		<official-title>To amend the Trademark Act of 1946 regarding the
		  disparagement of Native American persons or peoples through marks that use the
		  term <quote>redskin</quote>, and for other purposes.</official-title>

		<section id="HAA582E1DD65148A98360DA534306C2C1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Non-Disparagement of Native American
			 Persons or Peoples in Trademark Registration Act of
			 2013</short-title></quote>.</text>
		</section><section id="HF5269D44D448457988B1E07ABF84E719" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="H3C337637A67C441DBC0544E174D0D837"><enum>(1)</enum><text>The use of the
			 terms <quote>redskin</quote> and <quote>redskins</quote> in trademarks is
			 widely understood to refer to or imply a negative reference to Native American
			 persons or peoples, or both.</text>
			</paragraph><paragraph id="H048828CBE6BC4708992DAA9AAAE644C3"><enum>(2)</enum><text>The term
			 <quote>redskin</quote> has been demonstrated by overwhelming linguistic and
			 historical evidence to constitute a disparaging epithet insulting to Native
			 American persons or peoples, or both.</text>
			</paragraph><paragraph id="H8F080A6F891A4A26B794C18BF77F7C29"><enum>(3)</enum><text display-inline="yes-display-inline">Major Native American organizations,
			 including the National Congress of American Indians, the National Indian
			 Education Association, the Native American Journalists Association, the Native
			 American Rights Fund, the Morning Star Institute, the International Indian
			 Treaty Council, and the National Indian Youth Council, have opposed the
			 continued use of the term <quote>redskin</quote> in trademarks or as the name
			 of sports teams.</text>
			</paragraph><paragraph id="HADB0DDA4F7E04A8B85B4FE93E42457FB"><enum>(4)</enum><text>Recent
			 psychological evidence has demonstrated the general negative effects associated
			 with references in sports to Native American people.</text>
			</paragraph><paragraph id="H89E14501EFE54F6399393996029A5BDE"><enum>(5)</enum><text display-inline="yes-display-inline">Trademarks containing the term
			 <quote>redskin</quote>, or any derivation of the term, should not continue to
			 enjoy the benefits of Federal registration.</text>
			</paragraph></section><section id="H80229E5E3BB24984A61EE43134490766"><enum>3.</enum><header>References to
			 Trademark Act of 1946</header><text display-inline="no-display-inline">In this
			 Act, the term <quote>Trademark Act of 1946</quote> means the Act entitled
			 <quote>An Act to provide for the registration and protection of trademarks used
			 in commerce, to carry out the provisions of certain international conventions,
			 and for other purposes</quote>, approved July 5, 1946 (commonly referred to as
			 the <quote>Lanham Act</quote>; <external-xref legal-doc="usc" parsable-cite="usc/15/1051">15 U.S.C. 1051 et seq.</external-xref>).</text>
		</section><section id="HEB914AA1529246F0A0132577B32CFA7E"><enum>4.</enum><header>Registration of
			 marks containing certain terms</header><text display-inline="no-display-inline">Section 2(a) of the Trademark Act of 1946
			 (<external-xref legal-doc="usc" parsable-cite="usc/15/1052">15 U.S.C. 1052(a)</external-xref>) is amended by adding at the end the following: <quote>A
			 mark consisting of or including the term <quote>redskin</quote> or any
			 derivation of the term <quote>redskin</quote> shall be conclusively presumed to
			 consist of matter which may disparage persons if (1) the mark has been, is, or
			 is intended to be used in commerce in connection with references to or images
			 of one or more Native American persons or peoples, or to Native American
			 persons or peoples in general; or (2) the Director determines that the term as
			 included in the mark is commonly understood to refer to one or more Native
			 Americans persons or peoples, or to Native American persons or peoples in
			 general.</quote>.</text>
		</section><section id="H9F95EB8B944842CA8A884B500986E876"><enum>5.</enum><header>Cancellation of
			 marks</header><text display-inline="no-display-inline">Section 14 of the
			 Trademark Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/15/1064">15 U.S.C. 1064</external-xref>) is amended—</text>
			<paragraph id="HB5F238DAA7E84D64877D412D75699026"><enum>(1)</enum><text>in the text before
			 paragraph (1), by striking <quote>A petition to cancel</quote> and inserting
			 <quote>(a) <header-in-text level="subsection" style="OLC">Petitions to
			 cancel.—</header-in-text>A petition to cancel</quote>; and</text>
			</paragraph><paragraph id="H01CAA75BDEDE43B389B16E017EC89030"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HB6F40B9680CD42F0B966637537BE5040" style="USC">
					<subsection commented="no" id="H238EBB5C26EE4E8EB3A4D420A6017092"><enum>(b)</enum><header>Cancellation of
				marks containing certain terms</header>
						<paragraph commented="no" id="HDFED758A31514B208EDE4D6E2A81C465"><enum>(1)</enum><header>In
				general</header><text>Notwithstanding any other provision of this Act, the
				Director shall cancel a registration of a mark containing the term
				<quote>redskin</quote> or any derivation of the term <quote>redskin</quote>
				if—</text>
							<subparagraph commented="no" id="HAD5A68E4A7E447D58E55D0CB89ABA6C3"><enum>(A)</enum><text display-inline="yes-display-inline">the mark has been or is used in commerce in
				connection with references to or images of one or more Native American persons
				or peoples, or to Native American persons or peoples in general; or</text>
							</subparagraph><subparagraph commented="no" id="H889AC5D99165480592422E0BBC941901"><enum>(B)</enum><text display-inline="yes-display-inline">the Director determines that the term as
				included in the mark is commonly understood to refer to one or more Native
				American persons or peoples, or to Native American persons or peoples in
				general.</text>
							</subparagraph></paragraph><paragraph commented="no" id="H6AEBB9BD5A1448AB89C37B786D5E5698"><enum>(2)</enum><header>Renewal</header><text>A
				registration cancelled under paragraph (1) shall not be subject to renewal
				pursuant to section 9 of this
				Act.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section commented="no" id="H1100B701A43B48128E2F78CD6EC8F73F"><enum>6.</enum><header>Conforming
			 amendments</header>
			<subsection id="H8BB6056167074295996869F1A690337F"><enum>(a)</enum><header>Cancellation due
			 To blurring or dilution by tarnishment</header><text display-inline="yes-display-inline">Section 2(f) of the Trademark Act of 1946
			 (<external-xref legal-doc="usc" parsable-cite="usc/15/1052">15 U.S.C. 1052(f)</external-xref>) is amended in the final sentence by striking <quote>section
			 14</quote> and inserting <quote>section 14(a)</quote>.</text>
			</subsection><subsection id="H7CCC3F204BFA4B9B95BC51D67DC5FD4A"><enum>(b)</enum><header>Exception to
			 incontestability</header><text display-inline="yes-display-inline">Section 15
			 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1065">15 U.S.C. 1065</external-xref>) is amended in the text before paragraph (1) by
			 striking <quote>section 14 of this Act,</quote> and inserting <quote>section
			 14(a) of this Act or for which a registration is required to be cancelled under
			 section 14(b) of this Act,</quote>.</text>
			</subsection></section><section id="H6517E662936E433CADD4CE070FD92A53"><enum>7.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">This Act shall take
			 effect on the date of the enactment of this Act and shall apply to—</text>
			<paragraph id="H2440C2332CD743D1B62A0A194EE88905"><enum>(1)</enum><text>any mark that is
			 registered under the Trademark Act of 1946 before, on, or after such date;
			 and</text>
			</paragraph><paragraph id="HD19D3D98A387414A9D31D936A89D82EF"><enum>(2)</enum><text>any application to
			 register a mark under that Act that is pending on, or filed on or after, such
			 date.</text>
