			 as the <quote><short-title>Cabin Fee Act of
			 2013</short-title></quote>.</text>

			</subsection></section><section id="H6E80CACFB7424AA48D103EDD84659626"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H93E4DA7CE0F04F538A7BBCE4C75437A1"><enum>(1)</enum><header>Authorization;
			 authorize</header><text>The terms <quote>authorization</quote> and
			 <quote>authorize</quote> mean the issuance of a special use permit for the use
			 and occupancy of National Forest System land by a cabin owner under the
			 Recreation Residence Program.</text>
			</paragraph><paragraph id="H845ECA3CED214E26A6EA27226A04AF38"><enum>(2)</enum><header>Cabin</header><text>The
			 term <quote>cabin</quote> means a privately built and owned recreation
			 residence and related improvements on National Forest System land that—</text>
				<subparagraph id="HF43765931736435F8BA7D05A38C9B343"><enum>(A)</enum><text>is authorized for
			 private use and occupancy; and</text>
				</subparagraph><subparagraph id="H2E30D3BB3C924E2C827191329AED670B"><enum>(B)</enum><text>may be sold or
			 transferred between private parties.</text>
				</subparagraph></paragraph><paragraph id="H3A5C61B288994C21864B527DC1DB9C1C"><enum>(3)</enum><header>Cabin
			 owner</header><text>The term <quote>cabin owner</quote> means—</text>
				<subparagraph id="HD5CF5D2505B640ECBFB48508A66A2442"><enum>(A)</enum><text>a person
			 authorized by the Secretary to use and to occupy a cabin; and</text>
				</subparagraph><subparagraph id="H0EBBD09E9FF6472DB8481E83F8D6B994"><enum>(B)</enum><text>a trust, heir, or
			 assign of a person described in subparagraph (A).</text>
				</subparagraph></paragraph><paragraph id="H687E0563DA824BFC9A932D5B604E74C5"><enum>(4)</enum><header>Cabin transfer
			 fee</header><text>The term <quote>cabin transfer fee</quote> means a fee that
			 is paid to the United States on the transfer of a cabin between private parties
			 for money or other consideration that results in the issuance of a new
			 permit.</text>
			</paragraph><paragraph id="H7C96114D39E74EBEB7E85FC4846387BE"><enum>(5)</enum><header>Cabin user
			 fee</header><text>The term <quote>cabin user fee</quote> means an annual fee
			 paid to the United States by a cabin owner in accordance with an authorization
			 for the use and occupancy of a cabin.</text>
			</paragraph><paragraph id="H67A9688E59DC46138AC83E0B7AEA1338"><enum>(6)</enum><header>Current
			 appraisal cycle</header><text>The term <quote>current appraisal cycle</quote>
			 means the completion of Forest Service review and acceptance of—</text>
				<subparagraph id="H27D3D49A55EB47428CE075899B128139"><enum>(A)</enum><text>initial typical
			 lot appraisals; and</text>
				</subparagraph><subparagraph id="HDBC850D4C91F4CF2949CECEB46D662D9"><enum>(B)</enum><text>second appraisals,
			 if ordered by cabin owners and approved by the Forest Service.</text>
				</subparagraph></paragraph><paragraph id="H0EE4E096BB3D446BB413CB742A5DDADA"><enum>(7)</enum><header>Current cabin
			 user fee</header><text>The term <quote>current cabin user fee</quote> means the
			 most recent cabin user fee, as adjusted under section 3(c).</text>
			</paragraph><paragraph id="HA467456295914ECAB6FD0BB7EFCF6788"><enum>(8)</enum><header>Lot</header><text>The
			 term <quote>lot</quote> means a parcel of National Forest System land on which
			 a person is authorized to build, use, occupy, and maintain a cabin.</text>
			</paragraph><paragraph id="H426B6D74B80243FD8FE39D3A532D6777"><enum>(9)</enum><header>National forest
			 system</header><text>The term <quote>National Forest System</quote> has the
			 meaning given that term in section 11 of the Forest and Rangeland Renewable
			 Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1609">16 U.S.C. 1609</external-xref>).</text>
			</paragraph><paragraph id="H58D7AAF2D3B248AD90C86673B7615CA7"><enum>(10)</enum><header>Recreation
			 residence program</header><text>The term <quote>Recreation Residence
			 Program</quote> means the Recreation Residence Program established under the
			 last paragraph under the heading <quote>FOREST SERVICE</quote> in the Act of
			 March 4, 1915 (<external-xref legal-doc="usc" parsable-cite="usc/16/497">16 U.S.C. 497</external-xref>).</text>
			</paragraph><paragraph id="H08A035BA307D4976BEB2937A59D9495F"><enum>(11)</enum><header>Secretary</header><text>The
			 term <quote>Secretary</quote> means the Secretary of Agriculture, acting
			 through the Chief of the Forest Service.</text>
			</paragraph><paragraph id="H6F839BE9D1F64B5B9B1117BCCBA5CBD1"><enum>(12)</enum><header>Typical
			 lot</header><text>The term <quote>typical lot</quote> means a cabin lot, or
			 group of cabin lots, in a tract that is selected for use in an appraisal as
			 being representative of, and that has similar value characteristics as, other
			 lots or groups of lots within the tract.</text>
			</paragraph></section><section id="H8833C40D865F4AC88CD5EF0EA032394A"><enum>3.</enum><header>Cabin user
			 fees</header>
			<subsection id="H2353F64313154F8993FC69451B0750A8"><enum>(a)</enum><header>Payment of cabin
			 user fees</header><text>Cabin owners shall pay an annual cabin user fee
			 established by the Secretary in accordance with this section.</text>
			</subsection><subsection id="H20708328C7414E768F63944F5EDA2E78"><enum>(b)</enum><header>Initial cabin
			 user fees</header>
				<paragraph id="H08EEB055A2EC4B13A6A26E57254BD028"><enum>(1)</enum><header>Establishment</header><text>The
			 Secretary shall establish initial cabin user fees in accordance with this
			 subsection.</text>
				</paragraph><paragraph id="H282DCC0FAB03433DBBCD0ACEA877EF92"><enum>(2)</enum><header>Assignment to
			 value tiers</header><text>On completion of the current appraisal cycle, as
			 required by paragraph (4), the Secretary shall assign each permitted lot on
			 National Forest System land to 1 of 10 tiers based on the following
			 considerations:</text>
					<subparagraph id="H3FD18CD390784D4885C4FD2C02EA1286"><enum>(A)</enum><text>Before assigning
			 the lots to tiers, all appraised lot values shall be adjusted, or normalized,
			 for price changes occurring after the appraisal, in accordance with the
			 National Association of Homebuilders/Wells Fargo Housing Opportunity
			 Index.</text>
					</subparagraph><subparagraph id="HDF3E1A65BAB8433EB871E4AE0F088038"><enum>(B)</enum><text>Second appraisal
			 values shall supersede initial lot appraisal values for the normalization and
			 ranking process under subparagraph (A).</text>
					</subparagraph><subparagraph id="H1429EA7EF7FF4BA9BF584BA3CE538CEC"><enum>(C)</enum><text>The tiers shall be
			 established, on a national basis, according to relative lot value, with lots
			 having the lowest adjusted appraised value assigned to tier 1 and lots having
			 the highest adjusted appraised value assigned to tier 10.</text>
					</subparagraph><subparagraph id="H04EE727EB2E44FD99AF2CAA658A43106"><enum>(D)</enum><text>The number of lots
			 (by percentage) assigned to each tier is contained in the table set forth in
			 paragraph (3).</text>
					</subparagraph><subparagraph id="HE1F1CBCADF4944EBAF1C0D85D548A83A"><enum>(E)</enum><text>Data from
			 incomplete appraisals may not be used to establish the fee tiers under this
			 subsection.</text>
					</subparagraph><subparagraph id="H18D2098E14504BEB8BE5BDC26DAAB8A1"><enum>(F)</enum><text>Until assigned to
			 a tier under this subsection, the Secretary shall assess (and may adjust
			 annually subject to clause (ii)) an interim fee for permitted cabin lots
			 (including lots with incomplete appraisals) in an amount equal to the lesser
			 of—</text>
						<clause id="H412407B5F31747CAA2F66ACCA2A6CBCF"><enum>(i)</enum><text>$5,000; or</text>
						</clause><clause id="H7BE66B52DCD64219B291C6BC21497701"><enum>(ii)</enum><text>the
			 amount of the current cabin user fee, as determined under the Cabin User Fee
			 Fairness Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/6201">16 U.S.C. 6201 et seq.</external-xref>), which amount the Secretary may
			 increase annually by not more than 25 percent, except that the increased fee
			 shall not exceed the otherwise scheduled fee determined under the Cabin User
			 Fee Fairness Act of 2000.</text>
						</clause></subparagraph></paragraph><paragraph id="H622C924F6F844C21A770E4B62EF34942"><enum>(3)</enum><header>Amount of
			 initial cabin user fees</header><text>The initial cabin user fees, based on the
			 assignments under paragraph (2), are as follows:</text>

				</paragraph><paragraph id="H2DC8A5BEE7C84A32BD9954DE77F4ED45"><enum>(4)</enum><header>Deadline for
			 completion of current appraisal cycle</header><text display-inline="yes-display-inline">Not later than 3 years after the date of
			 enactment of this Act, the Secretary shall complete the current appraisal
			 cycle.</text>
				</paragraph><paragraph id="H7C6A7532C4F64B44A40F12957D14F98A"><enum>(5)</enum><header>Effective
			 date</header><text>The initial cabin user fees required by this subsection
			 shall take effect beginning with the first calendar year beginning after the
			 completion of the current appraisal cycle.</text>
				</paragraph></subsection><subsection id="HF892FB21CF4748F6B3169D3F005F83B2"><enum>(c)</enum><header>Annual
			 adjustments of cabin user fee</header><text>Once initial cabin user fees have
			 been assessed, based on the tier assignments under subsection (b)(2), the
			 Secretary shall use changes in the Implicit Price Deflator for the Gross
			 Domestic Product published by the Bureau of Economic Analysis of the Department
			 of Commerce, applied on a 5-year rolling average, to assess an annual
			 adjustment to cabin user fees.</text>
			</subsection><subsection id="H4C7E34AAD9BE45A6AFB255185EDBC817"><enum>(d)</enum><header>Effect of
			 destruction, substantial damage, or loss of access</header>
				<paragraph id="H581F4237B3D24A34AFE1C6107DD1C6D5"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall reduce the cabin user fee to $100 per
			 year for a cabin if—</text>
					<subparagraph id="H9187DD766A2E42F3B4265120C4A147D0"><enum>(A)</enum><text>the cabin is
			 destroyed or suffers substantial damage in an amount that is greater than 50
			 percent of replacement cost of the cabin; or</text>
					</subparagraph><subparagraph id="H0AED6BAFD6F14F5FA2B061027909BD75"><enum>(B)</enum><text>access to the
			 cabin is significantly impaired, whether by catastrophic events, natural
			 causes, or governmental actions.</text>
					</subparagraph></paragraph><paragraph id="H9F349E7401924824B91BEABF5D4CD706"><enum>(2)</enum><header>Term of reduced
			 fee</header><text>The reduced fee under paragraph (1) shall be in effect until
			 the later of—</text>
					<subparagraph id="H5865FD1D7CB44FA5B3750744190EE9D3"><enum>(A)</enum><text>the last day of
			 the year in which the destruction or impairment occurs; or</text>
					</subparagraph><subparagraph id="H88F0239C53B3466A91966CA3F19647A1"><enum>(B)</enum><text>the date on which
			 the cabin may be lawfully reoccupied and normal access has been
			 restored.</text>
					</subparagraph></paragraph></subsection></section><section id="HC80F101A7B9648A1B2CE189CD2E5BE98"><enum>4.</enum><header>Payment of cabin
			 transfer fees</header><text display-inline="no-display-inline">As a condition
			 of the issuance by the Secretary of a new authorization for the use and
			 occupancy of the cabin, the cabin owner transferring the cabin shall pay to the
			 Secretary a cabin transfer fee in the amount of $1,200.</text>
		</section><section id="HD622D363C9474F4B89D7F00DA84729FF"><enum>5.</enum><header>Right of appeal
			 and judicial review</header>
			<subsection id="HA5F34617F22B4B1F8D53B8DB3D0657B6"><enum>(a)</enum><header>Right of
			 appeal</header>
				<paragraph id="H8025120D879142B7A68B5A3A68308C33"><enum>(1)</enum><header>In
			 general</header><text>Notwithstanding any action of a cabin owner to exercise
			 rights in accordance with section 6, the Secretary shall by regulation grant to
			 the cabin owner the right to an administrative appeal of the determination of a
			 new cabin user fee, fee tier, or whether or not to reduce a cabin user fee
			 under section 3(d).</text>
				</paragraph><paragraph id="H178BC337B5DA4DA5BDB7CBC4A3F9654B"><enum>(2)</enum><header>Applicable
			 law</header><text>An appeal under paragraph (1) shall be pursuant to the appeal
			 process provided under subpart C of part 251 of title 36, Code of Federal
			 Regulations (or a successor regulation).</text>
				</paragraph></subsection><subsection id="H3E66C5D17F8A4A39ABE42A5863D63875"><enum>(b)</enum><header>Judicial
			 review</header>
				<paragraph id="H6D609F2F42BF46169AB4087F3F9344A1"><enum>(1)</enum><header>In
			 general</header><text>A cabin owner that contests a final decision of the
			 Secretary under this Act may bring a civil action in United States district
			 court.</text>
				</paragraph><paragraph id="H96852695326F4F64A42E1E8EEE176EE7"><enum>(2)</enum><header>Venue</header><text>The
			 venue for an action brought before the United States district court under this
			 subsection shall be in the Federal judicial district in which the cabin is
			 located.</text>
				</paragraph><paragraph id="HBF07CEC7A0264285B0D4B7A05C8E2B8C"><enum>(3)</enum><header>Effect on
			 mediation</header><text>Nothing in this Act precludes a person from seeking
			 mediation for an action under this Act.</text>
				</paragraph></subsection></section><section id="HB1546B92EFDA408B816FCF0C52369660"><enum>6.</enum><header>Effect</header>
			<subsection id="H30949CA9C8C54FD1B8D23497D8101063"><enum>(a)</enum><header>In
			 general</header><text>Nothing in this Act limits or restricts any right, title,
			 or interest of the United States in or to any land or resource.</text>
			</subsection><subsection id="H59A140ECE9CB4414A95E5021173DE5FC"><enum>(b)</enum><header>Special rule for
			 alaska</header><text>In determining a cabin user fee in the State of Alaska,
			 the Secretary shall not establish or impose a cabin user fee or a condition
			 affecting a cabin user fee that is inconsistent with 1303(d) of the Alaska
			 National Interest Lands Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3193">16 U.S.C. 3193(d)</external-xref>).</text>
			</subsection></section><section id="H182255AE3D964193B27F955E427831C4"><enum>7.</enum><header>Regulations</header><text display-inline="no-display-inline">Not later than December 31, 2014, the
			 Secretary shall issue regulations to carry out this Act.</text>
