		<section id="H9E575CE8D1E44B0EB757641343004B07" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>American Jobs Matter Act of
			 2013</short-title></quote>.</text>
		</section><section id="HDED94E70011B40E78DEB972D33CA3A7E" section-type="subsequent-section"><enum>2.</enum><header>Consideration and
			 verification of information relating to effect on domestic employment of award
			 of Federal contracts</header>
			<subsection id="H44511E8B74094CC38B5FC605673B0211"><enum>(a)</enum><header>Civilian agency
			 contracts</header><text display-inline="yes-display-inline">Section 3306 of
			 title 41, United States Code, is amended by adding at the end the following new
			 subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H41033D8A27924311A3779BAC47954627" style="OLC">
					<subsection id="H49586811C906428EBC92997B8562F378"><enum>(g)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H3C5CB5FAF1BD4B64AC9D8B830574C09E"><enum>(1)</enum><text>An executive agency, in
				issuing a solicitation for competitive proposals, shall state in the
				solicitation that the agency may consider information (in this subsection
				referred to as a <term>jobs impact statement</term>) that the offeror may
				include in its offer related to the effects on employment within the United
				States of the contract if it is awarded to the offeror.</text>
						</paragraph><paragraph id="H4BF92217EBEA4938AE69BC0CACA700ED" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The information that may be included in a
				jobs impact statement may include the following:</text>
							<subparagraph id="H53FB1DFB87704388BED0A83F908DDEEC"><enum>(A)</enum><text>The number of jobs expected to be
				created in the United States, or the number of jobs retained that otherwise
				would be lost, if the contract is awarded to the offeror.</text>
							</subparagraph><subparagraph id="H6FF99503340B455DB03AA782CFA46450"><enum>(B)</enum><text>The number of jobs created or retained
				in the United States by the subcontractors expected to be used by the offeror
				in the performance of the contract.</text>
							</subparagraph><subparagraph id="HBD6CD68E196C49C4BFFAF89875A694F8"><enum>(C)</enum><text>A guarantee from the offeror that jobs
				created or retained in the United States will not be moved outside the United
				States after award of the contract.</text>
							</subparagraph></paragraph><paragraph id="H2EAB4EA2ED814F6BBB1557E94C401B3F" indent="up1"><enum>(3)</enum><text>The contracting officer may consider
				the information in the jobs impact statement in the evaluation of the offer and
				may request further information from the offeror in order to verify the
				accuracy of any such information submitted.</text>
						</paragraph><paragraph display-inline="no-display-inline" id="H80B8985110D94EF28316447074FC7288" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">In the case of a contract awarded to an
				offeror that submitted a jobs impact statement with the offer for the contract,
				the executive agency shall, not later than six months after the award of the
				contract and annually thereafter for the duration of the contract or contract
				extension, assess the accuracy of the jobs impact statement.</text>
						</paragraph><paragraph id="H55EB1C0C31764F30A9676420A24D0D8E" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">The head of each executive agency shall
				submit to Congress an annual report on the frequency of use within the agency
				of jobs impact statements in the evaluation of competitive proposals.</text>
						</paragraph><paragraph id="H11539FB9F3BE4A4280581D6334C1C42C" indent="up1"><enum>(6)</enum><text display-inline="yes-display-inline">In any contract awarded to an offeror that
				submitted a jobs impact statement with its offer in response to the
				solicitation for proposals for the contract, the executive agency shall track
				the number of jobs created or retained during the performance of the contract.
				If the number of jobs that the agency estimates will be created (by using the
				jobs impact statement) significantly exceeds the number of jobs created or
				retained, then the agency may evaluate whether the contractor should be
				proposed for
				debarment.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H8418C40076264F52BD8F72C18FD39BAC"><enum>(b)</enum><header>Defense
			 contracts</header><text><external-xref legal-doc="usc" parsable-cite="usc/10/2305">Section 2305(a)</external-xref> of title 10, United States Code, is
			 amended by adding at the end the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H82C1C3DBB1FE40BC814C5FD36F988481" style="USC">
					<paragraph display-inline="no-display-inline" id="HFD9B3877E50D44E2837CB79B448441FE" indent="up1"><enum>(6)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HE983ABAEF9AA4304B9E0323989ED7229"><enum>(A)</enum><text>The head of an agency,
				in issuing a solicitation for competitive proposals, shall state in the
				solicitation that the agency may consider information (in this paragraph
				referred to as a <term>jobs impact statement</term>) that the offeror may
				include in its offer related to the effects on employment within the United
				States of the contract if it is awarded to the offeror.</text>
						</subparagraph><subparagraph id="H55FB0688C50247558D0E3E7E6D183561" indent="up1"><enum>(B)</enum><text>The information that may be included
				in a jobs impact statement may include the following:</text>
							<clause id="H3F1AC0EC384242C0BE32B6310CC7D25E"><enum>(i)</enum><text>The number of jobs expected to be
				created in the United States, or the number of jobs retained that otherwise
				would be lost, if the contract is awarded to the offeror.</text>
							</clause><clause id="H3713E8E6112543D69A73B515669F6C26"><enum>(ii)</enum><text>The number of jobs created or
				retained in the United States by the subcontractors expected to be used by the
				offeror in the performance of the contract.</text>
							</clause><clause id="H0DEE77269FD2481C865C7F880485E7E2"><enum>(iii)</enum><text display-inline="yes-display-inline">A guarantee from the offeror that jobs
				created or retained in the United States will not be moved outside the United
				States after award of the contract.</text>
							</clause></subparagraph><subparagraph id="H23158E4CE7434A3891FD2090FB488A69" indent="up1"><enum>(C)</enum><text>The contracting officer may consider
				the information in the jobs impact statement in the evaluation of the offer and
				may request further information from the offeror in order to verify the
				accuracy of any such information submitted.</text>
						</subparagraph><subparagraph display-inline="no-display-inline" id="H1DDD950A71224117BD6BB664C672FC0B" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">In the case of a contract awarded to an
				offeror that submitted a jobs impact statement with the offer for the contract,
				the agency shall, not later than six months after the award of the contract and
				annually thereafter for the duration of the contract or contract extension,
				assess the accuracy of the jobs impact statement.</text>
						</subparagraph><subparagraph id="HF44FEC122AAD48DA875D221627FAF8A2" indent="up1"><enum>(E)</enum><text display-inline="yes-display-inline">The Secretary of Defense shall submit to
				Congress an annual report on the frequency of use within the Department of
				Defense of jobs impact statements in the evaluation of competitive
				proposals.</text>
						</subparagraph><subparagraph id="H45FA4963F3CF47BEBD3B661A2A5F7E63" indent="up1"><enum>(F)</enum><text display-inline="yes-display-inline">In any contract awarded to an offeror that
				submitted a jobs impact statement with its offer in response to the
				solicitation for proposals for the contract, the agency shall track the number
				of jobs created or retained during the performance of the contract. If the
				number of jobs that the agency estimates will be created (by using the jobs
				impact statement) significantly exceeds the number of jobs created or retained,
				then the agency may evaluate whether the contractor should be proposed for
				debarment.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HE370847DCCD14861AB333E7D84EE4089"><enum>(c)</enum><header>Revision of
			 Federal Acquisition Regulation</header><text display-inline="yes-display-inline">The Federal Acquisition Regulation shall be
			 revised to implement the amendments made by this section.</text>
