		<section id="HC76A2F72395A4E53A24579CD538F3E4C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Protecting U.S. Missile Defense
			 Information Act of 2013</short-title></quote>.</text>
		</section><section id="H146617FFC74E49BD9588E3C444DA9CB2"><enum>2.</enum><header>Report and
			 briefings on missile defense discussions between the United States and the
			 Russian Federation</header>
			<subsection id="H4FEEDFBC1F8448D7B536340FB1C0CD48"><enum>(a)</enum><header>Report
			 required</header><text display-inline="yes-display-inline">The President shall
			 submit to the congressional defense committees a semi-annual report on any
			 discussions on missile defense between the United States Government and the
			 Government of the Russian Federation during the preceding 6-month
			 period.</text>
			</subsection><subsection id="HBCAABE88BDE3487FAC1E7C7F9EC4A922"><enum>(b)</enum><header>Matters To be
			 included</header><text display-inline="yes-display-inline">The report required
			 by subsection (a) shall include the following with respect to any such
			 discussions:</text>
				<paragraph id="H6E3FE0228BC8492DA892814F05196205"><enum>(1)</enum><text>The date or dates
			 of the discussions.</text>
				</paragraph><paragraph id="H4A3FC3C803644BB4B2FF1E1922480518"><enum>(2)</enum><text>The official or
			 officials of each government taking part in the discussions.</text>
				</paragraph><paragraph id="H2D81A91348B04DC89F7F9AED0D0925B2"><enum>(3)</enum><text>A
			 summary of the discussions.</text>
				</paragraph><paragraph id="H3468028CC467453884297C657DCAE7C0"><enum>(4)</enum><text>A
			 copy of any documents or other materials exchanged during or as a result of the
			 discussions.</text>
				</paragraph></subsection><subsection id="H265ABDDC1E1143C7AA593C01932DE9D7"><enum>(c)</enum><header>Initial
			 report</header><text display-inline="yes-display-inline">The initial report
			 required by subsection (a) shall be submitted not later than 180 days after the
			 date of the enactment of this Act and in addition to addressing any such
			 discussions during the preceding 6-month period shall also address any such
			 discussions during the 10-year period ending on the date of the enactment of
			 this Act.</text>
			</subsection><subsection id="H3D86980EA9704EB191E10E100D6CF687"><enum>(d)</enum><header>Form</header><text>The
			 reports required by subsection (a) shall be submitted in unclassified form, but
			 may contain a classified annex, if necessary.</text>
			</subsection><subsection id="H563FBD573C9747DE9333DD13305B2205"><enum>(e)</enum><header>Congressional
			 briefings</header><text display-inline="yes-display-inline">In conjunction with
			 the submission of the report required by subsection (a), the President shall
			 brief the congressional defense committees on the matters contained in the
			 report and any other matters relating to the report that the President
			 determines to be appropriate.</text>
			</subsection></section><section commented="no" id="H5691A2EE0DA04616A5D093C7EFD7FBD9"><enum>3.</enum><header>Reports and
			 briefings on declassification of certain missile defense information</header>
			<subsection commented="no" id="H0FC393846D4D48BF8356181180C05A46"><enum>(a)</enum><header>Report
			 required</header><text display-inline="yes-display-inline">The President shall
			 submit to the congressional defense committees a semi-annual report on meetings
			 held by the National Disclosure Policy Committee with respect to declassifying
			 documents containing information on the missile defense systems of the United
			 States.</text>
			</subsection><subsection commented="no" id="HE0DC9DA2CBBE4050B980075B8C286CD3"><enum>(b)</enum><header>Matters To be
			 included</header><text display-inline="yes-display-inline">The report required
			 by subsection (a) shall include the following with respect to any such
			 meetings:</text>
				<paragraph commented="no" id="HE0017483AD8340399660B968B4366E4D"><enum>(1)</enum><text>The date of the
			 meeting.</text>
				</paragraph><paragraph commented="no" id="HF8E4F317B92349539A1F8DABAFFA1ACC"><enum>(2)</enum><text display-inline="yes-display-inline">A description of the documents considered
			 by the National Disclosure Policy Committee during the meeting.</text>
				</paragraph><paragraph commented="no" id="HDD99C07B47ED469281D3FF699A455FB3"><enum>(3)</enum><text>The determination
			 made by the Committee with respect to declassifying such documents, including a
			 summary of the reasoning used to make such determination.</text>
				</paragraph></subsection><subsection commented="no" id="HC5E7261260CC4D89A41E8FC397EB511E"><enum>(c)</enum><header>Initial
			 report</header><text display-inline="yes-display-inline">The initial report
			 required by subsection (a) shall be submitted not later than 180 days after the
			 date of the enactment of this Act and in addition to addressing any such
			 meetings during the preceding 6-month period shall also address any such
			 meetings during the 10-year period ending on the date of the enactment of this
			 Act.</text>
			</subsection><subsection commented="no" id="H001D8C1677FD4565B14AFD8ABDDCA991"><enum>(d)</enum><header>Form</header><text>The
			 reports required by subsection (a) shall be submitted in unclassified form, but
			 may contain a classified annex, if necessary.</text>
			</subsection><subsection commented="no" id="H7F860C6CD55B49EB9AC51B81982B6748"><enum>(e)</enum><header>Congressional
			 briefings</header><text display-inline="yes-display-inline">In conjunction with
			 the submission of the report required by subsection (a), the President shall
			 brief the congressional defense committees on the matters contained in the
			 report and any other matters relating to the report that the President
			 determines to be appropriate.</text>
			</subsection></section><section commented="no" id="H46822022BF7D481DA6BB75983F2701EA"><enum>4.</enum><header>Limitation on
			 funds to provide the Russian Federation with access to certain missile defense
			 technology</header><text display-inline="no-display-inline">None of the funds
			 authorized to be appropriated or otherwise made available for fiscal year 2014
			 or any fiscal year thereafter for the Department of Defense may be used to
			 provide the Russian Federation with access to information regarding—</text>
			<paragraph commented="no" id="HE1C18F8EB599490BAC6815550D4B2F20"><enum>(1)</enum><text display-inline="yes-display-inline">missile defense technology of the United
			 States relating to hit-to-kill technology; or</text>
			</paragraph><paragraph commented="no" id="HC728CD1CE16345F8AF268C9866A92A1E"><enum>(2)</enum><text>telemetry data
			 with respect to missile defense interceptors or target vehicles.</text>
			</paragraph></section><section id="H1BD81C59157B468787C774D8DA5814F0"><enum>5.</enum><header>Limitation on
			 funds to negotiate or implement executive agreements relating to United States
			 missile defense capabilities</header>
			<subsection commented="no" id="H496AE18703844A7F9007E23469411950"><enum>(a)</enum><header>Statement of
			 policy</header><text display-inline="yes-display-inline">Congress declares that
			 the United States shall not be bound, politically or otherwise, by the terms of
			 any executive agreement relating to the missile defense capabilities of the
			 United States, including basing, locations, capabilities, and numbers of
			 missiles with respect to such missile defense capabilities.</text>
			</subsection><subsection id="HF0E49857BC124F9982E6583B15B467F7"><enum>(b)</enum><header>Limitation on
			 funds</header><text display-inline="yes-display-inline">None of the funds
			 authorized to be appropriated or otherwise made available for fiscal year 2014
			 or any fiscal year thereafter for the Department of Defense may be used—</text>
				<paragraph id="H70DE07928C7047F49DC063F03DF006EC"><enum>(1)</enum><text>to negotiate or
			 implement any executive agreement relating to the missile defense capabilities
			 of the United States, including basing, locations, capabilities, and numbers of
			 missiles with respect to such missile defense capabilities; or</text>
				</paragraph><paragraph id="H8C20039A11CC442B879AB7887033ACE7"><enum>(2)</enum><text>to implement rules
			 of engagement or Guidance for Employment of Force relating to such executive
			 agreement.</text>
				</paragraph></subsection><subsection id="H080A1F0FACC44067817BB02712CF9969"><enum>(c)</enum><header>Rule of
			 construction</header><text display-inline="yes-display-inline">Subsection (b)
			 shall not apply with respect to the use of funds to negotiate or implement any
			 executive agreement with a country with respect to which the United States has
			 entered into a treaty of alliance or has a security guarantee.</text>
			</subsection><subsection id="H28CF79CCCBD849C9B17CAB903AE7899D"><enum>(d)</enum><header>Executive
			 agreement defined</header><text>In this section, the term <term>executive
			 agreement</term> means an international agreement other than—</text>
				<paragraph id="HAA1352BAA46A4572AFE31223B6D971F1"><enum>(1)</enum><text>an agreement that
			 is in the form of a treaty under article II, section 2, clause 2 of the
			 Constitution of the United States; or</text>
				</paragraph><paragraph id="H11B7EF97914440C39FDEFAE5E90D85B9"><enum>(2)</enum><text display-inline="yes-display-inline">an agreement that requires implementing
			 legislation to be enacted into law for the agreement to enter into force with
			 respect to the United States.</text>
				</paragraph></subsection></section><section id="HB40D86C0867C42A7B48B0966CEBD47D2"><enum>6.</enum><header>Disclosure of and
			 report on Russian Federation support of ballistic missile defense programs of
			 China, Syria, Iran, and North Korea</header>
			<subsection id="H5B68F3B8DE794B55A1007B3EB7EAA311"><enum>(a)</enum><header>Disclosure of
			 support</header><text>The President shall seek to encourage the Government of
			 the Russian Federation to disclose any support by the Russian Federation or
			 Russian entities for the ballistic missile programs of the People’s Republic of
			 China, Syria, Iran, or North Korea.</text>
			</subsection><subsection id="H23D30530378E43059A1B8EE3181049A7"><enum>(b)</enum><header>Report
			 required</header><text display-inline="yes-display-inline">The President shall
			 submit to the congressional defense committees a semi-annual report on any
			 disclosure by the Government of the Russian Federation of any such support
			 during the preceding 6-month period.</text>
			</subsection><subsection id="HA962A576A67242E28CE3D56746BBED88"><enum>(c)</enum><header>Initial
			 report</header><text>The initial report required by subsection (b) shall be
			 submitted not later than 180 days after the date of the enactment of this Act
			 and in addition to addressing any such support during the preceding 6-month
			 period shall also address any such support during the 10-year period ending on
			 the date of the enactment of this Act.</text>
			</subsection><subsection id="HCA29611502754EAD9526C21E5CDDA6CD"><enum>(d)</enum><header>Form</header><text display-inline="yes-display-inline">The report required by subsection (b) shall
			 be submitted in unclassified form, but may contain a classified annex, if
			 necessary.</text>
			</subsection></section><section id="H15839B329DEC475393717B63D6B3B4A2"><enum>7.</enum><header>Congressional
			 defense committees defined</header><text display-inline="no-display-inline">In
			 this Act, the term <term>congressional defense committees</term> has the
			 meaning given that term in <external-xref legal-doc="usc" parsable-cite="usc/10/101">section 101(a)(16)</external-xref> of title 10, United States
			 Code.</text>
