which was referred to the <committee-name added-display-style="italic" committee-id="HII00" deleted-display-style="strikethrough">Committee on Natural Resources</committee-name></action-desc></action><action><action-date>September 20, 2013</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction><action-instruction>For text of introduced bill, see copy of bill as introduced on March 14, 2013</action-instruction></action><action display="yes"><action-desc display="yes"><pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of the Interior, acting through the Bureau of Land Management, to convey to the City of Carlin, Nevada, in exchange for consideration, all right, title, and interest of the United States, to any Federal land within that city that is under the jurisdiction of that agency, and for other purposes.<pagebreak></pagebreak></official-title></form><legis-body changed="added" committee-id="HII00" display-enacting-clause="yes-display-enacting-clause" id="HD1AE29CE4FBA42A59BD3448B829B76E1" reported-display-style="italic" style="OLC"><section id="H25B99C2141944D24A70E4BDB29DBDDB4" section-type="section-one"><enum>1.</enum><header>Conveyance of certain Federal land to City of Carlin, Nevada</header><subsection id="H1318C2DB3F4C42A38D6F7C2442F8B9F9"><enum>(a)</enum><header>Definitions</header><paragraph id="H8B6C9645169D41D1AC1F0EC7671277BC"><enum>(1)</enum><header>City</header><text display-inline="yes-display-inline">The term <quote>City</quote> means the City of Carlin, Nevada.</text></paragraph><paragraph id="H4C2B67D384814C159D0132E22587EFAB"><enum>(2)</enum><header>Federal land</header><text display-inline="yes-display-inline">The term <quote>Federal land</quote> means the approximately 1,400 acres of land located in the City of Carlin, Nevada, that is identified on the map as <quote>Carlin Selected Parcels</quote>.</text></paragraph><paragraph id="H2B5A08B9B86A4A67BF4CC6B32CE0B9E3"><enum>(3)</enum><header>Map</header><text display-inline="yes-display-inline">The term <quote>map</quote> means the map entitled <quote>Proposed Carlin, Nevada Land Sales</quote> map dated June 6, 2013.</text></paragraph></subsection><subsection id="H09BB8B526C144FFFBBAE7563FB15BBDD"><enum>(b)</enum><header>Conveyance required</header><text display-inline="yes-display-inline">Subject to valid existing rights and not later than 180 days after the date on which the Secretary of the Interior receives an offer from the City to purchase the Federal land, the Secretary, acting through the Bureau of Land Management, shall convey, notwithstanding the land use planning requirements of sections 202 and 203 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>, 1713), to the City, in exchange for consideration in an amount equal to the fair market value of the Federal land, all right, title, and interest of the United States, to such Federal land.</text></subsection><subsection display-inline="no-display-inline" id="H2CB12183CF734CC2966F103A5FDAFFE8"><enum>(c)</enum><header>Appraisal To determine fair market value</header><text display-inline="yes-display-inline">The Secretary shall determine the fair market value of the Federal land to be conveyed—</text><paragraph id="HD2BEEB0DD14A46ABAE9E552F98C0E9DA"><enum>(1)</enum><text display-inline="yes-display-inline">in accordance with the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>); and</text></paragraph><paragraph id="H49ADE3AD5EDF4D3880C21946EFFAA2D5"><enum>(2)</enum><text display-inline="yes-display-inline">based on an appraisal that is conducted in accordance with nationally recognized appraisal standards, including—</text><subparagraph id="H3E340B8BFDC84A2192A2A5A5A44791D7"><enum>(A)</enum><text display-inline="yes-display-inline">the Uniform Appraisal Standards for Federal Land Acquisition; and</text></subparagraph><subparagraph id="H0CB4E455FD3749A691CC5F8257AE6B5E"><enum>(B)</enum><text display-inline="yes-display-inline">the Uniform Standards of Professional Appraisal Practice.</text></subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" id="H33F1BEAA5C984D76BC1D73E17FE853AE"><enum>(d)</enum><header>Availability of map</header><text display-inline="yes-display-inline">The map shall be on file and available for public inspection in the appropriate offices of the Bureau of Land Management.</text></subsection><subsection id="H8C4E8C151A204ABC94D1325EB259BE36"><enum>(e)</enum><header>Costs</header><text>The City shall, at closing for the conveyance authorized under subsection (b), pay or reimburse the Secretary, as appropriate, for the reasonable transaction and administrative personnel costs associated with the conveyance authorized under such subsection, including the costs of appraisal, title searches, maps, and boundary and cadastral surveys.</text></subsection><subsection id="H1AA51EEF52CB4478934630B5CC1F0BA5"><enum>(f)</enum><header>Conveyance not a major Federal action</header><text display-inline="yes-display-inline">A conveyance or combination of conveyances made under this section shall not be considered a major Federal action for purposes of section 102(2) of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332(2)</external-xref>).</text></subsection><subsection id="HF159942176F846F7A5688BEC6D4077A4"><enum>(g)</enum><header>Release of United States</header><text>Upon making the conveyance under subsection (b), notwithstanding any other provision of law, the United States is released from any and all liabilities or claims of any kind or nature arising from the presence, release, or threat of release of any hazardous substance, pollutant, contaminant, petroleum product (or derivative of a petroleum product of any kind), solid waste, mine materials or mining related features (including tailings, overburden, waste rock, mill remnants, pits, or other hazards resulting from the presence of mining related features) on the Federal land in existence on or before the date of the conveyance.</text></subsection><subsection id="H5F4209CB8BC34E89A049AD14B2217817"><enum>(h)</enum><header>Withdrawal</header><text>Subject to valid existing rights, the Federal land identified for conveyance shall be withdrawn from all forms of—</text><paragraph id="H54362EC6D7C041999834C3DA3F4E7046"><enum>(1)</enum><text>entry, appropriation, or disposal under the public land laws;</text></paragraph><paragraph id="H46237353E3DE49328EFB897504046978"><enum>(2)</enum><text>location, entry, and patent under the mining laws; and</text></paragraph><paragraph id="HCB28A30D6826401C9131F04FEC8C362E"><enum>(3)</enum><text>disposition under the mineral leasing, mineral materials and geothermal leasing laws.</text></paragraph></subsection></section></legis-body><endorsement display="yes"><action-date>September 20, 2013</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc></endorsement></bill>
