		<official-title>To amend title 31, United States Code, to provide for
		  lessened penalties for certain violations of the anti-structuring laws when
		  violations are with respect to certain domestic financial institutions and are
		  not taken in connection with another crime, and for other
		  purposes.</official-title>

		<section id="HAFE45ACE201E487F8308880957298F4E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Small Business Deposit Relief Act of
			 2013</short-title></quote>.</text>
		</section><section id="HDFE7F52B2C254FEB80D65C3702A3976C"><enum>2.</enum><header>Limitation on
			 penalties for certain structuring not involving another crime</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/31/5324">Section 5324</external-xref> of title 31, United States
			 Code, is amended—</text>
			<paragraph id="H89A8B45A24E049D596F635D954067583"><enum>(1)</enum><text>in subsection
			 (d)—</text>
				<subparagraph id="H0E9DD7E46E544A8AAD9D1BF635AFD686"><enum>(A)</enum><text>by redesignating
			 paragraph (2) as paragraph (3); and</text>
				</subparagraph><subparagraph id="HFFE43BE7FDD244A49D3450F70129790A"><enum>(B)</enum><text>by inserting after
			 paragraph (1) the following:</text>
					<quoted-block display-inline="no-display-inline" id="H3557F8F0C8F647158E9682D0448E3142" style="OLC">
						<paragraph id="H2C497ADB03E74293AEC9B64364EF1671"><enum>(2)</enum><header>Limitation on
				criminal penalties for certain non-aggravated cases</header>
							<subparagraph id="HFCC8411D519D48F8B8346EF051E65844"><enum>(A)</enum><header>In
				general</header><text>Notwithstanding paragraph (1), but subject to paragraph
				(3), whoever violates this section shall be fined in accordance with title 18,
				United States Code, imprisoned for not more than 1 year, or both, where such
				violation—</text>
								<clause display-inline="no-display-inline" id="H802E62E221074792AC54291F71F70007"><enum>(i)</enum><text>was of section
				5324(a);</text>
								</clause><clause id="H7F951A2379374E2591EF65C5DDAF8524"><enum>(ii)</enum><text display-inline="yes-display-inline">was not made while also violating another
				law of the United States; and</text>
								</clause><clause id="HD0328EF7546F4D6A88516E5FE5600A7C"><enum>(iii)</enum><text>was made with
				respect to a transaction involving a domestic financial institution described
				under subparagraphs (A) through (F) of section 5312(a)(2).</text>
								</clause></subparagraph><subparagraph id="H964821BDB83A4749BF5F508102CA137F"><enum>(B)</enum><header>No imprisonment
				for first offense</header><text>Notwithstanding subparagraph (A), a person
				committing a violation described under that subparagraph shall not be subject
				to imprisonment for such violation if the person has not previously been
				convicted of a violation described under such
				subparagraph.</text>
							</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="H821B4CA3FF07492F918D8ED0A5404869"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H7D7E408B9EB0495E8A99BA963DC750F6" style="OLC">
					<subsection id="HBD062A8383324C5089BEE944A2874DC1"><enum>(e)</enum><header>Limitation on
				property forfeiture and monetary penalties for certain structuring not
				involving another crime</header><text display-inline="yes-display-inline">With
				respect to a violation, the aggregate amount of property forfeited under
				section 5317(c)(1), property seized and forfeited under section 5317(c)(2), any
				money penalty imposed under section 5321(a)(4)(A), and any fine imposed under
				subsection (d) may not exceed 10 percent of the amount of coins and currency
				(or such other monetary instruments as the Secretary may prescribe) involved in
				the transaction with respect to which the violation occurred, if the
				violation—</text>
						<paragraph id="HF1C8500BD54B4D29B65552C58CA99510"><enum>(1)</enum><text>was of section
				5324(a);</text>
						</paragraph><paragraph id="H2AAB903D2E964598BFBC17401D669E72"><enum>(2)</enum><text display-inline="yes-display-inline">was not made while also violating another
				law of the United States; and</text>
						</paragraph><paragraph id="H8B67DF5D51144AF08A282DE8595A15A4"><enum>(3)</enum><text>was made with
				respect to a transaction involving a domestic financial institution described
				under subparagraphs (A) through (F) of section
				5312(a)(2).</text>
