		<section id="H762C8C60D2E74720BD7E01821099E6FC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Waterways Are Vital for the Economy,
			 Energy, Efficiency, and Environment Act of 2013</short-title></quote> or the
			 <quote><short-title>WAVE4
			 Act</short-title></quote>.</text>
		</section><section id="HD3EA2B9FDB56416D8057DE860A72B08E"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="HD8C6A4CEEFFD41D5B0438AA94178A4C9"><enum>(1)</enum><text>The inland
			 waterways navigation system is vital to the economic well-being of the
			 Nation.</text>
			</paragraph><paragraph id="HF479EA77B66D4CEC906D59D3AD0A6A9E"><enum>(2)</enum><text>Energy reliability
			 and conservation are the cornerstones of the inland waterways navigation
			 system.</text>
			</paragraph><paragraph id="HE9DC0568A8574E4396A0F5A75BA94F53"><enum>(3)</enum><text>The efficiency of
			 the inland waterways navigation system creates the optimum transportation mode
			 for bulk commodities in the United States.</text>
			</paragraph><paragraph id="H35C17C4F5B2844659EED31B42CC7114D"><enum>(4)</enum><text>The inland
			 waterways navigation system provides for environmental protection and ecosystem
			 sustainability.</text>
			</paragraph></section><section commented="no" id="H80A1EABECE09447B9F9BE2B7F20E3BE8"><enum>3.</enum><header>Purposes</header><text display-inline="no-display-inline">In order to ensure continued safe,
			 dependable, highly cost-effective, and environmentally sustainable navigation
			 on the inland and intracoastal waterways of the United States, the purposes of
			 this Act are to—</text>
			<paragraph commented="no" id="HCF01BDECD51148449765663B05606CFD"><enum>(1)</enum><text>improve program
			 and project management applicable to the construction and major rehabilitation
			 of navigation projects on such waterways;</text>
			</paragraph><paragraph commented="no" id="HACDD7E68BCE14052BF945A0B0AD14439"><enum>(2)</enum><text>optimize inland
			 waterways navigation system reliability;</text>
			</paragraph><paragraph commented="no" id="HB6C140C05D01406782972B96E1703AAB"><enum>(3)</enum><text>minimize the size
			 and scope of inland waterways navigation project completion schedules;</text>
			</paragraph><paragraph commented="no" id="HFC9DC669CD724931A0851BF9309D033D"><enum>(4)</enum><text>eliminate
			 preventable delays in inland waterways navigation project completion schedules;
			 and</text>
			</paragraph><paragraph commented="no" id="H53B08536EF6F4986ABC807DA1C71AD27"><enum>(5)</enum><text>make inland
			 waterways navigation capital investments through use of prioritization criteria
			 that seek to maximize system-wide benefits and minimize overall system
			 risk.</text>
			</paragraph></section><section id="H6DFB699EF1A644358D2B788446DBA2A4"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph commented="no" id="HC5947826DDBA4078B3C571263BBD125A"><enum>(1)</enum><header>Qualifying
			 project</header><text display-inline="yes-display-inline">The term
			 <term>qualifying project</term> means any construction or major rehabilitation
			 project for navigation infrastructure of the inland and intracoastal waterways
			 that is—</text>
				<subparagraph commented="no" id="H98EF4EB03D08433B8B25B470A2CE7CCC"><enum>(A)</enum><text>authorized before,
			 on, or after the date of enactment of this Act;</text>
				</subparagraph><subparagraph commented="no" id="HEB3D9AC94E12425F8EDA3FB1EAAFC491"><enum>(B)</enum><text>not completed as
			 of the date of enactment of this Act; and</text>
				</subparagraph><subparagraph commented="no" id="H94E56FB3D46E4D6E8C09B57341FDC89D"><enum>(C)</enum><text>funded at least in
			 part from the Inland Waterways Trust Fund.</text>
				</subparagraph></paragraph><paragraph commented="no" id="HEB475902414F461C9722DA51A837EB3C"><enum>(2)</enum><header>Major
			 rehabilitation project</header><text>The term <term>major rehabilitation
			 project</term> means a project for the restoration of a major project or major
			 project feature that has an estimated cost greater than $100,000,000.</text>
			</paragraph></section><section id="H6EE497F7929C4486BD35A9A4C06E8632"><enum>5.</enum><header>Project delivery
			 process reforms</header><text display-inline="no-display-inline">The Secretary
			 of the Army, acting through the Chief of Engineers, shall require the
			 following:</text>
			<paragraph id="HA3036D65980D4EB7B0F2E29B19F76878"><enum>(1)</enum><text display-inline="yes-display-inline">Formal project management training and
			 certification for project managers of a qualifying project.</text>
			</paragraph><paragraph id="H95955952677E4401BCD66242A6834BCB"><enum>(2)</enum><text display-inline="yes-display-inline">Assignment as project managers for a
			 qualifying project only of personnel fully certified by the Chief of
			 Engineers.</text>
			</paragraph><paragraph id="H300D372906544635AC624DDBD48F769F"><enum>(3)</enum><text display-inline="yes-display-inline">Cost estimation that is risk-based and has
			 a confidence level of at least 80 percent for a qualifying project.</text>
			</paragraph><paragraph id="H73A9491619B14444B740E6FA85720451"><enum>(4)</enum><text>Independent
			 external peer review and submission to Congress (in the case of a feasibility
			 report) or the Secretary (in the case of a rehabilitation evaluation report)
			 for any qualifying project—</text>
				<subparagraph id="H0B36623D443D478793DA559B2296BF17"><enum>(A)</enum><text>that—</text>
					<clause id="H80F28DF1E0E145FF893880EE7817DA34"><enum>(i)</enum><text>has
			 an estimated total project cost greater than $45,000,000;</text>
					</clause><clause id="H22A025605C9340BBBAA6A331CC770A18"><enum>(ii)</enum><text>is
			 subject to public safety concerns, as determined by the Chief of
			 Engineers;</text>
					</clause><clause id="H928F6147144447D7852791E6732B9F58"><enum>(iii)</enum><text display-inline="yes-display-inline">involves a high level of complexity or
			 novel or precedent-setting approaches, as determined by the Chief of Engineers;
			 or</text>
					</clause><clause id="H33487C39CB4746EFAFEC3985D0414D44"><enum>(iv)</enum><text>is
			 identified by the Chief of Engineers as a matter of significant interagency
			 interest; or</text>
					</clause></subparagraph><subparagraph id="H59F4304D8E874958AF449E3E3FE09E52"><enum>(B)</enum><text>for which such a
			 review has been requested by the Governor of any State affected by the
			 project.</text>
				</subparagraph></paragraph><paragraph commented="no" id="H0472AB3BB9C349D7BE4FB28B051B6EA6"><enum>(5)</enum><text>Appointment to a
			 project development team for a qualifying project of a member of the Inland
			 Waterways Users Board, selected by the Chairman of the Users Board.</text>
			</paragraph><paragraph id="HE8EA4F5DB66649C5B858B75F7B24D9BE"><enum>(6)</enum><text display-inline="yes-display-inline">Communication quarterly to the Inland
			 Waterways Users Board of the status of a qualifying project that is under
			 construction.</text>
			</paragraph><paragraph commented="no" id="H9F2325CFF2914546ADD5263FF5049891"><enum>(7)</enum><text>Inclusion of the
			 Chairman of the Inland Waterways Users Board and the project development team
			 appointee under paragraph (5) as signatories of the project management plan for
			 a qualifying project.</text>
			</paragraph><paragraph id="H7C25B39752A944B290C417FD03F4F0DE"><enum>(8)</enum><text>Establishment of a
			 system to identify and apply on a continuing basis lessons learned from prior
			 or ongoing projects so as to improve the likelihood of on-time and on-budget
			 completion of qualifying projects.</text>
			</paragraph><paragraph id="H1E9D4D8703F34D40B089B09BD0EA03FA"><enum>(9)</enum><text>Evaluation,
			 including through use of one or more pilot projects, of early contractor
			 involvement acquisition procedures to improve on-time and on-budget project
			 delivery performance.</text>
			</paragraph><paragraph id="H4DDF0ABFFDDE41C994B8EA1921E11963"><enum>(10)</enum><text>Such additional
			 measures that the Secretary determines will achieve the purposes of this Act,
			 including, as determined appropriate by the Secretary—</text>
				<subparagraph id="H68160BCEE0BB4930AB8E981C72B85F23"><enum>(A)</enum><text>implementation of
			 applicable practices and procedures drawn from the Secretary’s management of
			 the military construction program;</text>
				</subparagraph><subparagraph id="HF0BD877C12754C7CA5EEDC6667EC1473"><enum>(B)</enum><text>creation of one or
			 more centers of expertise for the design and review of qualifying
			 projects;</text>
				</subparagraph><subparagraph id="H368BBF697DE645BC9D317DA5B2360C70"><enum>(C)</enum><text>development and
			 use of a portfolio of standard designs for inland navigation locks;</text>
				</subparagraph><subparagraph commented="no" id="HB306B0839F6D4630B1337DB45CAB53B5"><enum>(D)</enum><text>use of
			 full-funding contracts or formulation of a revised continuing contracts clause;
			 and</text>
				</subparagraph><subparagraph id="HED0877B1FE5B404880175A99F427B4BD"><enum>(E)</enum><text>establishment of
			 procedures for recommending new project construction starts using a capital
			 projects business model.</text>
				</subparagraph></paragraph></section><section commented="no" id="HAD49B2D5956D4DCA9F323F45C03A8C28"><enum>6.</enum><header>20-year capital
			 investment program</header>
			<subsection commented="no" id="H30CF296AAA4C4589B3532B97E594A06F"><enum>(a)</enum><header>Program
			 required</header><text>Not later than 1 year after the date of enactment of
			 this Act, the Secretary of the Army, working in conjunction with the Inland
			 Waterways Users Board, shall submit to Congress a 20-year program for making
			 capital investments on the inland and intracoastal waterways based on
			 application of objective national project-selection prioritization criteria, as
			 developed by the Secretary. Such program may be based on the 20-year capital
			 investment strategy contained in the Inland Marine Transportation System (IMTS)
			 Capital Projects Business Model, Final Report published on April 13, 2010, as
			 approved by the Inland Waterways Users Board.</text>
			</subsection><subsection commented="no" id="HC1CD36724ED84371AA3C00890EC1138A"><enum>(b)</enum><header>Annual review
			 and update</header><text display-inline="yes-display-inline">Beginning not
			 later than 1 year after the date on which a 20-year program is submitted to
			 Congress under subsection (a), and each year thereafter, the Secretary of the
			 Army, working in conjunction with the Inland Waterways Users Board, shall
			 submit to Congress an updated 20-year program. Such updated program shall
			 include identification and explanation of any changes that were made to the
			 prior year’s project-specific recommendations, including any changes that were
			 made to the objective national project-selection prioritization criteria that
			 were used to develop the updated recommendations.</text>
			</subsection><subsection commented="no" id="HD3BCD19DB1214AFF95E2E1D2ADEACC53"><enum>(c)</enum><header>Strategic review
			 and update</header><text display-inline="yes-display-inline">Not later than 5
			 years after the date of enactment of this Act, and every 5 years thereafter,
			 the Secretary of the Army, working in conjunction with the Inland Waterways
			 Users Board, shall submit to Congress a strategic review of the capital
			 investment program for the Inland Marine Transportation System and make such
			 revisions to the program as the Secretary and Users Board jointly consider
			 appropriate.</text>
			</subsection></section><section id="H784743B66C4B4F1C8996757D69BD2EC4"><enum>7.</enum><header>Cost sharing for
			 qualifying projects</header>
			<subsection id="HC18CA2AD9EF8403CBFEF2FB067D60914"><enum>(a)</enum><header>General
			 rule</header><text display-inline="yes-display-inline">Notwithstanding any
			 other provision of law, and subject to subsection (b), one-half of the cost of
			 construction of a qualifying project shall be paid only from amounts
			 appropriated from the general fund of the Treasury, and one-half of such costs
			 shall be paid only from amounts appropriated from the Inland Waterways Trust
			 Fund.</text>
			</subsection><subsection id="H421B5BD33F4F4DA8881D3670A4B8768C"><enum>(b)</enum><header>Special rule for
			 dams</header><text display-inline="yes-display-inline">Notwithstanding
			 subsection (a), the cost of construction of a dam shall be paid only from
			 amounts appropriated from the general fund of the Treasury.</text>
			</subsection></section><section id="HCDE4CD4398164CF980E3A6FF424A3943"><enum>8.</enum><header>Limitation on
			 expenditures from the Inland Waterways Trust Fund</header><text display-inline="no-display-inline">Section 9506 of the Internal Revenue Code of
			 1986 is amended—</text>
			<paragraph id="H6C2B5776DC27408A9209D1B0C58E017F"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (c)(1), by—</text>
				<subparagraph id="H28C3B93411CA41F1A1A624BD1B1B027B"><enum>(A)</enum><text>inserting
			 <quote>and subject to subsection (d),</quote> after <quote>Except as provided
			 in paragraph (2),</quote>; and</text>
				</subparagraph><subparagraph id="HB24ADEE880C0444287B1B3D6ABBFA319"><enum>(B)</enum><text>striking <quote>,
			 as in effect on the date of the enactment of this section</quote> and inserting
			 <quote>, provided that such expenditures may not exceed 50 percent of the total
			 cost of the construction or rehabilitation</quote>; and</text>
				</subparagraph></paragraph><paragraph id="H0A9B4FFAE77B4293998F700226B35B12"><enum>(2)</enum><text>by inserting at
			 the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HF63501C239EA4F7983FCD4A825157FCB" style="OLC">
					<subsection id="H2F80BB21AADF470482B949A649DD2421"><enum>(d)</enum><header>Limitation on
				expenditures from trust fund</header><paragraph commented="no" display-inline="yes-display-inline" id="HE2F77CC6177940D3916902A3578D5609"><enum>(1)</enum><text display-inline="yes-display-inline">Amounts in the Inland Waterways Trust Fund
				shall not be available for expenditures for—</text>
							<subparagraph id="H4064BDFF1C03440E9285F3ED8D2B57CD" indent="up1"><enum>(A)</enum><text>construction or rehabilitation of
				dams; or</text>
							</subparagraph><subparagraph id="H9EA89D881A034D329754CB4D969385F6" indent="up1"><enum>(B)</enum><text>any rehabilitation expenditure that
				does not equal or exceed $100,000,000.</text>
							</subparagraph></paragraph><paragraph id="H5A98A9882F1942DCAE54BA3336E521E3" indent="up1"><enum>(2)</enum><text>Amounts in the Inland Waterways Trust
				Fund may not be used to pay for any part of the cost to construct an authorized
				Federal project that exceeds the sum of—</text>
							<subparagraph id="H839A136018484E7BAFD987A59C1DD281"><enum>(A)</enum><text>the total authorized cost to construct
				the Federal project as specified in the Public Law that authorized construction
				of the project or, in the case of a rehabilitation project, in the relevant
				rehabilitation evaluation report;</text>
							</subparagraph><subparagraph id="H18AADFF9238141F0B6343401C2B4CEEC"><enum>(B)</enum><text>an adjustment for inflation for the
				time that elapses between the date of the project’s authorization and the date
				on which construction of the project begins; and</text>
							</subparagraph><subparagraph id="H0FA730D7F8754D79AF93155D4281E3F6"><enum>(C)</enum><text>an additional amount, if any, jointly
				agreed to by the Secretary and the Inland Waterways Users Board as appropriate
				to the
				project.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HBE748E62353B4A918541564DD7E6C83E"><enum>9.</enum><header>Revision to
			 inland waterways user fee</header><text display-inline="no-display-inline">Section 4042(b)(2)(A) of the Internal
			 Revenue Code of 1986 is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="H10406227BC694D9EB021170247EEA63E" style="OLC">
				<subparagraph id="H23DEFD5B851E447187143ABC3A75E837"><enum>(A)</enum><text display-inline="yes-display-inline">The Inland Waterways Trust Fund financing
				rate is the rate determined in accordance with the following table:</text>
