		<official-title>To amend the Internal Revenue Code of 1986 to prevent the
		  payment of unemployment compensation to individuals discharged for drug or
		  alcohol use.</official-title>

		<section id="HB64ADE1BF2334CD099F6C63C6903EFA2" section-type="section-one"><enum>1.</enum><header>Denial of unemployment
			 compensation to individuals discharged for drug or alcohol use</header>
			<subsection id="H23453C17A48F4D11872F750E399275EF"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subsection (a) of
			 <external-xref legal-doc="usc" parsable-cite="usc/26/3304">section 3304</external-xref> of the Internal Revenue Code of 1986 is amended—</text>
				<paragraph id="H2704A7ABF01B43818549FD89F0220EAC"><enum>(1)</enum><text>by inserting
			 <quote>except as provided in paragraph (15),</quote> before <quote>compensation
			 shall not</quote> in paragraph (10),</text>
				</paragraph><paragraph id="H3D4564AE2F454EC4B62FFC0B959BAB4B"><enum>(2)</enum><text>by redesignating
			 paragraphs (15) through (19) as paragraphs (16) through (20), respectively,
			 and</text>
				</paragraph><paragraph id="H6E2A28C32B8D4B509854209444C56EB4"><enum>(3)</enum><text>by inserting after
			 paragraph (14) the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="HE168A8D9E2A24E4B89905CAA25C4CEC7" style="OLC">
						<paragraph id="HF31946C203554CAB949EDC1E0982E5D6"><enum>(15)</enum><text display-inline="yes-display-inline">compensation shall not be payable to any
				individual on the basis of any services performed in connection with employment
				from which the individual was discharged for an employment-related drug or
				alcohol offense (as defined in subsection
				(g)),</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H98C7BA209420425AB678EF7A9171B2D2"><enum>(b)</enum><header>Employment-Related
			 drug or alcohol offense</header><text>Section 3304 of such Code is amended by
			 adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HC29787C80DF24DDB8BAE3C4C5A28FF4F" style="OLC">
					<subsection id="H0A8B264B3D314A12B42654343DE93C60"><enum>(g)</enum><header>Employment-Related
				drug or alcohol offense</header>
						<paragraph id="H96D3A46AD24C4A0C98203A2491960DB7"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">For purposes of
				subsection (a)(15), the term <quote>employment-related drug or alcohol
				offense</quote> includes but is not limited to the following:</text>
							<subparagraph id="HC624FCEB57304638AF6B4F8A8A2F835F"><enum>(A)</enum><text>Being under the
				influence of, or consuming or otherwise using, alcohol or any controlled
				substance while performing services for the employer.</text>
							</subparagraph><subparagraph id="HDCB2354400CC4A40BCA9EF748841436C"><enum>(B)</enum><text>Possessing any
				controlled substance on the premises of the employer.</text>
							</subparagraph><subparagraph id="HAFC39097A5BE48FFADE1E74BF3A4856E"><enum>(C)</enum><text>Failure to comply
				with a request by the employer to take a drug test.</text>
							</subparagraph><subparagraph id="H609463C2BD0E4F2F99404EB35E55A270"><enum>(D)</enum><text>Testing positive
				for illegal use of a controlled substance pursuant to a drug test requested by
				the employer.</text>
							</subparagraph></paragraph><paragraph id="HBB8F23221A9E434095287074CEAB24EA"><enum>(2)</enum><header>Controlled
				substance</header><text>For purposes of this subsection, the term
				<quote>controlled substance</quote> has the meaning given such term under
				applicable State law.</text>
						</paragraph><paragraph id="H2E3DC99F33EF41CB94D63E2816CEAA8C"><enum>(3)</enum><header>Drug
				test</header><text display-inline="yes-display-inline">For purposes of this
				subsection, the term <quote>drug test</quote> means a test designed to detect
				the illegal use of a controlled
				substance.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HFB2679B58718441B80020C461B9BBFF3"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to
			 compensation paid for weeks beginning after the end of the first session of the
			 State legislature which begins after the date of the enactment of this
			 Act.</text>
