		<official-title>To allow Americans to earn paid sick time so that they
		  can address their own health needs and the health needs of their
		  families.</official-title>

		<section commented="no" display-inline="no-display-inline" id="HA80618FFF76348599E6291C7483EECE6" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Healthy Families
			 Act</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="H9E81803505FC4819BFA393598E86589E" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="no-display-inline">Congress makes the following
			 findings:</text>
			<paragraph commented="no" display-inline="no-display-inline" id="H7F4D113E7E2D4347B066AC45A684A4CA"><enum>(1)</enum><text display-inline="yes-display-inline">Working Americans need time to meet their
			 own health care needs and to care for family members, including their children,
			 spouse, domestic partner, parents (including parents-in-law), and other
			 children and adults for whom they are caregivers.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1C208FE5A6CB41A4B237E76FF1658E63"><enum>(2)</enum><text display-inline="yes-display-inline">Health care needs include preventive health
			 care, diagnostic procedures, medical treatment, and recovery in response to
			 short- and long-term illnesses and injuries.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE59481D700594421ACFED1669F8F9248"><enum>(3)</enum><text display-inline="yes-display-inline">Providing employees time off to meet health
			 care needs ensures that they will be healthier in the long run. Preventive care
			 helps avoid illnesses and injuries and routine medical care helps detect
			 illnesses early and shorten their duration. A 2012 study published by BioMed
			 Central Public Health of results of the National Health Interview Survey found
			 that lack of paid sick leave is a barrier to receiving cancer screenings and
			 preventive care. Workers with paid sick leave were more likely to have a
			 mammogram, Pap test, or endoscopy, and were more likely to have visited a
			 doctor in the previous year, than workers without paid sick leave, even when
			 the results were adjusted for sociodemographic factors.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD97C122CD464456F9A37F9F4AD4BDBCE"><enum>(4)</enum><text display-inline="yes-display-inline">When parents are available to care for
			 their children who become sick, children recover faster, more serious illnesses
			 are prevented, and children’s overall mental and physical health improve. In a
			 2009 study published in the American Journal of Public Health, 81 percent of
			 parents of a child with special health care needs reported that taking leave
			 from work to be with their child had a <quote>good</quote> or <quote>very
			 good</quote> effect on their child’s physical health. Similarly, 85 percent of
			 parents of such a child found that taking such leave had a <quote>good</quote>
			 or <quote>very good</quote> effect on their child’s emotional health.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H11216222369D4CF9A474753F14A86D1C"><enum>(5)</enum><text display-inline="yes-display-inline">When parents cannot afford to miss work and
			 must send children with contagious illnesses to child care centers or schools,
			 infection can spread rapidly through child care centers and schools.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H255E43DFAA0F4F73BA786407DDE291CF"><enum>(6)</enum><text display-inline="yes-display-inline">Providing paid sick time improves public
			 health by reducing infectious disease. Policies that make it easier for sick
			 adults and children to be isolated at home reduce the spread of infectious
			 disease. A 2012 study published in the American Journal of Public Health found
			 that a lack of workplace policies like paid sick days contributed to an
			 additional 5,000,000 cases of influenza-like illness during the H1N1 pandemic
			 of 2009.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAA76A08892AD4479BD01240D083E11EA"><enum>(7)</enum><text display-inline="yes-display-inline">Routine medical care reduces medical costs
			 by detecting and treating illness and injury early, decreasing the need for
			 emergency care. These savings benefit public and private payers of health
			 insurance, including private businesses. A 2011 study by the Institute for
			 Women’s Policy Research found that a universal paid sick days policy would
			 reduce preventable visits to the emergency room and result in cost savings of
			 $1,100,000,000 per year, including $500,000,000 in savings for public health
			 insurance like Medicaid.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H779D49BEB59A4E88BCDEA575DAC72D28"><enum>(8)</enum><text display-inline="yes-display-inline">The provision of individual and family sick
			 time by large and small businesses, both here in the United States and
			 elsewhere, demonstrates that policy solutions are both feasible and affordable
			 in a competitive economy. A 2009 study by the Center for Economic and Policy
			 Research found that, of 22 countries with comparable economies, the United
			 States was 1 of only 3 countries that did not provide any paid time off for
			 workers with short-term illnesses.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H964FB6D082E640B699166393439F3B32"><enum>(9)</enum><text display-inline="yes-display-inline">Measures that ensure that employees are in
			 good health and do not need to worry about unmet family health problems help
			 businesses by promoting productivity and reducing employee turnover.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE7C959FB570943EBA0F9158735E4A6C5"><enum>(10)</enum><text display-inline="yes-display-inline">The American Productivity Audit completed
			 in 2003 found that lost productivity due to illness costs $226,000,000,000
			 annually, and that 71 percent of that cost stems from presenteeism, the
			 practice of employees coming to work despite illness. Studies in the Journal of
			 Occupational and Environmental Medicine, the Employee Benefit News, and the
			 Harvard Business Review show that presenteeism is a larger productivity drain
			 than either absenteeism or short-term disability.</text>
			</paragraph><paragraph id="H9BCC3B36EE914068AA19E4AE828E7AE1"><enum>(11)</enum><text>Working while
			 sick also increases a worker's probability of suffering an injury on the job. A
			 2012 study published by the American Journal of Public Health found that
			 workers with access to paid sick leave were 28 percent less likely than workers
			 without paid sick leave to suffer nonfatal occupational injuries.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1ACAC270782A45018A0BB43DDA354ED5"><enum>(12)</enum><text display-inline="yes-display-inline">The absence of paid sick time has forced
			 Americans to make untenable choices between needed income and jobs on the one
			 hand and caring for their own and their family’s health on the other.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1E507EB81A87413AB414F88C89914651"><enum>(13)</enum><text display-inline="yes-display-inline">Nearly 40 percent of the private sector
			 workforce, and 25 percent of the public sector workforce, lacks paid sick time.
			 Another 4,000,000 theoretically have access to sick time, but have not been on
			 the job long enough to use it. Millions more lack sick time they can use to
			 care for a sick child or ill family member.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2EE15753A9824D5A9288E4B19117A093"><enum>(14)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H8040529D3145490590BCF1DA0FC56279"><enum>(A)</enum><text display-inline="yes-display-inline">Workers’ access to paid sick time varies
			 dramatically by wage level.</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB149A8FFCF824C4F9E3122C8038BB992" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">For private sector workers—</text>
					<clause commented="no" display-inline="no-display-inline" id="H51D9AA9290C2404C834CE2EB5AD4268F"><enum>(i)</enum><text display-inline="yes-display-inline">for workers in the lowest quartile of
			 earners, 71 percent lack paid sick time;</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="H5A9934865B74427CB96630E51F1083A3"><enum>(ii)</enum><text display-inline="yes-display-inline">for workers in the next 2 quartiles, 36 and
			 25 percent, respectively, lack paid sick time; and</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="H5285292A188E400996A5C0BEA7B2FDD3"><enum>(iii)</enum><text display-inline="yes-display-inline">even for workers in the highest quartile,
			 16 percent lack paid sick time.</text>
					</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA73014E6E3C347C18A5053190542530D" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">For public sector workers—</text>
					<clause commented="no" display-inline="no-display-inline" id="HD4E82B6ECCB34A598EB2FB0DC8926061"><enum>(i)</enum><text display-inline="yes-display-inline">for workers in the lowest quartile of
			 earners, 25 percent lack paid sick time;</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="H5A9ECCE7910D438395CE45A6838373BF"><enum>(ii)</enum><text display-inline="yes-display-inline">for workers in the next 2 quartiles, 7
			 percent lack paid sick time; and</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="HBAAD05629D314043A9051E01E92D51AF"><enum>(iii)</enum><text display-inline="yes-display-inline">for workers in the highest quartile, 2
			 percent lack paid sick time.</text>
					</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA57F58E8BCCF4FD6A2BD30815CE6BA98" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">In addition, millions of workers cannot use
			 paid sick time to care for ill family members.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3B7051F59C464FCCBD9363117B284682"><enum>(15)</enum><text display-inline="yes-display-inline">Due to the roles of men and women in
			 society, the primary responsibility for family caregiving often falls on women,
			 and such responsibility affects the working lives of women more than it affects
			 the working lives of men.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H78B8BCFC55434EC9A8CB553065C0A992"><enum>(16)</enum><text display-inline="yes-display-inline">An increasing number of men are also taking
			 on caregiving obligations, and men who request paid time for caregiving
			 purposes are often denied accommodation or penalized because of stereotypes
			 that caregiving is only <term>women’s work</term>.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8CF6A8FDC0874201B8756F6B8899885C"><enum>(17)</enum><text display-inline="yes-display-inline">Employers’ reliance on persistent
			 stereotypes about the <term>proper</term> roles of both men and women in the
			 workplace and in the home continues a cycle of discrimination and fosters
			 stereotypical views about women's commitment to work and their value as
			 employees.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3A57E202CD764083BFF59B40630DD0F4"><enum>(18)</enum><text display-inline="yes-display-inline">Employment standards that apply to only one
			 gender have serious potential for encouraging employers to discriminate against
			 employees and applicants for employment who are of that gender.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H96760CFFA0C54414A585C66139069A6A"><enum>(19)</enum><text display-inline="yes-display-inline">It is in the national interest to ensure
			 that all Americans can care for their own health and the health of their
			 families while prospering at work.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE4C3921D02A2487191E8AF94636A4285"><enum>(20)</enum><text display-inline="yes-display-inline">Nearly 1 in 3 American women report
			 physical or sexual abuse by a husband or boyfriend at some point in their
			 lives. Domestic violence also affects men. Women account for about 85 percent
			 of the victims of domestic violence and men account for approximately 15
			 percent of the victims. Therefore, women disproportionately need time off to
			 care for their health or to find solutions, such as obtaining a restraining
			 order or finding housing, to avoid or prevent physical or sexual abuse.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7CF49FDE2D7D466EBB3E79227707FEC6"><enum>(21)</enum><text display-inline="yes-display-inline">One study showed that 85 percent of
			 domestic violence victims at a women’s shelter who were employed missed work
			 because of abuse. The mean number of days of paid work lost by a rape victim is
			 8.1 days, by a victim of physical assault is 7.2 days, and by a victim of
			 stalking is 10.1 days. Nationwide, domestic violence victims lose almost
			 8,000,000 days of paid work per year.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H187698925BB645678E5D72E3720DA817"><enum>(22)</enum><text display-inline="yes-display-inline">Without paid sick days that can be used to
			 address the effects of domestic violence, these victims are in grave danger of
			 losing their jobs. One survey found that 96 percent of employed domestic
			 violence victims experienced problems at work related to the violence. The
			 Government Accountability Office similarly found that 24 to 52 percent of
			 victims report losing a job due, at least in part, to domestic violence. The
			 loss of employment can be particularly devastating for victims of domestic
			 violence, who often need economic security to ensure safety.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC4AEC5AF77214D8E90EB76E18C0F6C16"><enum>(23)</enum><text display-inline="yes-display-inline">The Centers for Disease Control and
			 Prevention has estimated that domestic violence costs over $700,000,000
			 annually due to the victims’ lost productivity in employment.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7E1EF09096E6464482FD77A24E6B4DDC"><enum>(24)</enum><text display-inline="yes-display-inline">Efforts to assist abused employees result
			 in positive outcomes for employers as well as employees because employers can
			 retain workers who might otherwise be compelled to leave.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="HA64D980AA92549549E7E55EA16A3D09F" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="H68068EB943964F6BAD65D4E71ED27B18"><enum>(1)</enum><text display-inline="yes-display-inline">to ensure that all working Americans can
			 address their own health needs and the health needs of their families by
			 requiring employers to permit employees to earn up to 56 hours of paid sick
			 time including paid time for family care;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCDF3440B7F5D4B95A9DA2416AB2F6240"><enum>(2)</enum><text display-inline="yes-display-inline">to diminish public and private health care
			 costs by enabling workers to seek early and routine medical care for themselves
			 and their family members;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9E50FD95CE1E4BEC96078562617BF805"><enum>(3)</enum><text display-inline="yes-display-inline">to assist employees who are, or whose
			 family members are, victims of domestic violence, sexual assault, or stalking,
			 by providing the employees with paid time away from work to allow the victims
			 to receive treatment and to take the necessary steps to ensure their
			 protection;</text>
			</paragraph><paragraph id="H80BFEB43377B49699468E97D323B6389"><enum>(4)</enum><text>to address the
			 historical and persistent widespread pattern of employment discrimination on
			 the basis of gender by both private and public sector employers;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5992F7D280AC4872A2D058E7E8319DB7"><enum>(5)</enum><text display-inline="yes-display-inline">to accomplish the purposes described in
			 paragraphs (1) through (4) in a manner that is feasible for employers;
			 and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H975234352C104D718A9F8431B63EF1CB"><enum>(6)</enum><text display-inline="yes-display-inline">consistent with the provision of the 14th
			 Amendment to the Constitution relating to equal protection of the laws, and
			 pursuant to Congress' power to enforce that provision under section 5 of that
			 Amendment—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="H8B6D260298CC4244BF7DF751B2C5A671"><enum>(A)</enum><text display-inline="yes-display-inline">to accomplish the purposes described in
			 paragraphs (1) through (4) in a manner that minimizes the potential for
			 employment discrimination on the basis of sex by ensuring generally that paid
			 sick time is available for eligible medical reasons on a gender-neutral basis;
			 and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA1C2644C7C4F425F84DB270B073A6AC7"><enum>(B)</enum><text display-inline="yes-display-inline">to promote the goal of equal employment
			 opportunity for women and men.</text>
				</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="H97F0969E77EC4C7196D2C2CF96B16D2C" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph commented="no" display-inline="no-display-inline" id="H14968275E7CD4EB8826C537E6652E8C5"><enum>(1)</enum><header display-inline="yes-display-inline">Child</header><text display-inline="yes-display-inline">The term <term>child</term> means a
			 biological, foster, or adopted child, a stepchild, a child of a domestic
			 partner, a legal ward, or a child of a person standing in loco parentis, who
			 is—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="H7F7904D4410B4EE283180E02218E1EE9"><enum>(A)</enum><text display-inline="yes-display-inline">under 18 years of age; or</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HAC3FC40EFB474075A04422EBCF5EB271"><enum>(B)</enum><text display-inline="yes-display-inline">18 years of age or older and incapable of
			 self-care because of a mental or physical disability.</text>
				</subparagraph></paragraph><paragraph id="H678FEF5C881C46239D36F462BE59398A"><enum>(2)</enum><header>Domestic
			 partner</header><text>The term <term>domestic partner</term> means the person
			 recognized as being in a relationship with an employee under any domestic
			 partnership, civil union, or similar law of the State or political subdivision
			 of a State in which the employee resides.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF43C97E02FB94DFB908A853ED079C358"><enum>(3)</enum><header display-inline="yes-display-inline">Domestic violence</header><text display-inline="yes-display-inline">The term <term>domestic violence</term> has
			 the meaning given the term in section 40002(a) of the Violence Against Women
			 Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/42/13925">42 U.S.C. 13925(a)</external-xref>), except that the reference in such section to
			 the term <term>jurisdiction receiving grant monies</term> shall be deemed to
			 mean the jurisdiction in which the victim lives or the jurisdiction in which
			 the employer involved is located.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0872A32815C445B78608DA902837EFE8"><enum>(4)</enum><header display-inline="yes-display-inline">Employee</header><text display-inline="yes-display-inline">The term <term>employee</term> means an
			 individual who is—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="HEF8C92E51A61445982C13C6363295403"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="HD8FF6445BF0245F598ABA92A71A96423"><enum>(i)</enum><text display-inline="yes-display-inline">an employee, as defined in section 3(e) of
			 the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203(e)</external-xref>), who is not covered
			 under subparagraph (E), including such an employee of the Library of Congress,
			 except that a reference in such section to an employer shall be considered to
			 be a reference to an employer described in clauses (i)(I) and (ii) of paragraph
			 (5)(A); or</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="H7F012AB30D664518AAB7BC6BA7D32EED" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">an employee of the Government
			 Accountability Office;</text>
					</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H04CD1DAF99EB4C47810B15F37CD721D7"><enum>(B)</enum><text display-inline="yes-display-inline">a State employee described in section
			 304(a) of the Government Employee Rights Act of 1991 (42 U.S.C.
			 2000e–16c(a));</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9C9A50777163400CA8511B902B5ADA23"><enum>(C)</enum><text display-inline="yes-display-inline">a covered employee, as defined in section
			 101 of the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301</external-xref>), other than
			 an applicant for employment;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H599E66ACA65C4E83B777FAAC7DCFE0B3"><enum>(D)</enum><text display-inline="yes-display-inline">a covered employee, as defined in section
			 411(c) of title 3, United States Code; or</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFD622265C8AF4D29916E667279060E03"><enum>(E)</enum><text display-inline="yes-display-inline">a Federal officer or employee covered under
			 subchapter V of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/63">chapter 63</external-xref> of title 5, United States Code.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H54EA91BBFCAB4571BE40C4E62E261E65"><enum>(5)</enum><header display-inline="yes-display-inline">Employer</header>
				<subparagraph commented="no" display-inline="no-display-inline" id="HCA3DB7BF12954AC88A4FD9E9A6845416"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term <term>employer</term> means a
			 person who is—</text>
					<clause commented="no" display-inline="no-display-inline" id="H6EE3C7CD8DBC4319A77BAF61005721D1"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="H6E5F78CFE98745C29E83B808C0D2DC9D"><enum>(I)</enum><text display-inline="yes-display-inline">a covered employer, as defined in
			 subparagraph (B), who is not covered under subclause (V);</text>
						</subclause><subclause commented="no" display-inline="no-display-inline" id="H30907762DFCF4F0E9CE0E3D3E25C44DE" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">an entity employing a State employee
			 described in section 304(a) of the Government Employee Rights Act of
			 1991;</text>
						</subclause><subclause commented="no" display-inline="no-display-inline" id="H5F85B3493F5844BE9762E84BF34A9A0E" indent="up1"><enum>(III)</enum><text display-inline="yes-display-inline">an employing office, as defined in section
			 101 of the Congressional Accountability Act of 1995;</text>
						</subclause><subclause commented="no" display-inline="no-display-inline" id="H217B22B0066D47CE8F291C186480AF7F" indent="up1"><enum>(IV)</enum><text display-inline="yes-display-inline">an employing office, as defined in section
			 411(c) of title 3, United States Code; or</text>
						</subclause><subclause commented="no" display-inline="no-display-inline" id="HBCA553CECBCB46A892E8BD5EC8B8D839" indent="up1"><enum>(V)</enum><text display-inline="yes-display-inline">an employing agency covered under
			 subchapter V of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/63">chapter 63</external-xref> of title 5, United States Code; and</text>
						</subclause></clause><clause commented="no" display-inline="no-display-inline" id="H83967B1BBE024F0C8AE50BB49EEE14E6"><enum>(ii)</enum><text display-inline="yes-display-inline">is engaged in commerce (including
			 government), or an industry or activity affecting commerce (including
			 government), as defined in subparagraph (B)(iii).</text>
					</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFDF5EACE905645D58E0942FE8FF28ADE"><enum>(B)</enum><header display-inline="yes-display-inline">Covered employer</header>
					<clause commented="no" display-inline="no-display-inline" id="HDDE9791A20844C3CA3C241A0E9A291E2"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In subparagraph (A)(i)(I), the term
			 <term>covered employer</term>—</text>
						<subclause commented="no" display-inline="no-display-inline" id="H025D109269284861B6D643B43307514C"><enum>(I)</enum><text display-inline="yes-display-inline">means any person engaged in commerce or in
			 any industry or activity affecting commerce who employs 15 or more employees
			 for each working day during each of 20 or more calendar workweeks in the
			 current or preceding calendar year;</text>
						</subclause><subclause commented="no" display-inline="no-display-inline" id="HBDE6E1F34B09409BA86CC315AD97E490"><enum>(II)</enum><text display-inline="yes-display-inline">includes—</text>
							<item commented="no" display-inline="no-display-inline" id="H81FA57920377490C96539A4BF0B5CA2D"><enum>(aa)</enum><text display-inline="yes-display-inline">any person who acts, directly or
			 indirectly, in the interest of an employer to any of the employees of such
			 employer; and</text>
							</item><item commented="no" display-inline="no-display-inline" id="H4F1FA0576AB345D6A6A749BB24694C1B"><enum>(bb)</enum><text display-inline="yes-display-inline">any successor in interest of an
			 employer;</text>
							</item></subclause><subclause commented="no" display-inline="no-display-inline" id="HB97819648F7E430D8CAB6E0FE8287C10"><enum>(III)</enum><text display-inline="yes-display-inline">includes any <term>public agency</term>, as
			 defined in section 3(x) of the Fair Labor Standards Act of 1938 (29 U.S.C.
			 203(x)); and</text>
						</subclause><subclause commented="no" display-inline="no-display-inline" id="H388AC0773FF9433CA865B8CBAF30B895"><enum>(IV)</enum><text display-inline="yes-display-inline">includes the Government Accountability
			 Office and the Library of Congress.</text>
						</subclause></clause><clause commented="no" display-inline="no-display-inline" id="H13433A11CF1642EF89B2C35CA2AD9FEF"><enum>(ii)</enum><header display-inline="yes-display-inline">Public agency</header><text display-inline="yes-display-inline">For purposes of clause (i)(III), a public
			 agency shall be considered to be a person engaged in commerce or in an industry
			 or activity affecting commerce.</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="H0E413F426602447282FED6FDA1124DBE"><enum>(iii)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">For purposes of this subparagraph:</text>
						<subclause commented="no" display-inline="no-display-inline" id="H46DC93BB214F45188545C158FB2DA881"><enum>(I)</enum><header display-inline="yes-display-inline">Commerce</header><text display-inline="yes-display-inline">The terms <term>commerce</term> and
			 <term>industry or activity affecting commerce</term> mean any activity,
			 business, or industry in commerce or in which a labor dispute would hinder or
			 obstruct commerce or the free flow of commerce, and include
			 <term>commerce</term> and any <term>industry affecting commerce</term>, as
			 defined in paragraphs (1) and (3) of section 501 of the Labor Management
			 Relations Act, 1947 (29 U.S.C. 142 (1) and (3)).</text>
						</subclause><subclause commented="no" display-inline="no-display-inline" id="H323EED39748F4F3FAB9575F3DCCFB698"><enum>(II)</enum><header display-inline="yes-display-inline">Employee</header><text display-inline="yes-display-inline">The term <term>employee</term> has the same
			 meaning given such term in section 3(e) of the Fair Labor Standards Act of 1938
			 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203(e)</external-xref>).</text>
						</subclause><subclause commented="no" display-inline="no-display-inline" id="H458F9F32E4C3440188FEE88076C473F7"><enum>(III)</enum><header display-inline="yes-display-inline">Person</header><text display-inline="yes-display-inline">The term <term>person</term> has the same
			 meaning given such term in section 3(a) of the Fair Labor Standards Act of 1938
			 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203(a)</external-xref>).</text>
						</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3BBA9BF0ABF847C18CB943CC6DA31673"><enum>(C)</enum><header display-inline="yes-display-inline">Predecessors</header><text display-inline="yes-display-inline">Any reference in this paragraph to an
			 employer shall include a reference to any predecessor of such employer.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAC512D87F5D4422E851DFD23CC73210A"><enum>(6)</enum><header display-inline="yes-display-inline">Employment benefits</header><text display-inline="yes-display-inline">The term <term>employment benefits</term>
			 means all benefits provided or made available to employees by an employer,
			 including group life insurance, health insurance, disability insurance, sick
			 leave, annual leave, educational benefits, and pensions, regardless of whether
			 such benefits are provided by a practice or written policy of an employer or
			 through an <term>employee benefit plan</term>, as defined in section 3(3) of
			 the <act-name parsable-cite="ERISA">Employee Retirement Income Security Act of
			 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/29/1002">29 U.S.C. 1002(3)</external-xref>).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE46AFB7DA59D4941909EA2B761FBE310"><enum>(7)</enum><header display-inline="yes-display-inline">Health care provider</header><text display-inline="yes-display-inline">The term <term>health care provider</term>
			 means a provider who—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="H16311BCB81AE404E81451E52D559CA59"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="H46E832FBBD6046C683B9C4FAE2E8FE23"><enum>(i)</enum><text display-inline="yes-display-inline">is a doctor of medicine or osteopathy who
			 is authorized to practice medicine or surgery (as appropriate) by the State in
			 which the doctor practices; or</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="H0880C67B160F4602A85CD5080E596ACA" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">is any other person determined by the
			 Secretary to be capable of providing health care services; and</text>
					</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF25E846171D342E49E6910962523A21B"><enum>(B)</enum><text display-inline="yes-display-inline">is not employed by an employer for whom the
			 provider issues certification under this Act.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBC6322AC366C4A4BB82ADEA61D08DCEE"><enum>(8)</enum><header display-inline="yes-display-inline">Paid
			 sick time</header><text display-inline="yes-display-inline">The term <term>paid
			 sick time</term> means an increment of compensated leave that can be earned by
			 an employee for use during an absence from employment for any of the reasons
			 described in paragraphs (1) through (4) of section 5(b).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1F7B3BB720EB4212BBF169527D71FB6B"><enum>(9)</enum><header display-inline="yes-display-inline">Parent</header><text display-inline="yes-display-inline">The term <term>parent</term> means a
			 biological, foster, or adoptive parent of an employee, a stepparent of an
			 employee, parent-in-law, parent of a domestic partner, or a legal guardian or
			 other person who stood in loco parentis to an employee when the employee was a
			 child.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBF2D63975D4D4B8D8CECC584A7ADC719"><enum>(10)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the
			 Secretary of Labor.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9E8CBD4ED3AA48C6A064A7EF146CB0F3"><enum>(11)</enum><header display-inline="yes-display-inline">Sexual
			 assault</header><text display-inline="yes-display-inline">The term <term>sexual
			 assault</term> has the meaning given the term in section 40002(a) of the
			 Violence Against Women Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/42/13925">42 U.S.C. 13925(a)</external-xref>).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3FD956C8227045F09E609D21A1F624CC"><enum>(12)</enum><header display-inline="yes-display-inline">Spouse</header><text display-inline="yes-display-inline">The term <term>spouse</term>, with respect
			 to an employee, has the meaning given such term by the marriage laws of the
			 State in which the employee resides.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H032F245136964D73999B67F7A4246CB1"><enum>(13)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> has the meaning
			 given the term in section 3 of the Fair Labor Standards Act of 1938 (29 U.S.C.
			 203).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD64A67D61E72465DA8A2FD2739DA884F"><enum>(14)</enum><header display-inline="yes-display-inline">Stalking</header><text display-inline="yes-display-inline">The term <term>stalking</term> has the
			 meaning given the term in section 40002(a) of the Violence Against Women Act of
			 1994 (<external-xref legal-doc="usc" parsable-cite="usc/42/13925">42 U.S.C. 13925(a)</external-xref>).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC6A7BF9B4ED643EF9BFC694E62EBA7CC"><enum>(15)</enum><header display-inline="yes-display-inline">Victim services organization</header><text display-inline="yes-display-inline">The term <term>victim services
			 organization</term> means a nonprofit, nongovernmental organization that
			 provides assistance to victims of domestic violence, sexual assault, or
			 stalking or advocates for such victims, including a rape crisis center, an
			 organization carrying out a domestic violence, sexual assault, or stalking
			 prevention or treatment program, an organization operating a shelter or
			 providing counseling services, or a legal services organization or other
			 organization providing assistance through the legal process.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="H44BB7DA1C2EC4D4788DC8546237B3FDD" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Provision of paid sick time</header>
			<subsection commented="no" display-inline="no-display-inline" id="H942309638A1D42CFA8CE00E6F15DBAA8"><enum>(a)</enum><header display-inline="yes-display-inline">Accrual of paid sick time</header>
				<paragraph commented="no" display-inline="no-display-inline" id="HE58B237DBD8D4E37836CA15962A88C7A"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">An employer shall permit each employee
			 employed by the employer to earn not less than 1 hour of paid sick time for
			 every 30 hours worked, to be used as described in subsection (b). An employer
			 shall not be required to permit an employee to earn, under this section, more
			 than 56 hours of paid sick time in a calendar year, unless the employer chooses
			 to set a higher limit.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB4FCABF583AC406B87DBC18A00D274C1"><enum>(2)</enum><header display-inline="yes-display-inline">Exempt employees</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="H3F9AAC19359C49C3B6EC5EA66F2A05B6"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (3), for
			 purposes of this section, an employee who is exempt from overtime requirements
			 under section 13(a)(1) of the Fair Labor Standards Act of 1938 (29 U.S.C.
			 213(a)(1)) shall be assumed to work 40 hours in each workweek.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4EA8F1B7A0154ADF8D874D29970A79E1"><enum>(B)</enum><header display-inline="yes-display-inline">Shorter normal workweek</header><text display-inline="yes-display-inline">If the normal workweek of such an employee
			 is less than 40 hours, the employee shall earn paid sick time based upon that
			 normal work week.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD4953993C6AD4F248A35652766DFE74D"><enum>(3)</enum><header display-inline="yes-display-inline">Dates of accrual and use</header><text display-inline="yes-display-inline">Employees shall begin to earn paid sick
			 time under this section at the commencement of their employment. An employee
			 shall be entitled to use the earned paid sick time beginning on the 60th
			 calendar day following commencement of the employee's employment. After that
			 60th calendar day, the employee may use the paid sick time as the time is
			 earned. An employer may, at the discretion of the employer, loan paid sick time
			 to an employee in advance of the earning of such time under this section by
			 such employee.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8D8F89712E07465F91A30CCDD742A40E"><enum>(4)</enum><header display-inline="yes-display-inline">Carryover</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="H5BF5474950934FCE8C1A2FAB5B4D20FD"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B),
			 paid sick time earned under this section shall carry over from 1 calendar year
			 to the next.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBFCB275A03A14A639892A7F52EF9DC34"><enum>(B)</enum><header display-inline="yes-display-inline">Construction</header><text display-inline="yes-display-inline">This Act shall not be construed to require
			 an employer to permit an employee to accrue more than 56 hours of earned paid
			 sick time at a given time.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6D1E9FDC0CE74F4BB5C147BAF8198121"><enum>(5)</enum><header display-inline="yes-display-inline">Employers with existing
			 policies</header><text display-inline="yes-display-inline">Any employer with a
			 paid leave policy who makes available an amount of paid leave that is
			 sufficient to meet the requirements of this section and that may be used for
			 the same purposes and under the same conditions as the purposes and conditions
			 outlined in subsection (b) shall not be required to permit an employee to earn
			 additional paid sick time under this section.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF9B3552F5C77415A8EB33A8E0C34338E"><enum>(6)</enum><header display-inline="yes-display-inline">Construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed
			 as requiring financial or other reimbursement to an employee from an employer
			 upon the employee’s termination, resignation, retirement, or other separation
			 from employment for earned paid sick time that has not been used.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB001C7A1848540ACBE66DDDA6860A06A"><enum>(7)</enum><header display-inline="yes-display-inline">Reinstatement</header><text display-inline="yes-display-inline">If an employee is separated from employment
			 with an employer and is rehired, within 12 months after that separation, by the
			 same employer, the employer shall reinstate the employee's previously earned
			 paid sick time. The employee shall be entitled to use the earned paid sick time
			 and earn additional paid sick time at the recommencement of employment with the
			 employer.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4AC0E25D129443BA89EAE6C1A903412E"><enum>(8)</enum><header display-inline="yes-display-inline">Prohibition</header><text display-inline="yes-display-inline">An employer may not require, as a condition
			 of providing paid sick time under this Act, that the employee involved search
			 for or find a replacement worker to cover the hours during which the employee
			 is using paid sick time.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HAFDC6383FFA849FCBC39D5C58B1632F7"><enum>(b)</enum><header display-inline="yes-display-inline">Uses</header><text display-inline="yes-display-inline">Paid sick time earned under this section
			 may be used by an employee for any of the following:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HD0B01E2FEF4E4A5FAA20D3BB95892DB8"><enum>(1)</enum><text display-inline="yes-display-inline">An absence resulting from a physical or
			 mental illness, injury, or medical condition of the employee.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBA4F8DB7BC134A40A36542C333782BCA"><enum>(2)</enum><text display-inline="yes-display-inline">An absence resulting from obtaining
			 professional medical diagnosis or care, or preventive medical care, for the
			 employee.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H17089421734D4B4AA57CB3AF69098599"><enum>(3)</enum><text display-inline="yes-display-inline">An absence for the purpose of caring for a
			 child, a parent, a spouse, a domestic partner, or any other individual related
			 by blood or affinity whose close association with the employee is the
			 equivalent of a family relationship, who—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H06B958F15F264D039975AABE09FE0773"><enum>(A)</enum><text display-inline="yes-display-inline">has any of the conditions or needs for
			 diagnosis or care described in paragraph (1) or (2); and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H923A93295C874787B4D8C7681D5D5694"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of someone who is not a child,
			 is otherwise in need of care.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7A442A3A50C74DAAB8FA3C4974E84722"><enum>(4)</enum><text display-inline="yes-display-inline">An absence resulting from domestic
			 violence, sexual assault, or stalking, if the time is to—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H7AD79A895E0A48FE9465288A6C945B49"><enum>(A)</enum><text display-inline="yes-display-inline">seek medical attention for the employee or
			 the employee’s child, parent, spouse, domestic partner, or an individual
			 related to the employee as described in paragraph (3), to recover from physical
			 or psychological injury or disability caused by domestic violence, sexual
			 assault, or stalking;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6557A21A3CC249A7B0B2994B6EF0088B"><enum>(B)</enum><text display-inline="yes-display-inline">obtain or assist a related person described
			 in paragraph (3) in obtaining services from a victim services
			 organization;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HEA595F8B08BC4C77872C8B3B48929857"><enum>(C)</enum><text display-inline="yes-display-inline">obtain or assist a related person described
			 in paragraph (3) in obtaining psychological or other counseling;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF4A3D0B7F88C4392A972FD101D553B89"><enum>(D)</enum><text display-inline="yes-display-inline">seek relocation; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5B15290078EA49CCAD745552083AF132"><enum>(E)</enum><text display-inline="yes-display-inline">take legal action, including preparing for
			 or participating in any civil or criminal legal proceeding related to or
			 resulting from domestic violence, sexual assault, or stalking.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HD250C4C4BA99401DBE43140798400DB7"><enum>(c)</enum><header display-inline="yes-display-inline">Scheduling</header><text display-inline="yes-display-inline">An employee shall make a reasonable effort
			 to schedule a period of paid sick time under this Act in a manner that does not
			 unduly disrupt the operations of the employer.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HD5966C4640D54739AEBAC5EA83C57B12"><enum>(d)</enum><header display-inline="yes-display-inline">Procedures</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H65F9564040A84B43AD39B4962A7EFC49"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Paid sick time shall be provided upon the
			 oral or written request of an employee. Such request shall—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HEB8BDBDD085B4317B7D63A9D4F0FE0BE"><enum>(A)</enum><text display-inline="yes-display-inline">include the expected duration of the period
			 of such time;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7AAA30748D244F0199FF52E284D4C1F0"><enum>(B)</enum><text display-inline="yes-display-inline">in a case in which the need for such period
			 of time is foreseeable at least 7 days in advance of such period, be provided
			 at least 7 days in advance of such period; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE0368E12A72E4ADD95E275EDE9F8F561"><enum>(C)</enum><text display-inline="yes-display-inline">otherwise, be provided as soon as
			 practicable after the employee is aware of the need for such period.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDDB09E49EFBA4D4CACF9A2B25305C3B9"><enum>(2)</enum><header display-inline="yes-display-inline">Certification in general</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="HFE3EA14AB6F244EEBE4BB160D90C657B"><enum>(A)</enum><header display-inline="yes-display-inline">Provision</header>
						<clause commented="no" display-inline="no-display-inline" id="H8FDCCCFFCED9497F9DF8A6564C55AA41"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to subparagraph (C), an employer
			 may require that a request for paid sick time under this section for a purpose
			 described in paragraph (1), (2), or (3) of subsection (b) be supported by a
			 certification issued by the health care provider of the eligible employee or of
			 an individual described in subsection (b)(3), as appropriate, if the period of
			 such time covers more than 3 consecutive workdays.</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H563E4323F11342E9A07A612CD60E136E"><enum>(ii)</enum><header display-inline="yes-display-inline">Timeliness</header><text display-inline="yes-display-inline">The employee shall provide a copy of such
			 certification to the employer in a timely manner, not later than 30 days after
			 the first day of the period of time. The employer shall not delay the
			 commencement of the period of time on the basis that the employer has not yet
			 received the certification.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9826E7E7C2CF493AAF01A05BC386B647"><enum>(B)</enum><header display-inline="yes-display-inline">Sufficient certification</header>
						<clause commented="no" display-inline="no-display-inline" id="HA4D67639C5A34E09A4348FF4D14A7627"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A certification provided under subparagraph
			 (A) shall be sufficient if it states—</text>
							<subclause commented="no" display-inline="no-display-inline" id="HBFDC8446B3514E51BF8E3D006AF58478"><enum>(I)</enum><text display-inline="yes-display-inline">the date on which the period of time will
			 be needed;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="HE220D4572B4946C2A71A280AEF7EDF8D"><enum>(II)</enum><text display-inline="yes-display-inline">the probable duration of the period of
			 time;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="H435275BFAF764F52A1994844E313836C"><enum>(III)</enum><text display-inline="yes-display-inline">the appropriate medical facts within the
			 knowledge of the health care provider regarding the condition involved, subject
			 to clause (ii); and</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="HCB545F7182074DBF826584E891E8321A"><enum>(IV)</enum><item commented="no" display-inline="yes-display-inline" id="H0EE2460A13B74A0881497E55C895EA9F"><enum>(aa)</enum><text display-inline="yes-display-inline">for purposes of paid sick time under
			 subsection (b)(1), a statement that absence from work is medically
			 necessary;</text>
								</item><item commented="no" display-inline="no-display-inline" id="H758A226F5C1744429D756494E038FBBC" indent="up1"><enum>(bb)</enum><text display-inline="yes-display-inline">for purposes of such time under subsection
			 (b)(2), the dates on which testing for a medical diagnosis or care is expected
			 to be given and the duration of such testing or care; and</text>
								</item><item commented="no" display-inline="no-display-inline" id="H9376BCDC4660471B8147F939168A80CC" indent="up1"><enum>(cc)</enum><text display-inline="yes-display-inline">for purposes of such time under subsection
			 (b)(3), in the case of time to care for someone who is not a child, a statement
			 that care is needed for an individual described in such subsection, and an
			 estimate of the amount of time that such care is needed for such
			 individual.</text>
								</item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H59B79980E23149E3B957551C36B524DE"><enum>(ii)</enum><header display-inline="yes-display-inline">Limitation</header><text display-inline="yes-display-inline">In issuing a certification under
			 subparagraph (A), a health care provider shall make reasonable efforts to limit
			 the medical facts described in clause (i)(III) that are disclosed in the
			 certification to the minimum necessary to establish a need for the employee to
			 utilize paid sick time.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H881CE11168AD4C3FB478E8C2023A98BB"><enum>(C)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">Regulations prescribed under section 13
			 shall specify the manner in which an employee who does not have health
			 insurance shall provide a certification for purposes of this paragraph.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H81B5246556214E5B9DC0645FF7DEF64E"><enum>(D)</enum><header display-inline="yes-display-inline">Confidentiality and nondisclosure</header>
						<clause commented="no" display-inline="no-display-inline" id="H7D1FB8EE9A6F46C08C9749EA17914E66"><enum>(i)</enum><header display-inline="yes-display-inline">Protected health information</header><text display-inline="yes-display-inline">Nothing in this Act shall be construed to
			 require a health care provider to disclose information in violation of section
			 1177 of the <act-name parsable-cite="SSA">Social Security Act</act-name> (42
			 U.S.C. 1320d–6) or the regulations promulgated pursuant to section 264(c) of
			 the Health Insurance Portability and Accountability Act of 1996 (42 U.S.C.
			 1320d–2 note).</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="HDAA661ADFF8B422BAAF8C76D0AF683CC"><enum>(ii)</enum><header display-inline="yes-display-inline">Health information records</header><text display-inline="yes-display-inline">If an employer possesses health information
			 about an employee or an employee’s child, parent, spouse, domestic partner, or
			 an individual related to the employee as described in subsection (b)(3), such
			 information shall—</text>
							<subclause commented="no" display-inline="no-display-inline" id="HC9458B149C6B49C7B789116D32731311"><enum>(I)</enum><text display-inline="yes-display-inline">be maintained on a separate form and in a
			 separate file from other personnel information;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="H2F95132BAEF240DF9B03A42285C4B454"><enum>(II)</enum><text display-inline="yes-display-inline">be treated as a confidential medical
			 record; and</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="HD4F33E17CCCB49219BA718862C62D900"><enum>(III)</enum><text display-inline="yes-display-inline">not be disclosed except to the affected
			 employee or with the permission of the affected employee.</text>
							</subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE23F6177B7C84A639F3BD33D425E84AD"><enum>(3)</enum><header display-inline="yes-display-inline">Certification in the case of domestic
			 violence, sexual assault, or stalking</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="HCED26F5665F24FF89AB9C1B36587DD1A"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">An employer may require that a request for
			 paid sick time under this section for a purpose described in subsection (b)(4)
			 be supported by 1 of the following forms of documentation:</text>
						<clause commented="no" display-inline="no-display-inline" id="H6C79C34E0F1B478C92BF7A8B553C84D5"><enum>(i)</enum><text display-inline="yes-display-inline">A police report indicating that the
			 employee, or a member of the employee's family described in subsection (b)(4),
			 was a victim of domestic violence, sexual assault, or stalking.</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="HE046CDB6357644F1ACF4CF56E4BDC3E4"><enum>(ii)</enum><text display-inline="yes-display-inline">A court order protecting or separating the
			 employee or a member of the employee's family described in subsection (b)(4)
			 from the perpetrator of an act of domestic violence, sexual assault, or
			 stalking, or other evidence from the court or prosecuting attorney that the
			 employee or a member of the employee's family described in subsection (b)(4)
			 has appeared in court or is scheduled to appear in court in a proceeding
			 related to domestic violence, sexual assault, or stalking.</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H600E929256384EDDBD13049D88BD44B2"><enum>(iii)</enum><text display-inline="yes-display-inline">Other documentation signed by an employee
			 or volunteer working for a victim services organization, an attorney, a police
			 officer, a medical professional, a social worker, an antiviolence counselor, or
			 a member of the clergy, affirming that the employee or a member of the
			 employee's family described in subsection (b)(4) is a victim of domestic
			 violence, sexual assault, or stalking.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBEB915B818EA4569A0E7EF000F50F8A1"><enum>(B)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">The requirements of paragraph (2) shall
			 apply to certifications under this paragraph, except that—</text>
						<clause commented="no" display-inline="no-display-inline" id="H4663E69EFA1F4B12A813CF861C5C6DCD"><enum>(i)</enum><text display-inline="yes-display-inline">subclauses (III) and (IV) of subparagraph
			 (B)(i) and subparagraph (B)(ii) of such paragraph shall not apply;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H538C5AC34A774F918D4C11A25EB61A26"><enum>(ii)</enum><text display-inline="yes-display-inline">the certification shall state the reason
			 that the leave is required with the facts to be disclosed limited to the
			 minimum necessary to establish a need for the employee to be absent from work,
			 and the employee shall not be required to explain the details of the domestic
			 violence, sexual assault, or stalking involved; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H5FFE7A8139B24EE3B975A6015F88BE5D"><enum>(iii)</enum><text display-inline="yes-display-inline">with respect to confidentiality under
			 subparagraph (D) of such paragraph, any information provided to the employer
			 under this paragraph shall be confidential, except to the extent that any
			 disclosure of such information is—</text>
							<subclause commented="no" display-inline="no-display-inline" id="H6782849471DD40579159175CC998308B"><enum>(I)</enum><text display-inline="yes-display-inline">requested or consented to in writing by the
			 employee; or</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="H7A7F500F93CB4EE88DB1391802C435B9"><enum>(II)</enum><text display-inline="yes-display-inline">otherwise required by applicable Federal or
			 State law.</text>
							</subclause></clause></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H78483A1C435C4A399D6915FD581DE210" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Posting requirement</header>
			<subsection commented="no" display-inline="no-display-inline" id="H77D39F6702C043A8BDEB61831F4D444B"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Each employer shall post and keep posted a
			 notice, to be prepared or approved in accordance with procedures specified in
			 regulations prescribed under section 13, setting forth excerpts from, or
			 summaries of, the pertinent provisions of this Act including—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HBD93C3052C2D4CE9A2D806D47F01CD73"><enum>(1)</enum><text display-inline="yes-display-inline">information describing paid sick time
			 available to employees under this Act;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4897430DD34F452EB896F48D9661C60D"><enum>(2)</enum><text display-inline="yes-display-inline">information pertaining to the filing of an
			 action under this Act;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC8E8F58786B94BBCB5DAA43F7C4C14DE"><enum>(3)</enum><text display-inline="yes-display-inline">the details of the notice requirement for a
			 foreseeable period of time under section 5(d)(1)(B); and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8694AC974FC64B44BA3850578E10DDC5"><enum>(4)</enum><text display-inline="yes-display-inline">information that describes—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HBC95472E9C2C4BF4914970271004C5E1"><enum>(A)</enum><text display-inline="yes-display-inline">the protections that an employee has in
			 exercising rights under this Act; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H131B07F776194575A386F7B0631A7EA0"><enum>(B)</enum><text display-inline="yes-display-inline">how the employee can contact the Secretary
			 (or other appropriate authority as described in section 8) if any of the rights
			 are violated.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HD57E78F5B55B4F43891071DE2D17171D"><enum>(b)</enum><header display-inline="yes-display-inline">Location</header><text display-inline="yes-display-inline">The notice described under subsection (a)
			 shall be posted—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H8D75063CC0454188A25F84CFA027EF29"><enum>(1)</enum><text display-inline="yes-display-inline">in conspicuous places on the premises of
			 the employer, where notices to employees (including applicants) are customarily
			 posted; or</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCD640D78AE7E44E6ADD25343F86AA919"><enum>(2)</enum><text display-inline="yes-display-inline">in employee handbooks.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H4E245648A49B4A9B9AF7AD9D053EDD73"><enum>(c)</enum><header display-inline="yes-display-inline">Violation; penalty</header><text display-inline="yes-display-inline">Any employer who willfully violates the
			 posting requirements of this section shall be subject to a civil fine in an
			 amount not to exceed $100 for each separate offense.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="HB070D1CE3F124D329A72CDE93D395378" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Prohibited acts</header>
			<subsection commented="no" display-inline="no-display-inline" id="H721BB453DC744D05B44232138A135361"><enum>(a)</enum><header display-inline="yes-display-inline">Interference with rights</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H5DA6B79058D44DE192D5AB9BBD4B7117"><enum>(1)</enum><header display-inline="yes-display-inline">Exercise of rights</header><text display-inline="yes-display-inline">It shall be unlawful for any employer to
			 interfere with, restrain, or deny the exercise of, or the attempt to exercise,
			 any right provided under this Act, including—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HBB12635A06F547EE98F9D93F68B6812C"><enum>(A)</enum><text display-inline="yes-display-inline">discharging or discriminating against
			 (including retaliating against) any individual, including a job applicant, for
			 exercising, or attempting to exercise, any right provided under this
			 Act;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HEAF7B96978FB402D89B6F37F50307CE6"><enum>(B)</enum><text display-inline="yes-display-inline">using the taking of paid sick time under
			 this Act as a negative factor in an employment action, such as hiring,
			 promotion, or a disciplinary action; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H60D8B40833A04393BD700ACFCE73CD45"><enum>(C)</enum><text display-inline="yes-display-inline">counting the paid sick time under a
			 no-fault attendance policy or any other absence control policy.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9C5514690DF24E5B93F4379E35703451"><enum>(2)</enum><header display-inline="yes-display-inline">Discrimination</header><text display-inline="yes-display-inline">It shall be unlawful for any employer to
			 discharge or in any other manner discriminate against (including retaliating
			 against) any individual, including a job applicant, for opposing any practice
			 made unlawful by this Act.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H2FDFD592BB364DA68EC8CA67A4CD3D7E"><enum>(b)</enum><header display-inline="yes-display-inline">Interference with proceedings or
			 inquiries</header><text display-inline="yes-display-inline">It shall be
			 unlawful for any person to discharge or in any other manner discriminate
			 against (including retaliating against) any individual, including a job
			 applicant, because such individual—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H2077E407463041B48DD3E0BA5A124776"><enum>(1)</enum><text display-inline="yes-display-inline">has filed an action, or has instituted or
			 caused to be instituted any proceeding, under or related to this Act;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC9EAC36F35774B81986FE31978490BAD"><enum>(2)</enum><text display-inline="yes-display-inline">has given, or is about to give, any
			 information in connection with any inquiry or proceeding relating to any right
			 provided under this Act; or</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H270010F6D66444E3930F9E6985C9F80A"><enum>(3)</enum><text display-inline="yes-display-inline">has testified, or is about to testify, in
			 any inquiry or proceeding relating to any right provided under this Act.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H06391B6AE95E4FC8BB8C806043902FFA"><enum>(c)</enum><header display-inline="yes-display-inline">Construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed
			 to state or imply that the scope of the activities prohibited by section 105 of
			 the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2615">29 U.S.C. 2615</external-xref>) is less than the
			 scope of the activities prohibited by this section.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="H228DF5FE459A49DA9C958DC2F4CD38A5" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">Enforcement authority</header>
			<subsection commented="no" display-inline="no-display-inline" id="H43C115DD49CC4C6382278EBD7DDE9216"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H7FC53D786D2E45B08F0054899B8352ED"><enum>(1)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">In this subsection:</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H1CDE45A4998B4B4481E05B1DF0278AC8"><enum>(A)</enum><text display-inline="yes-display-inline">the term <term>employee</term> means an
			 employee described in subparagraph (A) or (B) of section 4(4); and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H35F1153692C042738F94DF044C711A6A"><enum>(B)</enum><text display-inline="yes-display-inline">the term <term>employer</term> means an
			 employer described in subclause (I) or (II) of section 4(5)(A)(i).</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB8F708561CDF4BDC8D8E23EE8A64F73B"><enum>(2)</enum><header display-inline="yes-display-inline">Investigative authority</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="HFB07EF8D215744A6A6406EC08F663D9C"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">To ensure compliance with the provisions of
			 this Act, or any regulation or order issued under this Act, the Secretary shall
			 have, subject to subparagraph (C), the investigative authority provided under
			 section 11(a) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/211">29 U.S.C. 211(a)</external-xref>), with
			 respect to employers, employees, and other individuals affected.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9E1DEE5CD23546CCBCCCFE99FE64D8BD"><enum>(B)</enum><header display-inline="yes-display-inline">Obligation to keep and preserve
			 records</header><text display-inline="yes-display-inline">An employer shall
			 make, keep, and preserve records pertaining to compliance with this Act in
			 accordance with section 11(c) of the Fair Labor Standards Act of 1938 (29
			 U.S.C. 211(c)) and in accordance with regulations prescribed by the
			 Secretary.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3E9BE8558224462688A7A810D545BD60"><enum>(C)</enum><header display-inline="yes-display-inline">Required submissions generally limited to
			 an annual basis</header><text display-inline="yes-display-inline">The Secretary
			 shall not require, under the authority of this paragraph, an employer to submit
			 to the Secretary any books or records more than once during any 12-month
			 period, unless the Secretary has reasonable cause to believe there may exist a
			 violation of this Act or any regulation or order issued pursuant to this Act,
			 or is investigating a charge pursuant to paragraph (4).</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H0844DB18738B441793A252E5F88C3F26"><enum>(D)</enum><header display-inline="yes-display-inline">Subpoena authority</header><text display-inline="yes-display-inline">For the purposes of any investigation
			 provided for in this paragraph, the Secretary shall have the subpoena authority
			 provided for under section 9 of the Fair Labor Standards Act of 1938 (29 U.S.C.
			 209).</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6559070212E34772860BDF4F03BF4037"><enum>(3)</enum><header display-inline="yes-display-inline">Civil action by employees or
			 individuals</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="H999DD93EDA7B4CB9BDD08455DFA4371C"><enum>(A)</enum><header display-inline="yes-display-inline">Right of action</header><text display-inline="yes-display-inline">An action to recover the damages or
			 equitable relief prescribed in subparagraph (B) may be maintained against any
			 employer in any Federal or State court of competent jurisdiction by one or more
			 employees or individuals or their representative for and on behalf of—</text>
						<clause commented="no" display-inline="no-display-inline" id="H11EC3D3DF92048F39554B4D44B33F1DE"><enum>(i)</enum><text display-inline="yes-display-inline">the employees or individuals; or</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H7CB0833D9FB342FB837980538D5FA388"><enum>(ii)</enum><text display-inline="yes-display-inline">the employees or individuals and others
			 similarly situated.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB376A06F6F4F44F98A81CA902260F52B"><enum>(B)</enum><header display-inline="yes-display-inline">Liability</header><text display-inline="yes-display-inline">Any employer who violates section 7
			 (including a violation relating to rights provided under section 5) shall be
			 liable to any employee or individual affected—</text>
						<clause commented="no" display-inline="no-display-inline" id="H47CDF99679024BF094201BBF8338B9F3"><enum>(i)</enum><text display-inline="yes-display-inline">for damages equal to—</text>
							<subclause commented="no" display-inline="no-display-inline" id="H81A30F3143E846CBB80CCBC532D1B650"><enum>(I)</enum><text display-inline="yes-display-inline">the amount of—</text>
								<item commented="no" display-inline="no-display-inline" id="H31B92FA5F05542E782737887CB3DAA45"><enum>(aa)</enum><text display-inline="yes-display-inline">any wages, salary, employment benefits, or
			 other compensation denied or lost by reason of the violation; or</text>
								</item><item commented="no" display-inline="no-display-inline" id="HFCA0F0AF9A194B42A9B4CDEC0BDB8C72"><enum>(bb)</enum><text display-inline="yes-display-inline">in a case in which wages, salary,
			 employment benefits, or other compensation have not been denied or lost, any
			 actual monetary losses sustained as a direct result of the violation up to a
			 sum equal to 56 hours of wages or salary for the employee or individual;</text>
								</item></subclause><subclause commented="no" display-inline="no-display-inline" id="H2A68508701DF4921BBC74AEDA0770166"><enum>(II)</enum><text display-inline="yes-display-inline">the interest on the amount described in
			 subclause (I) calculated at the prevailing rate; and</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="HA67F99B2E8554AAC8B3C204337F6A9C9"><enum>(III)</enum><text display-inline="yes-display-inline">an additional amount as liquidated damages;
			 and</text>
							</subclause></clause><clause commented="no" display-inline="no-display-inline" id="H3E01B3A408F04FEC986F2EF21180C189"><enum>(ii)</enum><text display-inline="yes-display-inline">for such equitable relief as may be
			 appropriate, including employment, reinstatement, and promotion.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE4A1C49586B44929A92E1E9AF3D38099"><enum>(C)</enum><header display-inline="yes-display-inline">Fees
			 and costs</header><text display-inline="yes-display-inline">The court in an
			 action under this paragraph shall, in addition to any judgment awarded to the
			 plaintiff, allow a reasonable attorney’s fee, reasonable expert witness fees,
			 and other costs of the action to be paid by the defendant.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2663A8CF908E455CA8B897A0BE03F5D0"><enum>(4)</enum><header display-inline="yes-display-inline">Action by the Secretary</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="HF9C4264CA06B4BE6BA31089D8343A881"><enum>(A)</enum><header display-inline="yes-display-inline">Administrative action</header><text display-inline="yes-display-inline">The Secretary shall receive, investigate,
			 and attempt to resolve complaints of violations of section 7 (including a
			 violation relating to rights provided under section 5) in the same manner that
			 the Secretary receives, investigates, and attempts to resolve complaints of
			 violations of sections 6 and 7 of the Fair Labor Standards Act of 1938 (29
			 U.S.C. 206 and 207).</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD4B863B65297469B9D58C8B7A8F262A1"><enum>(B)</enum><header display-inline="yes-display-inline">Civil action</header><text display-inline="yes-display-inline">The Secretary may bring an action in any
			 court of competent jurisdiction to recover the damages described in paragraph
			 (3)(B)(i).</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H84BF80DB629547CF81F19D408D31FCFF"><enum>(C)</enum><header display-inline="yes-display-inline">Sums
			 recovered</header><text display-inline="yes-display-inline">Any sums recovered
			 by the Secretary pursuant to subparagraph (B) shall be held in a special
			 deposit account and shall be paid, on order of the Secretary, directly to each
			 employee or individual affected. Any such sums not paid to an employee or
			 individual affected because of inability to do so within a period of 3 years
			 shall be deposited into the Treasury of the United States as miscellaneous
			 receipts.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF28EEABA5CA14151B9246ECEB771881B"><enum>(5)</enum><header display-inline="yes-display-inline">Limitation</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="H03335441AF7A488EB9FEC4FB77256B07"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), an
			 action may be brought under paragraph (3), (4), or (6) not later than 2 years
			 after the date of the last event constituting the alleged violation for which
			 the action is brought.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H08A5734B302D4DBABBAF3C8242796937"><enum>(B)</enum><header display-inline="yes-display-inline">Willful violation</header><text display-inline="yes-display-inline">In the case of an action brought for a
			 willful violation of section 7 (including a willful violation relating to
			 rights provided under section 5), such action may be brought within 3 years of
			 the date of the last event constituting the alleged violation for which such
			 action is brought.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H0E2F720EDFB74CA881DED055F945590E"><enum>(C)</enum><header display-inline="yes-display-inline">Commencement</header><text display-inline="yes-display-inline">In determining when an action is commenced
			 under paragraph (3), (4), or (6) for the purposes of this paragraph, it shall
			 be considered to be commenced on the date when the complaint is filed.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA0603D86FBDC4E49BDD0B3C01E53818C"><enum>(6)</enum><header display-inline="yes-display-inline">Action for injunction by
			 Secretary</header><text display-inline="yes-display-inline">The district courts
			 of the United States shall have jurisdiction, for cause shown, in an action
			 brought by the Secretary—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H3807BC7589594A82A1F8762CCC59F75B"><enum>(A)</enum><text display-inline="yes-display-inline">to restrain violations of section 7
			 (including a violation relating to rights provided under section 5), including
			 the restraint of any withholding of payment of wages, salary, employment
			 benefits, or other compensation, plus interest, found by the court to be due to
			 employees or individuals eligible under this Act; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE8FC4F3E5914401698033D01AA600E7C"><enum>(B)</enum><text display-inline="yes-display-inline">to award such other equitable relief as may
			 be appropriate, including employment, reinstatement, and promotion.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0DF29B6AF83C45238D1627F3B7F47F58"><enum>(7)</enum><header display-inline="yes-display-inline">Solicitor of Labor</header><text display-inline="yes-display-inline">The Solicitor of Labor may appear for and
			 represent the Secretary on any litigation brought under paragraph (4) or
			 (6).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAE98D9F6606042EFA6F14A4668D00F8C"><enum>(8)</enum><header display-inline="yes-display-inline">Government Accountability Office and
			 Library of Congress</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this
			 subsection, in the case of the Government Accountability Office and the Library
			 of Congress, the authority of the Secretary of Labor under this subsection
			 shall be exercised respectively by the Comptroller General of the United States
			 and the Librarian of Congress.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HB7AF58EB7A004492A44C4B319895A228"><enum>(b)</enum><header display-inline="yes-display-inline">Employees covered by Congressional
			 Accountability Act of 1995</header><text display-inline="yes-display-inline">The powers, remedies, and procedures
			 provided in the Congressional Accountability Act of 1995 (2 U.S.C. 1301 et
			 seq.) to the Board (as defined in section 101 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301</external-xref>)), or
			 any person, alleging a violation of section 202(a)(1) of that Act (2 U.S.C.
			 1312(a)(1)) shall be the powers, remedies, and procedures this Act provides to
			 that Board, or any person, alleging an unlawful employment practice in
			 violation of this Act against an employee described in section 4(4)(C).</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H6976331397FC4356816585BDB48BA423"><enum>(c)</enum><header display-inline="yes-display-inline">Employees covered by chapter
			 <enum-in-header>5</enum-in-header> of title <enum-in-header>3</enum-in-header>,
			 United States Code</header><text display-inline="yes-display-inline">The
			 powers, remedies, and procedures provided in <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/3/5">chapter 5</external-xref> of title 3, United
			 States Code, to the President, the Merit Systems Protection Board, or any
			 person, alleging a violation of section 412(a)(1) of that title, shall be the
			 powers, remedies, and procedures this Act provides to the President, that
			 Board, or any person, respectively, alleging an unlawful employment practice in
			 violation of this Act against an employee described in section 4(4)(D).</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HA2AA3F8E651F46E783769C6B309E7B60"><enum>(d)</enum><header display-inline="yes-display-inline">Employees covered by chapter
			 <enum-in-header>63 </enum-in-header>of title
			 <enum-in-header>5,</enum-in-header> United States Code</header><text display-inline="yes-display-inline">The powers, remedies, and procedures
			 provided in title 5, United States Code, to an employing agency, provided in
			 chapter 12 of that title to the Merit Systems Protection Board, or provided in
			 that title to any person, alleging a violation of chapter 63 of that title,
			 shall be the powers, remedies, and procedures this Act provides to that agency,
			 that Board, or any person, respectively, alleging an unlawful employment
			 practice in violation of this Act against an employee described in section
			 4(4)(E).</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HB23636D1B2534FE9B37466692CDB4074"><enum>(e)</enum><header display-inline="yes-display-inline">Remedies for State employees</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H3D76A7F6352E4BFDAF84FE8950BB74AA"><enum>(1)</enum><header display-inline="yes-display-inline">Waiver of sovereign immunity</header><text display-inline="yes-display-inline">A State's receipt or use of Federal
			 financial assistance for any program or activity of a State shall constitute a
			 waiver of sovereign immunity, under the 11th Amendment to the Constitution or
			 otherwise, to a suit brought by an employee of that program or activity under
			 this Act for equitable, legal, or other relief authorized under this
			 Act.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC5307A34A1294DD884C90D65DCDAB9A8"><enum>(2)</enum><header display-inline="yes-display-inline">Official capacity</header><text display-inline="yes-display-inline">An official of a State may be sued in the
			 official capacity of the official by any employee who has complied with the
			 procedures under subsection (a)(3), for injunctive relief that is authorized
			 under this Act. In such a suit the court may award to the prevailing party
			 those costs authorized by section 722 of the Revised Statutes (42 U.S.C.
			 1988).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF7CC5D0A6C87479E8A98D5AA2BD07DF3"><enum>(3)</enum><header display-inline="yes-display-inline">Applicability</header><text display-inline="yes-display-inline">With respect to a particular program or
			 activity, paragraph (1) applies to conduct occurring on or after the day, after
			 the date of enactment of this Act, on which a State first receives or uses
			 Federal financial assistance for that program or activity.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBACC96AA12D348789BE8DAEEEC029AB1"><enum>(4)</enum><header display-inline="yes-display-inline">Definition of program or
			 activity</header><text display-inline="yes-display-inline">In this subsection,
			 the term <term>program or activity</term> has the meaning given the term in
			 section 606 of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d-4a">42 U.S.C. 2000d–4a</external-xref>).</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H109863701932405A87E99E2B7A3B8C14" section-type="subsequent-section"><enum>9.</enum><header display-inline="yes-display-inline">Collection of data on paid sick time and
			 further study</header>
			<subsection commented="no" display-inline="no-display-inline" id="H242DBED7AAE14E7BAA892C1D03588C3A"><enum>(a)</enum><header display-inline="yes-display-inline">Compilation of information</header><text display-inline="yes-display-inline">Effective 90 days after the date of
			 enactment of this Act, the Commissioner of Labor Statistics shall annually
			 compile information on the following:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H80F64A105AED4F8BAFBBD43ED739ABC8"><enum>(1)</enum><text display-inline="yes-display-inline">The number of employees who used paid sick
			 time.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF21BDE98B67547BCBAD4A7239CE09E13"><enum>(2)</enum><text display-inline="yes-display-inline">The number of hours of paid sick time
			 used.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H545992AD4D5540339D0E72FCDA2A9241"><enum>(3)</enum><text display-inline="yes-display-inline">The number of employees who used paid sick
			 time for absences necessary due to domestic violence, sexual assault, or
			 stalking.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB711CCCC60AD4913981BD4AE3BD66BF7"><enum>(4)</enum><text display-inline="yes-display-inline">The demographic characteristics of
			 employees who were eligible for and who used paid sick time.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HFB804903E92F482196ECA183381A9E81"><enum>(b)</enum><header display-inline="yes-display-inline">GAO study</header>
				<paragraph commented="no" display-inline="no-display-inline" id="HA508756E2C5A47B1B49F3CD695644791"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Comptroller General of the United
			 States shall annually conduct a study to determine the following:</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H2F5D0240B4944DCFBEFB52405E7D400D"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="H2D6DD30D9A6C410EBEFECA1F87B9059D"><enum>(i)</enum><text display-inline="yes-display-inline">The number of days employees used paid sick
			 time and the reasons for the use.</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="HFFACE212195448F9A36C54193DB24AF8" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">The number of employees who used the paid
			 sick time for periods of time covering more than 3 consecutive workdays.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDF62AC8648944B9C97EA8F7825E824A1"><enum>(B)</enum><text display-inline="yes-display-inline">The cost and benefits to employers of
			 implementing the paid sick time policies.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H18F2715EB8AE439E854F1B35A39E3924"><enum>(C)</enum><text display-inline="yes-display-inline">The cost to employees of providing
			 certification to obtain the paid sick time.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC595C3E3EFBA4E21A4348911987EB1D2"><enum>(D)</enum><text display-inline="yes-display-inline">The benefits of the paid sick time to
			 employees and their family members, including effects on employees' ability to
			 care for their family members or to provide for their own health needs.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB6C8331BB3084FD2A3C9BB0A6A1614F2"><enum>(E)</enum><text display-inline="yes-display-inline">Whether the paid sick time affected
			 employees' ability to sustain an adequate income while meeting needs of the
			 employees and their family members.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H06D58C0E409B48538A698BB6A9230030"><enum>(F)</enum><text display-inline="yes-display-inline">Whether employers who administered paid
			 sick time policies prior to the date of enactment of this Act were affected by
			 the provisions of this Act.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF1AB9B00692E419E916AB2976BEB6EE6"><enum>(G)</enum><text display-inline="yes-display-inline">Whether other types of leave were affected
			 by this Act.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC7966D6F9BDE492CB77CBA641061CA7F"><enum>(H)</enum><text display-inline="yes-display-inline">Whether paid sick time affected retention
			 and turnover and costs of presenteeism.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9A8C9849D78E42C2BA466F3B9968586B"><enum>(I)</enum><text display-inline="yes-display-inline">Whether the paid sick time increased the
			 use of less costly preventive medical care and lowered the use of emergency
			 room care.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H994C0D438B6E46FB9A6E01FE9190F040"><enum>(J)</enum><text display-inline="yes-display-inline">Whether the paid sick time reduced the
			 number of children sent to school when the children were sick.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF6B0028460F74C5D913ECD13B97907CF"><enum>(2)</enum><header display-inline="yes-display-inline">Disaggregating data</header><text display-inline="yes-display-inline">The data collected under subparagraphs (A)
			 and (D) of paragraph (1) shall be disaggregated by gender, race, disability,
			 earnings level, age, marital status, family type, including parental status,
			 and industry.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD8150D54344B4DE5B248439EB0EDAF0E"><enum>(3)</enum><header display-inline="yes-display-inline">Reports</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="H71974B1A660F420392CAE6A1A687CA5A"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 18 months after the date of
			 enactment of this Act, the Comptroller General of the United States shall
			 prepare and submit a report to the appropriate committees of Congress
			 concerning the results of the study conducted pursuant to paragraph (1) and the
			 data aggregated under paragraph (2).</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H97FEF8E9376641ACA228AB83A1ECC4FC"><enum>(B)</enum><header display-inline="yes-display-inline">Followup report</header><text display-inline="yes-display-inline">Not later than 5 years after the date of
			 enactment of this Act, the Comptroller General of the United States shall
			 prepare and submit a followup report to the appropriate committees of Congress
			 concerning the results of the study conducted pursuant to paragraph (1) and the
			 data aggregated under paragraph (2).</text>
					</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H1F58D439929742DD831751898EAD61E0" section-type="subsequent-section"><enum>10.</enum><header display-inline="yes-display-inline">Effect on other laws</header>
			<subsection commented="no" display-inline="no-display-inline" id="HB13FB4F8441143CCABF87D69E341D60B"><enum>(a)</enum><header display-inline="yes-display-inline">Federal and State antidiscrimination
			 laws</header><text display-inline="yes-display-inline">Nothing in this Act
			 shall be construed to modify or affect any Federal or State law prohibiting
			 discrimination on the basis of race, religion, color, national origin, sex,
			 age, disability, sexual orientation, gender identity, marital status, familial
			 status, or any other protected status.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H3DB3222655A44B1F93238B80D0559483"><enum>(b)</enum><header display-inline="yes-display-inline">State and local laws</header><text display-inline="yes-display-inline">Nothing in this Act shall be construed to
			 supersede (including preempting) any provision of any State or local law that
			 provides greater paid sick time or leave rights (including greater amounts of
			 paid sick time or leave, or greater coverage of those eligible for paid sick
			 time or leave) than the rights established under this Act.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="HDD80182B008C4EDFA48ACDA8B6AF414C" section-type="subsequent-section"><enum>11.</enum><header display-inline="yes-display-inline">Effect on existing employment
			 benefits</header>
			<subsection commented="no" display-inline="no-display-inline" id="H3F45D24C0C5B48D0B7FAAEC7B6EB8C91"><enum>(a)</enum><header display-inline="yes-display-inline">More protective</header><text display-inline="yes-display-inline">Nothing in this Act shall be construed to
			 diminish the obligation of an employer to comply with any contract, collective
			 bargaining agreement, or any employment benefit program or plan that provides
			 greater paid sick leave or other leave rights to employees or individuals than
			 the rights established under this Act.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HC4D42FECFE6842DE90FFC021CCD26261"><enum>(b)</enum><header display-inline="yes-display-inline">Less protective</header><text display-inline="yes-display-inline">The rights established for employees under
			 this Act shall not be diminished by any contract, collective bargaining
			 agreement, or any employment benefit program or plan.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="H684DF7097C014DF9A83D769C25986A1F" section-type="subsequent-section"><enum>12.</enum><header display-inline="yes-display-inline">Encouragement of more generous leave
			 policies</header><text display-inline="no-display-inline">Nothing in this Act
			 shall be construed to discourage employers from adopting or retaining leave
			 policies more generous than policies that comply with the requirements of this
			 Act.</text>
		</section><section commented="no" display-inline="no-display-inline" id="HAB80896A12FF4723A24040E0D38DC062" section-type="subsequent-section"><enum>13.</enum><header display-inline="yes-display-inline">Regulations</header>
			<subsection commented="no" display-inline="no-display-inline" id="H91F96E1E9211444CBEECB47F4A89F8F6"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H2AFD17EEB1E44B92921CAF89ACA998EE"><enum>(1)</enum><header display-inline="yes-display-inline">Authority</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), not
			 later than 180 days after the date of enactment of this Act, the Secretary
			 shall prescribe such regulations as are necessary to carry out this Act with
			 respect to employees described in subparagraph (A) or (B) of section 4(4) and
			 other individuals affected by employers described in subclause (I) or (II) of
			 section 4(5)(A)(i).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H78879E24611346ACAFD94058C3D10980"><enum>(2)</enum><header display-inline="yes-display-inline">Government Accountability Office; Library
			 of Congress</header><text display-inline="yes-display-inline">The Comptroller
			 General of the United States and the Librarian of Congress shall prescribe the
			 regulations with respect to employees of the Government Accountability Office
			 and the Library of Congress, respectively, and other individuals affected by
			 the Comptroller General of the United States and the Librarian of Congress,
			 respectively.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HD2E22776A57A4BB08625CFD1393439A8"><enum>(b)</enum><header display-inline="yes-display-inline">Employees covered by Congressional
			 Accountability Act of 1995</header>
				<paragraph commented="no" display-inline="no-display-inline" id="HA76244F68BC7415193BD16A305E8BADE"><enum>(1)</enum><header display-inline="yes-display-inline">Authority</header><text display-inline="yes-display-inline">Not later than 90 days after the Secretary
			 prescribes regulations under section 13(a), the Board of Directors of the
			 Office of Compliance shall prescribe (in accordance with section 304 of the
			 Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1384">2 U.S.C. 1384</external-xref>)) such regulations as
			 are necessary to carry out this Act with respect to employees described in
			 section 4(4)(C) and other individuals affected by employers described in
			 section 4(5)(A)(i)(III).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H654461B488104C9E969E10CFFA50EC1E"><enum>(2)</enum><header display-inline="yes-display-inline">Agency regulations</header><text display-inline="yes-display-inline">The regulations prescribed under paragraph
			 (1) shall be the same as substantive regulations promulgated by the Secretary
			 to carry out this Act except insofar as the Board may determine, for good cause
			 shown and stated together with the regulations prescribed under paragraph (1),
			 that a modification of such regulations would be more effective for the
			 implementation of the rights and protections involved under this
			 section.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HD78196BE8CB54BE09DCE526D43885018"><enum>(c)</enum><header display-inline="yes-display-inline">Employees covered by chapter
			 <enum-in-header>5</enum-in-header> of title <enum-in-header>3</enum-in-header>,
			 United States Code</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H44D5E4C2E0144E8CA4671B8C18313CD9"><enum>(1)</enum><header display-inline="yes-display-inline">Authority</header><text display-inline="yes-display-inline">Not later than 90 days after the Secretary
			 prescribes regulations under section 13(a), the President (or the designee of
			 the President) shall prescribe such regulations as are necessary to carry out
			 this Act with respect to employees described in section 4(4)(D) and other
			 individuals affected by employers described in section 4(5)(A)(i)(IV).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H40D20397313447E0A87FBD02E942E1D9"><enum>(2)</enum><header display-inline="yes-display-inline">Agency regulations</header><text display-inline="yes-display-inline">The regulations prescribed under paragraph
			 (1) shall be the same as substantive regulations promulgated by the Secretary
			 to carry out this Act except insofar as the President (or designee) may
			 determine, for good cause shown and stated together with the regulations
			 prescribed under paragraph (1), that a modification of such regulations would
			 be more effective for the implementation of the rights and protections involved
			 under this section.</text>

				<paragraph commented="no" display-inline="no-display-inline" id="H8E9A3105458D4F14B7F97CCE473DB83E"><enum>(1)</enum><header display-inline="yes-display-inline">Authority</header><text display-inline="yes-display-inline">Not later than 90 days after the Secretary
			 prescribes regulations under section 13(a), the Director of the Office of
			 Personnel Management shall prescribe such regulations as are necessary to carry
			 out this Act with respect to employees described in section 4(4)(E) and other
			 individuals affected by employers described in section 4(5)(A)(i)(V).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC7217D49A6D34A1B8CBA01CD04AADA7D"><enum>(2)</enum><header display-inline="yes-display-inline">Agency regulations</header><text display-inline="yes-display-inline">The regulations prescribed under paragraph
			 (1) shall be the same as substantive regulations promulgated by the Secretary
			 to carry out this Act except insofar as the Director may determine, for good
			 cause shown and stated together with the regulations prescribed under paragraph
			 (1), that a modification of such regulations would be more effective for the
			 implementation of the rights and protections involved under this
			 section.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HBA22F03F613F4862930C4844B1B045DA" section-type="subsequent-section"><enum>14.</enum><header display-inline="yes-display-inline">Effective dates</header>
			<subsection commented="no" display-inline="no-display-inline" id="HBCDD19FC6E6C40DDB9B117EC9F71C02E"><enum>(a)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">This Act shall take
			 effect 6 months after the date of issuance of regulations under section
			 13(a)(1).</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H1B1888086C754DDBBBADD12D9B0F0106"><enum>(b)</enum><header display-inline="yes-display-inline">Collective bargaining
			 agreements</header><text display-inline="yes-display-inline">In the case of a
			 collective bargaining agreement in effect on the effective date prescribed by
			 subsection (a), this Act shall take effect on the earlier of—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H496E24207DD4426C8D866D26820B6EBA"><enum>(1)</enum><text display-inline="yes-display-inline">the date of the termination of such
			 agreement; or</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB5654F8BF4A44AE796736C6D3C354C8E"><enum>(2)</enum><text display-inline="yes-display-inline">the date that occurs 18 months after the
			 date of issuance of regulations under section 13(a)(1).</text>
