		<official-title>To prohibit certain grants under the Child Abuse
		  Prevention and Treatment Act to States that do not provide for certain minimal
		  terms of imprisonment for certain child abusers, and for other
		  purposes.</official-title>

		<section id="H923F13B5EABB436C9297BC49391D7A12" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Kilah Davenport Child Protection Act
			 of 2013</short-title></quote>.</text>
		</section><section id="H5FCED3CD0D364C21B458EC44BA195F17"><enum>2.</enum><header>In
			 general</header><text display-inline="no-display-inline">The Secretary of
			 Health and Human Services may not make a grant under section 106 or under title
			 II of the Child Abuse Prevention and Treatment Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5101">42 U.S.C. 5101 et seq.</external-xref>) to
			 a State until the date on which that State’s laws provide for a criminal
			 punishment including a term of imprisonment of not less than 3,800 days for any
			 individual who—</text>
			<paragraph id="HCACEF44328924F91852BC66790D627C0"><enum>(1)</enum><text>is a parent or any
			 other individual providing care to or supervision of a child of less than 16
			 years of age; and</text>
			</paragraph><paragraph id="HD038EA8ACC734A5597BEA6764D1AA0AF"><enum>(2)</enum><text>intentionally—</text>
				<subparagraph id="H7C96D5ECEB064F42B91646F25E45AB5C"><enum>(A)</enum><text display-inline="yes-display-inline">inflicts any serious bodily injury (as such
			 term is defined in <external-xref legal-doc="usc" parsable-cite="usc/18/1365">section 1365(h)(3)</external-xref> of title 18, United States Code) on that
			 child; or</text>
				</subparagraph><subparagraph id="HB6736DB8BD6741539F6F4FBEEC221179"><enum>(B)</enum><text>commits an assault
			 upon that child which results in—</text>
					<clause id="H820FFC8E6A6D42FB9A21A69723A44D99"><enum>(i)</enum><text display-inline="yes-display-inline">any serious bodily injury (as such term is
			 defined in <external-xref legal-doc="usc" parsable-cite="usc/18/1365">section 1365(h)(3)</external-xref> of title 18, United States Code) to the child;
			 or</text>
					</clause><clause id="H5825A7280078428BA0F09655DC892C48"><enum>(ii)</enum><text>permanent or
			 protracted loss or impairment of any mental or emotional function of the
			 child.</text>
					</clause></subparagraph></paragraph></section><section id="HDF57F3DF9DBC4ABB96DD037A100E2E18" section-type="subsequent-section"><enum>3.</enum><header>Expansion of predicate
			 for increased penalties for certain domestic assaults</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/117">Section 117(a)(1)</external-xref> of title 18, United States
			 Code, is amended by inserting <quote>, or against the child of or in the care
			 of the person committing the domestic assault</quote> after <quote>intimate
			 partner</quote>.</text>
		</section><section id="HAA171B0FA3EB4C4BBC32B2D62C0641C9"><enum>4.</enum><header>Effective
			 date</header>
			<subsection id="HD27EAFE71ED24426924FDC088C9329E2"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The provisions of
			 this Act, except as otherwise provided in subsection (b), shall take effect
			 beginning on the date of enactment of this Act.</text>
			</subsection><subsection id="HA58B1D4A7ADB4154ADA4672E5EAF67E3"><enum>(b)</enum><header>Exception</header><text display-inline="yes-display-inline">Section 2 of this Act shall take effect
			 beginning on the date that is 2 years after the date of enactment of this
			 Act.</text>
