		<section id="HFFF9CB4C210C48339CF3D64E69819AC7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Financial Competitive Act of
			 2013</short-title></quote>.</text>
		</section><section id="HBA16FFD4D60446A2819D214C4A0C0212" section-type="subsequent-section"><enum>2.</enum><header>Study of
			 implementation of basel iii capital requirements related to derivatives
			 exposures</header>
			<subsection id="H9A50AEA7F38E49EBB1F74036B53E55CD"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Financial Stability Oversight Council
			 shall conduct a study of the likely effects that differences between the United
			 States and other jurisdictions in implementing the derivatives credit valuation
			 adjustment (in this section referred to as <quote>CVA</quote>) capital
			 requirement would have on—</text>
				<paragraph id="HE326D28F8D594F5CB9922A0604FF046B"><enum>(1)</enum><text>United States
			 financial institutions that conduct derivatives transactions and participate in
			 derivatives markets;</text>
				</paragraph><paragraph id="H71071F2533AB4F1C84AD6399EAE8EE10"><enum>(2)</enum><text>end users of
			 derivatives; and</text>
				</paragraph><paragraph id="H08562D886AE34C53A2B5738A5280A6D8"><enum>(3)</enum><text>international
			 derivatives markets.</text>
				</paragraph></subsection><subsection id="H88DEC5C5AF8A474784EA384191AC275F"><enum>(b)</enum><header>Content</header><text display-inline="yes-display-inline">The study required by subsection (a) shall
			 include—</text>
				<paragraph id="H07B76BD872B5484AA1E0D84E1582EC5E"><enum>(1)</enum><text>an assessment
			 of—</text>
					<subparagraph id="H7E669382F70D4BA3AA1557B8DE27BDB4"><enum>(A)</enum><text>the extent to
			 which there are differences in the approaches that the United States and other
			 jurisdictions are taking regarding implementation of the CVA capital
			 requirement, and the nature of the differences;</text>
					</subparagraph><subparagraph id="HFEB6FA138DBC40BA9E40B31ECC3D97AC"><enum>(B)</enum><text>the impact that
			 the differences would have on—</text>
						<clause id="H26ADB1F3763C4D2CA6EC2AB83A9DEE49"><enum>(i)</enum><text>United States
			 financial institutions that conduct derivatives transactions and participate in
			 derivatives markets, including their ability to serve end users of
			 derivatives;</text>
						</clause><clause id="H40AED8CDBBAC4BBF9F69BAB4E253AC5B"><enum>(ii)</enum><text>pricing and other
			 costs of, and services available to, end users of derivatives in the United
			 States and other jurisdictions; and</text>
						</clause><clause id="H3163526C097A4CBD8BAAD1C126908B41"><enum>(iii)</enum><text>the
			 competitiveness of United States financial institutions and United States
			 derivatives markets, including the extent to which differences in the CVA
			 capital requirement could shift derivatives business among jurisdictions;
			 and</text>
						</clause></subparagraph><subparagraph id="HB2DCCB79EEBF466D88AC41DEC9CC6142"><enum>(C)</enum><text>the interaction
			 between differing CVA capital requirements and margin rules; and</text>
					</subparagraph></paragraph><paragraph id="H4390370A81D545B683B127B8D2655E44"><enum>(2)</enum><text>recommendations
			 regarding steps that the Congress and the Federal financial regulatory agencies
			 that comprise the Financial Stability Oversight Council should take to—</text>
					<subparagraph id="H42591F8783DD4DA9962B06DAD03EADEE"><enum>(A)</enum><text>minimize any
			 expected negative effects on United States financial institutions, derivatives
			 markets, and end users<deleted-phrase committee-id="HBA00" reported-display-style="strikethrough">; and</deleted-phrase><added-phrase committee-id="HBA00" reported-display-style="italic">;</added-phrase></text>
					</subparagraph><subparagraph id="HE50E2C357A424D60B81015574C73FFE2"><enum>(B)</enum><text>encourage greater
			 international consistency in implementation of internationally agreed capital,
			 liquidity, and other prudential standards<deleted-phrase committee-id="HBA00" reported-display-style="strikethrough">.</deleted-phrase><added-phrase committee-id="HBA00" reported-display-style="italic">;
			 and</added-phrase></text>
					</subparagraph><subparagraph changed="added" committee-id="HBA00" id="H9E0348B996EA4295AA26218E5F5CC404" reported-display-style="italic"><enum>(C)</enum><text display-inline="yes-display-inline">ensure that the Financial Stability
			 Oversight Council fulfills its statutory mandate to identify risks and respond
			 to emerging threats to financial stability.</text>
					</subparagraph></paragraph></subsection><subsection id="H8BE1C336EAC84B9280FE76226844214B"><enum>(c)</enum><header>Report</header><text>No
			 later than 90 days after the date of the enactment of this Act, the Financial
			 Stability Oversight Council shall submit a written report containing the
			 results of the study to the Chairman and ranking minority member of the
			 Committees on Agriculture and Financial Services of the House of
			 Representatives, and the Chairman and ranking minority member of the Committees
			 on Agriculture, Nutrition, and Forestry, and Banking, Housing, and Urban
			 Affairs of the Senate.</text>
