2.In this Act:
(1)Appropriate
Congressional committeesThe
term appropriate Congressional committees means the Committee on
Science, Space, and Technology of the House of Representatives and the
Committee on Commerce, Science, and Transportation and the Committee on Energy
and Natural Resources of the Senate.
(2)The term Center means the
Research and Development Information Center established in section
101(b).
(3)The
term Department means the Department of Energy.
(4)The term energy
critical element means any of a class of chemical elements that are
critical to one or more new, energy-related technologies such that a shortage
of such element would significantly inhibit large-scale deployment of
technologies that produce, transmit, store, or conserve energy.
(5)The term program
means the
program of research, development, demonstration, and commercial application to
assure the long-term, secure, and sustainable supply of energy critical
elements sufficient to satisfy the national security, economic well-being, and
industrial production needs of the United States established in section
101(a).
(6)The term rare earth materials means any of
the following chemical elements in any of their physical forms or chemical
combinations:
(A)Scandium.
(B)Yttrium.
(C)Lanthanum.
(D)Cerium.
(E)Praseodymium.
(F)Neodymium.
(G)Promethium.
(H)Samarium.
(I)Europium.
(J)Gadolinium.
(K)Terbium.
(L)Dysprosium.
(M)Holmium.
(N)Erbium.
(O)Thulium.
(P)Ytterbium.
(Q)Lutetium.
(7)The
term Secretary means the Secretary of Energy.

Elements</header>
<section id="H7525B29E9BF5424F9CD1D06B0E53FDCA" section-type="subsequent-section"><enum>101.</enum><header>Energy critical
elements program</header>
<subsection id="H1DA2DFF253C8412E86F9E15E19890AC0"><enum>(a)</enum><header>Establishment of
program</header>
<paragraph id="HD961785BEFDE4F2195C14DA9A5DF1039"><enum>(1)</enum><header>In
general</header><text>There is established in the Department a program of
research, development, demonstration, and commercial application to assure the
long-term, secure, and sustainable supply of energy critical elements
sufficient to satisfy the national security, economic well-being, and
industrial production needs of the United States.</text>
</paragraph><paragraph id="HC1D7023AA12548189961FBE9EF727DEE"><enum>(2)</enum><header>Program
activities</header><text display-inline="yes-display-inline">The program shall
support activities to—</text>
<subparagraph id="HB55F677AB08645CEAF5FE6A284786346"><enum>(A)</enum><text display-inline="yes-display-inline">better characterize and quantify virgin
stocks of energy critical elements using theoretical geochemical
research;</text>
</subparagraph><subparagraph id="HB2BBB2CCBAD841C9B997FC0D2B87896B"><enum>(B)</enum><text display-inline="yes-display-inline">explore, discover, and recover energy
critical elements using advanced science and technology;</text>
</subparagraph><subparagraph id="H8E9280CBD3164A4CB6437F785EEC3E09"><enum>(C)</enum><text display-inline="yes-display-inline">improve methods for the extraction,
processing, use, recovery, and recycling of energy critical elements;</text>
</subparagraph><subparagraph id="H434E06E2C6544533B9479BBD97BD2FE0"><enum>(D)</enum><text display-inline="yes-display-inline">improve the understanding of the
performance, processing, and adaptability in engineering designs of energy
critical elements;</text>
</subparagraph><subparagraph id="HE1B41046D2454BEB962B3CCE629234BD"><enum>(E)</enum><text display-inline="yes-display-inline">identify and test alternative materials
that can be substituted for energy critical elements in particular
applications; and</text>
</subparagraph><subparagraph commented="no" id="HE120AC83CC1343B1A7B16027B810B537"><enum>(F)</enum><text>engineer and test
applications that—</text>
<clause commented="no" id="H12CBD8FE81434AEE807C4E741ABB6BAF"><enum>(i)</enum><text display-inline="yes-display-inline">use recycled energy critical
elements;</text>
</clause><clause commented="no" id="HDBBAE11AF8824F93B65571C6570CFEDB"><enum>(ii)</enum><text>use alternative
materials; or</text>
</clause><clause commented="no" id="H87F05D6BAD7447129D2643DF1A3F158D"><enum>(iii)</enum><text display-inline="yes-display-inline">seek to minimize energy critical element
content.</text>
</clause></subparagraph></paragraph><paragraph id="H351E9DF34EE94581843226390D111390"><enum>(3)</enum><header>Improved
processes and technologies</header><text display-inline="yes-display-inline">To
the maximum extent practicable, the Secretary shall support new or
significantly improved processes and technologies as compared to those
currently in use in the energy critical elements industry.</text>
</paragraph><paragraph id="HC6D5A80A60CC4957A65FAA0CFE2C40FB"><enum>(4)</enum><header>Expanding
participation</header><text display-inline="yes-display-inline">In carrying out
the program, the Secretary shall encourage multidisciplinary collaborations of
participants, extensive opportunities for students at institutions of higher
education, or both.</text>
</paragraph><paragraph id="HA89123AC00674869B611F4F196B00BF0"><enum>(5)</enum><header>Consistency</header><text>The
program shall be consistent with the policies and programs in the National
Materials and Minerals Policy, Research and Development Act of 1980 (30 U.S.C.
1601 et seq.).</text>
</paragraph><paragraph id="H1245384CF9BE41AB94C98B4FEAE0CB0E"><enum>(6)</enum><header>International
collaboration</header><text display-inline="yes-display-inline">In carrying out
the program, the Secretary shall collaborate, to the extent practicable, on
activities of mutual interest with the relevant agencies of foreign countries
with interests relating to energy critical elements.</text>
</paragraph></subsection><subsection id="HCE847E3FF0924F72895E1CE4E99D6743"><enum>(b)</enum><header>Research and
Development Information Center</header>
<paragraph id="H8EE2E0D1BE1F4CB6A986C78FEBC1A9D9"><enum>(1)</enum><header>In
general</header><text>To collect, catalogue, disseminate, and archive
information on energy critical elements, the Secretary shall establish, through
a competitive process, a Research and Development Information Center.</text>
</paragraph><paragraph id="H83D8FC57D0F94CB190FC4F3ADA26162D"><enum>(2)</enum><header>Center
activities</header>
<subparagraph id="H44D02B06FF2B4CBF8A2344D3EEAB233B"><enum>(A)</enum><header>In
general</header><text>The Center shall—</text>
<clause id="H4B96D46343D94EE7AE7C79F523E22CC9"><enum>(i)</enum><text>serve as the
repository for scientific and technical data generated by the research and
development activities funded under this section;</text>
</clause><clause id="H761FF9E1175949CCA9429F8D81FF4BC8"><enum>(ii)</enum><text>assist scientists
and engineers in making the fullest possible use of the Center’s data
holdings;</text>
</clause><clause id="HEA084E7E380740318C65A7E43476E1DF"><enum>(iii)</enum><text display-inline="yes-display-inline">seek and incorporate other information on
energy critical elements to enhance the Center’s utility for program
participants and other users;</text>
</clause><clause id="HB8E46255B2B8496AB6DA29144EBFE6BC"><enum>(iv)</enum><text>provide advice to
the Secretary concerning the program; and</text>
</clause><clause id="H51D4FF796E304347B1D27499D34D8E40"><enum>(v)</enum><text display-inline="yes-display-inline">host conferences, at least annually, for
participants in the program and other interested parties to promote information
sharing and encourage new collaborative activities.</text>
</clause></subparagraph><subparagraph id="H7FBDC9269504486A9A86B533A689F5F7"><enum>(B)</enum><header>Restriction</header><text>Not
more than 2.5 percent of the amounts made available pursuant to this section
may be used for hosting conferences under subparagraph (A)(v).</text>
</subparagraph></paragraph></subsection><subsection id="H6802A44FBD924DC087C92FB6706C12C4"><enum>(c)</enum><header>Plan</header>
<paragraph id="H50C867EEBF37410CA920AF0708435617"><enum>(1)</enum><header>In
general</header><text display-inline="yes-display-inline">Within 180 days after
the date of enactment of this Act and biennially thereafter, the Secretary
shall prepare and submit to the appropriate Congressional committees a plan to
carry out the program and the Center.</text>
</paragraph><paragraph id="H1D462CF35F6D4457A606D41E5E61C672"><enum>(2)</enum><header>Specific
requirements</header><text>The plan shall include a description of—</text>
<subparagraph id="H4C12D6F3324E4B5B87D3310D4BF77C69"><enum>(A)</enum><text>the research and
development activities to be carried out by the program during the subsequent 2
years;</text>
</subparagraph><subparagraph id="HF196B4065A564A159C87EE81625B90CF"><enum>(B)</enum><text display-inline="yes-display-inline">the expected contributions of the program
and the Center to the creation of innovative methods and technologies for the
efficient and sustainable provision of energy critical elements to the domestic
economy;</text>
</subparagraph><subparagraph commented="no" id="H66AFD314EC6E42C0A399F8910ACD7285"><enum>(C)</enum><text>the technical
criteria to be used to evaluate applications for loan guarantees under section
1706 of the Energy Policy Act of 2005 (as added by
<internal-xref idref="H54D92D3A687A49C7A55A895892D2D34E" legis-path="103.">section 103</internal-xref>);</text>
</subparagraph><subparagraph commented="no" id="H3F4448BE406B455596D035FF79030080"><enum>(D)</enum><text>any projects
receiving loan guarantee support under such section 1706 and the status of such
projects;</text>
</subparagraph><subparagraph id="HCF0373E3DBD04BD59B3DB1E02383DD01"><enum>(E)</enum><text>how the program is
promoting the broadest possible participation by academic, industrial, and
other contributors; and</text>
</subparagraph><subparagraph id="H426773852F0A4DC28B2843AC961A3545"><enum>(F)</enum><text>actions taken or
proposed that reflect recommendations from the assessment conducted under
subsection (d) or the Secretary’s rationale for not taking action pursuant to
any recommendation from such assessment for plans submitted following the
completion of the assessment under such subsection.</text>
</subparagraph></paragraph><paragraph id="H9B58382EDBE749A48971EE8AF2453D71"><enum>(3)</enum><header>Consultation</header><text display-inline="yes-display-inline">In preparing each plan under
<internal-xref idref="H50C867EEBF37410CA920AF0708435617" legis-path="101.(c)(1)">paragraph (1)</internal-xref>, the Secretary shall
consult with appropriate representatives of industry, institutions of higher
education, Department of Energy national laboratories, professional and
technical societies, and other entities, as determined by the Secretary.</text>
</paragraph></subsection><subsection id="HC385C77441DA4C2B9133C3E39F7B10F5"><enum>(d)</enum><header>Assessment</header>
<paragraph id="H680498D23F744C35BE9A8C6C6341D253"><enum>(1)</enum><header>In
general</header><text display-inline="yes-display-inline">After the program has
been in operation for 4 years, the Secretary shall offer to enter into a
contract with the National Academy of Sciences under which the National Academy
shall conduct an assessment of the program, including the operations and
activities of the Center.</text>
</paragraph><paragraph id="HECD85044F1B84558BE4C9A378CC86347"><enum>(2)</enum><header>Inclusions</header><text display-inline="yes-display-inline">The assessment shall include the
recommendation of the National Academy of Sciences that the program should
be—</text>
<subparagraph id="HE9E585F551A34023972643D2EEDA09C7"><enum>(A)</enum><text>continued,
accompanied by a description of any improvements needed in the program;
or</text>
</subparagraph><subparagraph id="H487A641B184A425ABE19F577C79A5E25"><enum>(B)</enum><text>terminated,
accompanied by a description of the lessons learned from the execution of the
program.</text>
</subparagraph></paragraph><paragraph id="H524AE749D8D245D0A02A10646C2BC324"><enum>(3)</enum><header>Availability</header><text>The
assessment shall be made available to Congress and the public upon
completion.</text>
</paragraph></subsection><subsection id="HD4E4E0D0D0D14234BDDBF2D79F0260F0"><enum>(e)</enum><header>Authorization of
appropriations</header>
<paragraph id="H0AEE2FE99DAA4EB5941D36EB8FA1EE4A"><enum>(1)</enum><header>In
general</header><text>There are authorized to be appropriated to the Secretary
to carry out this section the following sums:</text>
<subparagraph id="HCE63DF9A91F641C7A492AC75F9069412"><enum>(A)</enum><text>For fiscal year
2014, $15,000,000.</text>
</subparagraph><subparagraph id="H99401E167714487FB4680FF2042A9D28"><enum>(B)</enum><text>For fiscal year
2015, $15,000,000.</text>
</subparagraph><subparagraph id="HBEEC30700FF14CFA880DD8E26CD7B02D"><enum>(C)</enum><text>For fiscal year
2016, $15,000,000.</text>
</subparagraph><subparagraph commented="no" id="HBDA8DB17A0DA4D039C57C719F6B06DEC"><enum>(D)</enum><text display-inline="yes-display-inline">For fiscal year 2017, $15,000,000.</text>
</subparagraph><subparagraph commented="no" id="HECED50F9655C410CBB2311070DB54EF7"><enum>(E)</enum><text display-inline="yes-display-inline">For fiscal year 2018, $15,000,000.</text>
</subparagraph></paragraph><paragraph id="H214B780EB1D341A0B4AEA68D9CB287EA"><enum>(2)</enum><header>Assessment</header><text>From
the amounts authorized under paragraph (1), there are authorized to be
appropriated to the Secretary $700,000 to enter into a contract under
subsection (d)(1).</text>
</paragraph><paragraph id="H55E2B98544294B699A3DD878FE28E862"><enum>(3)</enum><header>Availability</header><text>Such
sums shall remain available until expended.</text>
</paragraph></subsection></section><section id="H288DEFC7721742659465712532C77ED3"><enum>102.</enum><header>Supply of
energy critical elements</header><text display-inline="no-display-inline">The
President, acting through the Office of Science and Technology Policy,
shall—</text>
<paragraph id="HA0B797C6ECA7400A9E6E0D170452F9F7"><enum>(1)</enum><text display-inline="yes-display-inline">coordinate the actions of applicable
Federal agencies to promote an adequate and stable supply of energy critical
elements necessary to maintain national security, economic well-being, and
industrial production with appropriate attention to a long-term balance between
resource production, energy use, a healthy environment, natural resources
conservation, and social needs;</text>
</paragraph><paragraph id="H5F86301D8A8B43C08246EDCD960523DC"><enum>(2)</enum><text>identify energy
critical elements and establish early warning systems for supply problems of
energy critical elements;</text>
</paragraph><paragraph id="H78AFA17D9F4E4FC3AE8FA53F77049D2B"><enum>(3)</enum><text>establish a
mechanism for the coordination and evaluation of Federal programs with energy
critical element needs, including Federal programs involving research and
development, in a manner that complements related efforts carried out by the
private sector and other domestic and international agencies and
organizations;</text>
</paragraph><paragraph id="H011B1C967ECE4CB6B8E923DBF71F9754"><enum>(4)</enum><text>promote and
encourage private enterprise in the development of an economically sound and
stable domestic energy critical elements supply chain;</text>
</paragraph><paragraph id="H6F5B6792226A4AB2A679C91C1B64AEF9"><enum>(5)</enum><text>promote and
encourage the recycling of energy critical elements, taking into account the
logistics, economic viability, environmental sustainability, and research and
development needs for completing the recycling process;</text>
</paragraph><paragraph id="H2872B354FE11481BB1BBF5D0F9786A5B"><enum>(6)</enum><text>assess the need
for and make recommendations concerning the availability and adequacy of the
supply of technically trained personnel necessary for energy critical elements
research, development, extraction, and industrial production, with a particular
focus on the problem of attracting and maintaining high quality professionals
for maintaining an adequate supply of energy critical elements; and</text>
</paragraph><paragraph id="H8AEA62D312EB4085866511A6113BE23F"><enum>(7)</enum><text>report to Congress
on activities and findings under this section.</text>
</paragraph></section><section id="H54D92D3A687A49C7A55A895892D2D34E"><enum>103.</enum><header>Rare earth
materials loan guarantee program</header>
<subsection id="HDB9707D952B841AE9C45B1ABBC759451"><enum>(a)</enum><header>Amendment</header><text display-inline="yes-display-inline">Title XVII of the Energy Policy Act of 2005
(<external-xref legal-doc="usc" parsable-cite="usc/42/16511">42 U.S.C. 16511 et seq.</external-xref>) is amended by adding at the end the following new
section:</text>
<quoted-block display-inline="no-display-inline" id="H75AB00D6A1AB4D58A7C0E22FC1663104" style="OLC">
<section id="HFF60AA14D20747D190FAE677F4E57F66"><enum>1706.</enum><header>Temporary
program for rare earth materials revitalization</header>
<subsection id="HC36EBF62D05A43E69B70401254AEC8F4"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">As part of the
program established in section 101 of the <short-title>Securing Energy Critical Elements and American Jobs Act of
2013</short-title>, the Secretary is authorized to make guarantees under this
title for the commercial application of new or significantly improved
technologies (compared to technologies currently in use in the United States)
for the following categories of projects:</text>
<paragraph id="HA6428D7DA3FB48C598C9CB6D4A31C780"><enum>(1)</enum><text display-inline="yes-display-inline">The separation and recovery of rare earth
materials from ores or other sources.</text>
</paragraph><paragraph id="H151E26071115464F8C56658E7993E281"><enum>(2)</enum><text>The preparation of
rare earth materials in oxide, metal, alloy, or other forms needed for national
security, economic well-being, or industrial production purposes.</text>
</paragraph><paragraph id="H134E1A929DB3407C993DB781B2516EEC"><enum>(3)</enum><text display-inline="yes-display-inline">The application of rare earth materials in
the production of improved—</text>
<subparagraph id="HE4355EF078AB4B428DD75E7990469D7B"><enum>(A)</enum><text>magnets;</text>
</subparagraph><subparagraph id="H0884F30DB40140CDAAB03AAE7F19E084"><enum>(B)</enum><text>batteries;</text>
</subparagraph><subparagraph id="H7D91CCAF1DB4474FA832094797CB7D1F"><enum>(C)</enum><text display-inline="yes-display-inline">refrigeration systems;</text>
</subparagraph><subparagraph id="H26494660585843C9B9E80BB27E179857"><enum>(D)</enum><text>optical
systems;</text>
</subparagraph><subparagraph id="HB8216020F4894B71854F92424B451EEB"><enum>(E)</enum><text>electronics;
and</text>
</subparagraph><subparagraph id="H8878CE0157944EFC8F9A879250706F04"><enum>(F)</enum><text>catalysis.</text>
</subparagraph></paragraph><paragraph id="H64B8EAC6777C4357870BB5D903ADA0A1"><enum>(4)</enum><text>The application of
rare earth materials in other uses, as determined by the Secretary.</text>
</paragraph></subsection><subsection id="H7F66B40B174E4F3AB5F0832B484E0F40"><enum>(b)</enum><header>Timeliness</header><text display-inline="yes-display-inline">The Secretary shall seek to minimize delay
in approving loan guarantee applications, consistent with appropriate
protection of taxpayer interests.</text>
</subsection><subsection id="H9B88A27A94D848259266851287AD1842"><enum>(c)</enum><header>Cooperation</header><text>To
the maximum extent practicable, the Secretary shall cooperate with appropriate
private sector participants to achieve a complete rare earth materials
production capability in the United States within 5 years after the date of
enactment of the <short-title>Securing Energy Critical
Elements and American Jobs Act of 2013</short-title>.</text>
</subsection><subsection id="HA58603E363E240B1A7B6634EAC52E592"><enum>(d)</enum><header>Sunset</header><text>The
authority to enter into guarantees under this section shall expire on September
30,
2021.</text>
</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
</subsection><subsection id="H07E1FFEE49DF454193D535C2D0AD712A"><enum>(b)</enum><header>Table of
contents amendment</header><text display-inline="yes-display-inline">The table
of contents for the Energy Policy Act of 2005 is amended by inserting after the
item relating to section 1705 the following new item:</text>

National Materials and Minerals Policy, Research and Development Act of 1980
(<external-xref legal-doc="usc" parsable-cite="usc/30/1604">30 U.S.C. 1604</external-xref>) is amended—</text>

</paragraph></subsection><subsection id="HAD277D7237DD4DF7A1AE3C4A8736CA46"><enum>(b)</enum><header>Policy</header><text>Section
3 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/30/1602">30 U.S.C. 1602</external-xref>) is amended—</text>
<paragraph id="H7E7DA13FFC8B4F72B819C7DFBD3AA638"><enum>(1)</enum><text>by striking
<quote>The Congress declares that it</quote> and inserting <quote>It</quote>;
and</text>
</paragraph><paragraph id="H558E5070E94C4D0AAE4249AFCE889BC5"><enum>(2)</enum><text>by striking
<quote>The Congress further declares that implementation</quote> and inserting
<quote>Implementation</quote>.</text>
</paragraph></subsection><subsection id="H18AE06170DB24152B7FB2C35C8CF5839"><enum>(c)</enum><header>Implementation</header><text>Section
4 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/30/1603">30 U.S.C. 1603</external-xref>) is amended—</text>
<paragraph id="H33912DAF707744CF91D931E97C8AC64F"><enum>(1)</enum><text>by striking
<quote>For the purpose</quote> and all that follows through <quote>declares
that the</quote> and inserting <quote>The</quote>; and</text>
</paragraph><paragraph id="H8790BE235AFE437699B5BEC06D315BC0"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>departments and
agencies,</quote> and inserting <quote>departments and agencies to implement
the policies set forth in section 3</quote>.</text>
</paragraph></subsection></section><section id="H7874E0868DFA475382647CEDBFEA2BC0"><enum>202.</enum><header>Repeal</header><text display-inline="no-display-inline">Title II of <external-xref legal-doc="public-law" parsable-cite="pl/98/373">Public Law 98–373</external-xref> (30 U.S.C.
1801; 98 Stat. 1248), also known as the National Critical Materials Act of
1984, is repealed.</text>
