		  Mississippi River, and for other purposes.</official-title>

		<section id="H19E02C791BC047378370192ABD7F2512" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Mississippi River Navigation
			 Sustainment Act</short-title></quote>.</text>
		</section><section id="HFF5A1D7DBF954433A7EDBDE3D229BFF9"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
			<paragraph id="HADE27DD9CD1D4B958866A5EC12C97E76"><enum>(1)</enum><text>the Mississippi
			 River is the largest, most famous river in the United States and a vital
			 natural resource;</text>
			</paragraph><paragraph id="HCBD8015A326549688E367EAB19D438C8"><enum>(2)</enum><text>the Mississippi
			 River Basin is the third largest watershed in the world, covering more than
			 1,000,000 square miles and approximately 40 percent of the continental United
			 States;</text>
			</paragraph><paragraph id="H67845640901848428087FE2DE25684EE"><enum>(3)</enum><text>the rivers,
			 tributaries, and reservoirs that make up the Mississippi River Basin operate
			 naturally as a system and any attempt to operate projects within the
			 Mississippi River Basin by mankind should take this fact into
			 consideration;</text>
			</paragraph><paragraph id="H40D2403A17C14CF7B07D680055EAA08D"><enum>(4)</enum><text>the Mississippi
			 River is the backbone of the inland waterway system of the United States and a
			 crucial artery for the movement of goods;</text>
			</paragraph><paragraph id="H4ED41D65162C4EB59FFF1C4844EF60A6"><enum>(5)</enum><text>each year millions
			 of tons of commodities, including grain, coal, petroleum, and chemicals,
			 representing billions of dollars are transported on the Mississippi River by
			 barge;</text>
			</paragraph><paragraph id="H0363F275079D4309B48D6F8DFA266E12"><enum>(6)</enum><text>the Mississippi
			 River is home to some of the busiest commercial ports in the United States,
			 including the Port of New Orleans and the Port of St. Louis;</text>
			</paragraph><paragraph id="H8A185F297CB5412E9018B9715287870F"><enum>(7)</enum><text>safe and reliable
			 navigation of the Mississippi River is vital to the national economy;</text>
			</paragraph><paragraph id="H77C945A5678541649878B4B1537ACCA4"><enum>(8)</enum><text>extreme weather
			 events pose challenges to navigation and life along the Mississippi River and
			 are likely to become more severe and more frequent in the coming years, as
			 evidenced by the devastating floods along the Mississippi River in 2011 and the
			 near historic low water levels seen on the same stretch of the Mississippi
			 River in the winter of 2012–2013;</text>
			</paragraph><paragraph id="HD23CDAB36CDC444AA86D7A84BDCF042B"><enum>(9)</enum><text>the American
			 Waterways Operators and the Waterways Council, Incorporated have estimated that
			 a disruption of navigation on the Mississippi River due to low water levels
			 between December 2012 and January 2013 would have negatively impacted 20,000
			 jobs and $7,000,000,000 in cargo;</text>
			</paragraph><paragraph id="H9D3FFDE54F8A487189BEAEEF2A4ACC15"><enum>(10)</enum><text>the Regulating
			 Works Program of the St. Louis District of the Corps of Engineers is critical
			 to maintaining navigation on the middle Mississippi River during extreme
			 weather events and should receive continued Federal financial assistance and
			 support; and</text>
			</paragraph><paragraph id="HF457B5B29C114E10BF0DAFBE015C1716"><enum>(11)</enum><text>the Federal
			 Government, commercial users, and others have a shared responsibility to take
			 steps to maintain the critical flow of goods on the Mississippi River during
			 extreme weather events.</text>
			</paragraph></section><section id="H641AC021B80740988579130D4DADE7A6"><enum>3.</enum><header>Definitions</header>
			<subsection id="H38612BF3BA754C7FA2BE635711EA54B5"><enum>(a)</enum><header>Extreme
			 weather</header><text>The term <term>extreme weather</term> means—</text>
				<paragraph id="HD5053A88AC5A476DA7271987AE084BDF"><enum>(1)</enum><text>severe flooding
			 and drought conditions that lead to above or below average water levels;
			 or</text>
				</paragraph><paragraph id="HE33F28BA6CB84931850A2EFE7FC310EC"><enum>(2)</enum><text>other severe
			 weather events that threaten personal safety, property, and navigation on the
			 inland waterways of the United States.</text>
				</paragraph></subsection><subsection id="H1230333F28F34DE2841DA01C78A58C30"><enum>(b)</enum><header>Greater
			 Mississippi River Basin</header><text>The term <term>greater Mississippi River
			 Basin</term> means the area covered by hydrologic units 5, 6, 7, 8, 10, and 11,
			 as identified by the United States Geological Survey as of the date of
			 enactment of this Act.</text>
			</subsection><subsection id="H017B07B52ABA495A88267FA3F69483E5"><enum>(c)</enum><header>Lower
			 Mississippi River</header><text>The term <term>lower Mississippi River</term>
			 means the portion of the Mississippi River that begins at the confluence of the
			 Ohio River and flows to the Gulf of Mexico.</text>
			</subsection><subsection id="H1C5F3AF6B2F34FBB86D231FB1E99D655"><enum>(d)</enum><header>Middle
			 Mississippi River</header><text>The term <term>middle Mississippi River</term>
			 means the portion of the Mississippi River that begins at the confluence of the
			 Missouri River and flows to the lower Mississippi River.</text>
			</subsection><subsection id="HAE34B3B89864448D8FFC67EBDE2EF75C"><enum>(e)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Army, acting through the
			 Chief of Engineers.</text>
			</subsection></section><section id="HCD3C59C18BDE45809CA62873BC39FEB0"><enum>4.</enum><header>Greater
			 Mississippi River Basin Extreme Weather Management Study</header>
			<subsection id="H8B0DB0FFFF9244E49C5D3FE3105D1F91"><enum>(a)</enum><header>In
			 general</header><text>The Secretary shall carry out a study of the Mississippi
			 River Basin—</text>
				<paragraph id="HF93A6E40C5A749328BDB8F8E67424E6A"><enum>(1)</enum><text>to improve the
			 coordinated and comprehensive management of water resource projects in the
			 greater Mississippi River Basin relating to extreme weather conditions;
			 and</text>
				</paragraph><paragraph id="H56A26EF0E077469097B5B1B349D81EB1"><enum>(2)</enum><text>to evaluate the
			 feasibility of any modifications to those water resource projects and develop
			 new water resource projects to improve the reliability of navigation and more
			 effectively reduce flood risk.</text>
				</paragraph></subsection><subsection id="HB302AE544BBB47CF98B66C8B0EE59009"><enum>(b)</enum><header>Contents</header><text>The
			 study shall—</text>
				<paragraph id="H392955ACA2C3438AB20A5B0642B3CC34"><enum>(1)</enum><text>identify any
			 Federal actions necessary to prevent and mitigate the impacts of extreme
			 weather, including changes to authorized channel dimensions, operational
			 procedures of locks and dams, and reservoir management within the Mississippi
			 River Basin;</text>
				</paragraph><paragraph id="H149E2B852952402F9F0561ACD135A1B1"><enum>(2)</enum><text>evaluate the
			 effect on navigation and flood risk management to the Mississippi River of all
			 upstream rivers and tributaries, especially the confluence of the Illinois
			 River, Missouri River, and Ohio River;</text>
				</paragraph><paragraph id="HC1C933F27B0D4DFB9780AAC97A123C18"><enum>(3)</enum><text>identify and make
			 recommendations to remedy challenges to the Corps of Engineers presented by
			 extreme weather, including river access, in carrying out its mission to
			 maintain safe, reliable navigation; and</text>
				</paragraph><paragraph id="H17E1061CA08E4D6BAFC2023B73E32EE7"><enum>(4)</enum><text>identify and
			 locate natural or other potential impediments to maintaining navigation on the
			 middle and lower Mississippi River during periods of low water, including
			 existing industrial pipeline crossings.</text>
				</paragraph></subsection><subsection id="HC496D206330E426E8B2687ADE687D3D9"><enum>(c)</enum><header>Consultation and
			 use of existing data</header><text>In carrying out the study, the Secretary
			 shall—</text>
				<paragraph id="HAD52980AB2C143CFB25B83DA38DA34D6"><enum>(1)</enum><text>consult with
			 appropriate committees of Congress, Federal, State, tribal, and local agencies,
			 environmental interests, river navigation industry representatives, other
			 shipping and business interests, organized labor, and nongovernmental
			 organizations;</text>
				</paragraph><paragraph id="H236F168CD5924630AE964016CD9F1068"><enum>(2)</enum><text>to the maximum
			 extent practicable, use data in existence on the date of enactment of this Act;
			 and</text>
				</paragraph><paragraph id="HBA4E10F8CD914A6FAFC47A8C07D2D9AF"><enum>(3)</enum><text>incorporate
			 lessons learned and best practices developed as a result of past extreme
			 weather events, including major floods and the successful effort to maintain
			 navigation during the near historic low water levels on the Mississippi River
			 during the winter of 2012–2013.</text>
				</paragraph></subsection><subsection id="H8926C6D3EC504185BD4158331AB152A6"><enum>(d)</enum><header>Cost-Sharing</header><text>The
			 Federal share of the cost of carrying out the study under this section shall be
			 100 percent.</text>
			</subsection><subsection id="H53B2A38F7336427EBCBD07CCF8778591"><enum>(e)</enum><header>Report</header><text>Not
			 later than 3 years after the date of enactment of this Act, the Secretary shall
			 submit to Congress a report on the study carried out under this section.</text>
			</subsection></section><section id="H4892F4ED8FC144229A6AFF8AD5155EB2"><enum>5.</enum><header>Mississippi River
			 forecasting improvements</header>
			<subsection id="H8AB00C49336B4814B2405E540F045680"><enum>(a)</enum><header>In
			 general</header><text>The Secretary, in consultation with the Secretary of the
			 department in which the Coast Guard is operating, the Director of the United
			 States Geological Survey, the Administrator of the National Oceanic and
			 Atmospheric Administration, and the Director of the National Weather Service,
			 as applicable, shall improve forecasting on the Mississippi River by—</text>
				<paragraph id="H91ED74DD706742DE9F6F030FAFEFD2CB"><enum>(1)</enum><text>updating
			 forecasting technology deployed on the Mississippi River and its tributaries
			 through—</text>
					<subparagraph id="H76D9456EB9844B629978D7CDD6C22B56"><enum>(A)</enum><text>the construction
			 of additional automated river gages;</text>
					</subparagraph><subparagraph id="H411FD699D50147258CF08DD5EB3AB35D"><enum>(B)</enum><text>the rehabilitation
			 of existing automated and manual river gages; and</text>
					</subparagraph><subparagraph id="HD5405426D3CC4968B6CF605E5FD23C20"><enum>(C)</enum><text>the replacement of
			 manual river gages with automated gages, as the Secretary determines to be
			 necessary;</text>
					</subparagraph></paragraph><paragraph id="HCBB1EBD5ECBE46C5864CC7B17428CCFE"><enum>(2)</enum><text>constructing
			 additional sedimentation ranges on the Mississippi River and its tributaries;
			 and</text>
				</paragraph><paragraph id="H8B514F19B8C949BBB36B9CFC5E7C2C1F"><enum>(3)</enum><text>deploying
			 additional automatic identification system base stations at river gage
			 sites.</text>
				</paragraph></subsection><subsection id="HE5CD32BE775E495AB719E8A122C306EB"><enum>(b)</enum><header>Prioritization</header><text>In
			 carrying out this section, the Secretary shall prioritize the sections of the
			 Mississippi River on which additional and more reliable information would have
			 the greatest impact on maintaining navigation on the Mississippi River.</text>
			</subsection><subsection id="H161DF8B731E440CC9B38D7819E6F760F"><enum>(c)</enum><header>Report</header><text>Not
			 later than 1 year after the date of enactment of this Act, the Secretary shall
			 submit to Congress a report on the activities carried out by the Secretary
			 under this section.</text>
			</subsection></section><section id="H999098B247A547688AC8371AB008BF03"><enum>6.</enum><header>Corps of
			 Engineers flexibility in maintaining navigation</header>
			<subsection id="H40F64F2D37A0411099A1E8A2A4D60B13"><enum>(a)</enum><header>In
			 general</header><text>If the Secretary determines it to be critical to
			 maintaining safe and reliable navigation, the Secretary—</text>
				<paragraph id="HDDB2428E4CF3430E89AD8EA414306AB5"><enum>(1)</enum><text>in consultation
			 with the department in which the Coast Guard is operating, may construct
			 ingress and egress paths to docks, loading facilities, fleeting areas, and
			 other critical locations outside of the authorized navigation channel on the
			 Mississippi River; and</text>
				</paragraph><paragraph id="H5C6F1A4AE0484F108FE1EE3B9E67E13F"><enum>(2)</enum><text>operate and
			 maintain, through dredging and construction of river training structures,
			 ingress and egress paths to loading docks and fleeting areas outside of the
			 authorized navigation channel on the Mississippi River.</text>
				</paragraph></subsection><subsection id="H4FC3712F43AF466CA56016124C3A25D2"><enum>(b)</enum><header>Mitigation</header><text>The
			 Secretary may mitigate through dredging any incidental impacts to loading or
			 fleeting areas outside of the authorized navigation channel on the Mississippi
			 River that result from operation and maintenance of the authorized
			 channel.</text>
			</subsection></section><section id="H62F9AE5DDB4C4663985FCE79B43A77A3"><enum>7.</enum><header>Middle
			 Mississippi River environmental pilot program</header>
			<subsection id="HB6DCFB6231F34D37A380129AEF612AFF"><enum>(a)</enum><header>In
			 general</header><text>In accordance with the project for navigation,
			 Mississippi River between the Ohio and Missouri Rivers (Regulating Works),
			 Missouri and Illinois, authorized by the Act of June 25, 1910 (36 Stat. 631,
			 chapter 382) (commonly known as the <quote>River and Harbor Act of
			 1910</quote>), the Act of January 1, 1927 (44 Stat. 1010, chapter 47) (commonly
			 known as the <quote>River and Harbor Act of 1927</quote>), and the Act of July
			 3, 1930 (46 Stat. 918, chapter 847), the Secretary shall carry out for a period
			 of not less than 10 years, a pilot program to restore and protect fish and
			 wildlife habitat in the middle Mississippi River.</text>
			</subsection><subsection id="H0B75A2D1EF394A25B17391D245A8B9E3"><enum>(b)</enum><header>Authorized
			 activities</header>
				<paragraph id="HB0F0452294704449AB804F877B6DDCE9"><enum>(1)</enum><header>In
			 general</header><text>As part of the pilot program carried out under subsection
			 (a), the Secretary shall conduct any activities that are necessary to improve
			 navigation through the project while restoring and protecting fish and wildlife
			 habitat in the middle Mississippi River.</text>
				</paragraph><paragraph id="HDF256CB5C50249C493DA3FEF276335B7"><enum>(2)</enum><header>Inclusions</header><text>Activities
			 authorized under paragraph (1) shall include—</text>
					<subparagraph id="HF626DB36AD12470BA0BA6AF2AF5EAD8F"><enum>(A)</enum><text>the modification
			 of navigation training structures;</text>
					</subparagraph><subparagraph id="H3BB320F7E9DE42C1A0D1C5634D487D85"><enum>(B)</enum><text>the modification
			 and creation of side channels;</text>
					</subparagraph><subparagraph id="HC96E82CEAED344F5A8B6BBC384FDB113"><enum>(C)</enum><text>the modification
			 and creation of islands;</text>
					</subparagraph><subparagraph id="HFD6E8FA46811441FB55E049896A9C722"><enum>(D)</enum><text>any studies and
			 analyses necessary to develop adaptive management principles; and</text>
					</subparagraph><subparagraph id="H9721B3D41D8C421C825BDB2600F1B6F4"><enum>(E)</enum><text>the acquisition
			 from willing sellers of any land associated with a riparian corridor needed to
			 carry out the goals of the pilot program.</text>
					</subparagraph></paragraph></subsection><subsection id="H020AD02A15A74162B4D8C8965B9CB41C"><enum>(c)</enum><header>Cost-Sharing
			 requirement</header><text>The cost-sharing requirements under the provisions of
			 law described in subsection (a) for the project described in that subsection
			 shall apply to any activities carried out under this section.</text>
			</subsection></section><section id="HC4718D98ACE64CA1B5C56031ECC4DEAA"><enum>8.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated to carry out this Act such sums as are
			 necessary.</text>
