		<official-title>To amend title 18, United States Code, to protect more
		  victims of domestic violence by preventing their abusers from possessing or
		  receiving firearms, and for other purposes.</official-title>

		<section id="H714D0C99A2B84BFA91E73532E40B5BBD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Domestic
			 Violence Survivor Protection Act</quote>.</text>
		</section><section id="HED31A6C082A040EA8E279272CD7098A9"><enum>2.</enum><header>Definitions of
			 <quote>intimate partner</quote> and <quote>misdemeanor crime of domestic
			 violence</quote> expanded</header><text display-inline="no-display-inline">Section 921(a) title 18, United States Code,
			 is amended—</text>
			<paragraph id="H8F0A0891F1AF490AB74240BEF74FA3A3"><enum>(1)</enum><text>in paragraph (32),
			 by striking <quote>and an individual who cohabitates or has cohabited with the
			 person.</quote> and inserting <quote>or a dating partner (as defined in section
			 2266) or former dating partner.</quote>; and</text>
			</paragraph><paragraph id="HA53E92F278D94F81883EE556FC50DBFB"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (33)—</text>
				<subparagraph id="H5A6FED39B10A47B5B8D2C504D617949D"><enum>(A)</enum><text>by striking
			 <quote>or</quote> after <quote>has cohabited with the victim as a spouse,
			 parent, or guardian,</quote>; and</text>
				</subparagraph><subparagraph id="HBD8EEBAC44794466B1E0FB5E39736CDE"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting, <quote>, or by a dating
			 partner (as defined in section 2266) or former dating partner of the
			 victim</quote> before the period.</text>
				</subparagraph></paragraph></section><section id="HF040AE316C7149E5BC42FB36AA466454"><enum>3.</enum><header>List of persons
			 subject to a restraining or similar order prohibited from possessing or
			 receiving a firearm expanded</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/922">Section 922(g)(8)</external-xref> of title 18, United States
			 Code, is amended—</text>
			<paragraph id="HB924C2E0FB0F422CA5C17CDD125C025D"><enum>(1)</enum><text display-inline="yes-display-inline">by striking subparagraphs (A) and (B) and
			 amending them to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H607F9FE4A2D34C678416D8A9D7FA254F" style="USC">
					<subparagraph id="H162421FF3747407A8D7A1B09FA375575"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="H0032873568E04A2AB0F80B9E9C8C7860"><enum>(i)</enum><text display-inline="yes-display-inline">in the case of conduct described in
				subparagraph (B)(i), was issued after a hearing; or</text>
						</clause><clause id="H8D3808DF703347E8B401272E54701AC2" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of conduct described in clause
				(ii) or (iii) of subparagraph (B), was issued after a hearing of which such
				person received actual notice, and at which such person had an opportunity to
				participate;</text>
						</clause></subparagraph><subparagraph id="H7F475E475DB54163A74A38AB33F2D5D3"><enum>(B)</enum><text display-inline="yes-display-inline">restrains such person from—</text>
						<clause id="H4551FB53A7D04F53B5B84EA34E4BB901"><enum>(i)</enum><text display-inline="yes-display-inline">harassing, stalking, or threatening an
				intimate partner of such person, a child of such intimate partner or person, a
				family member even if the family member had never cohabited with such person,
				an individual who cohabitates or cohabited with the person, or an elderly or
				dependent adult, or engaging in other conduct that would place an individual
				described in this clause in reasonable fear of bodily injury to such
				individual, or in the case of an intimate partner, reasonable fear or bodily
				injury to the partner or child;</text>
						</clause><clause id="H786BF9CB8101466CB2C9E799850C7574"><enum>(ii)</enum><text display-inline="yes-display-inline">harassing, stalking, threatening or
				engaging in other conduct that would put an individual in reasonable fear of
				bodily injury to such individual, including an order which was issued at the
				request of an employer on behalf of its employee or at the request of an
				institution of higher education on behalf of its student; or</text>
						</clause><clause id="H47D4868A60124A1FAB5FB825B599E338"><enum>(iii)</enum><text>intimidating or
				dissuading a witness from testifying in court; and</text>
						</clause></subparagraph><after-quoted-block>; and </after-quoted-block></quoted-block>
			</paragraph><paragraph id="H0D20C9F0D83145D5ABF72DC82ED7BEDC"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (C), by striking
			 <quote>intimate partner or child</quote> each place it appears and inserting
			 <quote>individual described in subparagraph (B)</quote>.</text>
			</paragraph></section><section id="H6BF10D04105643A7B81309868A2E5FEC"><enum>4.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">The amendments made by
			 this Act shall apply—</text>
			<paragraph id="HEE527959788140EE8455C370B39BB757"><enum>(1)</enum><text>to a court order
			 issued on or after the date of the enactment of this Act and to a court order
			 in effect as of the date of enactment of this Act; and</text>
			</paragraph><paragraph id="H545C5EE88BD2453BA27752323E019096"><enum>(2)</enum><text>to a misdemeanor
			 crime of domestic violence committed on or after the date of the enactment of
			 this Act.</text>
