		<legis-type>A BILL</legis-type>
		<official-title>To amend the Immigration and Nationality Act to authorize
		  certain aliens who have earned a Ph.D. degree from a United States institution
		  of higher education in a field of science, technology, engineering, or
		  mathematics to be admitted for permanent residence and to be exempted from the
		  numerical limitations on H–1B nonimmigrants.</official-title>

		<section id="H36F9B050593448C9BA01C04053B0FEC3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Stopping Trained in America Ph.D.s
			 From Leaving the Economy Act of 2013</short-title></quote> or the
			 <quote><short-title>STAPLE
			 Act</short-title></quote>.</text>
		</section><section id="H6BDDCE1B7DD64A628DE03B272DA67F9C" section-type="subsequent-section"><enum>2.</enum><header>Exemption from
			 numerical limitations on permanent residents for certain United States educated
			 immigrants</header>
			<subsection id="H4CC48595D7B645A6A45DB01089D95393"><enum>(a)</enum><header>Aliens not
			 subject to direct numerical limitations</header><text>Section 201(b)(1) of the
			 Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151(b)(1)</external-xref>) is amended by adding at
			 the end the following:</text>
				<quoted-block id="H90E0E0C7A921477DBE92B697F452EB18" style="OLC">
					<subparagraph id="HE3EE6D518D18469DA485A8C94F749004"><enum>(F)</enum><text>Aliens who have
				earned a Ph.D. degree from a United States institution of higher education (as
				defined in section 101(a) of the Higher Education Act of 1965 (20 U.S.C.
				1001(a))) in a field of science, technology, engineering, or mathematics and
				who have an offer of employment from a United States employer in a field
				related to such
				degree.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H23BA060D192442BAB38F1FFC65413421"><enum>(b)</enum><header>Procedure for
			 granting immigrant status</header><text>Section 204(a)(1)(F) of the Immigration
			 and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154(a)(1)(F)</external-xref>) is amended—</text>
				<paragraph id="HF1577CDD733A46539E61E34C63D903CD"><enum>(1)</enum><text>by striking
			 <quote>or</quote> after <quote>203(b)(2),</quote>;</text>
				</paragraph><paragraph id="H5174B86FA3224AC7992C38E9988B000E"><enum>(2)</enum><text>by inserting
			 <quote>, or 201(b)(1)(F)</quote> after <quote>203(b)(3)</quote>; and</text>
				</paragraph><paragraph id="H5D57C0747239483F855948E9B2811E15"><enum>(3)</enum><text>by striking
			 <quote>Attorney General</quote> and inserting <quote>Secretary of Homeland
			 Security</quote>.</text>
				</paragraph></subsection></section><section id="H2B751673E0E84AD6B5AE1D665C88B4FA" section-type="subsequent-section"><enum>3.</enum><header>Exemption from H–1B
			 numerical limitation for certain United States educated
			 nonimmigrants</header><text display-inline="no-display-inline">Section
			 214(g)(5) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(g)(5)</external-xref>) is
			 amended—</text>
			<paragraph id="H1BDB4C1A35E8496AB4413CAD6ABD73F2"><enum>(1)</enum><text>in subparagraph
			 (B), by striking <quote>or</quote> at the end;</text>
			</paragraph><paragraph id="HD3CF448B8FD445C995B52782B728E8EE"><enum>(2)</enum><text>in subparagraph
			 (C), by striking the period at the end and inserting a semicolon; and</text>
			</paragraph><paragraph id="H396E7BA693E8426A9FFF0E0F378CEA0C"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H94917C4329514D3A9BD5C8EF90E33AA6" style="traditional">
					<subparagraph id="HB9663B3741F049FFB1089F6186C7A3DD" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">has earned a Ph.D. degree from a United
				States institution of higher education (as defined in section 101(a) of the
				Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>)) in a field of science,
				technology, engineering, or mathematics and with respect to whom the
				petitioning employer requires such education as a condition for the
				employment.</text>
