enum><text>Each able-bodied
			 individual participating in the work activation program—</text>
						<clause id="H02414CEA42A44D38B6946F3DE15282F6"><enum>(i)</enum><text>shall at the time
			 of application for supplemental food and nutrition assistance and every 12
			 months thereafter, register for employment in a manner prescribed by the
			 Governor of the State;</text>
						</clause><clause commented="no" id="H8BC23E67B4FF40FFB92101EBBB65C5A7"><enum>(ii)</enum><text display-inline="yes-display-inline">shall, each month of participation in the
			 program, participate in—</text>
							<subclause id="H993F99D5B66C4448B054D2FC0F768A96"><enum>(I)</enum><text>2
			 days of supervised job search for 8 hours per day at the program site;
			 and</text>
							</subclause><subclause id="HB80C4FAE3A7D4414B1EF6DD2F31B0388"><enum>(II)</enum><text>5 days of
			 off-site activity for 8 hours per day;</text>
							</subclause></clause><clause id="H26938741383F4D06A195EB10B781A423"><enum>(iii)</enum><text>shall not refuse
			 without good cause to accept an offer of employment, at a site or plant not
			 subject to a strike or lockout at the time of the refusal, at a wage not less
			 than the higher of—</text>
							<subclause id="HB75715F901F1413CA26173DEDC43BC73"><enum>(I)</enum><text>the applicable
			 Federal or State minimum wage; or</text>
							</subclause><subclause id="HE8BC1C9095474DCAA90166E4AB13DA86"><enum>(II)</enum><text>80 percent of the
			 wage that would have governed had the minimum hourly rate under section 6(a)(1)
			 of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/206">29 U.S.C. 206(a)(1)</external-xref>) been applicable
			 to the offer of employment;</text>
							</subclause></clause><clause id="H6051892A954944C88B8C45A9D4CEC588"><enum>(iv)</enum><text>shall not refuse
			 without good cause to provide a State agency with sufficient information to
			 allow the State agency to determine the employment status or the job
			 availability of the individual; and</text>
						</clause><clause id="HFE7A0FE919E149D3A9D1494FF78A39D6"><enum>(v)</enum><text>shall not
			 voluntarily—</text>
							<subclause id="HB3AE176A774841448FFEC4B4F1116CE8"><enum>(I)</enum><text>quit a job;
			 or</text>
							</subclause><subclause id="H4C71FAF02F3745C89661209F5D06B5CF"><enum>(II)</enum><text>reduce work
			 effort and, after the reduction, the individual is working less than 30 hours
			 per week, unless another adult in the same family unit increases employment at
			 the same time by an amount equal to the reduction in work effort by the first
			 adult.</text>
							</subclause></clause></subparagraph><subparagraph id="H86D9373FAAFD4D81BDB66723E271F0CB"><enum>(C)</enum><text>An able-bodied
			 individual participating in the work activation program who fails to comply
			 with 1 or more of the requirements described in subparagraph (B)—</text>
						<clause id="H17C01CDA7189464091C72C2651717096"><enum>(i)</enum><text>shall be subject
			 to a sanction period of not less than a 2-month period beginning the day of the
			 individual’s first failure to comply with such requirements during which the
			 individual shall not receive any supplemental food and nutrition assistance;
			 and</text>
						</clause><clause id="H16A96FA1B9264BD297D376C6233F80AD"><enum>(ii)</enum><text>may
			 receive supplemental food and nutrition assistance after the individual is in
			 compliance with such requirements for not less than a 1-month period beginning
			 after the completion of such sanction period, except that such assistance may
			 not be provided retroactively.</text>
						</clause></subparagraph></paragraph><paragraph id="HB8D4F7A5708343A098DA7DF27D67179B"><enum>(2)</enum><header>Penalties for
			 States</header><text display-inline="yes-display-inline">A State that does not
			 meet the participation requirements under
			 <internal-xref idref="H41369E0B22B5490797760235EB4F2E43" legis-path="3.(e)(1)(A)">paragraph (1)(A)</internal-xref> for the preceding
			 fiscal year, as determined by calculating the average monthly participation for
			 such year, shall be subject to a reduction of grant funds for the first full
			 quarter after the Secretary of the Treasury determines that the State failed to
			 meet such participation requirements in an amount equal to the greater
			 of—</text>
					<subparagraph id="HFD211208D23B476E92248C2D8D2E8394"><enum>(A)</enum><text>10 percent of the
			 grant funds the State would have otherwise received for such quarter; or</text>
					</subparagraph><subparagraph id="HCB32BC2D4B1C4F44A3422DFA6A80E7B3"><enum>(B)</enum><text>a percentage of
			 funds that equals the percentage by which the State failed to meet such
			 participation requirements.</text>
					</subparagraph></paragraph></subsection><subsection id="H978F3806CED84C708440B040A9A71C01"><enum>(f)</enum><header>Expenditure of
			 funds</header>
				<paragraph id="H577957DBB7E240009F1D55804C37A925"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in
			 <internal-xref idref="H9FDE4D7610BF4EB99D77E5AE9DF80FA9" legis-path="3.(f)(2)">paragraph (2)</internal-xref>, amounts received by a
			 State under
			 <internal-xref idref="HD52D6DE331E14C52AA918A66AD9F2A8F" legis-path="3.(a)">subsection (a)</internal-xref> for any fiscal year shall be
			 expended by the State in such fiscal year or in the succeeding fiscal
			 year.</text>
				</paragraph><paragraph id="H9FDE4D7610BF4EB99D77E5AE9DF80FA9"><enum>(2)</enum><header>Use of rainy day
			 fund permitted</header><text>Of the amounts received by a State under
			 <internal-xref idref="HD52D6DE331E14C52AA918A66AD9F2A8F" legis-path="3.(a)">subsection (a)</internal-xref>, the State may set aside, in
			 a separate account, such amounts as the State deems necessary to provide,
			 without fiscal limitation, supplemental food and nutrition assistance and
			 services for indigent individuals during—</text>
					<subparagraph id="H7196892E405443489A261C3128756682"><enum>(A)</enum><text>periods of
			 unexpectedly high rates of unemployment; or</text>
					</subparagraph><subparagraph id="HA66879D76C2C425297CD410040EFA609"><enum>(B)</enum><text>periods related to
			 circumstances that are not described in
			 <internal-xref idref="H7196892E405443489A261C3128756682" legis-path="3.(f)(2)(A)">subparagraph (A)</internal-xref> and that cause
			 unexpected increases in the need for such assistance and services for such
			 individuals.</text>
					</subparagraph></paragraph><paragraph id="HEE3B48467B2D45EFBB1A7E70091A31A9"><enum>(3)</enum><header>Funds remaining
			 after fiscal year 2023</header><text>If, after 2023, a State has funds in the
			 account under paragraph (2), the State may only expend such funds if such funds
			 are used in a manner that is permitted under
			 <internal-xref idref="H0A98863A57874CEAB3A19E28E698D1A2" legis-path="3.(g)">subsection (g)</internal-xref>, as such subsection is in
			 effect on September 30, 2023.</text>
				</paragraph></subsection><subsection id="H0A98863A57874CEAB3A19E28E698D1A2"><enum>(g)</enum><header>Use of
			 funds</header><text>A State may only use the amounts received under subsection
			 (a) as follows:</text>
				<paragraph id="HB58DBD39DCFF4057B33515E823346C7C"><enum>(1)</enum><header>General
			 purpose</header><text>For the purpose under
			 <internal-xref idref="H28D31A9A1B714B5784A11174ABA8D0DF" legis-path="2.">section 2</internal-xref>, except that nothing in this Act
			 shall be construed as limiting the flexibility of a State to determine which
			 providers of such assistance and services qualify to receive payment from a
			 grant made to the State under
			 <internal-xref idref="HD52D6DE331E14C52AA918A66AD9F2A8F" legis-path="3.(a)">subsection (a)</internal-xref>.</text>
				</paragraph><paragraph commented="no" id="H2E3B86500A844BE6926AE57AEC633592"><enum>(2)</enum><header>Authority to use
			 portion of federal assistance for other welfare-related programs</header>
					<subparagraph commented="no" id="H50C1C2A72B514521B59645B1FBE97DE9"><enum>(A)</enum><header>In
			 general</header><text>Subject to the limit under
			 <internal-xref idref="H03812DA3001D4B5D8E3340B5D1BE331B" legis-path="3.(e)(2)(B)">subparagraph (B)</internal-xref>, to carry out a State
			 program pursuant to any or all of the following provisions of law:</text>
						<clause commented="no" id="H84214519D8904A2B804F7972459A93FF"><enum>(i)</enum><text display-inline="yes-display-inline">Part A of title IV of the Social Security
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601 et seq.</external-xref>).</text>
						</clause><clause commented="no" id="H81A35093A9964D99AFB7C0A24EB13161"><enum>(ii)</enum><text>Section 1616 of
			 such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1382e">42 U.S.C. 1382e</external-xref>).</text>
						</clause></subparagraph><subparagraph commented="no" id="H03812DA3001D4B5D8E3340B5D1BE331B"><enum>(B)</enum><header>Limitation</header><text>A
			 State may not use more than 30 percent of the amount received under
			 <internal-xref idref="HFA0818037F2544D2AA929DFD850262A6" legis-path="3.(a)">subsection (a)</internal-xref> for a fiscal year to carry
			 out a State program, or programs, under
			 <internal-xref idref="H50C1C2A72B514521B59645B1FBE97DE9" legis-path="3.(e)(2)(A)">subparagraph (A)</internal-xref>.</text>
					</subparagraph><subparagraph commented="no" id="H858B8E22BB964C959F1C9D97C71D9E6B"><enum>(C)</enum><header>Requirements on
			 funds</header><text>Any amounts that are used under subparagraph (A)—</text>
						<clause commented="no" id="H57314BDA9C7444338EFD1A83EF2B6277"><enum>(i)</enum><text>shall not be
			 subject to any of the requirements of
			 <internal-xref idref="H978F3806CED84C708440B040A9A71C01" legis-path="3.(f)">subsection (f)</internal-xref> or
			 <internal-xref idref="HF9B6622D8D0446729541C9851637538C" legis-path="5.">section 5</internal-xref>; and</text>
						</clause><clause commented="no" id="H6B00BA926C2E4118A765DBA8CE933F35"><enum>(ii)</enum><text>shall be subject
			 to—</text>
							<subclause commented="no" id="HF8E5EBE61B6F43568107D4979354D510"><enum>(I)</enum><text>the audit
			 requirements under
			 <internal-xref idref="HE814E3155A1E46E1A0C5B78072841C0D" legis-path="4.">section 4</internal-xref>; and</text>
							</subclause><subclause commented="no" id="HB6B4FA81BCD3490BA8AA10474C48B046"><enum>(II)</enum><text>any requirements
			 that apply to Federal funds provided directly for such State program.</text>
							</subclause></clause></subparagraph></paragraph></subsection><subsection id="HD4F2EBF0EB634A67A93CD47E710AF8E8"><enum>(h)</enum><header>No funding for
			 illegal aliens</header><text>Except as provided under this Act, no funds
			 appropriated in this Act may be used to provide supplemental food and nutrition
			 assistance to an alien who is not lawfully admitted for permanent residence or
			 otherwise permanently residing in the United States under color of law.</text>
			</subsection><subsection id="H6AEDE8D25CE3421F941F85BCB01C6410"><enum>(i)</enum><header>Nonentitlement</header><text>Nothing
			 in this Act shall be construed as providing an individual with an entitlement
			 to supplemental food and nutrition assistance under this Act.</text>
			</subsection></section><section id="HE814E3155A1E46E1A0C5B78072841C0D"><enum>4.</enum><header>Administrative
			 and fiscal accountability</header>
			<subsection id="HAB79634C5D3147EC8DF1D6888EC6104B"><enum>(a)</enum><header>Audits</header>
				<paragraph id="H39A61D30CB2D40BAB7A592C7771964D6"><enum>(1)</enum><header>Contract with
			 approved auditing entity</header><text>Not later than October 1, 2014, and
			 annually thereafter, a State shall contract with an approved auditing entity
			 (as defined under
			 <internal-xref idref="H97CEAF02B420473AB9CC5D31FD2E5050" legis-path="4.(a)(3)(B)">paragraph (3)(B)</internal-xref>) for purposes of
			 conducting an audit under
			 <internal-xref idref="HEBC9DAAF23AC4C368394E77BE7C879E4" legis-path="4.(a)(2)">paragraph (2)</internal-xref> (with respect to the fiscal
			 year ending September 30 of such year).</text>
				</paragraph><paragraph id="HEBC9DAAF23AC4C368394E77BE7C879E4"><enum>(2)</enum><header>Audit
			 requirement</header><text>Under a contract under
			 <internal-xref idref="H39A61D30CB2D40BAB7A592C7771964D6" legis-path="4.(a)(1)">paragraph (1)</internal-xref>, an approved auditing
			 entity shall conduct an audit of the expenditures or transfers made by a State
			 from amounts received under a grant under this
			 <internal-xref idref="HFA0818037F2544D2AA929DFD850262A6" legis-path="3.(a)">section 3(a)</internal-xref> with respect to the fiscal year
			 which such audit covers, to determine the extent to which such expenditures and
			 transfers were expended in accordance with this Act.</text>
				</paragraph><paragraph id="H50ABC480BA25482BAC78D62621DCA0CA"><enum>(3)</enum><header>Entity
			 conducting audit</header>
					<subparagraph id="H05BD0B872A564D4ABFC7F4DC19C07CB9"><enum>(A)</enum><header>In
			 general</header><text>With respect to a State, the audit under
			 <internal-xref idref="HEBC9DAAF23AC4C368394E77BE7C879E4" legis-path="4.(a)(2)">paragraph (2)</internal-xref> shall be conducted by an
			 approved auditing entity in accordance with generally accepted auditing
			 principles.</text>
					</subparagraph><subparagraph id="H97CEAF02B420473AB9CC5D31FD2E5050"><enum>(B)</enum><header>Approved
			 auditing entity</header><text>For purposes of this section, the term
			 <term>approved auditing entity</term> means, with respect to a State, an entity
			 that is—</text>
						<clause id="HCECCE1629E3D495EA0DD95F8464F61C2"><enum>(i)</enum><text>approved by the
			 Secretary of the Treasury;</text>
						</clause><clause id="HEC71BCAA086B45AF925927B6B2897A05"><enum>(ii)</enum><text>approved by the
			 chief executive officer of the State; and</text>
						</clause><clause id="H2D400322BD4744A385A68BA2B476739B"><enum>(iii)</enum><text>independent of
			 any Federal, State, or local agency.</text>
						</clause></subparagraph></paragraph><paragraph id="H801A768D1ABF448A8A8FBBB22839F32E"><enum>(4)</enum><header>Submission of
			 audit</header><text>Not later than December 31, 2014, and annually thereafter,
			 a State shall submit the results of the audit under
			 <internal-xref idref="HEBC9DAAF23AC4C368394E77BE7C879E4" legis-path="4.(a)(2)">paragraph (2)</internal-xref> (with respect to the fiscal
			 year ending on September 30 of such year) to the State legislature and to the
			 Secretary of the Treasury.</text>
				</paragraph><paragraph id="H3542CE748D264E2B8E20DB4B65E516E8"><enum>(5)</enum><header>Additional
			 accounting requirements</header><text>The provisions of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/75">chapter 75</external-xref> of title 31,
			 United States Code, shall apply to the audit requirements of this
			 section.</text>
				</paragraph></subsection><subsection id="HEDE8398420A64A4086915F5023CF5317"><enum>(b)</enum><header>Reimbursement
			 and penalty</header><text display-inline="yes-display-inline">If, through an
			 audit conducted under
			 <internal-xref idref="HAB79634C5D3147EC8DF1D6888EC6104B" legis-path="4.(a)">subsection (a)</internal-xref>, an approved auditing entity
			 finds that any amounts paid to a State under a grant under
			 <internal-xref idref="HFA0818037F2544D2AA929DFD850262A6" legis-path="3.(a)">section 3(a)</internal-xref> were not expended in accordance
			 with this Act, the State shall pay to the Treasury of the United States any
			 such amount, plus 10 percent of such amount as a penalty.</text>
			</subsection><subsection id="H5A8CBBC5985B45CFAACDE88A6FCC2900"><enum>(c)</enum><header>Annual reporting
			 requirements</header>
				<paragraph id="H55CAB00FDE914F40845503FA0D344D3E"><enum>(1)</enum><header>In
			 general</header><text>Not later than January 31, 2015, and annually thereafter,
			 each State shall submit to the Secretary of the Treasury and the State
			 legislature a report on the activities carried out by the State during the most
			 recently completed fiscal year with funds received by the State under a grant
			 under section 3(a) for such fiscal year.</text>
				</paragraph><paragraph id="H3A5B32D55FC345A4B75039EE4979BCD2"><enum>(2)</enum><header>Content</header><text>A
			 report under
			 <internal-xref idref="H55CAB00FDE914F40845503FA0D344D3E" legis-path="4.(c)(1)">paragraph (1)</internal-xref> shall, with respect to a
			 fiscal year—</text>
					<subparagraph id="H629598C43D5E4872B7D2298F4D28C093"><enum>(A)</enum><text>contain the
			 results of the audit conducted by an approved auditing entity for a State for
			 such fiscal year, in accordance with the requirements of
			 <internal-xref idref="HAB79634C5D3147EC8DF1D6888EC6104B" legis-path="4.(a)">subsection (a)</internal-xref> of this section;</text>
					</subparagraph><subparagraph id="HE9C956C4466646A6901D9CDA5093E378"><enum>(B)</enum><text>specify the amount
			 of the grant made to the State under
			 <internal-xref idref="HFA0818037F2544D2AA929DFD850262A6" legis-path="3.(a)">section 3(a)</internal-xref> that is used to carry out a
			 program under
			 <internal-xref idref="H2E3B86500A844BE6926AE57AEC633592" legis-path="3.(e)(2)">section 3(f)(2)</internal-xref>;</text>
					</subparagraph><subparagraph id="H3CB438B0BECE4283A916017FEBBFCBED"><enum>(C)</enum><text>specify the number
			 of participants in the work activation program described in
			 <internal-xref idref="HFA5AFD943E8448518376D3E0EE02ABD2" legis-path="3.(e)">section 3(e)</internal-xref> in the State;</text>
					</subparagraph><subparagraph id="H5660AB8906D646CCB590A3940C4E797F"><enum>(D)</enum><text>specify the number
			 of participants in such program that found work through the program, including
			 the number of such participants who were hired as part-time employees and the
			 number of such participants who were hired as full-time employees; and</text>
					</subparagraph><subparagraph id="HECCB08C4411B4A6EAF5DA1FFA7A6C932"><enum>(E)</enum><text>be in such form
			 and contain such other information as the State determines is necessary to
			 provide—</text>
						<clause id="HF86C48BA33374A68851BE32B3BACB571"><enum>(i)</enum><text>an
			 accurate description of the activities conducted by the State for the purpose
			 described under
			 <internal-xref idref="H28D31A9A1B714B5784A11174ABA8D0DF" legis-path="2.">section 2</internal-xref> and any other use of funds permitted
			 under subsections (f) and (g) of
			 <internal-xref idref="HC144A57CBEE2492FAEA8531DEEBD2911" legis-path="3.">section 3</internal-xref>; and</text>
						</clause><clause id="HB4A1EBA42B40433F8BB3F31554CD5FFA"><enum>(ii)</enum><text>a
			 complete record of the purposes for which amounts were expended in accordance
			 with this Act.</text>
						</clause></subparagraph></paragraph><paragraph id="H19D75A5B6400472085623A4F7415B22D"><enum>(3)</enum><header>Conformity with
			 accounting principles</header><text>Any financial information in the report
			 under
			 <internal-xref idref="H55CAB00FDE914F40845503FA0D344D3E" legis-path="4.(c)(1)">paragraph (1)</internal-xref> shall be prepared and
			 reported in accordance with generally accepted accounting principles, including
			 the provisions of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/75">chapter 75</external-xref> of title 31, United States Code.</text>
				</paragraph><paragraph id="HFD5C75855D734A1E858F848C6170BA3A"><enum>(4)</enum><header>Public
			 availability</header><text>A State shall make copies of the reports required
			 under this section available on a public Web site and shall make copies
			 available in other formats upon request.</text>
				</paragraph></subsection><subsection id="H56E3748776ED4236BFB4673A65A665CE"><enum>(d)</enum><header>Failure To
			 comply with requirements</header><text>The Secretary of the Treasury shall not
			 make any payment to a State under a grant authorized by
			 <internal-xref idref="HFA0818037F2544D2AA929DFD850262A6" legis-path="3.(a)">section 3(a)</internal-xref>—</text>
				<paragraph id="H2F3F762F48524746BC704BA0BF64A2A5"><enum>(1)</enum><text>if an audit for a
			 State is not submitted as required under
			 <internal-xref idref="HAB79634C5D3147EC8DF1D6888EC6104B" legis-path="4.(a)">subsection (a)</internal-xref>, during the period between
			 the date such audit is due and the date on which such audit is submitted;
			 or</text>
				</paragraph><paragraph id="H6D6CADCCCA614FE89DF114928CCC926E"><enum>(2)</enum><text>if a State fails
			 to submit a report as required under
			 <internal-xref idref="H5A8CBBC5985B45CFAACDE88A6FCC2900" legis-path="4.(c)">subsection (c)</internal-xref>, during the period between
			 the date such report is due and the date on which such report is
			 submitted.</text>
				</paragraph></subsection><subsection id="H5A553E64D8FC4FFD9F3CFD4DD805AF52"><enum>(e)</enum><header>Administrative
			 supervision and oversight</header>
				<paragraph id="HF1113691977C48D7A84069F1B5F34297"><enum>(1)</enum><header>Limited role for
			 secretary of treasury and the attorney general</header>
					<subparagraph id="H3D4D26F56557452F8422DD7EB3CAA398"><enum>(A)</enum><header>Treasury</header><text>The
			 authority of the Secretary of the Treasury under this Act is limited to—</text>
						<clause id="HC96CA8D27B5C4840AD15A325F74BA9F2"><enum>(i)</enum><text>promulgating
			 regulations, issuing rules, or publishing guidance documents to the extent
			 necessary for purposes of implementing
			 <internal-xref idref="H97CEAF02B420473AB9CC5D31FD2E5050" legis-path="4.(a)(3)(B)">subsections (a)(3)(B)</internal-xref>,
			 <internal-xref idref="HEDE8398420A64A4086915F5023CF5317" legis-path="4.(b)">(b)</internal-xref>, and
			 <internal-xref idref="H56E3748776ED4236BFB4673A65A665CE" legis-path="4.(d)">(d)</internal-xref>;</text>
						</clause><clause id="HAB563CBA20C34D5989FEF25A852EE66F"><enum>(ii)</enum><text>making quarterly
			 payments to the States under grants under this Act in accordance with
			 <internal-xref idref="HFA0818037F2544D2AA929DFD850262A6" legis-path="3.(a)">section 3(a)</internal-xref>;</text>
						</clause><clause id="H15BCFD0CFB2D47DBB4C49604DF98E89B"><enum>(iii)</enum><text>approving
			 entities under
			 <internal-xref idref="H97CEAF02B420473AB9CC5D31FD2E5050" legis-path="4.(a)(3)(B)">subsection (a)(3)(B)</internal-xref> for purposes of
			 the audits required under
			 <internal-xref idref="HAB79634C5D3147EC8DF1D6888EC6104B" legis-path="4.(a)">subsection (a)</internal-xref>;</text>
						</clause><clause id="H556A1CA706D84039ABF77C7CAF4AE205"><enum>(iv)</enum><text>withholding
			 payment to a State of a grant under
			 <internal-xref idref="H56E3748776ED4236BFB4673A65A665CE" legis-path="4.(d)">subsection (d)</internal-xref>; and</text>
						</clause><clause id="HE931C5D16BDE4BD09C25CC39005E0BD0"><enum>(v)</enum><text>exercising the
			 authority relating to nondiscrimination that is specified in
			 <internal-xref idref="H8CF88AD9189C4DACBEA1B2ED9D39DED7" legis-path="5.(b)">section 5(b)</internal-xref>.</text>
						</clause></subparagraph><subparagraph id="H8DBC1065DC4F40E0BD2C617493525A85"><enum>(B)</enum><header>Attorney
			 general</header><text>The authority of the Attorney General to supervise the
			 amounts received by a State under
			 <internal-xref idref="HFA0818037F2544D2AA929DFD850262A6" legis-path="3.(a)">section 3(a)</internal-xref> is limited to the authority
			 under
			 <internal-xref idref="HD99670D8EE4445CFB025BDB15B836FE1" legis-path="5.(c)">section 5(c)</internal-xref>.</text>
					</subparagraph></paragraph><paragraph id="H6F5C9BF4EEC54FD8AAE203D96FEA929B"><enum>(2)</enum><header>Federal
			 supervision</header>
					<subparagraph id="H36A997085BE2486799D5398B2F6F14B9"><enum>(A)</enum><header>In
			 general</header><text>Except as provided under
			 <internal-xref idref="HF1113691977C48D7A84069F1B5F34297" legis-path="4.(e)(1)">paragraph (1)</internal-xref>, an administrative officer,
			 employee, department, or agency of the United States (including the Secretaries
			 of Agriculture and Health and Human Services) may not—</text>
						<clause id="H8E87921D20F44F42B394B4DF596BEC69"><enum>(i)</enum><text>supervise—</text>
							<subclause id="H7F4C506480814A389A50C4CBB4F9FD31"><enum>(I)</enum><text>the amounts
			 received by the States under
			 <internal-xref idref="HFA0818037F2544D2AA929DFD850262A6" legis-path="3.(a)">section 3(a)</internal-xref>; or</text>
							</subclause><subclause id="HAA8406FB63804D8AA21F8B7B42F50FB8"><enum>(II)</enum><text>the use of such
			 amounts by the States; or</text>
							</subclause></clause><clause id="HBEDD37137F4E4B3B8B45B574FF8CECBC"><enum>(ii)</enum><text>promulgate
			 regulations or issue rules in accordance with this Act.</text>
						</clause></subparagraph><subparagraph id="HE0032EF8A1F74FC4AFE67CB76938D9F5"><enum>(B)</enum><header>Limitation on
			 secretaries of agriculture and Health and Human Services</header><text>The
			 Secretaries of Agriculture and Health and Human Services shall have no
			 authority over any provision of this Act.</text>
					</subparagraph></paragraph></subsection><subsection id="H47914284CB104A8195247C3502B8AF3F"><enum>(f)</enum><header>Reservation of
			 state powers</header><text>Nothing in this section shall be construed to limit
			 the power of a State, including the power of a State to pursue civil and
			 criminal penalties under State law against any individual or entity that
			 misuses, or engages in fraud or abuse related to the funds provided to a State
			 under this Act.</text>
			</subsection></section><section id="HF9B6622D8D0446729541C9851637538C"><enum>5.</enum><header>Nondiscrimination
			 provisions</header>
			<subsection id="HEA878091102147DFBAA6BF9F7DDFB4D2"><enum>(a)</enum><header>Nondiscrimination
			 against individuals</header><text>No individual shall be excluded from
			 participation in, denied the benefits of, or subjected to discrimination under,
			 any program or activity funded in whole or in part with amounts paid to a State
			 under this
			 <internal-xref idref="HFA0818037F2544D2AA929DFD850262A6" legis-path="3.(a)">section 3(a)</internal-xref> on the basis of such
			 individual’s—</text>
				<paragraph id="H0E47A0233AAD4831974677D82F4C17CA"><enum>(1)</enum><text>disability under
			 section 504 of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/794">29 U.S.C. 794</external-xref>);</text>
				</paragraph><paragraph id="HE1289CDE3AE14EEB94C34A03F6AA5666"><enum>(2)</enum><text>sex under title IX
			 of the Education Amendments of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/20/1681">20 U.S.C. 1681 et seq.</external-xref>); or</text>
				</paragraph><paragraph id="H41622A8FE5794E44970A1E3DA9C4B4F2"><enum>(3)</enum><text>race, color, or
			 national origin under title VI of the Civil Rights Act of 1964 (42 U.S.C. 2000d
			 et seq.).</text>
				</paragraph></subsection><subsection id="H8CF88AD9189C4DACBEA1B2ED9D39DED7"><enum>(b)</enum><header>Compliance</header>
				<paragraph id="HEEF725C83EE84CA993D3E28DADA7A813"><enum>(1)</enum><header>In
			 general</header><text>If the Secretary of the Treasury determines that a State
			 or an entity that has received funds from amounts paid to a State under a grant
			 under section 3(a) has failed to comply with a provision of law referred to in
			 subsection (a), the Secretary of the Treasury shall notify the chief executive
			 officer of the State of such failure to comply and shall request that such
			 chief executive officer secure such compliance.</text>
				</paragraph><paragraph id="HB2F9353AA22143489779F24007CF6A89"><enum>(2)</enum><header>Refusal to
			 secure compliance</header><text>If, not later than 60 days after receiving
			 notification under
			 <internal-xref idref="HEEF725C83EE84CA993D3E28DADA7A813" legis-path="5.(b)(1)">paragraph (1)</internal-xref>, the chief executive
			 officer of a State fails or refuses to secure compliance with the provision of
			 law referred to in such notification, the Secretary of the Treasury may—</text>
					<subparagraph id="H68CE50FD96DC451887B6CD28103D9581"><enum>(A)</enum><text>refer the matter
			 to the Attorney General with a recommendation that an appropriate civil action
			 be instituted; or</text>
					</subparagraph><subparagraph id="H89A0586938D243D68DE3DA0ED9CBE6CF"><enum>(B)</enum><text>exercise the
			 powers and functions provided under section 505 of the Rehabilitation Act of
			 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/794a">29 U.S.C. 794a</external-xref>), title IX of the Education Amendments of 1972 (20 U.S.C.
			 1681 et seq.), or title VI of the Civil Rights Act of 1964 (42 U.S.C. 2000d et
			 seq.) (as applicable).</text>
					</subparagraph></paragraph></subsection><subsection id="HD99670D8EE4445CFB025BDB15B836FE1"><enum>(c)</enum><header>Civil
			 actions</header><text>If a matter is referred to the Attorney General under
			 subsection (b)(2)(A), or the Attorney General has reason to believe that a
			 State or entity has failed to comply with a provision of law referred to in
			 subsection (a), the Attorney General may bring a civil action in an appropriate
			 district court of the United States for such relief as may be appropriate,
			 including injunctive relief.</text>
			</subsection></section><section id="HE2206FEBA78640908E68D6FBFFC6770E"><enum>6.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this Act:</text>
			<paragraph id="HA7EDBD3867B54281B95CCB20CFA6E8A5"><enum>(1)</enum><header>Able-bodied
			 individual</header><text display-inline="yes-display-inline">The term
			 <term>able-bodied individual</term> means an individual who—</text>
				<subparagraph id="H1BD697850E484E5EB44E71B0627707F5"><enum>(A)</enum><text>is more than 18,
			 and less than 63, years of age;</text>
				</subparagraph><subparagraph id="HCC64AB00E44B4290B1F468368704A6B6"><enum>(B)</enum><text>is not physically
			 or mentally incapable of work;</text>
				</subparagraph><subparagraph id="HC4C24930B7BF40BE9ACD7345838722D1"><enum>(C)</enum><text>is not the
			 full-time caretaker of a disabled adult dependent; and</text>
				</subparagraph><subparagraph id="HB176EA4265374C0BAE87C5D5DE57E430"><enum>(D)</enum><text>does not have a
			 dependent child.</text>
				</subparagraph></paragraph><paragraph id="H783FF04C17AD43E1AD3B3D368D70C8A9"><enum>(2)</enum><header>Physically or
			 Mentally Incapable of Work</header><text display-inline="yes-display-inline">The term <term>physically or mentally
			 incapable of work</term> shall mean an individual—</text>
				<subparagraph id="HCD7CC4D63A5F498BB7EEE3FA4360E2ED"><enum>(A)</enum><text>who currently
			 receives benefits from the Supplemental Security Income program or another
			 program that provides recurring benefits to individuals because the individual
			 is disabled and unable to work; or</text>
				</subparagraph><subparagraph id="H5FF8D4DFBF9C434B8B88B43388802DEE"><enum>(B)</enum><text>who has been
			 medically certified as physically or mentally incapable of work and who has a
			 credible pending application for enrollment in the Supplemental Security Income
			 program or another program that provides recurring benefits to individuals
			 because the individual is disabled and unable to work.</text>
				</subparagraph></paragraph><paragraph commented="no" id="HDEBBEF4394FA4D48B35B053B18AEDD67"><enum>(3)</enum><header>Poverty
			 line</header><text display-inline="yes-display-inline">The term <term>poverty
			 line</term> means the poverty line (as defined by the Office of Management and
			 Budget and revised annually in accordance with section 673(2) of the Community
			 Services Block Grant Act) applicable to a family of the size involved.</text>
			</paragraph><paragraph id="H164D35D598304341B6CA943E1F57827B"><enum>(4)</enum><header>Supervised Job
			 Search</header><text display-inline="yes-display-inline">The term
			 <term>supervised job search</term> means a job search program which has the
			 following characteristics:</text>
				<subparagraph id="H45B5FA63A8164E37A4189FD1BBDEABE3"><enum>(A)</enum><text>The job search
			 occurs at an official location where the recipient's presence and activity can
			 be directly observed, supervised, and monitored.</text>
				</subparagraph><subparagraph id="H4332905B04EA42A29C66B56F64CF1D36"><enum>(B)</enum><text>The recipient's
			 entry, time on site, and exit from the official job search location are
			 recorded in a manner which prevents fraud.</text>
				</subparagraph><subparagraph id="HD86A404BC4D9416B99F44A3B2A3E79E9"><enum>(C)</enum><text>The recipient is
			 expected to remain and undertake job search activities at the job search center
			 except for brief, authorized departures for specified off-site
			 interviews.</text>
				</subparagraph><subparagraph id="H5CE6BF0581BA43388152BB7AEAF710F1"><enum>(D)</enum><text>The amount of time
			 the recipient is observed and monitored engaging in job search at the official
			 location is recorded.</text>
				</subparagraph></paragraph><paragraph id="H63723DD369574952A59CFCC1BD8E1812"><enum>(5)</enum><header>Supplemental
			 food and nutrition assistance</header><text display-inline="yes-display-inline">The term <term>supplemental food and
			 nutrition assistance</term> shall be defined by a State with respect to use of
			 such term for purposes of the application of this Act to the State.</text>
			</paragraph><paragraph commented="no" id="H3B55337449134CF4A1F05073F4DF13A2"><enum>(6)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> has the meaning
			 given the term in section 3 of the Food and Nutrition Act of 2008 (7 U.S.C.
			 2012) as of May 31, 2012.</text>
			</paragraph><paragraph id="HFE8CC5D79BEC40E0BF8E2A4296E65B6D"><enum>(7)</enum><header>Work
			 activation</header><text display-inline="yes-display-inline">The term
			 <term>work activation</term> means—</text>
				<subparagraph id="H868D8BD41CC24FEA84D638158D39A440"><enum>(A)</enum><text>supervised job
			 search;</text>
				</subparagraph><subparagraph id="HF4740A6FD7DB42B6904A75FCE5EBB6DA"><enum>(B)</enum><text>community service
			 activities;</text>
				</subparagraph><subparagraph id="H78F12FD9678E4BA2A2FDB63C55A9E8F3"><enum>(C)</enum><text>education and job
			 training for individuals who are family heads or married spouses of family
			 heads; or</text>
				</subparagraph><subparagraph id="HC7AA1B6A0B174AFD859554664B452AC3"><enum>(D)</enum><text>drug or alcohol
			 treatment.</text>
				</subparagraph></paragraph></section><section id="H3417E54DD0B24425B5D491D37D6ECBCF"><enum>7.</enum><header>Repeals</header><text display-inline="no-display-inline">The following provisions are
			 repealed:</text>
			<paragraph id="HDA21978A64914812840C2B77435BBA74"><enum>(1)</enum><text>The Emergency Food
			 Assistance Act of 1983 (<external-xref legal-doc="usc" parsable-cite="usc/7/7501">7 U.S.C. 7501 et seq.</external-xref>).</text>
			</paragraph><paragraph id="H29BBA4E8EB4D40C186625988612FDC5F"><enum>(2)</enum><text>Section 5 of the
			 Agriculture and Consumer Protection Act of 1973, (commonly known as the
			 commodity supplemental food program) (<external-xref legal-doc="usc" parsable-cite="usc/7/612c">7 U.S.C. 612c</external-xref> note).</text>
			</paragraph><paragraph id="H99BF843EAC114A5199011FB758F29A46"><enum>(3)</enum><text>Section 4402 of
			 <external-xref legal-doc="public-law" parsable-cite="pl/107/171">Public Law 107–171</external-xref> (relating to the seniors farmers’ market nutrition program)
			 (<external-xref legal-doc="usc" parsable-cite="usc/7/3007">7 U.S.C. 3007</external-xref>).</text>
			</paragraph><paragraph id="H67C12DC5BFCF4F1A8CD7FBA400A6826C"><enum>(4)</enum><text>The Food and
			 Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>).</text>
			</paragraph><paragraph id="H499B63B4D3114FD4A6C25390C2F9F2C5"><enum>(5)</enum><text>Section 19 of the
			 Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1769a">42 U.S.C. 1769a</external-xref>).</text>
			</paragraph></section><section id="HA8614BB6D62543F7A29BF1BA7B3B2CC6"><enum>8.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act, or the
			 application of such provision to any person or circumstance, is found to be
			 unconstitutional, the remainder of this Act, or the application of that
			 provision to other persons or circumstances, shall not be affected.</text>
		</section><section id="H858E1ED22B0747FEB8CDD74DFEDCF143"><enum>9.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">This Act and the
			 amendments made by this Act shall take effect with respect to items and
			 services furnished on or after October 1, 2013.</text>
