		<official-title>To amend title III of the Social Security Act to require
		  States to implement a drug testing program for applicants for and recipients of
		  unemployment compensation.</official-title>

		<section id="H7B6D464131494CBEAB40918B42B579AF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Accountability in Unemployment Act of
			 2013</short-title></quote>.</text>
		</section><section id="H495BA0B04E86491AA5B30D1991AA22F9" section-type="subsequent-section"><enum>2.</enum><header>Drug testing program
			 for applicants for and recipients of unemployment compensation</header>
			<subsection id="HAA04B33DB41D4C82AFE193F6FD777F12"><enum>(a)</enum><header>In
			 general</header><text>Section 303(l) of the Social Security Act (42 U.S.C.
			 503)(l)) is amended to read as follows:</text>
				<quoted-block act-name="" id="H5133A1C332BB4409B419E6BBF0C4A47B" style="OLC">
					<subsection id="HFEE2157CF02E4428B281C3A90EAC6E40"><enum>(l)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HF538A27C078B4BCBBA4D20E445B6B639"><enum>(1)</enum><text>For purposes of
				subsection (a), the law of a State shall provide that no regular compensation
				may be paid to an individual unless—</text>
							<subparagraph id="H7F2F421D9F634E449C5D87438F5BE3D9" indent="up1"><enum>(A)</enum><text>the individual is tested for the use
				of the drugs listed in paragraph (3)(A)—</text>
								<clause id="H9D64767C684A4E789815090D79D0C160"><enum>(i)</enum><text>if the individual has applied for
				such compensation and the application has not been approved, before the receipt
				of such compensation; and</text>
								</clause><clause id="H22CFEE7FA672448EA4AEC7CA9093BF84"><enum>(ii)</enum><text>in any other case, before the end
				of the 3-month period that begins on the date of the enactment of this
				subsection; and</text>
								</clause></subparagraph><subparagraph id="H233197C819904C31A4A8EA4C4E754224" indent="up1"><enum>(B)</enum><text>the individual tests negative for the
				use of such drugs or, in the case of an individual who tests positive for the
				use of such drugs, the individual meets the requirements of paragraph
				(2).</text>
							</subparagraph></paragraph><paragraph id="HD923AECC71244EB0AF0E7277C57A88C5" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H347F52DAFFC048069E0471DA9D063F21"><enum>(A)</enum><text>Except as provided in
				subparagraph (B), if an individual tests positive pursuant to paragraph (1) for
				the use of any drug listed in paragraph (3)(A), no regular compensation may be
				paid to the individual unless—</text>
								<clause id="H3DE8430917134C5FA82C36260F99C92D" indent="up1"><enum>(i)</enum><text>a 30-day period has elapsed since the
				results of the test were determined; and</text>
								</clause><clause id="H4A08E00B147E49508A1F050A9558FE9E" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">the individual tests negative for the use
				of each drug listed in paragraph (3)(A) at the end of such period.</text>
								</clause></subparagraph><subparagraph id="H939EDEA5DBC74DDBAD07236CC7D6D788" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">If an individual tests positive pursuant to
				paragraph (1) for the use of any drug listed in paragraph (3)(A) three or more
				times (whether for the same or a different drug), no regular compensation may
				be paid to the individual unless—</text>
								<clause id="H5215CFB7A473430FB64AD30B266F730D"><enum>(i)</enum><text>a 5-year period has elapsed since the
				results of the last test were determined; and</text>
								</clause><clause id="H95440A5348A843DEA847FEBDEAE168E3"><enum>(ii)</enum><text display-inline="yes-display-inline">the individual tests negative for the use
				of each drug listed in paragraph (3)(A) at the end of such period.</text>
								</clause></subparagraph></paragraph><paragraph id="H7BA46F2E08B24804B21B73B0C27E4544" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H1B285D5E19F74C109FF57FFFD924EFD9"><enum>(A)</enum><text>In conducting drug
				testing pursuant to paragraph (1), the State shall test for each of the
				following:</text>
								<clause id="HC4B121D3394F4B3EADC334826D7EA322" indent="up1"><enum>(i)</enum><text>Marijuana.</text>
								</clause><clause id="H4203085A261F4BAA9EEB63AE9D497828" indent="up1"><enum>(ii)</enum><text>Cocaine.</text>
								</clause><clause id="HAC165803445F4E2684CCA6C17AACAB7F" indent="up1"><enum>(iii)</enum><text>Opiates.</text>
								</clause><clause id="H0E3D3D3313B045E5A6C7E97BE11B1270" indent="up1"><enum>(iv)</enum><text>Amphetamines.</text>
								</clause><clause id="HDD7187B61B114FE3983FD20D5526FF19" indent="up1"><enum>(v)</enum><text>Methamphetamine.</text>
								</clause><clause id="HBAEE49B7A6C84E1A87D9B5F7662ACB1D" indent="up1"><enum>(vi)</enum><text>Phencyclidine.</text>
								</clause><clause id="H359547C5C98B49B78110D128A2952B56" indent="up1"><enum>(vii)</enum><text>Heroin.</text>
								</clause><clause id="H56A44231B9C34C758D96E5F025EBD379" indent="up1"><enum>(viii)</enum><text>Lysergic acid diethyliamide.</text>
								</clause><clause id="HF33C85B8936744DEB8AA65CEEB66C19A" indent="up1"><enum>(ix)</enum><text>3,4-methylenedioxy
				amphetamine.</text>
								</clause></subparagraph><subparagraph id="H4254CA79E8014BC693F69AD203F7F614" indent="up1"><enum>(B)</enum><text>A positive test for a drug listed in
				subparagraph (A) shall be treated as a negative test for purposes of this
				subsection if such drug was used pursuant to a valid prescription or as
				otherwise authorized by law.</text>
							</subparagraph></paragraph><paragraph id="HE3E450AB5D1C4BEBB02EB250946A70D8" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">The State shall require each individual who
				is tested pursuant to paragraph (1) to pay the portion of the cost of the drug
				testing that pertains to such individual. If such individual tests negative for
				the use of each drug listed in paragraph (3)(A) and the State provides regular
				compensation to the individual, the State shall increase the first payment of
				such compensation in an amount equal to the amount paid by the individual under
				this paragraph for the drug testing.</text>
						</paragraph><paragraph id="H384DA9D38B8B43EDA306520A0F28A675" indent="up1"><enum>(5)</enum><text>In this subsection, the term
				<quote>regular compensation</quote> has the meaning given such term in section
				205 of the Federal-State Extended Unemployment Compensation Act of 1970 (26
				U.S.C. 3304
				note).</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H7EEC703A8CBD46EA82599EEC57919FC3"><enum>(b)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 this section shall take effect 1 year after the date of the enactment of this
			 Act.</text>
