		<section display-inline="no-display-inline" id="HE2B2DA1F936E4B128BE28C94D6EFEC16" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Great Lakes Water Protection
			 Act</short-title></quote>.</text>
		</section><section id="H4D08E27ACD274CC1BDAF4CFFDA6FD1DA"><enum>2.</enum><header>Prohibition on
			 sewage dumping into the Great Lakes</header><text display-inline="no-display-inline">Section 402 of the Federal Water Pollution
			 Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1342">33 U.S.C. 1342</external-xref>) is amended by adding at the end the
			 following:</text>
			<quoted-block id="H84E0322788AB4647BB528DCC05AA6881">
				<subsection id="H9AA13769F79D483A9B01F5FF5A82F807"><enum>(s)</enum><header>Prohibition on
				sewage dumping into the Great Lakes</header>
					<paragraph id="HCA016362FC944E5AB2FA4B2CFEA114B4"><enum>(1)</enum><header>Definitions</header><text>In
				this subsection:</text>
						<subparagraph id="HB718C16741824C368407F8B769172EF8"><enum>(A)</enum><header>Bypass</header><text display-inline="yes-display-inline">The term <term>bypass</term> means an
				intentional diversion of waste streams to bypass any portion of a treatment
				facility which results in a discharge into the Great Lakes.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H80F33DF8F04D471EB34D9FF89A920F4A"><enum>(B)</enum><header>Discharge</header>
							<clause commented="no" display-inline="no-display-inline" id="H77D705F1EF9344008D4B30B7C8D850DD"><enum>(i)</enum><header>In
				general</header><text>The term <term>discharge</term> means a direct or
				indirect discharge of untreated sewage or partially treated sewage from a
				treatment works into the Great Lakes.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="HCF17635ED9684DDD9A0731CE48CA0BB8"><enum>(ii)</enum><header>Inclusions</header><text>The
				term <term>discharge</term> includes a bypass and a combined sewer
				overflow.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H61B47C949BF94CFB8C072F0681806739"><enum>(C)</enum><header>Great
				lakes</header><text>The term <term>Great Lakes</term> has the meaning given the
				term in section 118(a)(3).</text>
						</subparagraph><subparagraph id="H33627B7001224E08A701F79BC3CEEE99"><enum>(D)</enum><header>Partially
				treated sewage</header><text>The term <term>partially treated sewage</term>
				means any sewage, sewage and storm water, or sewage and wastewater, from
				domestic or industrial sources that—</text>
							<clause id="H338C9E87586C45AA9A76627005ED78F8"><enum>(i)</enum><text>is
				not treated to national secondary treatment standards for wastewater; or</text>
							</clause><clause id="H75B09B2039144CF9976BF9A3FC0361CD"><enum>(ii)</enum><text>is treated to a
				level less than the level required by the applicable national pollutant
				discharge elimination system permit.</text>
							</clause></subparagraph><subparagraph id="H1BCA921F20D9425FBD88ECBD3588A284"><enum>(E)</enum><header>Treatment
				facility</header><text display-inline="yes-display-inline">The term
				<term>treatment facility</term> includes all wastewater treatment units used by
				a publicly owned treatment works to meet secondary treatment standards or
				higher, as required to attain water quality standards, under any operating
				conditions.</text>
						</subparagraph><subparagraph id="H953A722E8E7947318B1298431354E6C7"><enum>(F)</enum><header>Treatment
				works</header><text>The term <term>treatment works</term> has the meaning given
				the term in section 212.</text>
						</subparagraph></paragraph><paragraph id="H6F78B95C7D3642198D1478C7863147FA"><enum>(2)</enum><header>Prohibition</header><text display-inline="yes-display-inline">A publicly owned treatment works is
				prohibited from performing a bypass unless—</text>
						<subparagraph id="H7B7A58F382684F6C86B4D61CF0960E12"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="H191F32F8F9B449BE88C53674C575EC35"><enum>(i)</enum><text>the bypass is
				unavoidable to prevent loss of life, personal injury, or severe property
				damage;</text>
							</clause><clause id="HF34A6C26A38A4FBBBB81208CEC17996B" indent="up1"><enum>(ii)</enum><text>there is not a feasible
				alternative to the bypass, such as the use of auxiliary treatment facilities,
				retention of untreated wastes, or maintenance during normal periods of
				equipment downtime; and</text>
							</clause><clause id="HB22A8765549E4E21AD334BE6EB11492F" indent="up1"><enum>(iii)</enum><text>the treatment works provides
				notice of the bypass in accordance with this subsection; or</text>
							</clause></subparagraph><subparagraph id="H963551CAC0B54F669894DA879EFF122C"><enum>(B)</enum><text>the bypass does
				not cause effluent limitations to be exceeded, and the bypass is for essential
				maintenance to ensure efficient operation of the treatment facility.</text>
						</subparagraph></paragraph><paragraph id="HBF3B6D9648D94C72842EDFAD23F10834"><enum>(3)</enum><header>Limitation</header><text>The
				requirement of paragraph (2)(A)(ii) is not satisfied if—</text>
						<subparagraph id="H503442C0A9B7402F8C5A1D94FDA0FB55"><enum>(A)</enum><text>adequate back-up
				equipment should have been installed in the exercise of reasonable engineering
				judgment to prevent the bypass; and</text>
						</subparagraph><subparagraph id="H255F911F1B134CADB258151A41FEE9BA"><enum>(B)</enum><text>the bypass
				occurred during normal periods of equipment downtime or preventive
				maintenance.</text>
						</subparagraph></paragraph><paragraph id="H0F73504BA564417D98C052883B22FFCA"><enum>(4)</enum><header>Immediate notice
				requirements</header>
						<subparagraph id="H0621E332D16442A0B741AC0FD94204FB"><enum>(A)</enum><header>In
				general</header><text>A publicly owned treatment works shall provide to the
				entities described in subparagraph (B)—</text>
							<clause id="H1B7F93BB722A4550A7DE49405A191ADC"><enum>(i)</enum><text>for any
				anticipated discharge, prior notice of that discharge; and</text>
							</clause><clause id="HED05B9CCD9064BC2954EF41D2C67D5A1"><enum>(ii)</enum><text>for any
				unanticipated discharge, as soon as practicable, but not later than—</text>
								<subclause id="H508720392AC648BAB39C0DAF3A10C2C2"><enum>(I)</enum><text>for a treatment
				works with an automated detection system, 2 hours after the discharge begins;
				and</text>
								</subclause><subclause id="HC50DC2E5C4DC4B5C927BA280C156A85A"><enum>(II)</enum><text>for a treatment
				works without an automated detection system, 12 hours after the discharge
				begins.</text>
								</subclause></clause></subparagraph><subparagraph id="H979664DB0B6943B2B69A559EB3D78BBC"><enum>(B)</enum><header>Notice</header><text>The
				entities referred to in subparagraph (A) are—</text>
							<clause id="HBD91345BD4534E3EA3EE4B8E799BDC7A"><enum>(i)</enum><text>the Administrator
				or, in the case of a State that has a permit program approved under this
				section, the State;</text>
							</clause><clause id="H3735F86CB0534E1386F79722DAF05AAC"><enum>(ii)</enum><text>each local health
				department or, if a local health department does not exist, the State health
				department;</text>
							</clause><clause id="H0C2A89FDD0864EC7B81474539B066896"><enum>(iii)</enum><text>the municipality
				in which the discharge occurred and each municipality with jurisdiction over
				waters that may be affected by the discharge;</text>
							</clause><clause id="H8E64BBB795064748BA9699B158122A7C"><enum>(iv)</enum><text>a
				daily newspaper of general circulation in each county in which a municipality
				described in clause (iii) is located; and</text>
							</clause><clause id="H00189C7970DB4986B541F95C275A25A9"><enum>(v)</enum><text>the general public
				through a prominent announcement on a publicly accessible Internet site of the
				treatment works.</text>
							</clause></subparagraph><subparagraph id="H0C6FDBF6E79E4C2B9306B33B2422BDEC"><enum>(C)</enum><header>Contents</header><text>The
				notice under subparagraph (A) shall include a description of—</text>
							<clause id="H849E26A0D34B4DD9884387C7A41DEEA6"><enum>(i)</enum><text>the volume and
				state of treatment of the discharge;</text>
							</clause><clause id="H9454DEB3A97343278DEBC5F8A05341F7"><enum>(ii)</enum><text>the date and time
				of the discharge;</text>
							</clause><clause id="H3876463D0E6C419DAA4037DDD9AD7AF5"><enum>(iii)</enum><text>the expected
				duration of the discharge;</text>
							</clause><clause id="HFCA81FEA087349AA92D00A74640032B7"><enum>(iv)</enum><text>the steps being
				taken to contain the discharge, except for a discharge that is a wet weather
				combined sewer overflow discharge;</text>
							</clause><clause id="H747048EBEC7946DEACD603525B7EA546"><enum>(v)</enum><text>the location of
				the discharge, with the maximum level of specificity practicable; and</text>
							</clause><clause id="HE925E458F85241AC997CBA3964E60ABE"><enum>(vi)</enum><text>the cause for the
				discharge.</text>
							</clause></subparagraph></paragraph><paragraph id="H270AB191B406468DBD2CAFC286BBBC40"><enum>(5)</enum><header>Follow-up notice
				requirements</header><text display-inline="yes-display-inline">Each publicly
				owned treatment works that provides notice under paragraph (4)(B) shall provide
				to the Administrator (or to the State in the case of a State that has a permit
				program approved under this section), not later than 5 days after the date on
				which the publicly owned treatment works provides initial notice, a follow-up
				notice containing—</text>
						<subparagraph id="HA6D3334B1D5C4B929A5E712C80754178"><enum>(A)</enum><text>a more full
				description of the cause of the discharge;</text>
						</subparagraph><subparagraph id="HEB4EDBB0545944ECBD7FC8D23556262C"><enum>(B)</enum><text display-inline="yes-display-inline">the reason for the discharge;</text>
						</subparagraph><subparagraph id="H3368354172454C5496EC8CCF30D91299"><enum>(C)</enum><text>the period of
				discharge, including the exact dates and times;</text>
						</subparagraph><subparagraph id="H3A2DC00F3B2347C5A814906E5532E1C6"><enum>(D)</enum><text display-inline="yes-display-inline">if the discharge has not been corrected,
				the anticipated time the discharge is expected to continue;</text>
						</subparagraph><subparagraph id="HFEA7DC0D866D41A882A2A2146D4AD579"><enum>(E)</enum><text display-inline="yes-display-inline">the volume of the discharge resulting from
				the bypass;</text>
						</subparagraph><subparagraph id="H78A7190EA7174465BAF7D1442594D339"><enum>(F)</enum><text display-inline="yes-display-inline">a description of any public access area
				that has or may be impacted by the bypass; and</text>
						</subparagraph><subparagraph id="HD4F7E8FAFCD54CF487AFEAD59A18AE68"><enum>(G)</enum><text>steps taken or
				planned to reduce, eliminate, and prevent reoccurrence of the discharge.</text>
						</subparagraph></paragraph><paragraph id="H6624A6B58A264AFCBDBC4E3B32DE2B5D"><enum>(6)</enum><header>Public
				availability of notices</header>
						<subparagraph id="H1BF6175137EB4C5A87BB4AB8071B3E3B"><enum>(A)</enum><header>In
				general</header><text>Not later than 48 hours after providing or receiving a
				follow-up notice under paragraph (5), as applicable, a publicly owned treatment
				works and the Administrator (or the State, in the case of a State that has a
				permit program approved under this section) shall each post the follow-up
				notice on a publicly accessible, searchable database on the Internet.</text>
						</subparagraph><subparagraph id="H84F8FB9F8C3F4CC283E91AD12CE3BCC8"><enum>(B)</enum><header>Annual
				publication</header><text>The Administrator (or the State, in the case of a
				State that has a permit program approved under this section) shall annually
				publish and make available to the public a list of each of the treatment works
				from which the Administrator or the State, as applicable, received a follow-up
				notice under paragraph (5).</text>
						</subparagraph></paragraph><paragraph id="H94050B62BA6A4D7DB2FC4976652E7DCE"><enum>(7)</enum><header>Sewage
				blending</header><text display-inline="yes-display-inline">Bypasses prohibited
				by this section include bypasses resulting in discharges from a publicly owned
				treatment works that consist of effluent routed around treatment units and
				thereafter blended together with effluent from treatment units prior to
				discharge.</text>
					</paragraph><paragraph id="HD828108980174B569836E39BF194F1B3"><enum>(8)</enum><header>Implementation</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
				enactment of this subsection, the Administrator shall establish procedures to
				ensure that permits issued under this section (or under a State permit program
				approved under this section) to a publicly owned treatment works include
				requirements to implement this subsection.</text>
					</paragraph><paragraph id="H4D11B50FFD014FB79AD4BC30803DDDFB"><enum>(9)</enum><header>Increase in
				maximum civil penalty for violations occurring after January 1,
				2033</header><text>Notwithstanding section 309, in the case of a violation of
				this subsection occurring on or after January 1, 2033, or any violation of a
				permit limitation or condition implementing this subsection occurring after
				that date, the maximum civil penalty that shall be assessed for the violation
				shall be $100,000 per day for each day the violation occurs.</text>
					</paragraph><paragraph id="H9111CBDD914F4478A7B291FE77E8BBF3"><enum>(10)</enum><header>Applicability</header><text>This
				subsection shall apply to a bypass occurring after the last day of the 1-year
				period beginning on the date of enactment of this
				subsection.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H512A91FD58244E0BB2323A9DE28CA54B"><enum>3.</enum><header>Establishment of
			 Great Lakes Cleanup Fund</header>
			<subsection id="H919025B4D48F46A1A24761010FF5DC23"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Title V of the
			 Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1361">33 U.S.C. 1361 et seq.</external-xref>) is amended—</text>
				<paragraph id="H48A7F3E960194A088BDFA9CA6ABF13CF"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating section 519 (33 U.S.C.
			 1251 note) as section 520; and</text>
				</paragraph><paragraph id="H7039CD3B66B84B25AC4AB1901B8712D8"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after section 518 (33 U.S.C.
			 1377) the following:</text>
					<quoted-block display-inline="no-display-inline" id="H5E86D1F465824292806124AE76842895" style="OLC">
						<section id="HA9088D40AC054E5FAB2AA3FCC4A3B81D"><enum>519.</enum><header>Establishment
				of Great Lakes Cleanup Fund</header>
							<subsection id="HA44195FDB347460D88AA4EFA29B04D67"><enum>(a)</enum><header>Definitions</header><text>In
				this section:</text>
								<paragraph id="HD0B06ADD8A2E42C9B283005C34D39527"><enum>(1)</enum><header>Fund</header><text>The
				term <term>Fund</term> means the Great Lakes Cleanup Fund established by
				subsection (b).</text>
								</paragraph><paragraph id="H6E57135D269D48378B1F449560BE9B71"><enum>(2)</enum><header>Great Lakes;
				Great Lakes States</header><text display-inline="yes-display-inline">The terms
				<term>Great Lakes</term> and <term>Great Lakes States</term> have the meanings
				given the terms in section 118(a)(3).</text>
								</paragraph></subsection><subsection id="HC6332FA108B441FCA83022E4A1D509D1"><enum>(b)</enum><header>Establishment of
				fund</header><text display-inline="yes-display-inline">There is established in
				the Treasury of the United States a trust fund to be known as the <quote>Great
				Lakes Cleanup Fund</quote> (referred to in this section as the
				<quote>Fund</quote>).</text>
							</subsection><subsection id="H8BED8FB0F36B46E9801A7193EDA78E1C"><enum>(c)</enum><header>Transfers to
				fund</header><text display-inline="yes-display-inline">Effective January 1,
				2033, there are authorized to be appropriated to the Fund amounts equivalent to
				the penalties collected for violations of section 402(s).</text>
							</subsection><subsection id="HED8BE31A2DBC41EC879540A3E4BAA0FC"><enum>(d)</enum><header>Administration
				of fund</header><text display-inline="yes-display-inline">The Administrator
				shall administer the Fund.</text>
							</subsection><subsection id="H15815FAB98174CF9AF514C61D7F7DE63"><enum>(e)</enum><header>Use of
				funds</header><text display-inline="yes-display-inline">The Administrator
				shall—</text>
								<paragraph id="HD9C34E61A44F48C28560C4B53C779F84"><enum>(1)</enum><text display-inline="yes-display-inline">make the amounts in the Fund available to
				the Great Lakes States for use in carrying out programs and activities for
				improving wastewater discharges into the Great Lakes, including habitat
				protection and wetland restoration; and</text>
								</paragraph><paragraph id="HA86DE7C339C94FAEA8FD78F27567B092"><enum>(2)</enum><text display-inline="yes-display-inline">allocate those amounts among the Great
				Lakes States based on the proportion that—</text>
									<subparagraph id="H529FADC85077444F8945BA2862D57768"><enum>(A)</enum><text display-inline="yes-display-inline">the amount attributable to a Great Lakes
				State for penalties collected for violations of section 402(s); bears to</text>
									</subparagraph><subparagraph id="H5CB3B3BD515241D18FBB33D8A14936D6"><enum>(B)</enum><text display-inline="yes-display-inline">the total amount of those penalties
				attributable to all Great Lakes States.</text>
									</subparagraph></paragraph></subsection><subsection id="H4A639EA05B174AFF8456B3FF5BE49840"><enum>(f)</enum><header>Priority</header><text>In
				selecting programs and activities to be funded using amounts made available
				under this section, a Great Lakes State shall give priority consideration to
				programs and activities that address violations of section 402(s) resulting in
				the collection of
				penalties.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HBC18F58AD90D4E98ACFCDA912F1DBFBA"><enum>(b)</enum><header>Conforming
			 amendment to State revolving fund program</header><text>Section 607 of the
			 Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1387">33 U.S.C. 1387</external-xref>) is amended—</text>
				<paragraph id="HEE6D57B1351F4E43A016E8EDA79B1B86"><enum>(1)</enum><text>by striking
			 <quote>There is</quote> and inserting <quote>(a)
			 <header-in-text level="subsection" style="OLC">In
			 general.—</header-in-text>There is</quote>; and</text>
				</paragraph><paragraph id="H68AFE77EFEC740E1B88B855F0337601C"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H21EE4CD79F864C1DBD7AD84003F24365" style="OLC">
						<subsection id="H13855223066541A59BC9562A57305E2C"><enum>(b)</enum><header>Treatment of
				Great Lakes Cleanup Fund</header><text>For purposes of this title, amounts made
				available from the Great Lakes Cleanup Fund under section 519 shall be treated
				as funds authorized to be appropriated to carry out this title and as funds
				made available under this title, except that the funds shall be made available
				to the Great Lakes States in accordance with section
				519.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section></legis-body>
