		<section id="H4F46BC4D0E45478BA431123BD15C67CD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Electronic Message Preservation
			 Act</short-title></quote>.</text>
		</section><section id="H531AD0577BDF4A8BBA95701574E8418B"><enum>2.</enum><header>Records
			 management</header>
			<subsection id="H5C9C5ED4C6024209A9A848B140AE7B6A"><enum>(a)</enum><header>Requirement for
			 Preservation of Electronic Messages</header>
				<paragraph id="HCDE486CE05824500B27133A26302567B"><enum>(1)</enum><header>In
			 general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/29">Chapter 29</external-xref> of title 44, United States Code, is amended by
			 adding at the end the following new section:</text>
					<quoted-block id="HFBFC9F402127415AAE09F4433123A281" style="USC">
						<section id="HDAA5EC66D08E46D38B2FF0E1F7D830AF"><enum>2911.</enum><header>Preservation
				of electronic messages and other records</header>
							<subsection id="H7ACAD6DD2CA94CAF978433D0FE22954C"><enum>(a)</enum><header>Regulations
				Required</header><text display-inline="yes-display-inline">Not later than 18
				months after the date of the enactment of this section, the Archivist shall
				promulgate regulations governing Federal agency preservation of electronic
				messages that are determined to be records (as such term is defined under
				section 3301 of this title). Such regulations shall, at a minimum—</text>
								<paragraph id="HD67DB57FAA1E46E1B2520E639519689D"><enum>(1)</enum><text>require the
				electronic capture, management, and preservation of such electronic records in
				accordance with the records disposition requirements of chapter 33 of this
				title;</text>
								</paragraph><paragraph id="HD144F23C850340A3AFE22495E0ED8024"><enum>(2)</enum><text>require that such
				electronic records are readily accessible for retrieval through electronic
				searches;</text>
								</paragraph><paragraph id="H0731953F3A894085B3ABD7254247D46D"><enum>(3)</enum><text>establish
				mandatory minimum functional requirements for electronic records management
				systems to ensure compliance with the requirements in paragraphs (1) and
				(2);</text>
								</paragraph><paragraph id="H544B8C01F41642B1B25B8A3569C99784"><enum>(4)</enum><text>establish a
				process to certify that Federal agencies’ electronic records management systems
				meet the functional requirements established under paragraph (3); and</text>
								</paragraph><paragraph id="HFE2FA8FAFE5B4ED8BBB3346EA91213A0"><enum>(5)</enum><text>include timelines
				for Federal agency compliance with the regulations that ensure compliance as
				expeditiously as practicable but not later than four years after the date of
				the enactment of this section.</text>
								</paragraph></subsection><subsection id="H3400854C003F47128DB682F949AEF6F6"><enum>(b)</enum><header>Coverage of
				Other Electronic Records</header><text>To the extent practicable, the
				regulations promulgated under subsection (a) shall also include requirements
				for the capture, management, and preservation of other electronic
				records.</text>
							</subsection><subsection id="H0F1FC55287BF47E9B6892A70FD844371"><enum>(c)</enum><header>Compliance by
				Federal Agencies</header><text>Each Federal agency shall comply with the
				regulations promulgated under subsection (a).</text>
							</subsection><subsection id="H6406960A1A1E484DBA1DFB7F22930E11"><enum>(d)</enum><header>Review of
				Regulations Required</header><text>The Archivist shall periodically review and,
				as necessary, amend the regulations promulgated under subsection (a).</text>
							</subsection><subsection id="HCFED178DDEF1412CB6B23265812B3EFD"><enum>(e)</enum><header>Reports on
				Implementation of Regulations</header>
								<paragraph id="H2F550105058F4BABB3D7574B4184A16F"><enum>(1)</enum><header>Agency report to
				archivist</header><text>Not later than four years after the date of the
				enactment of this section, the head of each Federal agency shall submit to the
				Archivist a report on the agency’s compliance with the regulations promulgated
				under this section.</text>
								</paragraph><paragraph id="H9F85013B50AF40FB95001B65B334AD0E"><enum>(2)</enum><header>Archivist report
				to congress</header><text>Not later than 90 days after receipt of all reports
				required by paragraph (1), the Archivist shall submit to the Committee on
				Homeland Security and Governmental Affairs of the Senate and the Committee on
				Oversight and Government Reform of the House of Representatives a report on
				Federal agency compliance with the regulations promulgated under subsection
				(a).</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H8B94399C99494041AF71A45D4079467D"><enum>(2)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The table of
			 sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/29">chapter 29</external-xref> of title 44, United States Code, is
			 amended by adding after the item relating to section 2910 the following new
			 item:</text>

			 as amended by subsection (a)(1), is further amended by adding at the end the
			 following new section:</text>

							<subsection display-inline="no-display-inline" id="H09F86ACAEF6846CC939D25B2D68F9A90"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">An officer or
				employee of an executive agency may not create or send a record using a
				non-official electronic messaging account unless such officer or
				employee—</text>
								<paragraph id="H5A45DA7BB97B44CB9D1BF3AEAB8B2E07"><enum>(1)</enum><text display-inline="yes-display-inline">copies an official electronic messaging
				account of the officer or employee in the original creation or transmission of
				the record; or</text>
								</paragraph><paragraph id="H082F496107B64E5BAADBAC992DABD414"><enum>(2)</enum><text>forwards a complete copy
				of the record to an official electronic messaging account of the officer or
				employee within five days after the original creation or transmission of the
				record.</text>
								</paragraph></subsection><subsection id="H003C18F392F4429DBB55D8F90D3AD95D"><enum>(b)</enum><header>Adverse
				Actions</header><text display-inline="yes-display-inline">The intentional
				violation of subsection (a) (including any rules, regulations, or other
				implementing guidelines), as determined by the appropriate supervisor, shall be
				a basis for disciplinary action in accordance with subchapter I, II, or V of
				<external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/75">chapter 75</external-xref> of title 5, as the case may be.</text>
							</subsection><subsection id="H9CB453D2BFD84583923735D752722342"><enum>(c)</enum><header>Definitions</header><text>In
				this section:</text>
								<paragraph id="H2E61ED39A26B4A71A62E231394454EFA"><enum>(1)</enum><header>Electronic
				messages</header><text>The term <quote>electronic messages</quote> has the
				meaning given that term in section 2901.</text>
								</paragraph><paragraph id="H7946831C7F20423580F921786C5DD5F7"><enum>(2)</enum><header>Electronic messaging
				account</header><text display-inline="yes-display-inline">The term
				<quote>electronic messaging account</quote> means any account that sends
				electronic messages.</text>
								</paragraph><paragraph id="H485AFEC4E1E24EDF9AF347D415D72A0C"><enum>(3)</enum><header>Executive
				agency</header><text>The term <quote>executive agency</quote> has the meaning
				given that term in <external-xref legal-doc="usc" parsable-cite="usc/5/105">section 105</external-xref> of title 5.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H72B446BD86C34581B946FF6121B3D1A5"><enum>(2)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The table of

			 amended by subsection (a)(2), is further amended by adding at the end the

			 (c)</added-phrase></enum><header>Definitions</header><text>Section 2901 of
			 title 44, United States Code, is amended—</text>
				<paragraph id="H24BED00C70B54B45B754083FFB0EA0EE"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (14); and</text>
				</paragraph><paragraph id="H13B1E805090147A59B6CFBA1891B28F7"><enum>(2)</enum><text>by striking
			 paragraph (15) and inserting the following new paragraphs:</text>
					<quoted-block id="H32E6E3C2367A4E5B962DE536CF4FB353" style="OLC">

				<term>electronic messages</term> means electronic mail and other electronic
				messaging systems that are used for purposes of communicating between

				<term>electronic records management system</term> means software designed to
				manage electronic records, including by—</text>
							<subparagraph id="H5ACAC50C15BC4F68970EF5168718C95F"><enum>(A)</enum><text>categorizing and
				locating records;</text>
							</subparagraph><subparagraph id="HB46D1BFA46CB457FBD3E34A5D600FFA0"><enum>(B)</enum><text>ensuring that
				records are retained as long as necessary;</text>
							</subparagraph><subparagraph id="H475F87513D1A48CDB797E3C0DD677ACA"><enum>(C)</enum><text>identifying
				records that are due for disposition; and</text>
							</subparagraph><subparagraph id="HF197F233626F4833AF3B8624EA99DC97"><enum>(D)</enum><text>ensuring the
				storage, retrieval, and disposition of
				records.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="H8EE2892A84F849CFAD8755CB569B9BD0"><enum>3.</enum><header>Presidential
			 records</header>
			<subsection display-inline="no-display-inline" id="H2D7FCFC50FC84CCEA1A9EBD47D492090"><enum>(a)</enum><header>Additional
			 Regulations Relating to Presidential Records</header>
				<paragraph id="H397E067A293141C882FB2F934410A0A9"><enum>(1)</enum><header>In
			 general</header><text><external-xref legal-doc="usc" parsable-cite="usc/44/2206">Section 2206</external-xref> of title 44, United States Code, is
			 amended—</text>
					<subparagraph id="H9E0ABC3C8E6642C486E813D4524535C1"><enum>(A)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (3);</text>
					</subparagraph><subparagraph id="H256E3F6C30804A8786403F3513666B30"><enum>(B)</enum><text>by striking the
			 period at the end of paragraph (4) and inserting <quote>; and</quote>;
			 and</text>

				controls necessary for the capture, management, and preservation of electronic
				messages;</text>
								</subparagraph><subparagraph id="H7FE07B94E4DF4B338B8030DDE0E5F418"><enum>(B)</enum><text>records management
				controls necessary to ensure that electronic messages are readily accessible
				for retrieval through electronic searches; and</text>
								</subparagraph><subparagraph id="HFE8A7D9921124D32B49BA4DD2FD6A3E1"><enum>(C)</enum><text>a process to
				certify the electronic records management system to be used by the President
				for the purposes of complying with the requirements in subparagraphs (A) and
				(B).</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H2E259DC919DD4C48A977573579791086"><enum>(2)</enum><header>Definitions</header><text>Section
			 2201 of title 44, United States Code, is amended by adding at the end the
			 following new paragraphs:</text>

			 required</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/22">Chapter 22</external-xref> of title 44, United States Code, is amended
			 by adding at the end the following new section:</text>

				of the President’s management of Presidential records</header>

				Certification</header><text>The Archivist shall annually certify whether the
				electronic records management controls established by the President meet
				requirements under sections 2203(a) and 2206(5) of this title.</text>
							</subsection><subsection id="HA4FB48D7EF1C4D8DAF2F428E618F3085"><enum>(b)</enum><header>Report to
				Congress</header><text>The Archivist shall report annually to the Committee on
				Homeland Security and Governmental Affairs of the Senate and the Committee on
				Oversight and Government Reform of the House of Representatives on the status
				of the
				certification.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H354926E155C649F5A699BC9BC8B56980"><enum>(2)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The table of

			 Congress</header><text display-inline="yes-display-inline">Section 2203(f) of
			 title 44, United States Code, is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H513C04D40C984137BDDA4EFFE275EDCE" style="USC">
					<paragraph id="HF6EE165F455A4B5C8250AE0E98E38241" indent="up1"><enum>(4)</enum><text>One year following the conclusion of
				a President’s term of office, or if a President serves consecutive terms one
				year following the conclusion of the last term, the Archivist shall submit to
				the Committee on Homeland Security and Governmental Affairs of the Senate and
				the Committee on Oversight and Government Reform of the House of
				Representatives a report on—</text>
						<subparagraph id="H13FBE9CE311E47C18DC97AA070592951"><enum>(A)</enum><text>the volume and format of electronic
				Presidential records deposited into that President’s Presidential archival
				depository; and</text>
						</subparagraph><subparagraph id="H9B78219D221141D2A8BA6C7577E99F06"><enum>(B)</enum><text>whether the electronic records
				management controls of that President met the requirements under sections
				2203(a) and 2206(5) of this
				title.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="HB2466390E5D9445FAB4747978CA8DB70"><enum>(d)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 <deleted-phrase committee-id="HGO00" reported-display-style="strikethrough">this
			 section</deleted-phrase><added-phrase committee-id="HGO00" reported-display-style="italic">subsections (a), (b), and (c)</added-phrase>
			 shall take effect one year after the date of the enactment of this Act.</text>
			</subsection><subsection changed="added" committee-id="HGO00" id="HDBFD288B8E5A44EAA67C45134AD9FFB0" reported-display-style="italic"><enum>(e)</enum><header>Disclosure requirement
			 for official business conducted using non-official electronic messaging
			 account</header>
				<paragraph id="HAB253379EE1A4223B91C857E721A932C"><enum>(1)</enum><header>Amendment</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/22">Chapter 22</external-xref> of title 44, United States Code,
			 as amended by subsection (b)(1), is further amended by adding at the end the
			 following new section:</text>

				transmission of the Presidential record.</text>
								</paragraph></subsection><subsection id="HA26600C173D2454096BD39677BDE34C8"><enum>(b)</enum><header>Adverse
				actions</header><text display-inline="yes-display-inline">The intentional
