		  make improvements in the Government Accountability Office.</official-title></form><legis-body id="H2E716F59B59F446C94837645BD8DF105" style="OLC"><section id="HACA3F70E4D66428DAD4CA83337C9187B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Government Accountability Office
			 Improvement Act</short-title></quote>.</text></section><section id="H4B2F11B222D447DB99227455483DC828"><enum>2.</enum><header>Government
			 Accountability Office Improvement</header><subsection id="H0064357B75F74578AF2A3D78C111B6A5"><enum>(a)</enum><header>Authority To
			 obtain information</header><paragraph id="H5432352933BA4135AF6CAB51030B8F7C"><enum>(1)</enum><header>Authority to
			 obtain records</header><text><external-xref legal-doc="usc" parsable-cite="usc/31/716">Section 716</external-xref> of title 31, United
			 States Code, is amended in subsection (a)—</text><subparagraph id="H6D9DB74415BB43D9A66DCD60DA33A6D7"><enum>(A)</enum><text>by striking
			 <quote>(a)</quote> and inserting <quote>(2)</quote>; and</text></subparagraph><subparagraph id="H1D51F86CC4244366A628143210972304"><enum>(B)</enum><text>by inserting after
			 the section heading the following:</text><quoted-block display-inline="no-display-inline" id="H79F16AA858D54C31B644B74CF7A1F5A6" style="OLC"><subsection id="HC8140ACEF4F540BA81F2BB605CB0A8E9"><enum>(a)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H207F61E7900A4956AD4417D322244073"><enum>(1)</enum><text>The Comptroller General
				is authorized to obtain such agency records as the Comptroller General requires
				to discharge his duties (including audit, evaluation, and investigative
				duties), including through the bringing of civil actions under this section. In
				reviewing a civil action under this section, the court shall recognize the
				continuing force and effect of the authorization in the preceding sentence
				until such time as the authorization is repealed pursuant to
				law.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H74716D527D1B4042B97059B318280C33"><enum>(2)</enum><header>Copies</header><text>Section 716(a) of
			 title 31, United States Code, as amended by subsection (a), is further amended
			 in the second sentence of paragraph (2) by striking <quote>inspect an agency
			 record</quote> and inserting <quote>inspect, and make and retain copies of, an
			 agency record</quote>.</text></paragraph></subsection><subsection id="H839DC920A5F4441DBF48721FAA1F56AC"><enum>(b)</enum><header>Administering
			 oaths</header><text><external-xref legal-doc="usc" parsable-cite="usc/31/711">Section 711</external-xref> of title 31, United
			 States Code, is amended by striking paragraph (4) and inserting the
			 following:</text><quoted-block display-inline="no-display-inline" id="HBBDB36FFD3344256BC95F2CC868A042B" style="OLC"><paragraph id="H5D6AEF405F244107B038932AD0A86694"><enum>(4)</enum><text>administer oaths
				to witnesses when auditing and settling accounts and, with the prior express
				approval of the Comptroller General, when investigating fraud or attempts to
				defraud the United States, or irregularity or misconduct of an employee or
				agent of the United
				States.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HFADB8860A50D4FB48FC7FDAADA04E69E"><enum>(c)</enum><header>Access to
			 certain information</header><paragraph id="H28A1007848CF4A7D812F28B38580643E"><enum>(1)</enum><header>Access to
			 certain information</header><text display-inline="yes-display-inline">Subchapter II of
			 chapter
			 7 of title 31, United States Code, is amended by adding at the
			 end the following:</text><quoted-block display-inline="no-display-inline" id="H24F2217B6F88417C83D02A5EC72DE7C8" style="USC"><section id="HC3B790EF2B864C2EAB95E8BC215F5A6A"><enum>721.</enum><header>Access to
				certain information</header><subsection id="H29CBBF3B6B6642E89E455D96FA15A909"><enum>(a)</enum><text>No provision of
				the Social Security Act, including section 453(l) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/653">42 U.S.C. 653(l)</external-xref>),
				shall be construed to limit, amend, or supersede the authority of the
				Comptroller General to obtain any information or to inspect or copy any record
				under section 716 of this title.</text></subsection><subsection id="H132191378C77496993278E92E8FA2021"><enum>(b)</enum><text>No provision of
				the Federal Food, Drug, and Cosmetic Act, including section 301(j) of that Act
				(21 U.S.C.
				331(j)), shall be construed to limit, amend, or supersede the
				authority of the Comptroller General to obtain any information or to inspect or
				copy any record under section 716 of this title.</text></subsection><subsection id="H776D7D84D0184ED99D9E2516F265783B"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H1BCFFC6DD8E54067A373EDD2F610DFBC"><enum>(1)</enum><text>The Comptroller General
				shall prescribe such policies and procedures as are necessary to protect from
				public disclosure proprietary or trade secret information obtained consistent
				with this section.</text></paragraph><paragraph id="H285F2798AFAF48C9B98F22F63BD9530F" indent="up1"><enum>(2)</enum><text>Nothing in this section shall be
				construed to—</text><subparagraph id="H363634EE434F47A5BE17C371051FF0DC"><enum>(A)</enum><text>alter or amend the prohibitions
				against the disclosure of trade secret or other sensitive information
				prohibited by <external-xref legal-doc="usc" parsable-cite="usc/18/1905">section 1905</external-xref> of title 18 and other
				applicable laws; or</text></subparagraph><subparagraph id="HE4C6AB6444A24BE7B0473B805F197C11"><enum>(B)</enum><text>affect the applicability of section
				716(e) of this title, including the protections against unauthorized disclosure
				contained in that section, to information obtained consistent with this
				section.</text></subparagraph></paragraph></subsection><subsection id="H11CD609AB56141B097925E5C899CED7A"><enum>(d)</enum><text>Specific
				references to statutes in this section shall not be construed to affect access
				by the Government Accountability Office to information under statutes that are
				not so
				referenced.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HC482D5C68C6740C2A932077BED0BFA73"><enum>(2)</enum><header>Technical and
			 conforming amendment</header><text>The table of sections for
			 chapter
			 7 of title 31, United States Code, is amended by inserting
			 after the item relating to
			 section
			 720 the following:</text><quoted-block id="H89DC5EF53B1947C5A4F402F02598F8C7" style="USC"><toc><toc-entry idref="HC3B790EF2B864C2EAB95E8BC215F5A6A" level="section">721. Access to certain
				information.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H4F6A83B8954845FFB11F1D30499D3F81"><enum>(d)</enum><header>Agency
			 reports</header><text><external-xref legal-doc="usc" parsable-cite="usc/31/720">Section 720(b)</external-xref> of title 31, United
			 States Code, is amended—</text><paragraph id="H3B7A521250C54B7D898B674533CC9D9D"><enum>(1)</enum><text>in the matter
			 preceding paragraph (1), by inserting <quote>or planned</quote> after
			 <quote>action taken</quote>; and</text></paragraph><paragraph id="H719E19F831654B98B487A2375E916A1A"><enum>(2)</enum><text>by striking
			 paragraph (1) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="HE3D8C0B2959C413EAA51B08DDF92F17B" style="OLC"><paragraph id="H92E16DA0B89444C083863AC2DB5699E1"><enum>(1)</enum><text>the Committee on
				Homeland Security and Governmental Affairs of the Senate, the Committee on
				Oversight and Government Reform of the House of Representatives, the
				congressional committees with jurisdiction over the agency program or activity
				that is the subject of the recommendation, and the Government Accountability
				Office before the 61st day after the date of the report;
